This Second Amendment to Commercl Improvement Grant Agreement (this "Second
Amendment") is made and entered into this )i day of 1 , 2026 by and between
THE COMMUNITY REDEVELOPMENT AGENCY F THE CITY OF CLEARWATER,
FLORIDA, a public body corporate and politic of the State of Florida created pursuant to Part III,
Chapter 163, Florida Statutes (the "Agency"), and BIG JIM'S & FAMILY BARBEQUE LLC, a
Florida limited liability company (the "Applicant") (collectively, the Agency and the Applicant are
the "Parties").
WITNESSETH:
WHEREAS, the Parties entered into that certain Commercial Improvement Grant
Agreement dated December 20, 2024 for exterior and interior improvements (the "Original
Agreement"); and
WHEREAS, the Parties entered into that certain First Amendment to Commercial
Improvement Grant Agreement dated January 28, 2026 (the "First Amendment" and collectively
with the Original Agreement, the "Agreement") in order to extend the project deadline due to
additional work required to complete the exterior improvements; and
WHEREAS, it has become apparent that the Applicant requires an additional $25,000.00
to complete the Project (as defined in the Agreement) due to unanticipated additional costs
associated with the roofing work.
NOW THEREFORE, in consideration of the mutual covenants and agreements contained
herein, and for other good and valuable consideration, the sufficiency and receipt whereof being
hereby acknowledged, the Parties agree as follows:
1. Recitals. The recitals set forth above are true and correct and are incorporated herein and made
a part of this Second Amendment.
2. Amended Grant Amount. The Agreement and its exhibits are hereby amended to reflect
Twenty -Five Thousand Dollars and 00/100 Cents ($25,000.00) of additional grant funds for a
new total grant amount of One Hundred Thousand Dollars and 00/100 Cents ($100,000.00).
3. In the event of conflict or ambiguity between the terms and provisions of this Second
Amendment and the Agreement, the term and provisions of this Second Amendment shall
control to the extent of any such conflict or ambiguity.
4. All sections of the Agreement not expressly amended herein shall remain in full force and
effect.
IN WITNESS WHEREOF, the Parties have executed this Second Amendment on the
date and year first written above.
