FIRST AMENDMENT TO COMMUNITY DEVELOPMENT BLOCK GRANT - CORONAVIRUS (CDBG-CV) PROGRAM AGREEMENTFIRST AMENDMENT TO COMMUNITY DEVELOPMENT BLOCK GRANT — CORONAVIRUS (CDBG-CV) PROGRAM AGREEMENT BETWEEN THE CITY OF CLEARWATER, FLORIDA AND SOCIETY OF ST. VINCENT DE PAUL OF UPPER PINELLAS COUNTY, INC. THIS FIRST AMENDMENT TO CDBG-CV PROGRAM AGREEMENT ("this First Amendment") is made and entered into by and between the City of Clearwater, Florida, a Florida municipal corporation, with a principal address of P.O. Box 4748, Clearwater, Florida 33758 (the "City") and Society of St. Vincent de Paul of Upper Pinellas County, Inc., a Florida not-for- profit corporation, with a principal address of 1345 Park Street, Clearwater, FL 33756 ("SVdP" or "Subrecipient") (the City and Subrecipient shall be referred to collectively as the "Parties"). WITNESSETH: WHEREAS, the Community Development Block Grant Program ("CDBG-CV") is administered by the United States Department of Housing and Urban Development ("HUD"); and WHEREAS, the City is an entitlement community that receives CDBG-CV funds awarded under the Housing and Community Development Act of 1974, in furtherance of its goal of promoting community development and improvement of public facilities, as further detailed in the Consolidated Plan for Housing and Community Development Programs 2020/2021-2024/2025; and WHEREAS, in response to the Coronavirus Pandemic (COVID-19) funds awarded under the Housing and Urban Development (HUD) has notified the City of Clearwater that it received a cumulative allocation of $1,351,560.00 of Community Development Block Grant Program — Coronavirus Response funds (CDBG-CV) to be used to prevent, prepare for, and respond to COVID-19; and; and WHEREAS, the City's allocation of CDBG-CV funds was authorized by the Coronavirus Aid, Relief, and Economic Security Act (the "CARES Act") to respond to the growing effects of the historic public health crises; and WHEREAS, the City has identified that there is a community need for providing non - congregate shelter for the homeless to help prevent the spread of the Coronavirus infection; and WHEREAS, the City desires to provide funding to the Subrecipient to help prevent the spread of the Coronavirus infection by providing emergency non -congregate shelter to homeless individuals and families who are living in public places not fit for human habitation; and WHEREAS, SVdP is a private not-for-profit corporation that provides homeless services; and WHEREAS, these services are an eligible activity under the CDBG-CV program in accordance with 24 CFR §570.201(e). It is a limited clientele activity and meets a national objective as required under 24 CFR §570.200(a)(2) and 24 CFR §570.208(a)(2); and FY 2025-26 CDBG-CV SVdP (Emergency Non -Congregate Shelter for Homeless Families) PS 16261 Page 1 of 4 WHEREAS, the Project meets the criteria of an eligible CDBG-CV activity by addressing the need for emergency non -congregate shelter for homeless individuals and families to help prevent the spread of the Coronavirus infection. This problem was further exacerbated by the closure in Clearwater of a homeless facility dedicated to families. This is during a time when we see family homelessness rise. Providing emergency non -congregate shelter for these individuals and families helps so they are off the street and no longer living in their cars or other unhealthy places. The Community Development Block Grant Program Cares Act (CDBG-CV) Grantee Best Practices Report by the Department of Housing and Urban Development Office of Community Planning and Development addresses the issue stating, "HUD has identified the sheltering of homeless persons in motel and hotel rooms as a best practice to enhance social distancing, reduce coronavirus transmission rates, and provide adequate quarantine facilities for the homeless with coronavirus; and WHEREAS, SVdP has available the necessary qualified personnel, facilities, materials, and supplies to perform such services and/or carry out such programs for these residents, who are eligible and qualified to receive said services and are within the income limits for low- and moderate -income persons as defined by HUD and adjusted annually, and which current income levels are attached as Exhibit "A" to the Agreement and incorporated herein by reference. WHEREAS, the Parties now wish to amend the Agreement to extend the term to September 30, 2026 and allocate an additional subaward to Subrecipient in the amount of $50,000.00 in FY 2024-2025 CDBG-CV funds toward the project. NOW THEREFORE, in consideration of the mutual covenants and agreements contained herein, and for other good and valuable consideration, the sufficiency and receipt whereof being hereby acknowledged, the City and SVdP agree as follows: 1. Recitals. The recitals set forth above are true and correct and are incorporated herein and made a part of this First Amendment. 2. Amendment. The Agreement is hereby amended to extend the term to September 30, 2026 and to allocate an additional subaward in the amount of FIFTY THOUSAND AND DOLLARS AND 00/100 CENTS ($50,000.00). 3. In the event of conflict or ambiguity between the terms and provisions of this First Amendment and the Agreement, the terms and provisions of this First Amendment shall control to the extent of any such conflict or ambiguity. 4. All sections of the Agreement not expressly amended herein shall remain in full force and effect.
