D., 1985, by and between PRECISION MANUFACTURING & SALES COMPANY, INC. and NORMAND BRUNET, hereinafter collectively referred to as "BRUNET", and JIM DAVID and DAVID INDUSTRIES, INC., hereinafter collectively referred to as "DAVID". WHEREAS, BRUNET owns the property located at 2140 Range Road, Clearwater, Florida, and desires to expand an existing one story building on the property; and, WHEREAS, DAVID owns the adjoining property located at 2120 Range Road, Clearwater, Florida, and has had installed a fire hydrant in a 10 foot utility easement existing on the East side of its property; and, WHERE~S, BRUNET desires to make use of said fire hydrant in ,~' obtaining approval of its site plan for the proposed building addition. NOW THEREFORE, based upon the above premises, the parties agree as follows: 1. Upon the execution of this Agreement, BRUNET shall pay to DAVID the sum of THREE THOUSAND FIVE HUNDRED ($3,500.00) DOLLARS. 2. DAVID agrees not to remove or move the fire hydrant existing between the two properties as long as DAVID owns the property. DAVID further agrees not to construct any obstacles, such as a fence, in and around the fire hydrant area so that a fire truck would be able to utilize the fire plug. 3. If, during DAVID'S continued ownership of the adjoining real property lo.cated at 2120 Range Road, Clearwater, Florida, the City of Clearwater determlnes that said fire hydrant is not sufficient to serve BRUNET'S requirements and BRUNET is thus required to install a fire hydrant at some other location, then and in such event DAVID shall, upon request, refund the said THREE THOUSAND FIVE HUNDRED ($3,500.00) DOLLARS without interest -- ., and BRUNET shall be free to install another fire hydrant at some other appropriate location on BRUNET'S property as directed by the City.
