The applicant is requesting approval of a request to divide one previously platted lot into two lots in order to
allow a single family residence to be built on the westerly 190 foot x 137 foot, 26,030 square foot portion of the
lot. There is an existing single family home on the easterly 60 foot x 137 foot, 8,220 square foot portion. The
second residence is currently under construction but the certificate of occupancy will not be issued until the lot
division has been approved, according to Code. The lots are zoned RS-8 which requires a minimum 70 foot wide
5,000 square foot comer lot and a 50 foot wide 5,000 square foot interior lot. The new westerly parcel will meet
the corner lot requirements and the easterly parcel will meet the interior lot requirements.
The code permits a lot division to be approved administratively provided certain provisions are met (please refer
to attached copy of Section 133.030 for these provisions).
Also, according to Section 133.030, the City Manager may, at his discretion, require any division of previously
platted property to comply with the full platting process where the conditions of the instant case warrant.
The Development Review Committee has reviewed the request (refer to attached copies of memos), with
approvals from all departments except Public Works. The Public Works Department feels the parcel should be
required to comply with the full platting process due to necessary road improvements and other circumstances
which indicate further division of the parcel. (note: The City's Land Development Code requires compliance with
it's Subdivision Regulations when a portion(s) of a property is sold). This applicant previously applied for
approval of a four lot subdivision for this property which was granted authorization on January 21, 1988 by the
City Commission but did not proceed any further with that plat.
I am therefore recommending that you disapprove this request for administrative lot division and require that
this land division comply with the full platting process.

d, Such action will not result in significant increases in service requirements or
interfere with maintaining existing service levels.
e., All easement requirements have been or will be satisfied.
f. Such split will not result in a tract or lot without direct access to a street.
g, A nonconforming situation will not be created.
In granting approval, the city manager may impose such conditions and restrictions upon the
property as determined necessary to carry out the intent and purpose of this chapter and the
development code. The city manager may, at his discretion, require any division or combina.
tion of previously platted property to comply with the full platting process where the condi-
