I am writing to confirm our telephone conversation regarding the applicable development
regulations for the proposed Bay Area Specialties building located on Range Road. The proposed building
is a warehouse and office building for Bay Area and has been designed to meet the requirements of the old
Land Development Code, The project was reviewed on several occasions by the City Development
Review Committee pursuant to the old Land Development Code documenting that the business owner has
expended financial and other resources in reliance on the old Code,
Therefore, the City of Clearwater will accept the building and site for building permits pursuant to
the old Land Development Code as shown on the site plan dated 2/12/99 as prepared by Barger Builders,

I need your help in trying to accommodate Mr. Barger, P.E. in the development of a 14,500 SF
wholesale/distribution facility proposed to be developed in the Clearwater's Industrial Park with the IRT Zoning
District. The property is vacant and is within the City's tax jurisdiction.
I have been working with the owner/engineer/and architect of this property for approximately one year; the site
plan has been before BPRC and DRC on several occasions; modifications were made to comply with staff
requests.
The site plan is designed with the numerical and dimensional requirements of the old code. The owner has
financing in place and is ready to move forward, however, the new Code has made the proposed development
unpermittable due to changes to the New Code's dimensional and numerical requirements and the lack of a IRT
Infill Zoning Provision. There is no other provisions in the Code to be flexible with this project. Can you please
look into this issue and keep the City's tax base in mind while making your determination. Thanks.
The engineer's assistant visited the PDS earlier this week to meet with Antonia and to ensure the proposed site
plan met all the code requirements before final submission. Apparently the developer designed the facility Code
has completesubmit the plans and talk to a planner this week to submit
