Dear Mr. Shaw:
This letter constitutes a Development Order pursuant to Section 4-202 E of the
Community Development Code, On September 13, 2001, the Development Review
Committee (DRC) reviewed your application for Flexible Standard Development to
permit a 450 square foot addition to an existing 2,742 square foot restaurant within the,
Downtown District. The 450 square foot addition will provide restrooms in compliance
with the Americans with Disabilities Act. The DRC unanimously recommended approval
of the application with the following bases and conditions:
Bases for approval:
1. The proposal complies with the Flexible Standard Development criteria per Section 2-
203.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913,
3. The development is compatible with the surrounding area and will enhance other
redevelopment efforts.
Conditions of approval:
1, That all existing and proposed signage meet the requirements of Code, to be verified
by an inspection by Staff prior to the issuance of a Certificate of Occupancy;
2, That a revised landscape plan be submitted to and approved by Staff, prior to the
issuance of any permits, which shows the following:
. The accurate location of all existing trees; and
. Additional landscaping in the interior, parking lot landscape island.

I concur with the findings of the Development Review Committee and, through this
letter, approve your application for Flexible Standard Development with the three
conditions as stated above, The approval is based on and must adhere to the site plan
dated November 2,2001.
Pursuant to Section 4-303, an application for a building permit shall be made within one
year of Flexible Standard Development approval (December 14, 2002). All required
certificates of occupancy shall be obtained within one year of the date of issuance of the
building permit. Time frames do not change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any impact fees that may be required. In
order to facilitate the issuance of any permit or license affected by this approval, please
bring a copy of this letter with you when applying for any permits or licenses that require
this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard
Development) may be initiated by a property owner abutting the property which is the
subject of the approval within seven days of the date the development order is issued. A
copy of the Development Order is being sent to the surrounding property owners. The
filing of an application/notice of appeal shall stay the effect of the decision pending the
final determination of the case. The appeal period for your case will expire on December
21,2001.

HANDICAP SYMBOLS ARE TO BE THERMO PLACTIC. ALL OTHER
LINES AND MARKINGS ARE TO BE PAINTED.
(14) ALL PAVEMENT STRIPING IS TO COMPLY WITH BOTH THE MANUAL
ON UNIFORM TRAFFIC CONTROL DEVICES AND SECTION 710, PAINTING
TRAFFIC STRIPES, OF F.D.O.T. STANDARD SPECIFICATIONS FOR
ROAD AND BRIDGE CONSTRUCTION, LATEST EDITIONS.
(15) TREE BARRICADES MUST REMAIN INTACT THROUGHOUT
CONSTRUCTION. ENCROACHMENT INTO OR FAILURE TO MAINTAIN
TREE BARRICADES WILL RESULT IN ENFOREMENT ACTION WHICH
MAY INCLUDE CITATIONS AND / OR PERMIT REVOCATION.
(16) CONTRACTOR TO OBTAIN ALL PERMITS / EXEMPTION NOTICES /
UTILITY LICENSES PRIOR TO CONSTRUCTION.
(20) THE CONTRACTOR / SUBCONTRACTOR SHALL PLACE A 1" DEEP
CONTRACTION JOINT EVERY 4' FEET IN THE SIDEWALK.
(21) THE CONTRACTOR / SUBCONTRACTOR SHALL LOCATE, FORM, AND
SLOPE THE SIDEWALKS IN ACCORDANCE WITH THE SITE GRADING
PLAN. MINIMUM SLOPE SHALL BE 1.0% AND MAXIMUM SIDEWALK
SLOPE SHALL NOT BE MORE THAN 3.0%.
(22) THE CONTRACTOR / SUBCONTRACTOR SHALL CONSTRUCT
PAVEMENT IN ACCORDANCE WITH THE TYPICAL PAVEMENT SECTION
DETAILS. THE FINISH PAVEMENT GRADES SHALL CONFORM TO
THOSE SPECIFIED ON THE SITE GRADING PLAN.
(26) REPAIR AND REPLACEMENT OF ALL PRIVATE AND PUBLIC PROPERTY
AFFECTED BY THIS WORK SHALL BE RESTORED TO A CONDITION
EQUAL TO OR BETTER THAN EXISTING CONDITIONS. ADDITIONAL COSTS
ARE INCIDENTAL TO OTHER CONSTRUCTION AND NO EXTRA
COMPENSATION IS TO BE ALLOWED.

PROPOSED WORK, THE CONTRACTOR / SUBCONTRACTOR SHALL
REPAIR THE UTILITIES AT NO ADDITIONAL EXPENSE TO THE OWNER.
(29) THE LOCATION OF ALL EXISTING UTILITIES SHOWN ON THE PLANS
HAVE BEEN DETERMINED FROM THE BEST INFORMATION AVAILABLE
AND ARE GIVEN FOR THE CONVENIENCE OF THE CONTRACTOR /
SUBCONTRACTOR. THE ENGINEER ASSUMES NO RESPONSIBILITY FOR
ACCURACY. PRIOR TO THE START OF ANY CONSTRUCTION ACTIVITY,
IT SHALL BE THE CONTRACTOR'S / SUBCONTRACTOR'S
RESPONSIBILITY TO NOTIFY THE VARIOUS UTILITIES AND TO MAKE
THE NECESSARY ARRANGEMENTS FOR ANY RELOCA~ONS OF THESE
UTILITIES WITH THE OWNER OF THE UTILITY. THE CONTRACTOR /
SUBCONTRACTOR SHALL EXERCISE CAUTION WHEN CROSSING AN
UNDERGROU~JD UTILITY, WHETHER SHOWN ON THE PLANS OR LOCATED
