(#5) Sally Demarest Board Reporter, City Clerk Department The meeting was called to order by Chairman Shuford at 9:00 a.m. in the Central Permitting Conference Room. In order to provide continuity, the items will be listed in agenda order although not necessarily discussed in that order. ITEM 1 - The minutes of the March 2, 1995 meeting were approved as submitted. ITEM 2 - Racetrac - (PSP 95-06); located at Gulf-to-Bay and David Avenue. The applicant proposes to construct a 2,989 sq. ft. gas station and convenience store with 12 fuel pumps and appurtenant fixtures. The gas station site consists of 1.03 acres subdivided from a larger parcel of 5.9 acres. Applicant has submitted the requested hydrological analyses of the 10-year rated storm sewer, 25-year one hour detention pond and the off-site area. The applicant or applicant's representative presented the site plan/plat and staff presented their comments in writing. Staff specifically indicated the conditions below, and in the ensuing discussion Mr. Shuford said the City greatly appreciates the efforts of the applicants to save trees and the applicant acknowledged they tried to save every tree they could. The applicant said he had talked with storm water management engineers and was told the present setup will not impact any future City development so the plan did not indicate any changes in this regard. The applicant expressed concern for safety hazards and preferred to use the trench drain as designed. He noted the zoning data sheet which had been added to the planand said application was made for a DOT permit on March 2, 1995, but the permit has not yet been received. The City Engineer has suggested an asphalt hump to go with the trench drain to ensure the drain does not clog (see item 13.) Copies of a memo dated February 13, 1995 from Rich Baier, City Engineer, to Mr. Bob Maran stating City policy re the Use of Slotted Drain or Channel Pipe Along Driveways were distributed (see attached). Application for conditional use permit for alcoholic beverage sales (beer and wine) will be agendaed for the March 28, 1995 Planning and Zoning Board meeting and P&Z approval with conditions will be noted on the site plan (see item 5.). The plan shows driveway flares on Gulf-to-Bay; the City Engineer would prefer minimum 25 ft. radials leading out onto Gulf-to-Bay for better traffic flow. Mr. Baier offered to contact FDOT; without FDOT approval of the radial design, the applicant may use his original plan. Mr. Hilton requested a letter from FDOT indicating acceptance of the driveway prior to certification. Mr. Mahan requested 12 copies of a one-page site plan showing changes and conditions. Listed below are suggested conditions for approval: 1. Signs and fencing/walls are subject to separate review and permitting processes. 2. The requisite building permits must be procured within one (1) year from the date of certification of the final site plan and all requisites certificates of occupancy must be obtained within three (3) years of the date of certification of the site plan. 3. The related final plat shall be recorded within one (1) year from the certification date of the final site plan and prior to issuance of a certificate of occupancy, whichever comes first. 4. The dates and conditions for approval by the Planning and Zoning Board for conditional use approval and the Development Code Adjustment Board for variance approval shall be provided on the preliminary plat/site plan prior to certification. 5. Final plat shall indicate date of Planning & Zoning Board approval of alcoholic beverage use, package sales of beer and wine, and conditions. 6. Applicant will obtain a letter from FDOT indicating approval of the driveway design. 7. Prior to the issuance of a certificate of occupancy, the dumpster/compactor must be visually screened, and gates must be provided with a minimum 12-foot clear opening to the front for access by Sanitation trucks. 8. The plan will indicate stop sign and stop bar at the entrance on Gulf-to-Bay. 9. Prior to the issuance of a building permit, a copy of the approved SWFWMD permit is to be provided to Engineering Site Plan Review. 10. A Reduced Pressure Backflow prevention devices must be installed by the City with applicable fees being paid by the owner. 11. Slotted trench drain at entrance drive must meet City Engineer's requirement of a high point on street side of trench drain (see copy of February 13, 1995 memo from Rich Baier, City Engineer, attached). 12. Prior to issuance of a building permit, a copy of the approved SWFWMD permit shall be submitted to Environmental Management. 13. Prior to issuance of a building permit, the grading plan shall show finished grades south of the proposed trench drain sufficient to hold 1/2" of runoff from .08 acres on site. 14. The applicant shall contact Parks & Recreation for the required 2% recreation/open space assessment fee, which shall be paid prior to certification. Mr. Mahan made a motion to approve the preliminary site plan with the above DRC suggested conditions, incorporating into the motion the comments made by staff. The motion was duly seconded and carried unanimously. ITEM 3 - Pace Tech - (PSP 95-01); located at 510 N. Garden Avenue. The applicant proposes to construct a 7,370 sq. ft. building expansion with associated parking, stormwater and landscaping. Stormwater drainage calculations and landscape plans have ben submitted for review. The applicant or applicant's representative presented the site plan/plat and staff presented their comments in writing. Staff specifically indicated the conditions below, and in the ensuing discussion it was noted that the project had been "on hold" until the applicant could resolve the parking lot, landscaping and sidewalks issues. Mr. Perkins referenced memo dated February 13, 1995 from Rich Baier, City Engineer, to Mr. Bob Maran stating City requirement re the Use of Slotted Drain or Channel Pipe Along Driveways and the applicant agreed to install an asphalt hump to drain to the pond. Mr. Hilton asked if water would be held from the new parking lot; the applicant replied the water would be detained on site and throttled to have a positive outfall to the Pinellas Trail. Mr. Shuford noted that the retention ponds have been designed to be somewhat larger than usual to compensate for the longer retention period. The City Engineer stipulated an ADA ramp at the corner of Maple and Garden Avenues. The applicant will apply to the Planning & Zoning Board relative to the conditional use for non-commercial parking in the new residential zone parking lot. The applicant said they will continue to work closely with their architect and City staff on their Master Plan. It was noted that the applicant intends to access City gas service. The proposed project is scheduled for receipt and referral before the City Commission on April 20, 1995. Listed below are conditions suggested for DRC approval: 1. The dates and conditions for approval of the non-commercial parking lot in a residential zone by the Planning and Zoning Board for conditional use approval and the Development Code Adjustment Board for variance approval shall be provided on the preliminary plat/site plan prior to certification. 3. Prior to the issuance of a building permit, a copy of the approved SWFWMD permit is to be provided to Engineering Site Plan Review. 5. The slotted trench drain must meet the requirements of the City Engineer (see copy of memo from Rich Baier, City Engineer, dated February 27, 1995, attached). 7. The detention ponds re to be designed for a 50 year storm per City of Clearwater Design Standards Manual. The existing storm system on Garden Avenue is very old and substandard by present City design standards. 8. Prior to certification, a copy of the SWFWMD permit application and calculations shall be provided to Environmental Management. 9. The applicant shall contact Parks & Recreation for the required 2% recreation/open space assessment fee, which shall be paid prior to certification. Mr. Mahan made a motion to approve the preliminary site plan with the above DRC suggested conditions, incorporating into the motion the comments made by staff. The motion was duly seconded and carried unanimously. ITEM 4 - Trade Center - (PSP 95-07); located at Cleveland and Garden Streets. The applicant proposes to construct a 547,000 sq. ft., 390 ft. tall multi-story mixed use office and apartment building to include an automated parking facility, gym, pool, and related facilities. The project will require the vacation of an adjoining alley. It was indicated by Mr. Mahan that agenda item 4 had been postponed indefinitely. ITEM 5 - Park Place Outparcel Plat - (SUB 95-01); located Gulf-to-Bay at Park Place Blvd. The applicant proposes to create five parcels of the Park Place development for the construction of three restaurants, a retail building and a stormwater retention pond. Platting the parcels will allow, among other benefits, the proper signage to be put in place for each of the parcels as appropriate. The final site plan for construction on the five parcels was approved by the City Commission on September 1, 1994. The applicant or applicant's representative presented the site plan/plat and staff presented their comments in writing. Staff specifically indicated the conditions below, and in the ensuing discussion Mr. Mahan stressed that cross access agreements and Unity of Title are required to be "in hand" before final approval; the applicant replied that the attorneys have been notified. The Unity of Title is required because of the lack of individual retentionand joint access requirements to utilities, and will be noted on the plat. It was suggested that the applicant show the drive or drive cuts off Park Place Boulevard. Listed below are conditions suggested for DRC approval: 1. A Unity of Title shall be recorded prior to certification of the site plan. 2. A detailed cross access agreement referring to A, B, C, D and E cross access, parking and all other common uses shall be shown on the plan. 3. The plat is to have wording addressing the Ingress/Egress and 10 foot Utility Easement over the proposed water mains up to and including meters, backflow prevention devices and hydrants. The water lines are not to be placed in easements showing bearings and distance as presently drawn on the plat. 4. The sanitary sewer systems and storm systems are private and there should be wording on the plat addressing cross access between owners. A cross access agreement is also to be addressed on the plat. 5. The City of Clearwater is requesting a 10 foot utility easement adjacent to the Gulf-to-Bay right of way for parcels A, B, C, D and E. 6. Add wording to the plat under PARK PLACE BOULEVARD that states previously dedicated. Mr. Mahan made a motion to approve the preliminary site plan with the above DRC suggested conditions, incorporating into the motion the comments made by staff. The motion was duly seconded and carried unanimously. There being no further business, by motion duly seconded, the Development Review Committee meeting adjourned at 10:30 a.m.
