On November 8, 2001, the Development Review Committee (DRC) reviewed your application for Flexible Standard Development to construct an utilities/infrastructure facility within the Downtown District. The proposal includes a 21,630 square foot energy plant in association with the Church of Scientology Training Center cUlTently under construction. The DRC unanimously recommended approval of the application with the following bases and conditions: Bases for approval: 1. The proposal complies with the Flexible Standard Development criteria per Section 2-902. 2. The proposal is in compliance with other standards in the Code including the General Applicability Criteria per Section 3-913. 3. The development is compatible with the sUlTounding area and will enhance other redevelopment efforts. Conditions of Approvals: 1. That no public seating be constructed within the right-of-way along East Avenue; 2. That the placement of any vertical obstruction of any kind must be a minimum two feet from any rights-of-way; 3. That an approved right-of-way permit be obtained for all landscaping within the any rights-of-way, prior to the issuance of any permit; 4. That the floor slab associated with any and all equipment with moving parts be completely isolated from the slab of the sUlTounding building to mitigate vibration; and 6. That all construction follow the acoustic and vibration analyses presented by Engineering Professionals, Inc. and Veneklasen Associates (with April 16, 2002 cover letter from Church of Scientology Religious Trust) in letters dated January 18, 2002 and April 15, 2002, respectively (included herein). I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development. The approval is based on and must adhere to the site plans dated March 26, 2002 and the acoustical analyses dated January 18, 2002 and March 28, 2002. Pursuant to Section 4-303, an application for a building permit shall be made within one year of Flexible Standard Development approval (April 17, 2003). All required certificates of occupancy shall be obtained within one year of the date of issuance of the building permit. Time frames do not change with successive owners. Please be aware that the issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by this approval, please bring a copy of this letter with you when applying for any permits or licenses that require this prior development approval. In addition, please be aware that an appeal of a Level One approval (Flexible Standard Development) may be initiated by a property owner abutting the property that is the subject of the approval within seven days of the date the development order is issued. A copy of the Development Order is being sent to the property owner and sUlTounding property owners. The filing of an application/notice of appeal shall stay the effect of the decision pending the final determination of the case. The appeal period for your case will expire on April 24, 2002. The external equipment required to reject t!eat or move air will be enclosed in a well arsa on the foof. This will help keep sound from gatting down to street level. The enclosure keeps all mechanical equipment from being seen from street lavel. 3, The equipment being installed will be the quietest avaitable on the market. This report documents our findings and recommendations. I. Criteria The City of Clearwater Noise Ordinance prohibits "loud and raucous noise" which endangers the comfort and peace of "reasonable persons of ordinary sensibilities." The Ordinance does not quantify its criteria. V A understands that in your interaction with the City a 5S dBA criteria has been deemed appropriate for this use. Depending on the background noise level, the equipment will be audible at times, but complaints should be minimized. V A understands that visitors may be in the main room, and that a reasonable noise level is desired to accommodate them. VA recommends a maximum interior noise level of 75 dBA. ll. Exterior Noise Impact The above referenced criterion will be met at potentially impacted properties with the following provisions: A. Exterior Construction I, The wall construction should remain concrete with a furred gypsum board wall on the inside) as shown on the drawings_ 2. The exterior windows should be 1I4-inch or thicker laminated glass with a minimum sound rating of STC-33 3. The "roll dov.'n" doors on the sides should be Milcor Telescoping Doors, with a rating of STC 29. Note that the criteria cannot be mel with a standard roll-down door. A ClIt sheet is anached. As an alternative to the Milcor door. a pair of standard roll-down doors in a vestibule arrangement may be used, with at least 12 inches between the twO doors. I , \ B. Engine Room Construction 1. The walls of the engine room should be constructed of high-absorption "acoustic" concrete blocks, as shown on the drawings. The "back" side of the wall (the side facing out into the main room)should be sealed. 2. The door to the engine room should be a sound-rated steel door with a minimum rating ofSTC 42. VA would recommend contacting Krieger Steel (562-695-0645) or Security Metal Products (323-772-1171) J. The windowro the engine room should be a single laminate panel, or a dual-glazed assembly" with at least one laminated panel, with a minimum rating of STC 35. C. Engine Room Ventilation . I. A "critical class" muffler sl1ol)ld be installed on the generator exhausts. The muffler should be equivalent to a Nelson 400 level exhaust silencer (cut sheet attached). 2. A 7-foot sound trap equivalent to lAC model 7Ms should be installed on both the intake and ewustduclS. The fiberglass fill in the traps should be bagged with a I-mil Mylar membrane (lAC will require the sound traps to be ordered this way). On the exhaust side, the sound trap l>hould be installed after the fan (EF-2). The sound traps should be installed completely outside the engine room. D. Acoustical Treatment I. VA understands that the cejlingt>eams and the underside of the deck will be coated with a spray- on cellulose product. The entire ceiling should be covered with a minimum thickness of I-inch of K-lJ or similar product with a minimum NRC of 0.7$. 2. V A recommends that the same product (or an applied foam) be sprayed on (or hung from) at least half of the wall area. In particular, treating the walls near the noisier pieces of equipment will provide additional benefit. III. Interior Noise Impact A. The level within the main room, with the acoustical treatment as described in item 11.0. above, will be approximately 80 dBA. This is somewhat above the criteria, and conversation will be difficult. Note that this is the maximum overall level assuming that all the equipment is running simultaneously. The level may be higher in the immediate vicinity of a noisy piece of equipment. B. Although the engines are the noisiest pieces of equipment and are confined to the engine room, some significantly noisy equipment remains. The chillers and pumps CP-l. 2, 3, and SP-I, 2 are all quite noisy, with sound power levels near 90 dBA. The noise level in the space cannot be further reduced without enclosing, relocating, or re-specifying this equipment ........l.i!O "1/"1 We trust that the information provided meets the requirements of the project.
