Scientology Central Energy Plant)
Dear Mr. Roush:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On November 8, 2001, the Development Review Committee (DRC)
reviewed your application for Flexible Standard Development to construct an
utilities/infrastructure facility within the Downtown District. The proposal includes a 21,630
square foot energy plant in association with the Church of Scientology Training Center
cUlTently under construction. The DRC unanimously recommended approval of the
application with the following bases and conditions:
Bases for approval:
1. The proposal complies with the Flexible Standard Development criteria per Section 2-902.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the sUlTounding area and will enhance other
redevelopment efforts.
Conditions of Approvals:
1. That no public seating be constructed within the right-of-way along East Avenue;
2. That the placement of any vertical obstruction of any kind must be a minimum two feet
from any rights-of-way;
3. That an approved right-of-way permit be obtained for all landscaping within the any
rights-of-way, prior to the issuance of any permit;
4. That the external noise level generated from the site at the property line not exceed 55
dBA and an inspection demonstrating compliance with this limitation be performed, plioI'
to the issuance of a Certificate of Occupancy;

5. That the floor slab associated with any and all equipment with moving parts be completely
isolated from the slab of the sUlTounding building to mitigate vibration; and
6. That all construction follow the acoustic and vibration analyses presented by Engineering
Professionals, Inc. and Veneklasen Associates (with April 16, 2002 cover letter from
Church of Scientology Religious Trust) in letters dated January 18, 2002 and April 15,
2002, respectively (included herein).
I concur with the findings of the Development Review Committee and, through this letter,
approve your application for Flexible Standard Development. The approval is based on and
must adhere to the site plans dated March 26, 2002 and the acoustical analyses dated January
18, 2002 and March 28, 2002.
Pursuant to Section 4-303, an application for a building permit shall be made within one year
of Flexible Standard Development approval (April 17, 2003). All required certificates of
occupancy shall be obtained within one year of the date of issuance of the building permit.
Time frames do not change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any impact fees that may be required. In order
to facilitate the issuance of any permit or license affected by this approval, please bring a copy
of this letter with you when applying for any permits or licenses that require this prior
development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard
Development) may be initiated by a property owner abutting the property that is the subject of
the approval within seven days of the date the development order is issued. A copy of the
Development Order is being sent to the property owner and sUlTounding property owners.
The filing of an application/notice of appeal shall stay the effect of the decision pending the
final determination of the case. The appeal period for your case will expire on April 24, 2002.

We understand there are some conoerns expressed by the neighbors to the Central
Ener9Y Plant sound and appearance, we wish to address them in this lettar.

1. All of the noisiest engine driven equipment will be enclosed in a block room in
the center of the b~lding. There are no wall louvers, which would allow
sound to escape. The "floor slab of this room win be completely isolated from
the slab of the surrQunding, building to stop vibration. All equipment with
moving parts will have vibration isolation.
2. The external equipment required to reject t!eat or move air will be enclosed in a
well arsa on the foof. This will help keep sound from gatting down to street
level. The enclosure keeps all mechanical equipment from being seen from
street lavel.
3, The equipment being installed will be the quietest avaitable on the market.
The engIne silencer'S are "crltlca''''grade, The cooling towers will have neWly
developed quiet fans, aound aUanuators and variable speed drives to reduce
fan speeds when possible.
4. The exterior. walls of the building will be' primarily sound deadening concrete
with e){terior insuletion. The windows will be insulated and opaque,

Veneklasen Associates has completed our acoustical review of the proposed central plant for the Flag
renovation. This report documents our findings and recommendations.
I. Criteria
The City of Clearwater Noise Ordinance prohibits "loud and raucous noise" which endangers the
comfort and peace of "reasonable persons of ordinary sensibilities." The Ordinance does not quantify its
criteria.
V A understands that in your interaction with the City a 5S dBA criteria has been deemed appropriate for
this use. Depending on the background noise level, the equipment will be audible at times, but
complaints should be minimized.
V A understands that visitors may be in the main room, and that a reasonable noise level is desired to
accommodate them. VA recommends a maximum interior noise level of 75 dBA.
ll. Exterior Noise Impact
The above referenced criterion will be met at potentially impacted properties with the following
provisions:
A. Exterior Construction
I, The wall construction should remain concrete with a furred gypsum board wall on the inside) as
shown on the drawings_
2. The exterior windows should be 1I4-inch or thicker laminated glass with a minimum sound rating
of STC-33
3. The "roll dov.'n" doors on the sides should be Milcor Telescoping Doors, with a rating of STC 29.
Note that the criteria cannot be mel with a standard roll-down door. A ClIt sheet is anached.
As an alternative to the Milcor door. a pair of standard roll-down doors in a vestibule
arrangement may be used, with at least 12 inches between the twO doors.

B. Engine Room Construction
1. The walls of the engine room should be constructed of high-absorption "acoustic" concrete
blocks, as shown on the drawings. The "back" side of the wall (the side facing out into the main
room)should be sealed.
2. The door to the engine room should be a sound-rated steel door with a minimum rating ofSTC
42. VA would recommend contacting Krieger Steel (562-695-0645) or Security Metal Products
(323-772-1171)
J. The windowro the engine room should be a single laminate panel, or a dual-glazed assembly"
with at least one laminated panel, with a minimum rating of STC 35.
C. Engine Room Ventilation
. I. A "critical class" muffler sl1ol)ld be installed on the generator exhausts. The muffler should be
equivalent to a Nelson 400 level exhaust silencer (cut sheet attached).
2. A 7-foot sound trap equivalent to lAC model 7Ms should be installed on both the intake and
ewustduclS. The fiberglass fill in the traps should be bagged with a I-mil Mylar membrane
(lAC will require the sound traps to be ordered this way). On the exhaust side, the sound trap
l>hould be installed after the fan (EF-2). The sound traps should be installed completely outside
the engine room.
D. Acoustical Treatment
I. VA understands that the cejlingt>eams and the underside of the deck will be coated with a spray-
on cellulose product. The entire ceiling should be covered with a minimum thickness of I-inch of
K-lJ or similar product with a minimum NRC of 0.7$.
2. V A recommends that the same product (or an applied foam) be sprayed on (or hung from) at least
half of the wall area. In particular, treating the walls near the noisier pieces of equipment will
provide additional benefit.
III. Interior Noise Impact
A. The level within the main room, with the acoustical treatment as described in item 11.0. above, will
be approximately 80 dBA. This is somewhat above the criteria, and conversation will be difficult.
Note that this is the maximum overall level assuming that all the equipment is running
simultaneously. The level may be higher in the immediate vicinity of a noisy piece of equipment.
B. Although the engines are the noisiest pieces of equipment and are confined to the engine room,
some significantly noisy equipment remains. The chillers and pumps CP-l. 2, 3, and SP-I, 2 are all
quite noisy, with sound power levels near 90 dBA. The noise level in the space cannot be further
reduced without enclosing, relocating, or re-specifying this equipment

22. SITE CLEARING/STRIPPING: THE INITIAL SITE PREPARATION SHALL CONSIST

THE SURFACE TOPSOIL TO STOCKPILES FOR REUSE. EXISTING ASPHALT PAVEMENT

23. AFTER STRIPpiNG AND ROUGH GRADING THE SITE, THE EXPOSED
NEAR-SURFACE SOIL BENEATH THE CONSTRUCTION AREA, 12" MINIMUM,
SHALL BE COMPACTED TO DENSITIES EQUIVALENT TO 98% OF MODIFIED

SEDIMENT AND/OR PREVENT THE TRANSPORT OF SEDIMENT ONTO
ADJACENT PROPERTIES, OR INTO EXISTING WATER BODIES, MUST
BE INSTALLED, CONSTRUCTED OR, IN THE CASE OF VEGETATIVE
BUFFERS, PROTECTED FROM DISTURBANCE, AS A FIRST STEP IN
THE LAND ALTERATION PROCESS. SUCH SYSTEMS SHALL BE FULLY

27. CONTRACTOR TO COORDINATE THE POINTS OF CONNECTION OF THE
UTILITIES WITH DIFFERENT SUBS. SITE CONTRACTOR TO CONSTRUCT THE
UNDERGROUND INFRASTRUCTURES i.e. SANITARY SEWER, STORM SEWER,
WATER LINES, FIRE LINES, ETC. TO 5' OUTSIDE OF THE BLDG(S). THE
PLUMBING CONTRACTOR TO CONNECT AND MEET THE INVERT ELEVATIONS
OF THE SAID UTILITIES. ANY UTILITY WORK PERFORMED WITHIN 5' OF THE
BLDG. SHALL BE THE RESPONSIBILlll' OF THE PLUMBING CONTRACTOR.
ALL WORK SHALL COMPLY WITH ALL APPLICABLE FEDERAL, STATE, AND
LOCAL CODES, ORDINANCES AND REQUIREMENTS.
28. ALL SITE/CIVIL WORK SHALL BE PERFORMED AND FINISHED IN A WORKMANLIKE
MANNER TO COMPLETE SATISFACTION OF THE ENGINEER
IN ACCORDANCE WITH THE BEST RECOGNIZED TRADE PRACTICES.
29. DEVIATIONS FROM THESE PLANS AND SPECIFICATIONS WITHOUT CONSENT OF
THE ENGINEER MAY BE CAUSE FOR THE WORK TO BE UNACCEPTABLE.
DEVIATIONS SHALL RECEIVE WRITTEN APPROVAL FROM THE ENGINEER
BEFORE INSTALLATION.
2. PROTECTION OF EXISTING STORM SEWER SYSTEMS:
DURING CONSTRUCTION, ALL STORM SEWER INLETS IN THE
VICINI1l' OF THE PROJECT SHALL BE PROTECTED BY SEDIMENT
TRAPS SUCH AS SECURED HAY BALES, SOD, STONE, ETC., WHICH
SHALL BE MAINTAINED AND MODIFIED AS REQUIRED BY
CONSTRUCTION PROGRESS, AND WHICH MUST BE APPROVED BY THE
ENGINEER BEFORE INSTALlATION.
30. ALL NECESSARY PERMITS AND LICENSES SHALL BE OBTAINED AND PAID
BY THE CONTRACTOR.
31. SIGNS, BUFFER WALLS & FENCES ARE SUBJECT TO SEPARATE
SUBMITTAL(S) AND PERMITTING.
3. SEDIMENTATION BASIN: THE CONTRACTOR SHALL BE REQUIRED TO
PROHIBIT DISCHARGE OF SILT DURING CONSTRUCTION OF ANY RETENTION

7. SIDEWALKS ARE TO BE RECONSTRUCTED WITHIN THREE (3) DAYS AFTER
REMOVAL AND SAFE PEDESTRIAN TRAFFIC IS TO BE MAINTAINED AT
ALL TIMES. WHEN EXISTING SIDEWALK IS REMOVED, IT IS TO BE
REMOVED TO THE NEAREST EXPANSION JOINT.
8. PLACE EXPANSION JOINTS WHERE 4" AND 6" SIDEWALKS ABUT AT DRIVEWAYS.
9. SAW-CUT EXISTING EDGE OF PAVEMENT PRIOR TO REMOVAL OF CURB.

5. PROTECTION AND STABILIZATION OF SOIL STOCKPILES: FILL
MATERIAL STOCKPILES SHALL BE PROTECTED AT ALL TIMES BY
ON-SITE DRAINAGE CONTROLS WHICH PREVENT EROSION OF THE
STOCKPILED MATERIAL. CONTROL OF DUST FROM SUCH STOCKPILES
MAY BE REQUIRED, DEPENDING UPON THEIR LOCATION AND THE
EXPECTED LENGTH OF TIME THE STOCKPILES WILL BE PRESENT.
IN NO CASE SHALL AN UNSTABILiZED STOCKPILE REMAIN AFTER
TEN (10) CALENDAR DAYS.
6. MAINTENANCE: ALL EROSION AND SILTATION CONTROL DEVICES
SHALL BE CHECKED REGULARLY BY THE CONTRACTOR, ESPECIALLY
AFTER EACH RAINFALL AND SHALL BE CLEANED OUT AND/OR REPAIRED
AS REQUIRED.
LANDSCAPE NOTES
1. ALL LANDSCAPE MATERIAL SHALL BE FLORIDA GRADE # 1
OR BETTER, SELECTED FROM CITY OF CLEARWATER APPROVED
SPECIES LIST.
2. REQUIRED SHADE TREES SHALL BE A MINIMUM OF 12' HIGH, 4"
CALIPER AT THE TIME OF PLANTING. TO PROMOTE DIVERSllY,
AT LEAST 2 DIFFERENT SPECIES SHALL BE UTiliZED.
3. REQUIRED ACCENT TREES SHALL BE A MINIMUM OF 8' HIGH, 2"
CAliPER AT THE TIME OF PLANTING.
4. REQUIRED HEDGES IN THE PERIMETER BUFFER SHALL BE A

10. PROTECTIVE BARRIERS SHALL BE PLACED AROUND ALL PROTECTED TREES
PRIOR TO CONSTRUCTION ACTIVITIES AND SHALL REMAIN IN PLACE DURING
CONSTRUCTION. THEY SHALL BE NO LESS THAN REQUIREMENTS STATED IN
SECTION 3-1205E OF THE CLEARWATER COMMUNllY DEVELOPMENT CODE.
SURFACE WATER SYSTEM REQUIREMENTS
DRAINAGE NOTES
1. THE RETENTION AREA SHALL BE ROUGH GRADED PRIOR TO CON-
STRUCTION, WITH ALL STORM WATER DIRECTED TO IT. AFTER
COMPLETION OF ALL WORK, REMOVE DEBRIS AND SILTATION FROM
THE BOTTOM OF THE RETENTION BASIN, FINE GRADE THE FINAL
TWO (2) INCHES AND SOD. CONTRACTOR TO MAINTAIN THE SIDE
SLOPE REQUIRED AS SHOWN ON PLAN, AND NOTIFY ENGINEER FOR
AN INSPECTION PRIOR TO SODDING.
2. THE RETENTION AREA SHALL BE CONSTRUCTED EARLY IN THE
CONSTRUCTION PERIOD TO MITIGATE ANY ADVERSE WATER QUANTITY
IN PARTS OFF SITE.
3. AFTER COMPLETION OF THE PROJECT, THE OWNER WILL BE RESPON-
SIBLE FOR THE OPERATION AND MAINTENANCE OF THE STORMWATER
FACILITIES. ACTIONS INCLUDED SHALL BE REGULAR MOWING OF THE
BOTTOM AND SIDE SLOPES, PLUS PERIODIC INSPECTIONS AND RE-

1. THE FILTER SAND SHALL BE HARMON BROTHERS 20/55, OR APPROVED
EQUAL, APPROVED BY THE ENGINEER, AND MEET CURRENT
SWFWMD AND D.E.P. RULES. THE FILTER SAND MUST BE WASHED
(LESS THAN ONE PERCENT SILT, CLAY. AND ORGANIC MATTER)
AND HAVE AN EFFECTIVE GRAIN SIZE OF 0.20 TO 0.55 MILLIMETERS
IN DIAMETER; A UNIFORMITY COEFFICIENT OF 1.5 OR GREATER,
AND A PERMEABILllY RATE OF 0.046 CM/SEC (0.09 FT/MIN) OR GREATER.
IF THE PERMEABILl1l' RATE OF THE FILTER SAND IS LESS THAN 0.046
CM/SEC. A REPLACEMENT OF THE FILTER SYSTEM WILL BE RE-

1. NEW WATER MAINS
AFTER COMPLETION OF INSTALLATION OF NEW WATER MAINS. PRESSURE
TESTING SHALL BE PERFORMED IN ACCORDANCE WITH THE LOCAL
JURISDICTION WATER SYSTEM STANDARDS AND SPECIFICATIONS. SAMP-
LING OF NEW WATER MAINS SHALL CONFORM WITH COUNlY PUBLIC
HEALTH UNIT REQUIREMENTS AND RESULTS FORWARDED TO THE
ENGINEER. UNDER NO CIRCUMSTANCES SHALL A NEW WATER SYSTEM
BE PLACED INTO SERVICE UNTIL CERTIFICATION BY THE ENGINEER HAS
BEEN COMPLETED AND A RELEASE FROM COUNlY PUBLIC HEALTH UNIT

2. IRRIGATION NOTE:
IRRIGATION SYSTEMS SHALL UTILIZE LOW VOLUME DESIGN SUCH AS LOW
TRAJECTORY HEADS OR SOAKER HOSES TO PROVIDE DIRECT APPLICATION
AND LOW EVAPORATION AND MUST HAVE A RAIN SENSOR DEVICE OR
SWITCH WHICH WILL OVERRIDE THE IRRIGATION CYCLE OF THE SPRINKLER
SYSTEM WHEN ADEQUATE RAINFALL HAS OCCURRED. WATER SUPPLY SHALL
BE PIPE TO EACH INDIVIDUAL PLANTER ISlAND.
SHALLOW WELLS, OPEN SURFACE WATER BODIES, OR RECLAIMED WATER
SHALL BE USED (UNLESS UNAVAILABLE) AS A SOURCE OF IRRIGATION
WATER. 100 % COVERAGE MUST BE PROVIDED. AN IRRIGATION PLAN SHALL
BE SUBMITTED IN ORDER TO AVOID DELAYS AT THE TIME OF THE CER-
TIFICATE OF OCCUPANCY INSPECTION SHOULD A NON-ACCEPTABLE SYSTEM

3. TREE BARRICADES
REQUIRED TREE BARRICADES AND EROSION CONTROL MEASURES
MUST REMAIN INTACT THROUGHOUT CONSTRUCTION. ENCROACHMENT
INTO OR FAILURE TO MAINTAIN THESE BARRICADES WILL RESULT
IN ENFORCEMENT ACTION WHICH MAY INCLUDE CITATIONS AND/OR
PERMIT REVOCATIONS. AS PROVIDED BY THE CllY OF CLEARWATER
COMMUNITY DEVELOPMENT CODE.
4. TRENCH EXCAVATION
- INCLUDE OSHA STANDARD 29 CFR, SECTION 1926.650 SUBPART p.
WHICH IS NOW A PART OF LAWS OF FLORIDA CHAPTER 90-96.
- THE CONTRACTOR SHALL PROVIDE WRITTEN ASSURANCE OF
COMPLIANCE WITH THIS LAW.
- A SEPARATE COST ITEM IDENTIFYING THE COST OF COMPLIANCE.
- A TRENCH SAFETY SYSTEM SHALL BE DESIGNED BY THE CONTRACTOR,
AND APPROVED BY THE ENGINEER.
5. ALL RETENTION AREAS, STORM SEWER PIPING, STORM SEWER
STRUCTURES, ETC. MUST BE IN PLACE AS PART OF THE FIRST
PHASE OF CONSTRUCTION.
IT IS THE RESPONSIBILllY OF THE CONTRACTOR TO ACCOMMODATE
POSITIVE DRAINAGE THROUGHOUT CONSTRUCTION TO AVOID FLOODING
OF THE ADJACENT PROPERTIES. ANY FLOODING THAT MAY OCCUR
DUE TO HIS WORK SHALL BE THE SOLE RESPONSIBILllY OF THE
CONTRACTOR TO REPAIR.

THE IRRIGATION CONTRACTOR SHALL PROVIDE AN UNDERGROUND IRRI-
GATION SYSTEM TO COVER 100% OF ALL ON SITE PLANTING AREAS.
THIS SYSTEM SHALL CONTAIN BUT NOT BE LIMITED TO THE FOLLOWING:
1. UNDERGROUND PIPIING, SHALL BE PVC SCHEDULE 40 OR BETTER.
2. SEVEN (7) DAY PROGRAMMABLE TIME CLOCK TO ACTIVATE lONES.
3, SPRINKLER HEADS COMPATIBLE WITH THE TYPE OF PLANTING,
4. ELECTRIC VALVES.
5. GAUGE 14 UF COPPER WIRE.
6, FIBERGLASS OR PLASTIC ZONE VALVE BOXES,
WHERE PIPING IS UNDER DRIVEWAY AND CONCRETE WALKS, THE PIPES
SHALL BE INSTALLED IN SCHEDULE 40 SLEEVES 18" BELOW GRADE.
MATERIALS SUPPLIED SHALL BE EQUAL TO THOSE MANUFACTURED BY
RAIN BIRD OR APPROVED EQUAL.
THE IRRIGATION CONTRACTOR SHALL SUBMIT A SYSTEM LAY-OUT ALONG
WITH CATALOG SHEETS OF ALL COMPONENTS IN THE SYSTEM TO THE
OWNER FOR APPROVAL PRIOR TO INSTALLATION.
THE ENTIRE SYSTEM SHALL BE GUARANTEED BY THE CONTRACTOR FOR
ONE YEAR FROM THE DATE OF ACCEPTANCE BY THE ARCHITECT/
ENGINEER.
ANY AND ALL USE OF HOSE BIBBS IN ASSOCIATION WITH
NON-POTABLE WATER SUPPLIES SHALL BE IN FULL COMPLIANCE
WITH SBCCI STANDARD PLUMBING CODE, CHAPTER VI CRITERIA.
REFERENCE COLOR CODING OF ABOVE GRADE RISER PIPING
AND LABEL/TAGGING OF OUTLETS AS NON-POTABLE WATER SUPPLY
IS REQUIRED.

4. THE USE OF SOIL TESTING TO IDENTIFY SOIL CONDITIONS NECES-
SARY FOR THE CONTINUED SURVIVAL OF PROPOSED LANDSCAPING.
5. ORGANIC SOIL AMENDMENTS (SUCH AS TOP SOILS, MANURE, PEAT
AND COMPOSTED MATERIALS) MIXED WITH EXISTING SOILS WITHIN LAND-
CAPING PLANTER BEDS TO DEPTHS CONSiSTENT WITH THE ROOT DEPTH
OF PROPOSED PLANTED MATERIAL (USE ONLY IF EXISTING SOIL
CONDITIONS WARRANT THESE AMENDMENTS).
6. THE PRESERVATION AND INCORPORATION OF EXiSTING PLANT
COMMUNITIES ON SITE INTO THE LANDSCAPE PLAN.
7. THE MINIMAL USE OF TURF GRASSES WHICH REQUIRE FREQUENT
IRRIGATION.
8. LOW-MAINTENANCE DESIGN.
TREE & SHRUB PLANTING DETAILS
1. THE ROOT MASS FORM OF EACH TREE PROPOSED FOR INSTALLATION
SHALL BE BALLED OR BURLAPPED. BARE ROOT TREES ARE NOT AC-
CEPTABLE. ALL NONBIODEGRADABLE WRAPPINGS WILL BE REMOVED
AND BURLAP WILL BE FOLDED DOWN TO ENHANCE WATER ABSORPTION.
IF WIRE BASKETS ARE USED IN CONJUNCTION WITH BALLED AND
BURLAPPED TREES THE FIRST FEW ROWS OF EACH BASKET SHALL BE
REMOVED AT THE TIME OF INSTALLATION.
2. SUPPORTING APPARATUS SHALL BE REMOVED AFTER 1 COMPLETE
GROWING SEASON. ALSO THE FLEXIBLE ATTACHMENTS SHALL BE USED
WHERE SUPPORT WIRES ARE WRAPPED AROUND TREE TRUNKS/STEMS
TO PREVENT CAMBIAL DAMAGE.
3. PLANTING HOLES ASSOCIATED WITH PROPOSED TREES MUST BE SLOPED
(NOT COMPACTED) AND A MINIMUM OF 18-24 INCHES WIDER THAN
THE DIAMETER OF THE ROOT BALL. TREES SHALL BE INSTALLED SUCH
THAT THE TOP OF THE ROOT MASS IS LEVEL WITH THE SURFACE OF
THE PLANTING HOLE. TREES SHOULD BE INSTALLED 3 - 5 INCHES
ABOVE GRADE ON SITES CONTAINING CLAY. A 2 - 3 INCH LAYER OF
ORGANIC MULCH MUST ALSO BE PLACED OVER THE ENTIRE SURFACE
OF EACH PLANTING HOLE. TO PREVENT FUNGAL INFECTION MULCH
SHOULD BE PULLED BACK A FEW INCHES FROM THE BASE OF EACH TREE.
