RE: Development Order regarding case FLS 00-05-38 at 2760 Gulf to Bay Boulevard
Dear Mr. Dionna:
This letter constitutes a Development Order pursuant to Section 4-202 E of the Community
Development Code. On April 12, 2001, the Development Review Committee (DRC) reviewed
your application to reduce the front (south) setback along Gulf to Bay Boulevard from 25 feet to
15 feet, reduce the side (west) setback from 10 feet to seven feet, reduce the rear (north) setback
from 20 feet to five feet and approval of an automotive service station in the Commercial
District. The application includes a 3,000 square foot convenience store with six, two-pump gas
islands, a 300 square foot, automatic car wash and a 2,500 square foot restaurant. The DRC
unanimously recommended approval of the proposal subject to the following ten conditions:
1) That the billboard be removed prior to the issuance of any permits;
2) That a four-foot safety fence be provided around the retention pond (3: 1 slope)
and that the fence be fully screened with landscaping and constructed of a non-
chainlink material (where visible offsite);
3) That a final landscape plan is submitted to and approved by Staff prior to the
issuance of any permits;
4) That final, dimensioned, and rendered elevations for each building/structure be
submitted to and approved by Staff prior to the issuance of any permits;
5) That the proposed restaurant be compatible with the proposed convenience
store/gas station in terms of color, architectural style, and materials;
6) That all mechanical equipment including HV AC are screened by architectural
elements;
7) That all tanker deliveries be limited to non-peak hours;
8) That the dumpster be fully enclosed with a wall matching the proposed buildings
in terms of color, architectural style, and materials;

I concur with the findings of the Development Review Committee and, through this letter,
approve your application for Flexible Standard Development with the ten conditions as stated
above The approval is based on and must adhere to the site plan dated October 5, 200 1 and the
elevations. as revised and faxed, dated November 29,2001.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (December 6, 2002). All required certificates of
occupancy shall be obtained within one year of the date of issuance of the building permit. Time
frames do not change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the necessity
to obtain any building permits or pay any impact fees that may be required. In order to facilitate
the issuance of any permit or license affected by this approval, please bring a copy of this letter
with you when applying for any permits or licenses that require this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard
Development) may be initiated by a property owner abutting the property which is the subject of
the approval within seven days of the date the development order is issued. A copy of the
Development Order is being sent to the surrounding property owners. The filing of an
application/notice of appeal shall stay the effect of the decision pending the final determination
of the case. The appeal period for your case will expire on December 12, 2001.
