RE: Development Order regarding case UU at 1280 South Highland Avenue
Dear Mr. Hand:
This letter constitutes a Development Order pursuant to Section 4-202 E of the
Community Development Code. On September 13, 2001, the Development Review
Committee (DRC) reviewed your application for Flexible Standard Development to
reduce the front (east and south) setback along South Highland Avenue and Lakeview
Road, respectively, from 25 feet to 15 feet. The application includes the establishment of
a 2,600 square foot automotive service station/convenience store with six, fuel pumps.
The DRC unanimously recommended approval of the application with the following three
conditions:
1. That all existing and proposed signage meet the requirements of Code, to be verified
by an inspection by Staff prior to the issuance of a Certificate of Occupancy;
2. That accurate drainage calculations be submitted to and approved by Staff prior to the
issuance of any permits; and
3. That a revised stormwater engineering plan including proper contour lines for the
northeast retention pond overflow onto Highland be submitted to and approved by
Staff, prior to the issuance of any permits.
I concur with the findings of the Development Review Committee and, through this
letter, approve your application for Flexible Standard Development with the three
conditions as stated above. The approval is based on and must adhere to the site plan
dated November 2, 2001.
Pursuant to Section 4-303, an application for a building permit shall be made within one
year of Flexible Standard Development approval (December 14, 2002). All required
certificates of occupancy shall be obtained within one year of the date of issuance of the
building permit. Time frames do not change with successive owners.

Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any impact fees that may be required. In
order to facilitate the issuance of any permit or license affected by this approval, please
bring a copy of this letter with you when applying for any permits or licenses that require
this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard
Development) may be initiated by a property owner abutting the property which is the
subject of the approval within seven days of the date the development order is issued. A
copy of the Development Order is being sent to the surrounding property owners. The
filing of an application/notice of appeal shall stay the effect of the decision pending the
final determination of the case. The appeal period for your case will expire on December
21,2001.

B. GRADING OF PLANTING BEDS
ALL PLANTING BEDS SHALL BE o. BELOW ADJACENT STRUCTURES AND SLOPE
AT 3% A WAY FROM EXISTING STRUCTURES. VERIFY THIS CONDITION WITH
GENERAL CONTRACTOR PRIOR TO BEGINNING WORK. PARKING LOT ISLANDS
SHALL SLOPE AT 3% FROM CENTER OF ISlAND TO CURB. TOE OF SLOPE ON
ALL BEDS SHALL FINISH AT 2. BELOW SIDEWALKS, CURBS OR OTHER HARD
EDGING TO ALLOW FOR MULCH THICKNESS.
e. BED PREP ARA TION AND PLANTING
ENTIRE EXTENT OF ALL PLANTING BEDS AND PLANTING ISLANDS SHALL
CONTAIN SUIT ABLE SOIL TO A MINIMUM DEPTH OF THREE FEET FOR THE
KIND OF PLANT MATERIAL BEING INSTALLED IN THAT LOCATION.
LOOSEN SOIL TO A MNMUM DEPTH OF FOUR INCHES AND REMOVE ALL
DEBRIS. REGRADE THE BED TO ITS PRE-PLANTING SUBGRADE. SPREAD
APPROVED FABRIC-TYPE WEED BARRIER OVER ALL SHRUB BEDS. IF REQUIRED.
DIG PLANTING PITS AT 2 TIMES THE DIAMETER OF THE POT. FILL PLANT
PIT WITH 50% EXISTING SOIL AND 50% TOPSOIL (SEE BELOW) AND
COMPACT SO THAT THE TOP OF ROOT BALL WILL SETTLE 1/8 DEPTH OF
ROOT BALL ABOVE FINISH GRADE. SET PLANT AND FILL REMAINDER OF
HOLE WITH PLANTING MIX. FERTILIZE EACH PLANT WITH THE RECOMMENDED
RA TE OF 0-0-0 FERTILIZER AND/OR AGRIFORM TABLETS, WATER IN THOROUGHLY.
RESET ANY PLANTS THAT SETTLE TOO DEEP. REMOVE SPOIL DIRT AND RAKE

OF GRADE A SHREDDED CYPRESS MULCH OR PINE BARK MULCH. REMOVE ALL

D. TOPSOIL
TOPSOIL SHALL BE A NATURAL FRIABLE, FERTILE. FINE LOAM SOIL. IT
SHALL BE CERTIFIED (BY TESTING) TO BE FREE OF WEED SEEDS AND
PA THOGENS. IT SHALL ALSO BE FREE OF LITTER, SOD, CLAY, STONES,
ROOTS AND STUMPS. IT SHALL BEAR A PH OF BETWEEN 5.5 AND 7.5.
E. EDGING
ALL EDGING SHALL BE AS DESCRIBED IN THE PLANTING DETAILS.
F. TREE STAKING

THERE SHALL BE NO ADDITIONS, DELETIONS, OR SUBSTITUTIONS
