To Whom It May Concern:
The Clearwater Planning Department has received an application for Flexible Standard Development for the
property at 749 Island Way. The request is reduce the rear setback from 25 feet to 20 feet for the purpose
of constructing a one-story room addition to an existing house. If the application demonstrates compliance
with the requirements of the development code, the Planning Director will approve or approve with
conditions the application. If the application does not demonstrate compliance, the Planning Director will
deny the application.
Pursuant to Section 4-202 C. of the Clearwater Community Development Code, the Planning Department
shall notify the owners of the properties with in 200 feet of the property that is the subject of the application
that an application has been filed. You have the right to appeal the decision of the Planning Director to the
Community Development Board regarding the above-referenced application. Should you choose to appeal
the decision, an application for appeal must be received by the Planning Department within seven days of
the date the development order is issued. A fee of $100 must accompany the application for appeal

The area is generally composed of single-story waterfront
houses with a mid-rise condominium building to the west.
STAFF ANALYSIS
The 0.27 acre site is located on the east side of Island Way adjacent to a waterway that ultimately
ends in Clearwater Harbor. The immediate vicinity is generally composed of single-story ranch-
style waterfront houses. All properties are well landscaped and properly maintained. The Sea
Island and Island Way condominiums are located across the street to the west.
The site is occupied by a one-story ranch-style house much like others in the neighborhood. The
house includes stone and stucco exterior materials and a white, barrel-tile roof. The house, with
existing pool deck, is located approximately 38 feet from the seawall. There are existing hedges
along the north and south property lines that act as buffers to adjacent properties.
The proposal includes a 1,600 square foot addition to the rear of the house. The house expansion
will include a master bedroom, master bathroom and family room. The addition is planned for

the rear of the house and will wrap around the existing pool area. The west and east exterior
walls will be primarily glass to maximize views to the waterway as seen from the pool area. The
owners' long term goal is to upgrade the entire house exterior.
The request is to reduce the rear setback from 25 feet to 20 feet. Waterfront properties normally
have a greater rear setback to preserve water views. By applying for the Flexible Standard
application, the Development Review Committee concluded that water views of adjacent
properties would not be substantially reduced with this proposal.
FLEXIBLE STANDARD CRITERIA FOR DETACHED DWELLINGS IN THE LOW
MEDIUM DENSITY RESIDENTIAL DISTRICT:
1. The reduction in rear setback will allow for the preservation of existing vegetation
which could not otherwise be preserved; or
The proposal does not meet this criterion.
2. The reduction in rear setback will allow the development or redevelopment of a
substandard lot which would otherwise not be feasible; or
The proposal does not meet this criterion.
3. The reduction results in an efficient house layout; and
An existing swimming pool and the existing house layout severally restricts other
reasonable locations for the addition. A second story would result in a design out of
character with the existing neighborhood.
4. The structures located within the rear setback otherwise required in the LMDR
District are buffered with landscape material or fences to protect the privacy and
value of adjacent properties.
There are existing hedges along the north and south property line that will help buffer
the proposed addition from adjacent properties.

GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The neighborhood is generally composed of single-story ranch-style waterfront homes.
The proposed addition is in keeping with the existing neighborhood character without
severely degrading views to the water.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The proposed addition is designed to match the eXIstmg house and the overall
architectural style of many neighborhood homes. Homes adjacent to the water generally
retain a 20-feet rear setback and preserve water views. The addition will not severely
degrade water views and should not reduce the value of adjacent properties.
3. The proposed development will not adversely affect the health or safety of persons
residing or working in the neighborhood of the proposed use.

proposed addition is consistent with the architectural style of the existing house and many
homes in the general vicinity.
6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
The addition is not expected to cause any negative impacts for adjacent properties.

STAFF RECOMMENDATION:

Staff believes that the proposed addition complies with the standards of the Community
Development Code and the Flexible Standard Development criteria for the Low Medium Density
Residential district. Staff recommends APPROV AL of the request to reduce the rear setback
from 25 feet to 20 feet for the purpose constructing a 1,600 square-foot addition at 749 Island
Way.

To Whom it may concern,
This letter is in response to the request for approval of a 20' set back from the sea wall
where 25' is recommended. This response is to the conditions for approval as listed in
Se~tion 3-913.
1. The approval of this request would be in keeping with the other houses in this area.
There are existing houses that have developed elevated areas close to the sea wall,
they vary from additional retaining walls to level the yard, pool enclosures (also
elevated), and building structures. The owner wishes to keep this house one story.
2. The approval of this request would not hinder the redevelopment of any other
adjacent property. The property to the north has recently been remodeled and has
been elevated toward the sea wall.
3. The approval of this request will not affect the health, safety or the welfare of any
one in the neighborhood.
4. This request has nothing to do with traffic.
5. The redevelopment of this house is in keeping with other projects on Island Estates.
6. The approval of this request should not impact the adjacent properties as the .
primary view of these properties is font and back yard (east & west). The option is
when these one story houses are redeveloped to two stories, thus increasing
potential views. The other factors of noise, odors and hours of operation are
irrelevant.
I would hope that you agree with me that approval of this request would not be detrimental
to any of the adjacent properties. Thank you for your time and consideration and anticipate

Dear Mr. Fisher:
On December 18, 2000, the Development Review Committee (DRC) reviewed your application
for Flexible Standard development to reduce the rear setback from 25 feet to 20 feet. The
proposal includes a 1,600 square foot one-story master bedroom and family room addition. The
DRC unanimously recommended approval of the application. I concur with the findings of the
Development Review Committee and, through this letter, approve your application for Flexible
Standard development.
Pursuant to Section 4-303, an application for building permit shall be made within one (1) year
of the date of this Development Order (December 26, 2001). All required certificates of
occupancy shall be obtained within one (1) year of the date of issuance of the initial building
permit. Time frames do not change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the necessity
to obtain any building permits or pay any impact fees that may be required. In order to facilitate
the issuance of any permit or license affected by this approval, please bring a copy of this letter
with you when applying for any permits or licenses that require this prior development approval.

APPROVAL AT 749 ISLAND WAY
To Whom It May Concern:
The Clearwater Planning Department has received an application for Flexible Standard Development for the
property at 749 Island Way. The request is reduce the rear setback from 25 feet to 20 feet for the purpose
of constructing a one-story room addition to an existing house. If the application demonstrates compliance
with the requirements of the development code, the Planning Director will approve or approve with
conditions the application. If the application does not demonstrate compliance, the Planning Director will
deny the application.
Pursuant to Section 4-202 C. of the Clean-vater Community De'/ebpment Code, the Planning Department
shall notify the owners of the properties with in 200 feet of the property that is the subject of the application
that 'an application has been filed. You have the right to appeal the decision of the Planning Director to the
Community Development Board regarding the above-referenced application. Should you choose to appeal
the decision, an application for appeal must be received by the Planning Department within seven days of
the date the development order is issued. A fee of $100 must accompany the application for appeal
The application will be reviewed for sufficiency by the Development Review Committee (DRC) on
December 18,2000 in the Planning Department conference room - Room 216 - on the second floor of the
Municipal Services Building, 100 South Myrtle Avenue in Clearwater. Should you choose to observe the
