I hereby certify as a licensed Professional Engineer, registered in accordance
with Florida Statute 471, that the above project's site and/or construction plans
meet or exceed all applicable design criteria specified by City municipal
ordinance, State, and Federal established standards. I understand that it is my
responsibility as the Project's Professional Engineer to perform quality assurance
review of these submitted plans to ensure that such plans are free from errors
and/or omissions. Further, I accept that the City's Final Inspection for a
Certificate of Occupancy does not relieve me of my own quality assurance
review.

ANNEXATION OF ENCLAVES INTO THE CITY OF CLEARWATER
GENERAL PROJECT DESCRIPTION:
The scope of services for this project includes:
The involuntary annexation of approximately 20 parcels into the City of Clearwater following the
approval of the Special Act entitled Chapter 98-484, Laws of Florida, (also known as House Bill
3851. Effective July 1, 1999, this Act allows the City of Clearwater to involuntarily annex
enclaves of one acre or less in size under specific conditions. The 20 parcels were identified
through Phase I of the Study completed by Wade-Trim and presented to the City Commission
on October 2, 2000.
Presenting pertinent data unique to each parcel for inclusion in an Annexation Application and
required staff reports for submittal of the Community Development Board for review and
approval.
Preparing a list of qualified properties that meet the Special Act requirements for submittal to the
Pinellas Planning Council (PPC) for review and Pinellas County Commission for approval.
Assisting in the preparation of a complete package of City Commission approved annexations,
including appropriate studies, reports, documentation and annexation ordinances.
Assisting in the preparation of the annexation package(s) to the Florida Department of
Community Affairs (DCA) in Tallahassee.
Providing design survey, geotechnical engineering, construction design plans and
specifications, and bid documents for the phased construction improvements associated with
expanding sewer service to the 20 identified parcels.
Providing bidding assistance and limited construction engineering and inspection services.
PHASE /I PLANNING SERVICES
1.0 Prepare Annexation Applications for Processing
The Consultant will assist City staff by assembling pertinent information regarding each parcel
to be annexed. The information will be included in the Applications for Annexation required by
the City of Clearwater for formal processing through the City's various review entities. It is
assumed the City, as the applicant, will comply with the review criteria outlined in the Act as well
as the City's internal review processes.
The Consultant will prepare accompanying reports and recommendations regarding the
appropriateness of the proposed annexations. This activity will be completed in concert with
City Staff who will provide required maps and aerials for inclusion in the reports.

The Consultant will attend the Community Development Board meetings, to provide technical
support to the staff if needed during the presentation of the Applications for Annexation.
Deliverables: Background data and information, as determined, for each parcel to be annexed.
2.0 Letter to Effected Property Owners
The Consultant will prepare a letter to each of the 20 property owners discussing the schedule
and procedures to be followed by the City when annexing the properties. More specifically, the
letter will include a proposed schedule, procedures to be followed regarding connection to the
City's sanitary sewer system, and other pertinent information as appropriate.
Deliverables: Letter to Property Owners
3.0 Preparation of List of Qualified Properties for PPC and Pinellas SOCC Review
The Consultant will prepare a list of qualified properties for submittal to the Pinellas Planning
Council (PPC) and Pinellas County Board of County Commissioners for review and approval.
The list will include appropriate graphic and support materials for review by County technical
staffs. The list will include the 20 properties previously referenced.
Deliverables: A list of Qualified Properties with Support Data
4,0 Annexation Process Meetings
The Consultant will attend the following meetings necessary in the preparation and processing
of the twenty annexations:
. Two Meetings with Staff
. One Community Development Board Meeting
. Two City Commission Meetings
. Pinellas Planning Council Meeting
. One Pinellas BOCC Meeting
Additional meetings will be attended, as directed, on a time and materials basis consistent with
the approved range of billing rates.
ENGINEERING SERVICES
5.0 Design, Permitting and Construction Documents for Sewer Connections
The Consultant will provide professional land surveying and geotechnical engineering services
to map existing features associated with the extension of sanitary sewer service to identified
properties to be annexed. The Consultant will conduct topographic and subsurface utility
surveys along the route of necessary sanitary sewer system extensions to locate natural and

man made features. The Consultant will utilize City Atlas sheets to identify existing utilities
where possible.
The Consultant will prepare information and submittals to obtain the following Agency permit
approvals:
1. Department of Environmental Protection
2. Pinellas County Right-of-Way Permit
3. Corp of Engineers Dredge and Fill Permit
4. FOOT Right-of Way Use Permit
The Consultant will conduct pre-application meetings with the agencies listed above.
The Owner will provide plan review and permit fees.
The construction documents will consist of construction drawings and specifications. The
construction drawings will be prepared in a plan and profile format. Sanitary Sewer details will
be provided as well. Utility conflicts will be addressed accordingly on the plan and profile
construction sheets or if necessary, separate utility adjustments sheets will be provided. The
construction plans will include survey information sufficient for construction stake out of the
proposed sanitary sewer improvements.
Progress drawings shall be submitted for review and Owner's approval at 30%, 60% and 90%
and 100% intervals of this task. Coordination meetings shall be conducted following submission
of these plans to review the Owner's comments.
Project cost estimate will be prepared at the 60% stage of the work and updated for 90%.
The Consultant will prepare the bid form and technical specification sections for the project
during the final stages of the design work.
6.0 Sanitary Sewer Deliverables

It is understood the Consultant will take an aggressive lead on behalf of the City in completing
this work, recognizing the limited City staff available to work on this project. The scope of
services is divided into two primary activities: planning activities and engineering activities.
Primary Consultant activities will include:
Developing an interactive public information program explaining the annexation process,
benefits, property owner obligations, and schedule, including the conduct of public meetings and
preparation of notices and other information to be mailed to the affected property owners,
Evaluating the identified enclaves regarding geography, similarity of extensions required,
ease/difficulty of construction, preferred design and construction schedules to accommodate
annexations and the provision of needed services.
Evaluating whether the existing parcels previously identified by the City meet the special act
requirements regarding existing septic systems.
Developing the process for connection to the City's system and permit requirements.
Assisting City staff by collecting pertinent data unique to each parcel for inclusion in an
Annexation Application and required staff reports for submittal of the Community Development
Board for review and approval.
Preparing a list of qualified properties that meet the Special Act requirements for submittal to the
Pinellas Planning Council (PPC) for review and Pinellas County Commission for approval.

2.0 Evaluation of Enclaves to be Annexed
The Consultant will review the 146 parcels identified by the City with respect to compliance with
the provisions of Chapter 98-484, Laws of Florida. Particular attention will be given to
geography, similarity of utility extensions required, special act requirements regarding existing
septic systems, ease/difficulty of construction, preferred design and construction phasing
schedules to accommodate the annexations.
The Consultant will develop processes for evaluating septic tank compliance and connection to
the City's sanitary sewer system including permit requirements.
The Consultant will provide a recommended phasing program to accomplish grouped
annexations.
Deliverables: A list of qualified properties proposed for annexations that complies with the law
identified by preferred "groupings" of phased annexations. The preferred process for evaluating
septic tank compliance and connection of existing systems. A schedule of activities associated
with the processing of the "groupings" of phased annexations.
3.0 Assist In Preparation of Annexation Applications for Processing
The Consultant will assist City staff by assembling pertinent information regarding each parcel
to be annexed. The information will be included in the Applications for Annexation required by
the City of Clearwater for formal processing through the City's various review entities. It is
assumed the City, as the applicant, will comply with the review criteria outlined in the Act as well
as the City's internal review processes.
The Consultant will assist City staff in the preparation of accompanying reports and
recommendations regarding the appropriateness of the proposed annexations.
The Consultant will attend the Community Development Board meetings, to provide technical
support to the staff if needed during the presentation of the Applications for Annexation.

4.0 Preparation of List of Qualified Properties for PPC and Pinellas sacc Review
The Consultant will prepare a list of qualified properties for submittal to the Pine lias Planning
Council (PPC) and Pinellas County Board of County Commissioners forreview and approval.
The list will include appropriate graphic and support materials for review by County technical
staffs. The listing will be prepared by "groupings" of annexations.
Deliverables: A list of Qualified Properties with Support Data
5.0 Annexation Process Meetings
The Consultant will attend the following meetings necessary in the preparation and processing
of five (5) groupings of annexations:
· Project Kick-off Meeting with City Staff
· Preliminary Meeting with PPC
. Public Information Program Development - two meetings with staff
. Evaluation of Enclaves - two meetings with staff
. Public Workshops - five in community
. Community Development Board Meetings - six meetings
. City Commission Meetings - five meetings First Reading
. Individual Meetings with Property Owners - ten estimated
Additional meetings will be attended, as directed, on a time and materials basis consistent with
the approved range of billing rates.
ENGINEERING SERVICES
6.0 Identification and Prioritization of Construction Projects
The Consultant will identify and prioritize construction-related improvements based on cost and
complexity and effort required to extend sanitary sewer service to annexed properties. It is
recognized that many parcels can receive sanitary sewer service with a direct connection from
existing City service abutting the annexed property. Other properties will require varying levels
of design and construction effort to extend service to the annexed properties. The Consultant
will therefore identify and prioritize needed City construction improvements for the "groupings" of
annexations identified in earlier tasks.
7.0 Design, Permitting and Construction Documents for Sewer Connections
The Consultant will provide professional land surveying and geotechnical engineering services
to map existing features associated with the extension of sanitary sewer service to select
properties to be annexed. The Consultant will conduct topographic and subsurface utility
surveys along the route of necessary sanitary sewer system extensions to locate natural and
man made features. The Consultant will utilize City Atlas sheets to identify existing utilities
where possible.

The Consultant will prepare information and submittals to obtain the following Agency permit
approvals:
1. Department of Environmental Protection
2. SWFWMD Standard General Permit and ERP Permit
3. Corp of Engineers Dredge and Fill Permit & Port Authority Permit
4. FOOT Right-of Way Use Permit
The Consultant will conduct pre-application meetings with the agencies listed above.
The Owner will provide plan review and permit fees.
The construction documents will consist of construction drawings and specifications. The
construction drawings will be prepared in a plan and profile format. Sanitary Sewer details will
be provided as well. Utility conflicts will be addressed accordingly on the plan and profile
construction sheets or if necessary, separate utility adjustments she,ets will be provided. The
construction plans will include survey information sufficient for construction stake out of the
proposed sanitary sewer improvements,
Progress drawings shall be submitted for review and Owner's approval at 30%, 60% and 90%
intervals of this task. Coordination meetings shall be conducted following submission of these
plans to review the Owner's comments.
Project cost estimate will be prepared at the 60% stage of the work and updated for 90%.
The Consultant will prepare the bid form and technical specification sections for the project
during the final stages of the design work.

ANNEXATION OF ENCLAVES INTO THE CITY OF CLEARWATER
GENERAL PROJECT DESCRIPTION:
The scope of services for this project includes:
The involuntary annexation of approximately 146 parcels into the City of Clearwater
following the approval of the Special Act entitled Chapter 98-484, Laws of Florida, (also
known as House Bill 3851. Effective July 1, 1999, this Act allows the City of Clearwater
to involuntarily annex enclaves of one acre or less in size under specific conditions.
It is understood the Consultant will take an aggressive lead on behalf of the City in
completing this work, recognizing the limited City staff available to work on this project.
The scope of services is divided into two primary activities: planning activities and
engineering activities. Primary Consultant activities will include:
Developing an interactive public information program explaining the annexation process,
benefits, property owner obligations, and schedule, including the conduct of public
meetings and preparation of notices and other information to be mailed to the affected
property owners.
Evaluating the identified enclaves regarding geography, similarity of extensions required,
ease/difficulty of construction, preferred design and construction schedules to
accommodate annexations and the provision of needed services.
Evaluating whether the existing parcels previously identified by the City meet the special
act requirements regarding existing septic systems.
Developing the process for connection to the City's system and permit requirements.
Assisting City staff by collecting pertinent data unique to each parcel for inclusion in an
Annexation Application and required staff reports for submittal of the Community
Development Board for review and approval.
Preparing a list of qualified properties that meet the Special Act requirements for
submittal to the Pinellas Planning Council (PPC) for review and Pinellas County
Commission for approval.
Assisting in the preparation of a complete package (by grouping) of City Commission
approved annexations, including appropriate studies, reports, documentation and
annexation ordinances.
Assisting in the preparation of the annexation package(s) to the Florida Department of
Community Affairs (DCA) in Tallahassee.
Providing design survey, geotechnical engineering, construction design plans and

ANNEXATION OF ENCLAVES INTO THE CITY OF CLEARWATER
GENERAL PROJECT DESCRIPTION:
The scope of services for this project includes:
The involuntary annexation of approximately 146 parcels into the City of ClealWater
following the approval of the Special Act entitled Chapter 98-484, Laws of Florida, (also
known as House Bill 3851. Effective July 1, 1999. this Act allows the City of Clearwater
to involuntarily annex enclaves of one acre or less in size under specific conditions.
Of the 146 parcels identified by the City's Planning and Development Services and
Engineering Production Departments, seven parcels are sufficiently small to likely
prevent development. Therefore, the primary focus of the work to be perlormed by the
Consultant will focus on the remaining 139 parcels.
It is understood the Consultant will take an aggressive lead on behalf of the City in
completing this assignment, recognizing the limited City staff available to work on this
project. The scope of services. is divided into two primary activities: planning activities
and engineering activities. Primary Consultant activities will include:
Developing an interactive public information program explaining the annexation process,
benefits, property owner obligations, and schedule, including the conduct of public
meetings and preparation of notices and other information to be mailed to the affected
property owners.
Evaluating the identified enclaves regarding geography, similarity of extensions required~
ease/difficulty of construction, preferred design and construction schedules to
accommodate annexations and the provision of needed sanitary sewer services.
Evaluating whether the existing parcels previously identified by the City meet the special
Act requirements regarding existing septic systems.
Developing the process for connection to the City's system and permit requirements.

Completing the required Annexation Applications and preparing the required staff reports
for submittal of the Community Development Board for review and approval.
Preparing a list of qualified properties for submittal to the Pinellas Planning Council
(PPC) for review and Pinellas County Commission for approval and attending the
required PPC technical review committee meetings and regularly scheduled PPC and
80Ce meetings.
Preparing and forwarding a complete package of City Commission approved
annexations, including appropriate studies, reports, documentation and annexation
ordinances.
Preparing and forwarding the annexation package(s) to the Florida Department of
Community Affairs (DCA) in Tallahassee.
Providing design survey, geotecnical engineering, construction design plans and
specifications, and bid documents for the phased construction improvements.
.Providing bidding assistance and construction engineering and inspection services.
PLANNING SERVICES
1.0 Develop Interactive Public Information Program
The Consultant will meet with staff to discuss the preferred Public Information Program.
The Consultant will formalize the desired interactive Public Information Program that
explains the annexation process, benefits of being annexed into the City, property owner
obligations, and schedule of annexation activities. The program will include the
identification of public workshop format, public notice content and format, media
program, and other appropriate public involvement activities and techniques.
Deliverables: Public Information Program document.

2.0 Evaluation of Enclaves to be Annexed
The Consultant will review the 146 parcels identified by the City with respect to
compliance with the provisions of Chapter 98.484, Laws of Florida. Particular attention
will be given to geography, similarity of utility extensions required, special act
requirements regarding existing septic systems, ease/difficulty of construction, preferred
design and construction phasing schedules to accommodate the annexations.
The Consultant will develop processes for evaluating septic tank compliance and
connection to the City's sanitary sewer system including permit requirements,

3.0 Preparation of Annexation Applications for Processing ~
The Consultant will prepare the Applications for Annexation req ed by the City of
ClealWater for formal processing through the City's various rev' w entities. It is
assumed the City, as the applicant, will comply with the revie criteria outlined in the
as well as the City's internal review processes.
The Consultant will prepare accompanying reports and commendations regarding the
appropriateness of the proposed annexations, and th ecommended Comprehensive
Plan Land Use Category and Zoning Classification f each parcel to be annexed.
The Consultant will attend the Community Development Board meeting, it needed, to
present the Applications for Annexation.
Deliverables: Completed Applications for Annexation and accompanying staff reports.
4.0 Preparation of List of Qualified Properties for PPC and Pinellas BOCC
Review
The Consultant will prepare a list of qualified properties for submittal to the Pinellas
Planning Council (PPC) and Pinellas County Board of County Commissioners for review
and approval. The list will include appropriate graphic and support materials for review
by County technical staffs, The listing will be prepared by "groupings" of annexations,

5.0 Preparation of Annexation Ordinances and Support Documentation for City
Commission Meetings
The Consultant will prepare required Annexation Ordinances and support documentation
for the Commission Agenda Packages for the numerous properties to be annexed. It is
envisioned this will be accomplished in groups of four or five separate agenda packages
consistent with the schedule of annexations identttied in Task 2.0 above.
6.0 Annexation Process Meetings
The Consultant will attend the following meetings necessary in the preparation and
processing of five (5) groupings of annexations:

· Public Information Program Development - two meetings with staff

said that she didn't think there was any General Fund money budgeted. She was prepared the agenda item using
the Water and Sewer code, but if some of the contract related to annexation planning, I was concerned that we not
just charge it all to Water and Sewer unless we can justify it. Any comments?

This should be looked at more closely since the upside of this includes increases in property tax revenue to the Gen. Fd.
Please change the funding code. This is more in line with System expansion and the Wade Trim water & sewer related
costs should be charged to 315-96630-561300-535-000. There is sufficient Sewer Tap revenues in this project to pay
Water & Sewer's portion of the Wade Trim costs.

Mahshid, the task duration for the planning tasks is as follows. Task 3-to prepare the public info program-3
weeks; to implement the program (and let owners know) will be run simultaneously with the design and

Enclave Annexation Schedule
Here is the suggested scope for the enclave annexation program. Please note that this includes the major tasks
to give us an idea for planning purposes. I have also assumed that the consultant selected will be one with both
engineering and planning expertise and will do the vast majority of the work (as opposed to city staff), Prior to
developing the scope for the consultant, both Planning and Engineering should revisit which exact tasks can be
done in house, Each major task is also identified as either a planning or engineering lead task.
1, Evaluate the enclaves re geography, similarity of extension required, easel difficulty in construction and
any other similarities or differences which will influence the schedule, Determine the phasing of the design and
construction. (Engineering)
2. Evaluate whether and how many existing homes meet the special act requirement re existing septic tank
system, Determine the City's process for connection for existing systems, ie. whether permit is required.
(Engineering)
3. Develop a public information program explaining the annexation process, the benefits of annexing and
the property owner's obligations. Determine the appropriate method(s) of letting property owners know about the
annexation program and schedule. Hold the appropriate public meetings and send letters to affected property
owners. (Planning)
4, Design each phase of sewer extension. (Engineering)
5. Build the utility extension, (Engineering)
6. Process the enclaves in groups to formally annex the properties into the City (review by Community
Development Board and approval by City Commission). Coordinate the annexation approval with the
construction of the extensions, (Planning)

During the 1998 legislative session, the Florida Legislature approved a special act to
address some of the enclave issues in Pinellas County. The Special Act entitled Chapter 98-484
applies only to Pinellas County and allows for involuntary annexations under certain
circumstances and only from July 1, 1999 to June 30,2001. Involuntary annexations may be
permitted of some or all enclaves which existed as of July 1, 1999 provided that each enclave is
less than one acre in size and is bounded on all sides by the same municipality. The Public
Works Administration had reviewed the existing enclaves within Clearwater and identified 139
enclaves that meet the requirements of the Special Act. These 139 enclaves are distributed
throughout the City geographically and tend to be single family parcels; seventeen enclaves are
developed with a nonresidential use and one enclave is a duplex.
The Special Act established several obligations that a municipality must meet should it
involuntarily annex some or all of the enclaves as analyzed below,
· The city must have a defined planning area in accordance with the Florida Statutes.
Clearwater meets this requirement through its planning area adopted pursuant to an
interlocal agreement with Pinellas County in 1992.
· The city must be able to timely serve the enclaves with urban services, For the
Clearwater enclaves, only sewer service is lacking; potable water service is currently
provided to each enclave either by Clearwater or Pinellas County, The analysis
prepared by the Public Works Department indicates that Clearwater can timely serve
the enclaves with sewer service. A majority of94 of the 139 enclaves have sewer
lines existing immediately adjacent to the property and can easily be provided with
service. For the remaining 45 enclaves, sewer extensions will be required.

The city must I for the construction costs to extend ules to the enclaves. City
Attorney Pam Akin has determined that construction costs must include the sewer
impact fee for all existing structures, The Public Works Department evaluated the
costs to extend sewer service to all 139 enclaves and the costs include design of the
extension, the actual construction costs, the sewer impact fees for existing structures
($900 per single family home), and any outstanding assessment fees for previous
extensions, The total cost to extend sewer service to all 139 enclaves is estimated at
$994,584,
The Planning Department prepared a fiscal analysis (Memorandum dated June 3, 1999
attached) comparing the financial benefits with the costs associated with annexing the enclaves,
We have estimated new revenues in three sources if the enclaves are annexed as follows:
· the estimated new ad valorem taxes to be realized = $ 54,520;
· the estimated new franchise fees paid by private utilities for the ability to operate
within the City = $ 22,444; and
· the estimated new utility fees collected against the gross sales of electricity, natural
gas, liquid propane, water, fuel oil and telecommunications = $44,540.
The total of new revenues estimated to be received by the City if all 139 enclaves are
annexed is $121,504 per year, Based on this revenue estimate, the City can recover its utility
extension costs in approximately eight years, This payback schedule is a reasonable one when
also considering the intangible benefits of annexing the enclaves which include the improved
ability of the City to plan for its entire planning area; improved groundwater quality through
gradual elimination of septic tanks; improved and more cost effective delivery of city services
including public safety services and code enforcement; and increased neighborhood
cohesiveness,
An additional intangible benefit of annexing the enclaves is to demonstrate success in this
limited involuntary annexation program. For more than twenty years, there has not been any
ability to address the extensive enclave problem in Clearwater, Upon effective completion of
this annexation program, the City will be positioned to pursue additional initiatives to address the
remaining enclave issues,
The Planning and Development Services Administration recommends that the enclave
annexation program be immediately initiated and seriously pursued, To implement this program,
we recommend that an engineering/planning firm be hired to design the utility extensions,
develop a schedule for annexation, develop a public information program to inform the enclave
property owners and coordinate the timing of the extensions with actual effective date of the
property's annexation. The Planning Department will support the selected firm through the
annexation public hearing process with the Community Development Board and the City
Commission,
The hiring of an outside firm to coordinate the annexation program is appropriate for this
short-term specialized program in which the coordination of utility extension with the effective
date of annexation is critical both from a practical and public relations point of view. Current
staff is not available to perform this program without impacting existing work priorities, The
City currently has five engineering firms who have been pre-qualified for City work and are
under a master contract. Planning and Development Services Administration recommends that
we evaluate and select one of the five pre-approved firms for their ability to perform the
assignment in accordance with our scope and schedule. The existing master contract allows the
City to select the most qmled firm and begin work in a timely fain recognizing the limited
time to complete this project. The costs for the design and planning of the project can be paid
out of the Sewer Trust Fund.
I would like to update the City Commission on our plan regarding enclave annexation
and suggest the August 30, 1999 work session. Please let me know if you need any additional
