CONSISTENCY WITH CITY'S COMPREHENSIVE PLAN [Section 4-603.F.l] Recommended Findings of Fact Applicable Goals, Objectives and Policies from the Clearwater Comprehensive Plan in support of the proposed land use plan amendment are as indicated below: 2.2.1 Policy - On a continuing basis, the Community Development Code and the site plan approval process shall be utilized in promoting infill development and/or planned developments that are compatible. 2.4 Objective - Compact urban development within the urban service area shall be promoted through application of the Clearwater Community Development Code. 3.0 Goal - A sufficient variety and amount of future land use categories shall be provided to accommodate public demand and promote infill development. 5.1.1 Policy - No new development or redevelopment will be permitted which causes the level of City services (traffic circulation, recreation and open space, water, sewage treatment, garbage collection, and drainage) to fall below minimum acceptable levels. However, development orders may be phased or otherwise modified consistent with provisions of the concurrency management system to allow services to be upgraded concurrently with the impacts of development. Recommended Conclusions of Law The proposed plan amendment will result in land designated for institutional use at the intersection of Marilyn Street and NE Coachman Road adjacent to an existing place of worship and in close proximity to another school. CONSISTENCY WITH COUNTYWIDE PLAN Recommended Findings of Fact The purpose of the proposed INS Future Land Use Plan category, as specified by Section 2.3.3.7.3 of the Countywide Rules, is to depict those areas of the County that are now used, or appropriate to be used, for public/semi-public institutional purposes; and to recognize such areas consistent with the need, character and scale of the institutional use relative to surrounding uses, transportation facilities, and natural resource features. The primary uses permitted within the INS category are Public Educational Facilities; Private Schools; Colleges; Hospital, Medical Clinic; Church, Religious Institution, Cemetery; Funeral Home/Mortuary; Social/Public Service Agency; Child Day Care; Fraternal, Civic Organization; Municipal Office Building, Courthouse; Library; Public Safety Facility, Emergency Medical Service Building; and Convention Center. The secondary uses permitted with in this category are Residential Uses of up to a maximum of 12.5 dwelling units per acre; Residential Equivalent uses at a ratio of three beds per one permitted dwelling unit; Recreation/Open Space; Transportation/ Utility; and Ancillary Non-Residential. The FLOP Map pattern along in the vicinity of the subject site includes institutional to the south and farther to the east and west of the site and residential to the west and southwest. Industrial uses are located to the north and office and commercial uses existing adjacent to the site to the east. There is a consistent pattern of INS designated land use fronting on NE Coachman Road. The compatibility of institutional and residential land uses is evidenced by existing land use patterns and by the fact that the Countywide Rules allow residential uses in the INS classification and institutional uses in all residential land use classifications. Recommended Conclusions of Law The proposed location of the INS future land use plan category is consistent with the purpose and locational characteristics of the Countywide Plan. III. COMPATIBILITY WITH SURROUNDING PROPERTY/CHARACTER OF THE CITY & NEIGHBORHOOD [Sections 4-602.F.2 & 4-603.F.3] Recommended Findings of Fact In the vicinity of the subject site, NE Coachman Road is a two-lane collector roadway that is controlled by traffic signals at Drew Street (south) and North Belcher Road (east). NE Coachman Road is characterized by a variety of institutional uses including a school, other places of worship, as well as offices, single-family residential and a variety of commercial uses. Primarily single-family dwellings characterize the immediate area to the southwest. Institutional, office and commercial uses are generally located along the south side of NE Coachman Road. A variety of industrial uses including warehouse and light manufacturing existing farther to the north along Palmetto Street. Offices and commercial uses existing to the north and east adjacent to the site. Land located between Marilyn Street and NE Coachman Road is generally designated RU. The area to the north and east is developed with offices and a variety of commercial uses designated Residential CG and R/OG. Land farther to the north is designated Industrial Limited (IL). Recommended Conclusions of Law The proposed FLUP amendment and rezoning is compatible with surrounding uses and designations due to the similarity of land use patterns of institutional property adja~ent to residential property and the site's adjacency to the property to which it will be joined through a Unity of Title. The proposed FLUP and zoning atlas amendments are compatible with surrounding properties and the character ofthe City and neighborhood. IV. SUFFICIENCY OF PUBLIC FACILITIES Recommended Findings of Fact As stated earlier, the overall subject site is approximately 1.95 acres in area and is presently vacant. The applicant is requesting to amend the FLUP designation of the site to the INS Category (City of Clearwater) and to rezone it to the I District (City of Clearwater). The allowable development potential in the INS category is 12.5 dwelling units per acre or a floor area ratio of 0.65, which would allow 24 dwellings units or 55,212 square feet of gross floor area to be constructed. Roadways The accepted methodology for reviewing the transportation impacts of proposed plan amendments is based on the Pinellas Planning Council's (PPC) traffic generation guidelines. The PPC's traffic generation rates have been calculated for the subject site based on the existing and proposed FLUP categories and are included in the next tables. The first table examines the maximum potential traffic of the FLUP amendment from the CG Category to the INS classification. In addition, no impact to the operational efficiency of the signalized intersections within the subject area is anticipated by the proposed amendment. Mass Transit The Citywide LOS for mass transit will not be affected by the proposed plan amendment. The total miles of fixed route service will not change; the subject site is located along an existing transit route and headways are less than or equal to one hour. Pinellas Suncoast Transit Authority (PST A) bus service is available along North Belcher Road to the east. Water The current FLUP category could use up to 4,672 gallons per day. Under the proposed FLUP categories, water demand could approach approximately 5,521 gallons per day. Solid Waste The current Commercial General FLUP category permits a variety of uses the least CG intensive, from a solid waste standpoint, a FAR 0.55 bank, would result in the production of 86 Floor Area 46,718 tons of solid waste per year. In addition, the site will be joined together with the Light of Christ Church site through a Unity of Title prior to the issuance of any building permits. Payment of an Open Space impact fee of four percent of the just market value or the most recent sales price will be required. Open Space, Recreation Land and Recreation Facility impact fees will be required if the property is ever developed with residential uses. The amount and timing of this fee is dependent on the number of developed units and will be addressed and paid during the site plan review process. Recommended Conclusions of Law Based on the findings of a traffic study submitted included in this report, the proposed FLUP amendment and rezoning will most likely not result in an increase in traffic volumes, however, any increase will not degrade the level of service of this segment of NE Coachman Road. It has also heen determined that the amendment and rezoning will not negatively affect the City's current level of service for water, wastewater, solid waste disposal or mass transit. Based on the findings above, the proposed FLUP and rezoning does not require nor affect the provision of public services in a negative manner. IMPACT ON NATURAL ENVIRONMENT [Section 4-603.F.5.] Recommended Findings of Fact No jurisdictional wetlands are located on the subject site and the site is generally bare, as it has been used as unpaved off-street parking for some time. Prior to development of the subject property, site plan approval will be required which includes a stormwater management system that meets all City and Southwest Florida Water Management District (SWFWMD) stormwater management criteria. Water quantity and quality will be controlled in compliance with the Clearwater Comprehensive Plan. Recommended Conclusions of Law The site has little vegetation and no wetlands. The natural environment of the site will be protected through the City's tree preservation and stormwater management requirements. The proposed FLUP amendment and rezoning will not result in adverse impacts on the natural environment. VI. LOCATION OF DISTRICT BOUNDARIES [Section 4-602 .F.6.] Recommended Findings of Fact: The location of the proposed I District boundary are logical based on the fact that the subject site will be joined through a Unity of Title to the site adjacent to the west which currently has a FLUP classification of INS and zoning designation of the I district. Recommended Conclusions of Law: The proposed zoning district boundaries are appropriately drawn in regard to location and classifications of streets, ownership lines, development patterns and the natural environment. VII. CONSISTENCY OF DEVELOPMENT WITH COMMUNITY DEVELOPMENT CODE AND CITY REGULATIONS [Sections 2-1001.1. & 4-602.F.1. and .2.] Recommended Findings of Fact: The existing FLUP category permits a density of 24 dwelling units per acre however, the Code does not include dwelling units as a permitted use. The existing FLUP category and zoning district permits an impervious surface ratio (ISR) of 0.95. The proposed INS future land use category and I District are less intensive. The I District permits 12.5 dwelling units per acre and an ISR of 0.65. Under the current C zoning district provisions, a minimum lot width of 100 feet and a minimum lot area of 10,000 square feet are required. Under the current I zoning district provisions, a minimum lot width of 100 feet and a minimum lot area of 20,000 square feet are required. The subject site is approximately 84,942 square feet in lot area and 130 feet in lot width. The subject will be joined through a Unity of Title with the property adjacent to the west. It is understood that approval of this land use plan amendment and zoning district designation does not guarantee the right to develop on the subject property. Transportation concurrency must be met, and the property owner will have to comply with all laws and ordinances in effect at the time development permits are requested. SUMMARY AND RECOMMENDATIONS An amendment of the FLUP Map from the Commercial General (CG) Category (County) to the Institutional (INS) Category (City of Clearwater) and a rezoning from the C-2, General Retail Commercial and Limited Services District (County) to the Institutional (1) District (City of Clearwater) is requested. The site is vacant. The site has a FLUP designation of Commercial General (CG) (County), zoning classification of C-2, General Retail Commercial and Limited Services District (County) and is included in a companion application to annex into the City of Clearwater. The applicant plans to construct a school as an accessory use to a Place of Worship adjacent to the west (Light of Christ Church). The site is held in common ownership by the Light of Christ Church. The subject site will also be joined to that adjacent property through a Unity of Title prior to the issuance of any building permits. In accordance with the Countywide Plan Rules, the FLlJP amendment is subject to approval by the Pinellas Planning Council and Board of County Commissioners acting as the Countywide Planning Authority. Based on the FLUP classification, acreage and density involved in this plan amendment, review and approval by the Florida Department of Community Affairs is not required. I. CONSISTENCY WITH CITY'S COMPREHENSIVE PLAN [Section 4-603.F.l] Recommended Findings of Fact Applicable Goals, Objectives and Policies from the Clearwater Comprehensive Plan in support of the proposed land use plan amendment are as indicated below: 2.2.1 Policy - On a continuing basis, the Community Development Code and the site plan approval process shall be utilized in promoting infill development and/or planned developments that are compatible. 2.4 Objective - Compact urban development within the urban service area shall be promoted through application of the Clearwater Community Development Code. 3.0 Goal - A sufficient variety and amount of future land use categories shall be provided to accommodate public demand and promote infill development. 5.1.1 Policy - No new development or redevelopment will be permitted which causes the level of City services (traffic circulation, recreation and open space, water, sewage treatment, garbage collection, and drainage) to fall below minimum acceptable levels. However, development orders may be phased or otherwise modified consistent with provisions of the concurrency management system to allow services to be upgraded concurrently with the impacts of development. Recommended Conclusions of Law The proposed plan amendment will result in land designated for institutional use at the intersection of Marilyn Street and NE Coachman Road adjacent to an existing place of worship and in close proximity to another school. Additionally it will enable infill development to occur without degrading the level of service of any public facility. The FLUP amendment and rezoning is compatible with the surrounding residential and institutional uses. The proposed FLUP amendment is not in conflict with any Clearwater Comprehensive Plan Goals, Objectives or Policies and is consistent with the Clearwater Comprehensive Plan. CONSISTENCY WITH COUNTYWIDE PLAN Recommended Findings of Fact The purpose of the proposed INS Future Land Use Plan category, as specified by Section 2.3.3.7.3 of the Countywide Rules, is to depict those areas of the County that are now used, or appropriate to be used, for public/semi-public institutional purposes; and to recognize such areas consistent with the need, character and scale of the institutional use relative to surrounding uses, transportation facilities, and natural resource features. The primary uses permitted within the INS category are Public Educational Facilities; Private Schools; Colleges; Hospital, Medical Clinic; Church, Religious Institution, Cemetery; Funeral HomelMortuary; SociallPublic Service Agency; Child Day Care; Fraternal, Civic Organization; Municipal Office Building, Courthouse; Library; Public Safety Facility, Emergency Medical Service Building; and Convention Center. The secondary uses permitted with in this category are Residential Uses of up to a maximum of 12.5 dwelling units per acre; Residential Equivalent uses at a ratio of three beds per one permitted dwelling unit; Recreation/Open Space; Transportation/ Utility; and Ancillary Non-Residential. The FLUP Map pattern along in the vicinity of the subject site includes institutional to the south and farther to the east and west of the site and residential to the west and southwest. Industrial uses are located to the north and office and commercial uses existing adjacent to the site to the east. There is a consistent pattern of INS designated land use fronting on NE Coachman Road. The compatibility of institutional and residential land uses is evidenced by existing land use patterns and by the fact that the Countywide Rules allow residential uses in the INS classification and institutional uses in all residential land use classifications. Recommended Conclusions of Law The proposed location of the INS future land use plan category is consistent with the purpose and locational characteristics of the Countywide Plan. III. COMPATIBILITY WITH SURROUNDING PROPERTY/CHARACTER OF THE CITY & NEIGHBORHOOD [Sections 4-602.F.2 & 4-603.F.3] Recommended Findings of Fact In the vicinity of the subject site, NE Coachman Road is a two-lane collector roadway that is controlled by traffic signals at Drew Street (south) and North Belcher Road (east). NE Coachman Road is characterized by a variety of institutional uses including a school, other places of worship, as well as offices, single-family residential and a variety of commercial uses. Primarily single- family dwellings characterize the immediate area to the southwest. Institutional, office and commercial uses are generally located along the south side of NE Coachman Road. A variety of industrial uses including warehouse and light manufacturing existing farther to the north along Palmetto Street. Offices and commercial uses existing to the north and east adjacent to the site. Recommended Conclusions of Law The proposed FLUP amendment and rezoning is compatible with surrounding uses and designations due to the similarity of land use patterns of institutional property adjagent to residential property and the site's adjacency to the property to which it will be joined through a Unity of Title. The proposed FLUP and zoning atlas amendments are compatible with surrounding properties and the character of the City and neighborhood. IV. SUFFICIENCY OF PUBLIC FACILITIES Recommended Findings of Fact As stated earlier, the overall subject site is approximately 1.95 acres in area and is presently vacant. The applicant is requesting to amend the FLUP designation of the site to the INS Category (City of Clearwater) and to rezone it to the I District (City of Clearwater). The allowable development potential in the INS category is 12.5 dwelling units per acre or a floor area ratio of 0.65, which would allow 24 dwellings units or 55,212 square feet of gross floor area to be constructed. Roadways The accepted methodology for reviewing the transportation impacts of proposed plan amendments is based on the Pinellas Planning Council's (PPC) traffic generation guidelines. The PPC's traffic generation rates have been calculated for the subject site based on the existing and proposed FLUP categories and are included in the next tables. The first table examines the maximum potential traffic of the FLUP amendment from the CG Category to the INS classification. A retail establishment was used as the test to determine the net difference between the traffic impacts between uses within the CG and INS FLUP classifications. The transportation impacts associated with this land use plan amendment will not result in the degradation of the existing LOS to the surrounding road network, as the traffic generation associated with the proposed amendment will not exceed one percent of the existing PM Peak hour trips of NE Coachman Road. In addition, no impact to the operational efficiency of the signalized intersections within the subject area is anticipated by the proposed amendment. Mass Transit The Citywide LOS for mass transit will not be affected by the proposed plan amendment. The total miles of fixed route service will not change; the subject site is located along an existing transit route and headways are less than or equal to one hour. Pinellas Suncoast Transit Authority (PST A) bus service is available along North Belcher Road to the east. Water The current FLUP category could use up to 4,672 gallons per day. Under the proposed FLUP categories, water demand could approach approximately 5,521 gallons per day. The proposed land use will not negatively affect the City's current LOS for water . Under the proposed FLUP categories, sewer demand could approach approximately 4,417 gallons per day. The proposed land use amendment will not negatively affect the City's current LOS for wastewater. Solid Waste The current Commercial General FLUP category permits a variety of uses the least intensive, from a solid waste standpoint, a bank, would result in the production of 86 tons of solid waste per year. The most intensive use, a restaurant, would produce up to 582 tons of solid waster per year. Under the proposed FLUP category, the maximum development of a school could Solid Waste generate 295 tons of solid waste per year. Site Area The proposed land use and plan amendment will not negatively affect the City's current LOS for solid waste disposal. The use of the site is proposed to be limited to a school as accessory to an existing place of worship (Light of Christ Church). In addition, the site will be joined together with the Light of Christ Church site through a Unity of Title prior to the issuance of any building permits. Payment of an Open Space impact fee of four percent of the just market value or the most recent sales price will be required. Open Space, Recreation Land and Recreation Facility impact fees will be required if the property is ever developed with residential uses. The amount and timing of this fee is dependent on the number of developed units and will be addressed and paid during the site plan review process. Recommended Conclusions of Law Based on the findings of a traffic study submitted included in this report, the proposed FLUP amendment and rezoning will most likely not result in an increase in traffic volumes, however, any increase will not degrade the level of service of this segment of NE Coachman Road. It has also been determined that the amendment and rezoning will not negatively affect the City's current level of service for water, wastewater, solid waste disposal or mass transit. Based on the findings above, the proposed FLUP and rezoning does not require nor affect the provision of public services in a negative manner. IMPACT ON NATURAL ENVIRONMENT [Section 4-603.F.5.] Recommended Findings of Fact No jurisdictional wetlands are located on the subject site and the site is generally bare, as it has been used as unpaved off-street parking for some time. Prior to development of the subject property, site plan approval will be required which includes a stormwater management system that meets all City and Southwest Florida Water Management District (SWFWMD) stormwater management criteria. Water quantity and quality will be controlled in compliance with the Clearwater Comprehensive Plan. Recommended Conclusions of Law The site has little vegetation and no wetlands. The natural environment of the site will be protected through the City's tree preservation and stormwater management requirements. The proposed FLUP amendment and rezoning will not result in adverse impacts on the natural environment. VI. LOCATION OF DISTRICT BOUNDARIES [Section 4-602 .F.6.] Recommended Findings of Fact: The location ofthe proposed I District boundary are logical based on the fact that the subject site will be joined through a Unity of Title to the site adjacent to the west which currently has a FLUP classification of INS and zoning designation of the I district. Recommended Conclusions of Law: The proposed zoning district boundaries are appropriately drawn in regard to location and classifications of streets, ownership lines, development patterns and the natural environment. VII. CONSISTENCY OF DEVELOPMENT WITH COMMUNITY DEVELOPMENT CODE AND CITY REGULATIONS [Sections 2-1001.1. & 4-602.F.1. and .2.] Recommended Findings of Fact: The existing FLUP category permits a density of 24 dwelling units per acre however, the Code does not include dwelling units as a permitted use. The existing FLUP category and zoning district permits an impervious surface ratio (ISR) of 0.95. The proposed INS future land use category and I District are less intensive. The I District permits 12.5 dwelling units per acre and an ISR of 0.65. Under the current C zoning district provisions, a minimum lot width of 100 feet and a minimum lot area of 10,000 square feet are required. Under the current I zoning district provisions, a minimum lot width of 100 feet and a minimum lot area of 20,000 square feet are required. The subject site is approximately 84,942 square feet in lot area and 130 feet in lot width. The subject will be joined through a Unity of Title with the property adjacent to the west. Both properties are currently held in common ownership. The subject property exceeds the City's minimum 1 District dimensional requirements and is therefore consistent with the Community Development Code. It is understood that approval of this land use plan amendment and zoning district designation does not guarantee the right to develop on the subject property. Transportation concurrency must be met, and the property owner will have to comply with all laws and ordinances in effect at the time development permits are requested. SUMMARY AND RECOMMENDATIONS An amendment of the FLUP Map from the Commercial General (CG) Category (County) to the Institutional (INS) Category (City of Clearwater) and a rezoning from the C-2, General Retail Commercial and Limited Services District (County) to the Institutional (1) District (City of Clearwater) is requested. The proposed designations meet the purpose and locational requirements of the Countywide Plan; the use of the property is consistent with the proposed designations; the property exceeds the minimum dimensional requirements of the Community Development Code and is consistent with the Clearwater Comprehensive Plan. It is located on the north side of NE Coachman Road approximately 240 feet west of North Belcher Road. The site is currently vacant and has a FLUP classification of Commercial General (CG) and a Pinellas County zoning designation of General Retail Commercial and Limited Services District (C-2). The applicant is requesting to amend the FLUP designation of the site to the Institutional (INS) classification and to rezone it to the Institutional (I) District in order to construct a 7,200 square foot educational facility on the site. This Future Land Use Plan (FLUP) amendment consolidates the Diocese of St. Petersburg's adjoining property, which currently is Light of Christ Catholic Church, into the same land use/ zoning categories as the subject parcel. In accordance with the Countywide Plan Rules, the FLUP amendment is subject to approval by the Pinellas Planning Council and Board of County Commissioners acting as the Countywide Planning Authority. Based on the size of the property and the classification requested, review and approval by the Florida Department of Community Affairs is not required. I. CONSISTENCY WITH CITY'S COMPREHENSIVE PLAN [Section 4-603.F.l] Recommended Findings of Fact Applicable Goals, Objectives and Policies from the Clearwater Comprehensive Plan in support of the proposed land use plan amendment are as indicated below: 2.1 Objective - The City of Clearwater shall continue to support innovative planned development and mixed land use development techniques in order to promote infill development that is consistent and compatible with the surrounding environment. 2.2.1 Policy - On a continuing basis, the Community Development Code and the site plan approval process shall be utilized in promoting infill development and/or planned developments that are compatible. 3.0 Goal - A sufficient variety and amount of future land use categories shall be provided to accommodate public demand and promote infill development. 5.1.1 Policy - No new development or redevelopment will be permitted which causes the level of City services (traffic circulation, recreation and open space, water, sewage treatment, Staff Report - Community Development Board - December 20,2005 -Case LUZ2005-09011 Page 2 e e garbage collection, and drainage) to fall below minimum acceptable levels. However, development orders may be phased or otherwise modified consistent with provisions of the concurrency management system to allow services to be upgraded concurrently with the impacts of development. The proposed educational facility is consistent and compatible with the surrounding environment and causes no degradation of levels of service in the infrastructure network of the area. Recommended Conclusions of Law The proposed plan amendment is not in conflict with any Clearwater Comprehensive Plan Goals, Objectives or Policies, and is consistent with the Clearwater Comprehensive Plan. II. CONSISTENCY WITH COUNTYWIDE PLAN Recommended Findings of Fact It is the purpose of the proposed Institutional (1) category, as specified in Section 2.3.3.7.3 of the Countywide Rules, to depict those areas of the County that are now used, or appropriate to be used, for public/semipublic institutional purposes; and to recognize such areas consistent with the need, character and scale of the institutional use relative to surrounding uses, transportation facilities, and natural resource features. This category is generally appropriate to those locations where educational, health, public safety, civic, religious and like institutional uses are required to serve the community; and to recognize the special needs of these uses relative to their relationship with surrounding uses and transportation access. The site is located in between existing Institutional uses along NE Coachman Road and existing Commercial General uses along North Belcher Road. It is also located in an area that is developed with residential uses with allowable densities ranging between 7.5 units per acre to 15 units per acre. Recommended Conclusions of Law The proposed plan amendment is consistent with the purpose and locational characteristics of the Countywide Plan; therefore, the proposed amendment is consistent with the Countywide Plan. III. COMPATIBILITY WITH SURROUNDING PROPERTY/CHARACTER OF THE CITY & NEIGHBORHOOD [Section 4-602.F.2 & 4-603.F.3] Recommended Findings of Fact A mix of single-family dwellings and commercial uses characterize the immediate area to the south. Retail and commercial businesses exist immediately to the west, along North Belcher Road. Adjacent to the east is an existing place of worship. They are compatible with surrounding uses and consistent with the character of the immediate surrounding area and neighborhood. IV. SUFFICIENCY OF PUBLIC FACILITIES Recommended Findings of Fact The overall subject site is approximately 1.95 acres in area and is presently vacant. Based on a floor area ratio of .65, as allowed in the Institutional District category, the maximum permitted floor area could be 55,212 square feet. The applicant proposes to construct a 7,200 square foot educational facility on the site.' Roadways The accepted methodology for reviewing the transportation impacts of proposed plan amendments is based on the Pinellas Planning Council's (PPC) traffic generation guidelines. Specific uses in the current and proposed zoning districts have also been analyzed for the level of vehicle trips that could be generated based on the Institute of Transportation Engineer's Manual. Therefore, very few new trips will be generated by the development of the property, the proposed plan amendment and rezoning will not result in the degradation of the existing LOS to the surrounding road network. Mass Transit The Citywide LOS for mass transit will not be affected by the proposed plan amendment. The total miles of fixed route service will not change; the subject site is located within 200 feet of an existing transit route along North Belcher Road. Water The current FLUP category (CG) could use up to 4,671 gallons per day. Under the proposed FLUP category (1), water demand could approach approximately 5,521 gallons per day. Wastewater The current FLUP category could produce up to 3,737 gallons per day. Under the proposed FLUP category, sewer demand could approach approximately 4,416 gallons per day. Solid Waste The site under the current Commercial General FLUP category is vacant. The proposed site improvements under the Institutional (1) FLUP category would result in the production of 8.8 tons of solid waste per year. Staff Report - Community Development Board - December 20,2005 -Case LUZ2005-090l1 Page 5 e e Recreation and Open Space The proposed land use plan amendment and rezoning will not impact the LOS of recreational acreage or facilities due to the proposed non-residential land use. Recommended Conclusions of Law Based on the fact that the educational/daycare facility is currently operated on the adjacent Light of Christ Church site and the new facility will only replace the existing portable buildings, the proposed FLUP designation generally will generate the same amount of traffic as the portable units. Furthermore the proposed amendment will generate less traffic than uses allowed in the existing CG category, therefore the proposed FLUP amendment and rezoning will not degrade the LOS of the surrounding road network. It will also not negatively affect the City's current LOS for water, wastewater, solid waste disposal or mass transit. V. IMPACT ON NATURAL ENVIRONMENT [Section 4-603.F.5.] Recommended of Findings of Fact Based on current information, no wetlands appear to be located on the subject site and the site is cleared and used as overflow parking. Prior to development of this property, site plan approval will be required. At that time, tree preservation requirements will be addressed and the stormwater management system will be required to meet all City and Southwest Florida Water Management District (SWFWMD) stormwater management criteria. Water quantity and quality will be controlled in compliance with the Clearwater Comprehensive Plan. Recommended Conclusions of Law The site is cleared and no wetlands appear to be located on the subject site. The natural environment of the site will be protected through the City's tree preservation and stormwater management requirements. VI. LOCATION OF DISTRICT BOUNDARIES [Section 4-602 .F.6.] Recommended Findings of Fact The location of the proposed Institutional (1) District boundaries is consistent with the boundaries of the subject site. The site is rectangular in shape and currently cleared with no improvements. The proposed amendment consolidates this site with the applicants adjoining property under the same Future Land Use and zoning categories. The proposed boundaries are logical and merge this site into the appropriate zoning district. The proposed Institutional (I) District is compatible with the existing Office (0) District to the north, the Commercial (C) District to the east and the Institutional (1) Districts to the south and west. Recommended Conclusions of Law The district boundaries are appropriately drawn in regard to location and classifications of streets, ownership lines, existing improvements and the natural environment. CONSISTENCY OF DEVELOPMENT WITH COMMUNITY DEVELOPMENT CODE AND CITY REGULATIONS [Sections 2-303 & 4-602.F.1. and .2.] Recommended Findings of Fact The existing C-2 zoning district permits a variety of office uses at aFAR of 0.55 and an impervious surface ratio (lSR) of 0.90. The subject site has a lot width of 135 feet and a lot area of 84,942 square feet. It exceeds the minimum lot width requirement of 200 feet and the lot area requirement of 40,000 square feet of the Institutional (I) zoning district. Allowable uses in the Institutional (I) district include assisted living facilities, cemeteries, congregate care, educational facilities, government uses, hospitals, nursing homes and places of worship. Recommended Conclusions of Law The proposed use of the subject site is consistent with the uses allowed in the Institutional (I) zoning district and the site exceeds minimum lot width and area requirements of the District. Approval of this land use plan amendment and zoning district designation does not guarantee the right to develop on the subject property. Transportation concurrency must be met, and the property owner will have to comply with all laws and ordinances in effect at the time development permits are requested. SUMMARY AND RECOMMENDATIONS An amendment of the FLUP from the Commercial General (CG) category to the Institutional (I) category and a rezoning from the County C-2 District to the Institutional (I) District for the subject site is requested. This 1.95-acre site exceeds the minimum requirements for the proposed use of the property as a religious/educational facility. The neighborhood is characterized by offices to the north, commercial uses to the east and institutional uses to the west and south. The proposed future land use plan amendment and rezoning is compatible with the existing neighborhood. The proposed Institutional (I) Future Land Use Plan classification and Institutional (I) zoning district is consistent with both the City and the Countywide Comprehensive Plans, is compatible with the surrounding area, does not require nor affect the provision of public services, is compatible with the natural environment and is consistent with the development regulations of the City. L FINDINGS Based on the background data and analysis in this report, the following findings are submitted for consideration of the recommendation for approval: A. The proposed changes are consistent with the overall objectives of the City's Beach by Design Redevelopment Plan (also referred to by the Countywide Rules as a Special Area Plan), and maintains the essential relationship between the individual districts within the Special Area plan. B. The changes are consistent with the Countywide Rules and will maintain consistency with the Updated Countywide Plan for Pinellas County (The Countywide Plan). C. The submittal satisfies the requirements of the Countywide Rules, and a condition placed upon the original approval of the amendment adding the Community Redevelopment District designation to the area as part of Case #CW 01-25, that requires the City to submit any amendment to the Beach by Design Special Area Plan to the PPC and CPA for review and consideration based on the nature of the change. FINDINGS Based on the background data and analysis in this report, the following findings are submitted for consideration of the recommendation for approval of the amendment request: A. The proposed amendment is consistent with Division 5.3, Section 5.3.4 of the Rules Concerning the Administration of the Countywide Future Land Use Plan (Countywide Rules), the purpose of which is to recognize and provide for Level 1 subthreshold amendments of the Countywide Plan Map. B. Sections 5.3.5.1 through 5.3.5.6 of the Countywide Rules define the Relevant Countywide Considerations as review criteria for a Level 1 subthreshold amendment. In the event that the amendment does not involve and is determined to be outside the purview of any of the enumerated Relevant Countywide Considerations, such amendment shall be considered and processed as a subthreshold amendment. in consideration of and based upon these findings, it is recommended that the proposed amendment be approved. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pinellas County, Florida, acting as the Countywide Planning Authority in regular meeting duly assembled on May 2, 2006, as follows: Section 1 - Amending the Countywide Future Land Use Plan The Countywide Future Land Use Plan for Pinellas County adopted in Section 3(a) of Ordinance 89-4 is amended to reflect the changes adopted as follows: #CW 06-24 1.8 acres located on the north side ofNE Coachman Road, approximately 170 feet west of Belcher Road, from Commercial General to Institutional. Section 2. Severability If any Section, Subsection, sentence, clause, phrase, or provision of this Ordinance is for any reason held invalid or unconstitutional by a Court of Competent Jurisdiction, such holding shall not be construed to render the remaining provisions of this Ordinance invalid or unconstitutional. Section 3. Effectiveness of Plan Action The Plan desigp.ations of this Ordinance do not go into effect until the comparable local comprehensive plan designation is approved by the local jurisdiction. e .
