speak at the meeting, please wait to be recognized, then state and spell your name and provide your address. Persons
without party status speaking before the COB shall be limited to three minutes unless an individual is representing a group
in which case the Chairperson may authorize a reasonable amount of time up to 10 minutes. The Community
Development Board will review the case and make a recommendation to the City Council for final disposition.
Five days prior to the COB meeting, staff reports and recommendations on the above requests will be available for review
by interested parties between the hours of 8:30 a.m. and 4:30 p.m., weekdays, at the City of Clearwater, Planning

Interested parties may appear and be heard at the hearing or file written notice of approval or objection with the Planning
Director or City Clerk prior to the hearing. Any person who decides to appeal any decision made by the Board or Council,
with respect to any matter considered at such hearings, will need to request a record of the proceedings and, for such
purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based per Florida Statute 286.0105. Community Development Code Sec 4-206
states that party status shall be granted by the Board in quasi-judicial cases if the person requesting such status
demonstrates that slhe is substantially affected. Party status entitles parties to personally testify, present evidence,
argument and witnesses, cross-examine witnesses, appeal the decision and speak on reconsideration requests, and needs
to be requested and obtained during the case discussion before the CDB.
An oath will be administered swearing in all persons giving testimony in quasi-judicial public hearing cases. If you wish to
speak at the meeting, please wait to be recognized, then state and spell your name and provide your address. Persons
without party status speaking before the CDB shall be limited to three minutes unless an individual is representing a group
in which case the Chairperson may authorize a reasonable amount of time up to 10 minutes. The Community
Development Board will review the case and make a recommendation to the City Council for final disposition.
Five days prior to the CDB meeting, staff reports and recommendations on the above requests will be available for review
by interested parties between the hours of 8:30 a.m. and 4:30 p.m., weekdays, at the City of Clearwater, Planning

COUNTY, CW 06-42 OF ST. PETERSBURG, AND CASE CW 06-45 OF CLEARWATER.
Summary Explanation/Backaround:
The Board has received three proposed subthreshold amendments to the FLUP that have been reviewed by the
Pinellas Planning Council (PPC or Council). These are as follows:
Item a is Case CW 06-41, which is a submittal by Pinellas County. This is a 0.2-acre proposal located on the
southwest corner of 54th Avenue and 69th Street North. The proposal is to go from Residential Urban (up to 7 1/2
units an acre) to ResidentiallOffice General. The proposal is to redevelop the lot by replacing the existing office with
a new office building. County staff concurs with the PPC recommendation of approval.
Item b is Case CW 06-42, which is a submittal by the City of St. Petersburg. This is a 2.1-acre proposal located on
the south side of Savona Drive Northeast between Plaza Comercio and San Merino Boulevard Northeast. The
property is owned by Pinellas County and the proposal is to go from Residential Urban (up to 7112 units an acre) to
Water/Drainage Feature and Preservation. The proposal would recognize the site's existing drainage facility and
wetland mitigation area associated with the recent construction of Savona Drive. County staff concurs with the PPC
recommendation of approval.
Item c is Case CW 06-45, which is a submittal by the City of Clearwater. This is a 0.5-acre proposal located on the
southeast corner of Howard Street and Martin Luther King Jr. Boulevard. The proposal is to go from Commercial
General to Residential Urban (up to 7 1/2 units an acre). The property is currently vacant and the proposed use is
for affordable housing consisting of four single-family detached homes. County staff concurs with the PPC
recommendation of approval.

Case CW 06-45 - Clearwater - Mr. Brinson stated that this 0.5-acre site is located
on the southeast comer of Howard Street and Martin Luther King Jr. Boulevard.
The proposed amendment is a request to change the plan designation from
Commercial General - CG to Residential Urban - RU. This amendment qualifies
as a "Type A" Subthreshold amendment, based on the amendment being one acre
or less in size, and is therefore eligible for approval under the official acceptance
process.
This amendment will allow for the development of four single-family detached
homes. Mr.. Brinson stated that the current Commercial General designation
would allow up to 24 residential units per acre on the site, however the City's
regulations do not allow residential uses; therefore, the request is for the
Residential Urban category.
Gina Clayton added that this application IS related to an affordable housing
project.
Rick MacAulay moved approval of the staff recommendation of approval; the
motion was seconded by Jim Miller, and approved (Vote 12-0).

WHEREAS, a proposed amendment to the Countywide Future Land Use Plan, which is
an element of the Countywide Comprehensive Plan of Pinellas County, Florida, has been
presented at a public hearing to the Board of County Commissioners in their capacity as the
Countywide Planning Authority; and
WHEREAS, notices of public hearings have been accomplished as required by Chapter
73-594, Laws of Florida, as amended; and
WHEREAS, procedures of the Special Act and County Charter have been followed
concerning the Pinellas Planning Council and the Countywide Planning Authority for proposed
amendment to the Countywide Future Land Use Plan; and
WHEREAS, the City of Clearwater initiated a proposed amendment which was
considered at a public hearing by the Pinellas Planning Council on October 18, 2006, with
recommendation made by the Council that is documented in the Council report referred to as
Exhibit A; and
WHEREAS, the Board has conducted a public hearing and taken action that is
documented by ordinance for approvals or partial approvals and partial denials and by resolution
for denials, with both documents including the relevant Council reports as attached.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of
Pinellas County, Florida, acting as the Countywide Planning Authority in regular meeting duly
assembled on November 7, 2006, as follows:
Section I - Amending the Countywide Future Land Use Plan
The Countywide Future Land Use Plan for Pinellas County adopted in Section 3(a) of
Ordinance 89-4 is amended to reflect the changes adopted as follows:
#CW 06-45 0.5 acre located on the southeast corner of Howard Street and Martin
Luther King Jr. Boulevard, from Commercial General to Residential
Urban.
Section 2.
Severability
If any Section, Subsection, sentence, clause, phrase, or
provision of this Ordinance is for any reason held invalid or unconstitutional by a Court of
Competent Jurisdiction, such holding shall not be construed to render the remaining provisions
of this Ordinance invalid or unconstitutional.
Section 3.
Effectiveness of Plan Action
The Plan designations of this Ordinance do
not go into effect until the comparable local comprehensive plan designation is approved by the
local jurisdiction.
Section 4.
Filing of Ordinance~ Effective Date A certified copy of this ordinance shall be
filed with the Secretary of State with the Ordinance and Exhibit A to be filed with Clerk of the
Circuit Court. This Ordinance shall take effect upon filing with the Department of State.

1. FINDINGS
Based on the background data and analysis in this report, the following fmdings are submitted
for consideration of the recommendation for approval of the amendment request:
A. The proposed amendment is consistent with Division 5.3, Section 5.3.4 of the Rules
Concerning the Administration of the Countywide Future Land Use Plan (Countywide
Rules), the purpose of which is to recognize and provide for "Type A" subthreshold
amendments of the Countywide Plan Map.
B. In particular, this amendment qualifies as a "Type A" subthreshold amendment, based on the
amendment being one acre or less in size, and is therefore eligible for approval under the
official acceptance process.
In consideration of and based upon these findings, it is recommended that the proposed
amendment be approved.
PINELLAS PLANNING COUNCIL ACTION:
10/18/06: The Council recommended approval of the amendment from Commercial General
to Residential Urban (vote 13-0).

This amendment has been submitted by Clearwater to the Council for Official Acceptan,ce in

Subthreshold Type - "A"
Section 5.3.4.1- of the Countywide Rules defmes a "Type A" subthreshold amendment as an
amendment of one acre or less, irrespective of the plan classification or category from which
and to which the amendment is sought.
"Type A" subthreshold amendments are subject to an annual aggregation limit of thirty acres.
Combined with previous subthreshold amendments, the City's total for the year 2006 is 7.5
acres.
Subthreshold Amendment Review Policy
It is the policy of the Council, consistent with the purpose, procedure and threshold
determinants of the Countywide Rules, that subthreshold amendments will be removed from
the official acceptance procedure only for substantive reasons related to the Countywide Plan
and Rules.
Local Government Transmittal:
On September 21, 2006, Clearwater's City Council acting as the applicant local government,
gave approval to amend the City's Future Land Use Map and authorized an application for
amendment of the Countywide Plan Map

WHEREAS, a proposed amendment to the Countywide Future Land Use Plan, which is
an element of the Countywide Comprehensive Plan of Pinellas County, Florida, has been
presented at a public hearing to the Board of County Commissioners in their capacity as the
Countywide Planning Authority; and
WHEREAS, notices of public hearings have been accomplished as required by Chapter
73-594, Laws of Florida, as amended; and
WHEREAS, procedures of the Special Act and County Charter have been followed
concerning the Pinellas Planning Council and the Countywide Planning Authority for proposed
amendment to the Countywide Future Land Use Plan; and
WHEREAS, the City of Clearwater initiated a proposed amendment which was
considered at a public hearing by the Pinellas Planning Council on October 18, 2006, with
recommendation made by the Council that is documented in the Council report referred to as
Exhibit A; and
WHEREAS, the Board has conducted a public hearing and taken action that is
documented by ordinance for approvals or partial approvals and partial denials and by resolution
for denials, with both documents including the relevant Council reports as attached.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of
Pinellas County, Florida, acting as the Countywide Planning Authority in regular meeting duly
assembled on November 7, 2006, as follows:
Section 1 - Amending the Countywide Future Land Use Plan
The Countywide Future Land Use Plan for Pinellas County adopted in Section 3(a) of
Ordinance 89-4 is amended to reflect the changes adopted as follows:
#CW 06-45 0.5 acre located on the southeast comer of Howard Street and Martin
Luther King Jr. Boulevard, from Commercial General to Residential
Urban.
Section 2.J,
Severability
If any Section, Subsection" sentence, clause, phrase, or
provision of this Ordinance IS for any reason held invalid or unconstitutional by a Court of
Competent Jurisdiction, such holding shall not be construed to render the remaining provisions
of this Ordinance invalid or unconstitutional.
Section 3.
Effectiveness of Plan Action
The Plan designations of this Ordinance do
not go into effect until the comparable local comprehensive plan designation is approved by the
local jurisdiction.
Section 4.
Filing of Ordinance; Effective Date A certified copy of this ordinance shall be
filed with the Secretary of State with the Ordinance and Exhibit A to be filed with Clerk of the
Circuit Court. This Ordinance shall take effect upon filing with the Department of State.

L FINDINGS
Based on the background data and analysis in this report, the following findings are submitted
for consideration of the recommendation for approval of the amendment request:
A. The proposed amendment is consistent with Division 5.3, Section 5.3.4 of the Rules
Concerning the Administration of the Countywide Future Land Use Plan (Countywide
Rules), the purpose of which is to recognize and provide for "Type A" subthreshold
amendments of the Countywide Plan Map.
B. In particular, this amendment qualifies as a "Type A" subthreshold amendment, based on the
amendment being one acre or less in size, and is therefore eligible for approval under the
official acceptance process.
In consideration of and based upon these findings, it is recommended that the proposed
amendment be approved.

II. BACKGROUND
This amendment has been submitted by Clearwater to the Council for Official Acceptance in
accordance with the Countywide Rules. This amendment from Commercial General to
Residential Urban will allow for the development of four affordable single-family detached
homes.

It should be noted, that under the Countywide Rules the current Commercial General
designation would allow up to 24 residential units per acre on the site, however the City's
regulations are more restrictive and do not allow residential uses, that is why the request for the
Residential Urban Countywide Plan Map category.
Subthreshold Type - "A"
Section 5.3.4.1 of the Countywide Rules defines a "Type A" subthreshold amendment as an
amendment of one acre or less, irrespective of the plan classification or category from which
and to which the amendment is sought.
"Type A" subthreshold amendments are subject to an annual aggregation limit of thirty acres.
Combined with previous subthreshold amendments, the City's total for the year 2006 is 7.5
acres.
Subthreshold Amendment Review Policy
It is the policy of the Council, consistent with the purpose, procedure and threshold
determinants of the Countywide Rules, that subthreshold amendments will be removed from
the official acceptance procedure only for substantive reasons related to the Countywide Plan
and Rules.
Local Government Transmittal:
On September 21, 2006, Clearwater's City Council acting as the applicant local government,
gave approval to amend the City's Future Land Use Map and authorized an application for
amendment of the Countywide Plan Map

ANALYSIS:
This Future Land Use Plan (FLUP) amendment and rezoning application involves one parcel of
land, approximately 0.476 acres in area located on the southeast comer of Martin Luther King Jr.
Avenue and Howard Street. The site is currently vacant. The site has a FLUP designation of
Commercial General (CG) and is within the Commercial (C) District. The applicant is
requesting to amend the FLUP designation of the site to the Residential Urban (RU)
classification and to rezone it to the Medium Density Residential (MDR) District in which
single-family detached dwellings are a permitted use.
In accordance with the Countywide Plan Rules, the land use plan amendment is subject to
approval by the Pinellas Planning Council and Board of County Commissioners acting as the
Countywide Planning Authority.
I. CONSISTENCY WITH CITY'S COMPREHENSIVE PLAN [Section 4-603.F.l]
Recommended Findings of Fact:
Applicable Goals, Objectives and Policies from the Clearwater Comprehensive Plan in support
of the proposed land use plan amendment are as indicated below:
16.4 Objective - The City of Clearwater shall continue to provide zoning and land use
regulations that allow for the development and redevelopment of affordable housing in
stable neighborhoods.
2.1 Objective - The City of Clearwater shall continue to support innovative planned
development and mixed land use development techniques in order to promote infill
development that is consistent and compatible with the surrounding environment.
2.2.1 Policy - On a continuing basis, the Community Development Code and the site plan
approval process shall be utilized in promoting infill development and/or planned
developments that are compatible.
3.0 Goal - A sufficient variety and amount of future land use categories shall be provided to
accommodate public demand and promote infill development.
Recommended Conclusions of Law:
The proposed plan amendment is not in conflict with any Clearwater Comprehensive Plan Goals,
Objectives or Policies, and is consistent with the Clearwater Comprehensive Plan.

II. CONSISTENCY WITH COUNTYWIDE PLAN
Recommended Findings of Fact:
The purpose of the proposed Residential Urban (RU) category, as specified in Section 2.3.3.1.5
of the Countywide Rules, is to designate areas in the County that are now developed, or
appropriate to be developed, in an urban low density residential manner; and to recognize such
areas as primarily well-suited for residential uses that are consistent with the urban qualities and
natural resource characteristics of such areas. The Residential Urban (RU) category is generally
appropriate to locations removed from, but in close proximity to urban activity centers; in areas
where use and development characteristics are urban residential in nature; and in areas serving as
a transition between more suburban and more urban residential areas. These areas are generally
served by and accessed from minor and collector roadways, which connect to the arterial and
thoroughfare highway network. This property is in close proximity to other residential uses and
recreational areas. Therefore, the proposed use of the property is consistent with the purposes of
the Residential Urban (RU) category that permits single-family detached dwellings.
Recommended Conclusions of Law:
The proposed plan amendment is consistent with the purpose and locational characteristics of the
Countywide Plan and is consistent with the provisions set forth in the Residential Urban
Category.
III. COMPATIBILITY WITH SURROUNDING PROPERTY/CHARACTER OF THE
CITY & NEIGHBORHOOD [Sections 4-602.F.2 & 4-603.F.3]
Recommended Findings of Fact:
A variety of residential uses characterize the immediate area on all sides including a park and
recreational open space uses to the north. The proposed FLUP designation and rezoning are in
character with the overall FLUP designation in the area and are compatible with surrounding
uses.
Recommended Conclusions of Law:
The proposed plan and zoning atlas amendments are compatible with surrounding properties and
the character of the City and neighborhood.
IV. SUFFICIENCY OF PUBLIC FACILITIES
Recommended Findings of Fact:
The overall subject site is approximately 0.476 acres in area and is presently vacant. The
applicant is requesting to amend the FLUP designation of the site to the Residential Urban (RU)
classification and to rezone it to the Medium Density Residential (MDR) District. The applicant
is proposing to construct 4 low income single-family homes on the site. The allowable
development potential in the Residential Urban (RU) category is 7.5 units per acre.

The accepted methodology for reviewing the transportation impacts of proposed plan
amendments is based on the Pinellas Planning Council's (PPC) traffic generation guidelines.
The PPC's traffic generation rates have been calculated for the subject site based on the existing
and proposed FLUP categories and are included in the next table that examines the maximum
potential traffic of the future land use plan amendment from the Commercial General (CG) to the
Residential Urban (RU) classification.

Based on the 2005 Pinellas County Metropolitan Planning Organization (MPO) Level of Service
Report, the segment of Martin Luther King Jr. A venue from Belleair Road to Lakeview Road has
a LOS ofD. The proposed FLUP category of Residential Urban (RU) would decrease PM peak
hour traffic on this segment of Martin Luther King Jr. Avenue by a total of 17 trips. The traffic
generated by this plan amendment is projected to decrease and will not result in the degradation
of the existing LOS to the surrounding road network.
Specific uses in the current and proposed zoning districts have also been analyzed for the level of
vehicle trips that could be generated based on the Institute of Transportation Engineer's Manual.

The City of Clearwater Engineering Department has concluded that the transportation impacts
associated with this land use plan amendment will not result in the degradation of the existing
LOS to the surrounding road network, as the traffic generation associated with the proposed
amendment is a reduction in trips and will generate only 4 PM peak hour trips and will not
change the LOS in that section of Martin Luther King Jr. Avenue if the site. In addition, no
impact to the operational efficiency of the signalized intersections within the subject area is
anticipated by the proposed amendment.
Mass Transit
The Citywide LOS for mass transit will not be affected by the proposed plan amendment. The
total miles of fixed route service will not change; the subject site is located along an existing
transit route and headways are less than or equal to one hour. Pinellas Suncoast Transit
Authority (PST A) bus service is available along Martin Luther King Jr. Avenue.
Water
The current FLUP category could use up to 1153 gallons per day. Under the proposed FLUP
categories, water demand could approach approximately 1000 gallons per day. The proposed
future land use plan amendment will not negatively affect the City's current LOS for water.
Wastewater
The current FLUP category could produce up to 922 gallons per day. Under the proposed FLUP
categories, sewer demand could approach approximately 800 gallons per day. The proposed
future land use plan amendment will not negatively affect the City's current LOS for wastewater.

Solid Waste
The current Commercial General FLUP category would result in the production of 58 tons of
solid waste per year. Under the proposed FLUP category, the proposed housing could generate
10 tons of solid waste per year. The proposed land use and plan amendment will not negatively
affect the City's current LOS for solid waste disposal.
Recreation and Open Space
The proposed future land use plan and zoning designations will permit the development of up to
4 detached dwelling units. Open Space, Recreation Land and Recreation Facility impact fees
will be required when the property is developed with residential uses. The amount and timing of
this fee is dependent on the number of developed units and will be addressed and paid during the
site plan review process.
Recommended Conclusions of Law:
Based on the allowable uses and density of the proposed future land use plan amendment the
traffic generated by this plan amendment will not result in the degradation of the existing LOS to
the surrounding road network or the operational efficiency of the signalized intersections.
Additionally, the amendment and rezoning will not negatively affect the City's current level of
service for mass transit, water, wastewater, solid waste, or recreation and open space. Based on
the findings above, the proposed FLUP and rezoning does not require nor affect the provision of
public services in a negative manner.
V. IMPACT ON NATURAL ENVIRONMENT [Section 4-603.F.5.]
Recommended Findings of Fact:
Development upon the site will require site plan approval. At that time, the stormwater
management system will be required to meet all City and Southwest Florida Water Management
District (SWFWMD) stormwater management criteria.
Recommended Conclusions of Law:
Water quantity and quality will be controlled in compliance with the Clearwater Comprehensive
Plan. As there are no wetlands on the subject site that could be impacted by future development,
the natural environment will not be affected adversely.
VI. LOCATION OF DISTRICT BOUNDARIES [Section 4-602 .F.6.]
Recommended Findings of Fact:
The location of the proposed Medium Density Residential (MDR) District boundaries are logical
based on the use of this property, and this rezoning will consolidate this site into the appropriate
zoning district. It will blend into the existing Medium Density Residential (MDR) District to the
south.
Recommended Conclusions of Law:
The district boundaries are appropriately drawn in regard to location and classifications of streets
and ownership lines.

VII. CONSISTENCY OF DEVELOPMENT WITH COMMUNITY DEVELOPMENT
CODE AND CITY REGULATIONS [Sections 2-701.1 & 4-602.F.1. and .2.]
Recommended Findings of Fact:
The existing future land use plan category and zoning district permit a floor area ratio of 0.55 and
an impervious surface ratio (ISR) of 0.95. The proposed Residential Urban (RU) land use
category and Medium Density Residential (MDR) district permits a floor area ratio of 0040 and
an ISR of 0.65. Under the proposed Medium Density Residential (MDR) zoning district
provisions, a minimum lot width of 50 feet and a minimum lot area of 5,000 square feet are
required. The size ofthe subject site is 20,976 square feet in area and is 104 feet in width.
Recommended Conclusions of Law:
The proposed use of this property as residential is consistent with the uses allowed as part of a
Level One Minimum Standard Development use in the Medium Density Residential (MDR)
zoning district. The subject property exceeds the City's minimum Medium Density Residential
(MDR) District's dimensional requirements and is therefore consistent with the Community
Development Code.
Approval of this land use plan amendment and zoning district designation does not
guarantee the right to develop on the subject property. Transportation concurrency must be
met, and the property owner will have to comply with all laws and ordinances in effect at the
time development permits are requested.
SUMMARY AND RECOMMENDATIONS
An amendment of the FLUP from the Commercial General (CG) category to the Residential
Urban (RU) category and a rezoning from the Commercial (C) District to the Medium Density
Residential (MDR) District for the subject site is requested. This OA76-acre site exceeds the
minimum requirements for the Medium Density Residential District and the proposed future land
use plan amendment and rezoning is compatible with the existing neighborhood, which consists
of single-family residential dwellings to the south and west, office uses to the east, and open-
space/recreational uses to the north. The proposed changes are in conformance with the
Clearwater Comprehensive Plan.

The Planning Department recommends the following actions on the request based on the
recommended findings of fact and recommended conclusions of law:
a) Recommend APPROVAL of the Future Land Use Plan amendment from the Commercial

COUNTYWIDE FUTURE LAND USE PLAN MAP
The Pinellas Planning Council (PPC) and the Board of County Commissioners, in
their capacity as the Countywide Planning Authority (CPA), will conduct public
hearings on proposed map amendments to the "Countywide Future Land Use Plan
for Pinellas County" (Countywide Plan Map), pursuant to the "Rules Concerning the
Administration of the Countywide Future Land Use Plan," as amended (Countywide
Rules), as set forth in the listing below.
The PPC public hearinQ will be held on Wednesday, October 18, 2006, at 1:00 PM.
The CPA public hearing will be held on Tuesday, November 7,2006, at 9:30 AM.
Both hearings are in the Board of County Commissioners Assembly Room, 5th Floor,
Pinellas County Courthouse, 315 Court Street, Clearwater, Florida.
The PPC will make a recommendation to the CPA on the proposed amendments to the
Countywide Plan Map as listed below, or to other plan categories as determined
appropriate in accordance with Chapter 88-464, Laws of Florida, as amended, and the
Countywide Rules.
Any amendment that qualifies as a subthreshold amendment will be considered under the
official acceptance process and will be approved by the PPC and CPA as subthreshold,
unless by majority vote of either board, it is removed from the subthreshold portion of the
agenda and continued for consideration as a regular amendment at the same or a
subsequent meeting. Any member of the public or interested person may be heard at the
public hearings with respect to a request to remove a subthreshold amendment for
consideration as a regular amendment.
The proposed Countywide Plan Map amendments are listed as follows:
1) CW 06-41 - Submitted by Pinellas County - 0.2 acres
Current Category: Residential Urban
Proposed Category: Residential/Office General
Located on the southwest corner of 54th Avenue and 69th Street
North.
The proposed Residential/Office General category is used to depict areas
appropriate for office, mixed use, and/or medium density residential use
(maximum residential density of 15 dwelling units per acre). The current
Residential Urban category is used to depict areas that are primarily well-
suited for low density residential uses at a maximum density of 7.5 dwelling
units per acre. The amendment area is developed with an office.

CW 06-42 - Submitted by St. Petersburg - 2.1 acres
Current Category: Residential Urban
Proposed Categories: Water/Drainage Feature and Preservation
Located on the south side of Savona Drive Northeast, between Plaza
Comercio and San Merino Boulevard Northeast.
The proposed Water/Drainage Feature category is used to depict areas that
include water bodies and drainage features, or that are proposed for such
uses. The proposed Preservation category is used to depict natural areas
worthy of preservation. The current Residential Urban category is used to
depict areas that are primarily well-suited for low density residential uses at a
maximum density of 7.5 dwelling units per acre. The amendment area
contains a retention pond and a preservation area.

3) CW 06-43 - Submitted by Pinellas Park - 2.3 acres
Current Categories: Residential Urban and Residential Medium
Proposed Category: Institutional
Located on the south side of Park Boulevard, approximately 600 feet
west of 66th Street North.
The proposed Institutional category is used to depict areas appropriate for
public/semi-public institutional use (Le., public and private schools, hospitals,
clinics, churches, day care, libraries, etc.). The current Residential Urban
category is used to depict areas that are primarily well-suited for low density
residential uses at a maxirnum density of 7.5 dwelling units per acre. The
current Residential Medium category is used to depict areas that are primarily
well-suited for medium density residential uses at a maximum density of 15
dwelling units per acre. The amendment area is vacant.
4) CW 06-44 - Submitted bv LarQo - 306.5 acres
Current Categories: Residential Urban, Residential Urban with
Water/Drainage Feature, Residential low Medium, Residential Medium,
Residential Medium with Water/Drainage Feature, Institutional, Water,
Residential/Office General, Commercial General, Community
Redevelopment District, Residential/Office/Retail, Industrial limited, and
Recreation/Open Space
Proposed Category: Community Redevelopment District
Located along the east and west sides of Clearwater-Largo Road, east of
the Pinellas Trail, west of the CXS Railroad tracks, south of South Fort
Harrison Avenue, and north of 4th Avenue Northwest.
The proposed Community Redevelopment District category is used to depict
areas appropriate for community centers and neighborhoods, including their
redevelopment, in accord with a special area plan. The uses and their
respective densities and intensities, are included within the special area plan
and the City's Future Land Use Element. The existing categories offer a wide
range of residential and non-residential uses at varying densities and

Current Category: Commercial General
Proposed Category: Residential Urban
Located on the southeast corner of Howard Street and Martin Luther
King Jr. Boulevard.
The proposed Residential Urban category is used to depict areas that are
primarily well-suited for low density residential uses at a maximum density of
7.5 dwelling units per acre. The current Commercial General category is used
to depict areas appropriate for uses providing community and countywide
commercial goods and services. The amendment area is vacant.
The details of the proposed amendments are available at the office of the PPC, 600

8250. Also, more detailed lists of potential uses associated with each Countywide
Plan Map category are available by accessing the Countywide Rules on our website

are invited to attend the hearings to present facts or express views on the cases
shown in this advertisement.
The public is hereby advised that the effect of any proposed amendment may
significantly impact the type and intensity of use of the subject property and may be
of interest to neighboring property owners. The PPC will make an advisory
recommendation to the CPA for approval, approval with modification or conditions,
denial, denial with alternative recommendations, or continuance of the items. The
recommendation by the ppC and the action of the CPA may amend the Countywide
Plan Map from the existing plan category to the proposed plan category as
referenced above for the amendment, or to another plan category as may be
determined appropriate based on the public hearings and consistent with the
Countywide Plan, Countywide Rules and procedures related thereto.
If a person substantially affected decides to request an administrative hearing
based on a decision to deny the request at any of these hearings, they will
need a record of the proceedings and, for such purpose, may need to ensure
that a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the petition for the hearing is to be based.

PUBLIC HEARING PROCEDURES
Public Hearings before the Pinellas Planning Council are governed by Pinellas
Planning Council Resolution No. 96-2 which is outlined on the reverse side.
Becaus~ this process encourages and provides for testimony to be, submitted in
writing in advance of the hearing, the following guidelines are expected to be
sufficient to accommodate efficient presentations:
· The applicant should complete their presentation in ten (10) minutes.
· Persons who have been authorized to represent an organization or group
of five (5) or more persons should limit their presentation to ten (10)
minutes. It is expected that others in the organization or group will waive
their time.
· All other persons may speak lip to a total of three (3) minutes each.
The Planning Council procedure provides that, at the conclusion of each of the

Interested parties may appear and be heard at the hearing or file written notice of approval or objection with the Planning
Director or City Clerk prior to the hearing. Any person who decides to appeal any decision made by the Board or Council,
with respect to any matter considered at such hearings, will need to request a record of the proceedings and, for such
purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based per Florida Statute 286.0105. Community Development Code Sec 4-206
states that party status shall be granted by the Board in quasi-judicial cases if the person requesting such status
demonstrates that slhe is substantially affected. Party status entitles parties to personally testify, present evidence,
argument and witnesses, cross-examine witnesses, appeal the decision and speak on reconsideration requests, and needs
to be requested and obtained during the case discussion before the CDB.
An oath will be administered swearing in all persons giving testimony in quasi-judicial public hearing cases. If you wish to
speak at the meeting, please wait to be recognized, then state and spell your name and provide your address. Persons
without party status speaking before the CDB shall be limited to three minutes unless an individual is representing a group
in which case the Chairperson may authorize a reasonable amount of time up to 10 minutes. The Community
Development Board will review the case and make a recommendation to the City Council for final disposition.
Five days prior to the CDB meeting, staff reports and recommendations on the above requests will be available for review
by interested parties between the hours of 8:30 a.m. and 4:30 p.m., weekdays, at the City of Clearwater, Planning

application from the City of Clearwater for amendment of the Countywide Future Land
Use Plan. The Council recommended approval of case CW 06-45, as noted on page 1 of
the accompanying agenda memorandum.
This amendment will be considered, including the recommendation of the PPC, by the
Board of County Commissioners, in their capacity as the Countywide Planning Authority
(CPA), on November 7, 2006 at 9:30 a.m.

RECOMMENDATION:
Council, Based on Accompanying Findings (LA & B), Recommend to the Countywide
Planning Authority That The Proposed Type A Subthreshold Amendment To Residential
Urban Be Approved Pursuant To The Official Acceptance Process.
1. FINDINGS
Based on the background data and analysis in this report, the following findings are submitted
for consideration of the recommendation for approval of the amendment request:
A. The proposed amendment is consistent with Division 5.3, Section 5.3.4 of the Rules
Concerning the Administration of the Countywide Future Land Use Plan (Countywide
Rules), the purpose of which is to recognize and provide for "Type A" subthreshold
amendments of the Countywide Plan Map.
B. In particular, this amendment qualifies as a "Type A" subthreshold amendment, based on the
amendment being one acre or less in size, and is therefore eligible for approval under the
official acceptance process.
In consideration of and based upon these findings, it is recommended that the proposed
amendment be approved.
PINELLAS PLANNING COUNCIL ACTION:
10/18/06: The Council recommended approval of the amendment from Commercial General
to Residential Urban (vote 13-0).
