Board revIewed your applIcatIOn for FlexIble Development approval to penmt a
problematIc use m the CommerCial DIstnct wIthm a bUlldmg WhICh does not meet all of
the current land development regulatIons and IS wIthm 500 feet of another problematIc
use as part of a ComprehenSive InfiH Redevelopment Project, ComprehenSIVe SIgn
Program and a ComprehenSIve Landscape Program Based on the apphcatIon and the
staff recommendatIon, the Board found that the proposal IS m complIance WIth the
standards and cntena for a ComprehenSIve rntill Redevelopment Project, the maximum
development potentIal standards and all other applIcable standards of the Commumty
Development Code The Commumty Development Board approved the applIcatIOn With
the followmg condItIons
1 That SIgnage be lImIted to two attached SIgnS, as mcluded With the applIcatIOn
(no freestandmg SIgnS), and
2 That reference to check cashmg (problematIc use) be prohIbIted on any SIgns
VISIble from the publIc nght-of-way or from adjacent propertIes
Pursuant to SectIon 4-407, an apphcatIon for a bUIldmg permit shall be made wIthm one
year of FlexIble Development approval (December 27,2001) All reqUIred certificates of
occupancy shall be obtamed wIthm one year of the date of Issuance of the bUIldmg
permit TIme frames do not change WIth succeSSIve owners The Commumty
Development Board may grant an extenSIOn of tIme for a penod not to exceed one year
