Tills letter constItutes a Development Order pursuant to SectIOn 4-206 D 7 of the
CommunIty Development Code On July 18, 2000, the Commuruty Development Board
reviewed your apphcatlon to reduce the front setback from 25 feet to 10 feet along
Charles Avenue, reduce the front setback trom 25 feet to seven feet along McMullen
Booth Road, reduce the front setback from 25 feet to 24 feet along Damel Street, reduce
the side setbacks from 20 feet to five feet, and reduee the parkmg reqUirement from 24
spaces to 22 spaces, as a ComprehensIVe Infill Redevelopment Project and ComprehensIVe
Landscape Program Based on the apphcatlon and the staff recommendation, the Board
found that the proposal IS 10 comphance With the standards and cntena for FleXIble
Development approval, the maximum development potential standards, and all other
applIcable standards of the Commumty Development Code The Commuruty
Development Board granted approval of the apphcatlOn with the followmg condItIons
1)
That the landscape plan be further revised to mclude a tIered effect along
McMullen Booth Road, as provided through a landscape easement wlthm
the flght-of-way, and that the agreement With Pmellas County for same be
finalized pnor to the Issuance of a bUlldmg permIt,
That If the agreement to landscape the fIght-of-way IS not secured, the
landscape plan be amended to exceed Code reqUirements m an equal
monetary eqUivalent as If the landscapmg easement had been obtamed,
That the final desIgn and color of the bUlldmg be conSIstent With the plans
as submitted, and
That slgnage comply WIth Code
