referenced property r gave him much of the paperwork that had previously been submitted to
me, so that It could be used for submittal of the FleXible Development application He will get with
his client within the next two days to discuss the Issues I told him of the January 14th date you
mentioned In your most recent email to me It was his indicatIOn that they will be attempting to
sl.,Jbmlt a complete application to me by January 14, 2004 By our schedule, the next application
deadline IS January 29,2004 Should no application be filed by January 29,2004, I would
recommend you exercIsing your enforcement actions against the property owner
Assuming a complete application IS flied by January 29th at the latest date, and assuming the
application IS sufficient to meet Code provIsions, the case would be scheduled for the March 4,
2004, Development Review Committee meeting and then the Apnl 20,2004, Community
Development Board (COB) meeting
We also discussed Ihat any approval of Ihe application by the COB would Include condltlon(s) to
keep Ihe transformal1on process moving (submission for site and bUilding permits and actual
construction) to finally ISsue occupational licenses I suggested he Include as part of the

Last week my engineer met again WIth these departments and was Informed that the
plan as presented by hIm would not meet code because It required that cars might back
out Info Oak Avenue directly from the parking areas
Accordmg to my engineer you were Informed of these Issues and have agreed to
postpone further enforcement actIon until these techmcallssues can be resolved
My engineer assures me that he will continue to work dilIgently on a plan reVISIon that
meets code or, alternatively, he would pursu~ a vanance for the parking Issues
