requirements, the applicant would have to demolish eXlstmg structures and
redeSign the Site, which IS ImpractIcal and would be disruptive to the eXisting ALF
on the property, which IS occupied
2 The development of the parcel proposed for development as a
comprehensive inflll redevelopment project or residential infill project Will
not reduce the fair market value of abutting properties. (Include the
existing value of the site and the proposed value of the site with the

certIfied sIte plan, approved In 1996 pnor to adoptton of the CommunIty
Development Code Any change In use or ownership of the parcel would likely
trigger a Similar comprehensive Inflll request
9. Adequate off~street parking in the immediate vicinity according to the
shared parking formula In Division 14 of Article 3 will be available to avoid
on~street parking in the Immediate vicimty of parcel proposed for
development.
The eXisting ALF and the proposed medical clinic will be converted to
condominIum ownership of the bUlldmgs, WIth the surrounding driveways, parkIng
area and landscaping as common area As shown on the revised site plan,
there are currently 47 spaces on the site which are proposed to remain A
proposed dumpster pad and enclosure wIll use 2 of the 47 parkmg spaces
Due to the fact that the "mixed use" category does not take Into account that one
of the uses IS an ALF, staff has mdlcated that It will calculate parking on the ALF

ThIS IS a request for Flex[ble Development Approval for a Comprehensive Inflll
Redevelopment Project to allow a mIxed use development SpeCifically, there IS an
eXisting adult liVing faCIlity on the property, a portion of which IS proposed to be
converted to a medical cliniC The requested uses are a 7,971 square foot medIcal
cliniC and a 32-bed adult hVlng faCIlity
The proposed bUSinesses Will receive deliveries by vans or small trucks that are
of a Size that can park In a regular parking space They Will not receive deliveries by
any type of semi or tractor traIler truck Our fleXible development applicatIOn Includes a
request for reductIon of required parking spaces Since thiS IS a change of use With no
additional bUilding construction or redevelopment, we are limited to the number of
spaces currently on site To add the loading space would entaIl the further reductIon of
the eXisting parking, which we do not feel IS necessary
Therefore, we request that the City staff recommend approval of our request for

9 Adequate off-street parking in the Immediate vicinity according to the

on-street parking in the Immediate vlcimty of parcel proposed for

The eXisting ALF and the proposed medical clinic will be converted to
condommlum ownership of the bUlldmgs, with the surrounding driveways, parking
area and landscaping as common area There are 40 parking spaces eXisting on
the site and proposed
The staff has asked us to calculate reqUired parking based on a "mixed use"
requiring 4 to 5 spaces per 1,000 square feet of gross floor area Therefore,
there are 74 to 93 spaces reqUired by Code, based on a gross floor area of
18,425 square feet
The "mixed use" category does not take Into conSideration the fact that one of
the uses IS an adult Ilvmg faCility (a grandfathered use) The reSidents of the
faCility do not drive cars The followmg calculation more adequately deSCribes
the parking need for the proposed use
ALF - 8 Spaces
The approved site plan states the follOWing parking formula for the ALF (which IS
a grandfathered use)
1 space per 2 dwelling Units + 1 space per 2 employees
The 32-bed ALF Will have a maximum of 4 employees per shIft and Will reqUire 8
spaces, calculated as follows
32 beds - 3 beds per Unit = 11 dwelling Units -2 spaces = 6 spaces for reSidents
4 employees - 2 = 2 spaces for employees
Medical CliniC - 24 Spaces
Section 2-703 of the Code requires 2 to 3 spaces per 1,000 sq ft of gross floor
area of medical cliniC
The 7,971 sq ft cliniC Will reqUire 24 spaces, calculated as follows
7,971 sq ft - 1,000 sq ft = 8 x 3 spaces = 24 spaces
Based on the above calculations, 32 parking spaces are needed to serve the
proposed uses (8 for the ALF and 24 for the medical clinic) and there are 40
spaces on the property
10. The design of all buildings complies with the Tourist District or Downtown
District design gUidelines in Division 5 of Article 3 (as applicable).

On behalf of the applicant in connection with the referenced application, we
hereby request a waiver of the Clty'E. requirement of one loading space, as set forth In
Section 3~1406 of the Clearwater Community Development Code.
This is a request for Flexible Development Approval for a ComprehenSIve Infill
Redevelopment Project to allow a Inixed use development. Specifically, there is an
existing adult living facility on the property, a portion of which is proposed to be
converted to a medical clinic. The requested uses are a 7,971 square foot medIcal
cliniC and a 32-bed adult lIVIng facility
The proposed bUSinesses will receive deliveries by vans or small trucks that are
of a size that can park In a regular parking space. They will not receive deliveries by
any type of semI or tractor traIler trwik Our flexible development applicatIon Includes a
request for reduction of reqUIred parking spaces Since thiS IS a change of use with no
additIonal bUilding construction or redevelopment, we are Iimrt.ed to the number of
spaces currently on site To add the. loading space would entail the further reductton of
the existing parking, which we do not feel is necessary
Therefore, we request that the City sta.ff recommend approval of our request for
a waiver the loading space requIrement You mentIoned at the ORC meeting that in the
event the project IS approved without a loading space, you would like to add a condition
of approval that the loading space be required in thE~ event of any future change In use
