The purpose of thIS letter IS to adVise the City of Clearwater Planrung Department, the City of Clearwater
ConumsslOuers and the Pmellas County Board of County ComrmssIoners of our OPPOSITION to the
proposed rezorung ORDINANCE NO 7270-04 regardmg the Beckett Lake Lodge property at 2155
Montclmr Road As residents and owners of nearby or adjacent property we find the proposed ordmance
unacceptable and not m accordance With the developers agreement put m place by the Pmellas County
Development Services m 1999
If approved, Beckett Lake Lodge has plans to build a second bUIldmg WIth approxImately 55-60

addItIonal staff and parkIng allowances which WIll further encroach on the current very delicate --

The ongmal1995 Pmellas County Development Services developers' agreement allowed for a total 0[95
ALF beds on the entIre property and a smgle, 2-story bwldmg was to be bUIlt on the west portIOn of the
property All allowable bUlldmg denSity (uruts per acre) were to be transferred to a smgle concentrated
bUlldmg SIte to keep the mtruSIOn to the senSitive wetlands, conservatIOn and uplarld area to a minImUm
No further buildmg or development was to be allowed In the future
The current owners of Beckett Lake Lodge purchased the vacant property With this developers' agreement
m place PrIor to bUlldmg Beckett Lake Lodge, the developers' agreement was amended m 1999 WIth
Pmellas County to allow a hIgher umt to bed converSIOn factor for an ALF of 3 beds per urnt consistent
WIth the factor used by the Pmellas Planrung Council. TIlls new factor allowed an mcrease to 133 beds
(from the ongmal 95 bed limit) for thiS property and the bUlldmg was permItted to become a 3 story (vs 2
story) project proVided It remamed under the 35 foot bUlldmg height code restrIctIOn Deed restrIctIOns
and easements were to also be put In place to keep the land use In accordance WIth the final developers
agreement

NOTICE OF OPPOSITION
Beckett Lake Lodge has been built m accordance WIth the fmal Pmellas County developers' agreement
from 1999 and It was also annexed mto the City of Clearwater to benefit from the available CIty services
Now that Beckett Lake Lodge is withm the CIty of Clearwater, they are applymg for a change to the RLM
(10 uruts per acre) zOTIlng classtticatIon from the current RU (7 5 units per acre) zomng classificatIOn. If
approved, the total beds permitted would effectively double that of what was ongmally planned for thiS
property - 190 beds mstead of the ongmal 95 beds
This request for addItion development of tlus property is unacceptable to the resIdents of Beckett Lake
Estates for many reasons The current level of development is vIewed by many to be already too invasive
and m our opmion was too aggressive as It IS The final developers agreement for thIS property gave
many generous conceSSIOns to allow the owners to effecttvely get everythmg they asked for m 1999 at the
expense of the property becommg over developed and some Beckett Lake Estate property owners
permanently damaged financIally Some property owners in Beckett Lake Estates have already lost the
pnvate use of their back yards and have realized a sIgmficant drop III the property values because of the 3-
story development tnunedIately behmd them The current development of Beckett Lake Lodge has
mterfered WIth these owners bemg able to enJoy their homes or unable to sell the properties.
Beckett Lake Estates IS a smgle-famIly home commumty developed at approxImately a 3 umt per acre
denSIty The RU (7 5 umts per acre) zonmg level of Beckett Lake Estates IS mlsleadmg as It was used for
our development because It was the lowest densIty level used by the CIty of Clearwater at the tIme The
fact that our neIghborhood has a 3 urut per acre development denSIty and IS duectly adjacent to current 7 5
umts per acre Beckett Lake Lodge development IS dlsturbmg enough however a rezorung of the Beckett
Lake Lodge property to a 10 urut per acre level IS completely unacceptable and could set a precedent for
development of other nearby propertIes The Beckett Lake Lodge developers' agreement mdlcates the
"special exception" granted to allow the concentrated denSity to be placed m one bUIldmg sIJe area only
There was never any dIscussIOn or mdlcatIon that addItIonal future project expansions or addIttonal
bUIldmg would ever be considered on thIS prop~rty -Anythmg-beyond thts Is-not In accordance::.wIth_the - . ~-~
conditions of the detailed developers agreement or land use plan and should therefore be demed
Please reVIew all records of the developers agreements on file WIth Pmellas County Development
ServIces before any further consIderatIOns of the proposed ordInance Pmellas County has placed
sIgmficant bme and resources mto the specIal comprehensive developers agreement reached m 1999 and
thiS should not be ignored or changed
