1. Call To Order
The Chair called the meeting to order at 1:30 p.m. at the Main Library
followed by the Pledge of Allegiance.
2. Approval of Minutes
2.1 Approve the minutes of the November 20, 2024 Municipal Code Enforcement Board
meeting as submitted in written summation.
Member Farrar moved to approve the minutes of the November 20,
2024 Municipal Code Enforcement Board meeting as submitted in
written summation. The motion was duly seconded and carried
unanimously.
3. Citizens to be Heard Regarding Items Not on the Agenda
Bill Jonson said a property that once had an active unsafe case still has
significant maintenance issues and requested staff to look into the
issues.
Property representative Colleen McErnney said repairs for 1216 Missouri
Ave., Case 55-24, are ongoing and due to the storms additional repairs are
needed. She requested more time to complete the repairs.
4. New Business Items
4.1 Continued from August 28, 2024 - Case 99-24 - Find respondent(s) Jonathan Wade Sr at
1312 N Madison Ave. in violation of Code for Portable Storage Units; and issue an order
with the compliance deadline and fine if compliance is not met. (Dixon)
No one was present to represent the Respondent.
Inspector Dixon provided a PowerPoint presentation. A POD unit is being
stored in the backyard. In response to a question, he said he spoke with
owner and gave additional time to comply.
Member Farrar moved to find the Respondent in violation of the City of

Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before February 1, 2025. If the Respondent
does not comply within the time specified, the Board may order a fine
of $150.00 per day per violation for each day each violation continues
to exist. After 3 months from the recordation date of such lien, if the
fines and fees remain unpaid, the City Attorney's office is authorized to
foreclose, collect or settle such lien using any legal or equitable
remedies available under the law. The motion was duly seconded and
carried unanimously.
4.2 Continued from August 28, 2024 - Case 100-24 - Find respondent(s)Torey D Taylor at
1118 Palm Bluff St. in violation of Code for Exterior Surfaces and Abandoned Building;
and issue an orderwith the compliance deadline and fine if compliance is not met.

Inspector Dixon said the property complied prior to the meeting.
Member Farrar moved to find the Respondent was in violation of the
City of Clearwater Code as referred to in the affidavit in this case, the
violation was corrected prior to today's hearing, and to enter an order
that no fine be imposed against the Respondent. If the Respondent
repeats the violation, the Board my order a fine of up to $500 for each
day the violation continues to exist. The motion was duly seconded
and carried unanimously.
4.3 Case 113-24 - Find respondent(s)Teresa M and James R Matty at 879 Eldorado Ave. in
violation of Code for Fences and Walls; and issue an order with the compliance deadline
and fine if compliance is not met. (Kasman)
No one was present to represent the Respondent.
Inspector Kasman provided a PowerPoint presentation. He said there
were other violations at property, but the owner's son came into town to
take care of the property and only the fence remains an issue. He said
progress has been made on the fence, the gate has been repaired, but
panels are still failing and in danger of falling onto the sidewalk. He said
he has left messages with the son but has had no contact.
Discussion ensued with consensus to grant additional time to comply as

the property is located on the beach.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before March 20, 2025. If the Respondent
does not comply within the time specified, the Board may order a fine
of $150.00 per day per violation for each day each violation continues
to exist. After 3 months from the recordation date of such lien, if the
fines and fees remain unpaid, the City Attorney's office is authorized to
foreclose, collect or settle such lien using any legal or equitable
remedies available under the law. The motion was duly seconded and

4.4 Case 114-24 - Find respondent(s) Joseph Peter Sikorski at 826 Mandalay Ave. in
violation of Code for Exterior Surfaces, Door and Window Openings, and Roof
Maintenance; and issue an order with the compliance deadline and fine if compliance is
not met. (Kasman)
No one was present to represent the Respondent.
Inspector Kasman provided a PowerPoint presentation. He said the roof
condition was the initial draw to the property. The exterior surfaces are dingy
and there is rust on the downspouts. There is fascia and soffit damage over
the main entrance and above the garage. The garage door is rusted and
needs repainted. He said he had contact with the owner once.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before January 18, 2025. If the Respondent
does not comply within the time specified, the Board may order a fine

4.6 Case 117-24 - Find respondent(s)Timothy and Tori Charles at 609 '/2 Alden Ave. in
violation of Code for Exterior Surfaces and Exterior Storage; and issue an orderwith the
compliance deadline and fine if compliance is not met. (Kasman)
Property owner Tori Charles was present and denied the violations.
Inspector Kasman provided a PowerPoint presentation. He said there are
two similar houses on the property (one parcel.) He said a washer and dryer
are sitting outside and plastic is hanging on the side of the house. Both
houses have exterior structure defects. He spoke with the property owner in
June. There is exterior storage issues and damage to the siding on both
structures. He said permits were obtained in September and work has
started but much needed exterior work needs to be done for compliance.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Tori Charles said repair permits were obtained prior to the hurricanes and
that it is difficult to find a contractor for smaller projects. She said tarps are
periodically hung on the porch area to block the afternoon sun and to hide
personal items stored on the porch. She said she thought by having the
work ongoing she was in compliance. Assistant City Attorney Jerrod
Simpson said the code does not have an exception for open and active
permits. Ms. Charles requested time to comply as the contractor had to
go to another job.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before February 1, 2025. If the Respondent
does not comply within the time specified, the Board may order a fine
of $150.00 per day per violation for each day each violation continues
to exist. After 3 months from the recordation date of such lien, if the
fines and fees remain unpaid, the City Attorney's office is authorized to
foreclose, collect or settle such lien using any legal or equitable
remedies available under the law. The motion was duly seconded and
carried unanimously.
4.7 WITHDRAWN - Case 119-24 - Find respondent(s) Clearbridge LLC at 1672 Druid Rd. E.
in violation of Code for Residential Rental Business Tax Receipt; and issue an orderwith

She said the property is advertised for six and seven nights minimum
stay. She has had no contact with owners.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before January 18, 2025. If the Respondent
does not comply within the time specified, the Board may order a fine
of $150.00 per day for the Short Term Rental and a fine of$50.00 per
day for the Residential Rental Business Tax Receipt violation for each
day each violation continues to exist. After 3 months from the
recordation date of such lien, if the fines and fees remain unpaid, the
City Attorney's office is authorized to foreclose, collect or settle such
lien using any legal or equitable remedies available under the law. The

Inspector Kasman provided a PowerPoint presentation. He said he has
had no contact with the owner and there are no active utilities at the
property. He said he has cited the property for lot clearing several times
and the issues are typically taken care of. There is an expired building
permit for this property. Assistant City Attorney Jerrod Simpson said the
lack of utilities is a factor in determining an abandoned building.

Inspector Nardin provided PowerPoint presentation. The roof collapsed
and there is a lot of vegetative growth inside the structure. Plywood
covering a converted garage area is busted open. He said he had one
phone call with an individual who was attempting to get the ownership
changed as the current owner passed away.

Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before January 18, 2025. If the Respondent
does not comply by that date, the City may take all reasonable actions,
including entering the property, to bring the property into compliance
and charge the Respondent with all costs, which will become a lien o
the property. The Board may order a fine of$150.00 per day for each
day the violation continues to exist. If costs, fines, and fees remain
unpaid 3 months after such lien is filed, the City is authorized to

6. Other Board Action
6.1 Case 58-24 - Consider request by petitioner(s) Jingbai Wang at 200 Windward Isl to
reduce the fine re Short Term Rental; and if approved, issue an order that specifies a fine
that includes administration costs and establishes a date payable or the lien will revert to
its original amount.
Property owner Jingbai Wang was present. He said he lives in Austin, TX
and did not receive the notices regarding the violation and that a neighbor
notified him. He said he rented the house out to cover expenses.
In response to a question, Code Compliance Supervisor Green said the
case was heard by the Board in May and was brought into compliance in
August.
Attorney for the Board Andy Salzman said administrative and
investigative costs total $1,421.20 and the total lien amount is
$11,400.00.
One individual said he is a neighbor and the subject property was rented

in January 2024 then was sublet to someone else. He said he has texts
starting from February between him and the property owner regarding
issues created by tenants.
Code Compliance Manager Mulder said proper notice was sent and it is
the property owner's responsibility to update the Pinellas County Property
Appraiser for mailing address changes.
Member Farrar moved to deny the request for a lien reduction. The
motion was duly seconded and carried unanimously.
6.2 Case 36-12 - Consider request by petitioner(s) Nicolo Tarantini at 505 N Garden Ave. to
reduce the fine re Door and Window Openings; and if approved, issue an order that
specifies a fine that includes administration costs and establishes a date payable or the
lien will revert to its original amount.
Property owner Nicolo Tarantini was present. He said the previous owner
passed away in 2011 and nobody took responsibility for the property. He
said he purchased the property and did all necessary work to bring it into
compliance. In response to questions, he said he was aware there were
liens on the property when he purchased it. He said he didn't pursue a
lien reduction until now because there was a tenant residing in the home
and there were litigation issues with the estate. It is not currently for sale.
Attorney for the Board Andy Salzman said administrative and
investigative costs total $1,184.20.
Member Farrar moved to enter an order reducing the amount of the lien
for Case 36-12 to $1,500.00, payable within 30 days or or the lien will
revert to its original amount. The motion was duly seconded and
carried with the following vote:

Inspector Stephens presented Cases 164-24 and 165-24 together in a
PowerPoint presentation. He said he spoke to the property owner once
since the case was opened and they attempted to contact him on Monday,
but he has not spoken to them yet. He said the property is overgrown and
the grass is over a foot and a half high. Pallets are stacked along the side of
the house and shopping carts are in the backyard. An inoperable vehicle sits
in the driveway, the tag has an expired sticker from February 2022. He said
when he spoke to the property owner months ago, they said the truck
belonged to a boyfriend who passed away and they have no legal standing
to do anything with it.
Member Farrar moved to enter an order finding the Respondent in
violation of the City of Clearwater Code and requiring the Respondent
to correct the violations within five days of the Board's written order. If
the Respondent does not comply within the time specified, the City
may take all reasonable actions, including entry onto the property, to
abate and maintain the nuisance, and charge the Respondent with the
reasonable costs which will become a lien on the property. After 3
months from the recordation date of such lien, if the costs remain
unpaid, the City Attorney's office is authorized to foreclose, collect or
settle such lien using any legal or equitable remedies available under
the law. The motion was duly seconded and carried unanimously.

Inspector Mattocks presented Cases 168-24 and 169-24 together in a
PowerPoint presentation. He said the property includes one lot and 2

parcels. The property is vacant and overgrown. There are 2 large
concrete blocks stored on the property. A couch, several mattresses, and
bags of trash litter the lots as well.

7.6 Case 170-24 (PNU2024-01381)-Accept the Nuisance Abatement Lien for
respondent(s) Frederic Picard at 1032 N Missouri Ave. for Lot Clearing; and issue an
order with the compliance deadline and authorize the City to mitigate the violation if
compliance is not met. (Dixon)
No one was present to represent the Respondent.
Inspector Dixon provided a PowerPoint presentation. He said the case
was started prior to the hurricanes. He spoke with the owner once who
said the property was damaged in the hurricanes. The property is
overgrown and debris litters the property. In response to a question, Mr.
Dixon said the house is abandoned, the owner purchased to fix it up.
Member Farrar moved to enter an order finding the Respondent in
violation of the City of Clearwater Code and requiring the Respondent
