Agenda based on evidence in the record,including the applications and the staff reports, and hereby adopt the

8. Case: F 2024-03009—211 and 221 Skiff Point Level Two Application

Location: 0.418 acres (two parcels) located on the south side of Skiff Point approximately 206 feet
west of the intersection of Larboard Way and Skiff Point.
Request: Flexible Development approval to construct a 1,504 square foot commercial dock as
accessory to a 12-unit attached dwelling project at the property located at 211 and 221 Skiff Point in
the Medium High Density Residential District of the Island Estates Neighborhood Conservation
Overlay District (MHDR-IENCOD). The dock exceeds 500 square feet in size and requested is
flexibility for maximum dock width. (Community Development Code Section 3-601.C.3.)

Frank Pfiffner requested party status because he received notice of the hearing, he is the President of the
Sea Island Condominium Association, and is a unit owner at 400 Larboard Way, which is located
approximately 200 feet from the subject property.
In response to questions, Attorney Daigneault said the motion considered by the Board should conclude the
request as an individual owner and as the representative of the association. He said he did not hear Mr.
Pfiffner say he received notice on behalf of the Association. Mr. Pfiffner said he was not aware if the
Association received notice of the hearing. Attorney Daigneault said ideally the Board would receive a
memorialization of Mr. Pfiffner's ability to represent the Association but was not sure the Board should get

stuck on the technicality as the Board seems poised to approve the request for party status.
Vice Chair Boutzoukas moved to grant Mr.Pfiffner party status as an individual and as President of the
Association. The motion was duly seconded and carried unanimously.
Richard Toenjes requested party status as the President oflsland Moorings Condo Association. He said the
Condo Association received notice of the variance request and he received notice as an individual.
Vice Chair Boutzoukas moved to grant Mr.Boutzoukas party status. The motion was duly seconded and
carried unanimously.
Attorney Mytych requested Melissa Hauck-Baker be accepted as an expert witness in the fields of general
planning, zoning, redevelopment planning, land development code & land development code amendments,
special area plans and overlay districts, site plan review, landscape architecture, historic preservation,
comprehensive sign programs and all other matters she is about to test.
Member Achinelli moved to accept Melissa Hauck-Baker as an expert witness in the fields of general planning,
zoning, redevelopment planning,land development code & land development code amendments, special area
plans and overlay districts, site plan review, landscape architecture, historic preservation, and comprehensive
sign programs. The motion was duly seconded and carried unanimously.
Attorney Mytych requested Michael MacDonald be accepted as an expert witness in the fields of waterway
management, aids to navigation, relationships between vessel navigation over water structures, ground
support operations on airfields and all other matters he is about to test.
Member Haudricourt moved to accept Michael MacDonald as an expert witness in in the fields of waterway
management, aids to navigation, relationships between vessel navigation over water structures, ground support
operations on airfields. The motion was duly seconded and carried unanimously.
Ms. Hauch Baker provided a PowerPoint presentation.
In response to questions, Ms. Hauck Baker said the waterway width between the two points is 260 f. Per
code, the dock could go out to 142 f. in length. She said the dock meets the side setbacks. The proposed
dock will be for the residents who will live within the upland area in the attached dwelling unit project. At
this point, the review goes to the local jurisdiction. Once the local jurisdiction renders a decision, the
applicant may pursue filing with Pinellas County Water and Navigation, which is when all of the regulatory
agencies get involved.
Applicant representative Brian Aungst, Jr. requested Al Carrier be certified as an expert witness in the
fields of dock and marina permitting and design, environmental engineering, and civil engineering of and
submitted a copy ofMr. Carrier's resume.
Board Member Haudricort moved to accept All Carrier as an expert witness. The motion was duly seconded
and carried unanimously.
Mr. Aungst and Mr. Carrier provided a PowerPoint presentation. Mr. Aungst said the dock cannot be
located next to the seawall due to the presence of sea grass. Mr. Carrier said the project was originally
designed andpermitted through the Florida Department of Environmental Protection (FDEP) and the Army

Corps of Engineers (ACOE) by Foster Consulting. Foster Consulting conducted a benthic survey and
mapped the sea grass. The benthic survey was submitted to FDEP. He said FDEP and ACOE confirmed the
sea grass location; both agencies approved the project but required the applicant to have the walkway over
the sea grass be at lease 5 ft. above mean high water and the decking material cannot be wider than 6 in.
planks and must have 0.5 in. gap in between each plank. Mr. Carrier said the dock was redesigned to be
smaller in order to meet city code. Mr. Aungst said the older existing docks in the area were built prior to
the current law and that is why they are closer to the sea wall.
In response to questions, Mr. Aungst said there is only one walkway in the center of the property. The
existing docks will be removed.
Mr. Pfiffner provided a copy ofresume and requested to be accepted as an expert witness.
In response to questions, Attorney Daigneault said Mr. Pfiffner would be an expert witness in the field of
law and the Board has not qualified an attorney in 12 years. Lawyers are not considered expert witnesses.
Board Member Hupp moved to qualify Mr.Pfiffner as an expert witness in the field of law. The motion failed
for a lack of a second.
Mr. Pfiffner expressed concerns with the proposed length ofthe dock and questioned the presence ofsea
grass. On October 19, 2021, the applicant originally submitted an application for a 112 f. wide dock that
was not approved by the City. He said the original application did not include any information regarding
sea grass. The dock cannot be longer than 25 f. of the width of the waterway.
Mr. Toenjes provided a copy of his resume. He said it is clear that the proposal is not consistent with city
code. When the original application was heard, the City's Environmental Manager Ed Chesney stated that
the plans at the time were not consistent with city code or the neighborhood. The proposed plans were not in
harmony with the scale or character of the adjacent properties and the neighborhood in general. He said
the neighborhood is residential and not commercial and all of the adjacent docks were built within ]Oft. of
the seawall.
In response to questions, Marine and Aviation Director Michael MacDonald said he has held the Marine
and Aviation Director position for a little less than one year. Prior to the director position he was the
Marine and Aviation Operations Manager. He has worked in Marine and Aviation since February 2017. He
said he reviewed the application that is being heard today. In his opinion, there were no concerns related to
water navigation, safety, or hazards as it relates boat traffic or other related safety concerns. As the
Harbormaster, he recommends approval. Ms. Hauck-Baker said the email sent to Stephanie Dawson was in
response to a resident inquiry regarding the application. In the email, she explained that the only reason the
application was going before the CDB was because the proposed dock exceeds 500 sq.ft. and is a multi-
family dock. She said the if the proposal was for a single family or two-family dock, even at the proposed
length or width, it would not come before the CDB because it would require administrative approval and
signatures of no objection from each adjacent neighbor. She said if the application was for a single- or two-
family dock, the request could go up to 142 ft. in length from the seawall without a variance. Many of the
residential docks in Island Estates, Clearwater beach, and Bay Esplanade exceed the 500 sq.ft. dimension
threshold. Ms. Hauck-Baker said the Island Estates Neighborhood Conservation Overlay District supports
the approval of the application in terms of the residential boating community uses. Any multi use dock,

which is a dock that is not a single family or a two-family use dock, that exceeds 500 sq.f. area
automatically becomes a commercial dock,per city code. She said the application does not propose any
commercial activity (leasing of boats or fueling) at the dock. In 2007, Majestic Point, the property directly
adjacent to the west, was approved for a 1,666 sq.f. -dock with 15 slips and 209 f. wide. In 1980, the
neighbors directly to the east were approved for a 834 sq.ft dock with 6 slips and a 3 ft. setback to the
applicant's property and 209 f. width. She said under the current code, the maximum width for the dock
would be 81 f. She said 60% of the docks in the subject area had deviations from the allowable width under
the current code. Based on the evidence provided by the applicant, there are sea grasses that would be
impacted if the dock is built closer to the sea wall. She said no tie poles are being proposed. The code
contemplates and allows for a deviation to width to protect sea grass. Mr. Carrier said per city code, tie
poles are allowed if I foot from the extended property line. There is no intent to add tie poles. Mr. Aungst
said the applicant would not object if the Board wishes to add the tie pole stipulation as a condition of
approval. Mr. Carrier said the sea wall was reconstructed when the property was developed. The mean low
water line at the sea wall is -1.4. Ms. Hauck-Baker said staff received comments opposing the proposed
application and were not included in the staff report. The 2021 application was not mentioned in the staff
report because it was never approved. The application before the Board is a different application. She said
she was not aware of the parameters of the applicant's prior request as she was not the assignedplanner.
The distance that appears from the sea wall is considered the length and staff looks at the overall length.
She said the proposed dock is compliant with what the maximum length would be.
Three individuals spoke in opposition.
Mr. Pfffner said the request should not be approved because the proposed dock would stick out like a sore
thumb and is not in harmony with the scale and character of the adjacent property.
Mr. Toenjes said the request fails the harmony test and should not be approved.
Mr. Aungst said the application before the Board meets all approval criteria and the proposed dock is
compatible and in harmony with the development pattern of the area and adjacent properties. Mr. Carrier
said the benthic survey was provided as part of the application. He presented a copy of the FDEP permit
that requires the applicant to avoid the sea grass. Mr. Aungst said the deviation being requested is not for
length or setback; the application meets the setbacks and dimensional standards for administrative
approval.
Discussion ensued with comments made that calling the proposed dock a commercial dock is confusing
when the proposed use is residential and the name should be changed and that based on the evidence
presented the application meets the approval criteria and should be approved. It was suggested that the sea
grass report should be provided as part of the application process. There was consensus to include the
condition that there not be any tie poles in the setback area.
Board Member Boutzoukas moved to approve Case FLD2024-03009 based on the evidence and testimony
presented in the application,the Staff Report and at today's hearing, and hereby adopt the Findings of Fact
and Conclusions of Law stated in the Staff Report with conditions of approval as listed,plus the condition that
there not be any tie poles or boats in the side setback area without review or approval by the City. The motion
was duly seconded and carried unanimously.

1. Appoint Board Member to Serve on the Affordable Housing Advisory Committee (AHAC)
Chair Quattrocki moved to nominate Vice Chair Boutzoukas to serve on the AHAC as the CDB representative.
The motion was duly seconded and carried unanimously.
Discussion ensued regarding the process of sharing the letters of opposition with the board members. There
was consensus for staff to share the letters by Tuesday (day before the meeting).

PROJECT EXPERIENCE:
Crystal Island Roadway and Drainage Improvement
Project Manager for the reconstruction of approximately 2.0 miles of residential
roadways on Crystal Island. The work included the reconstruction of the roadways
including base, sub -base asphalt and curbs, upgrade of the stormwater collection
system and 13 stormwater outfalls, replacement of the sanitary sewer forcemain
with a subaqueous directional drill, replacement of the seawalls and box culverts on
Flamingo Drive and upgrade the potable water services. City of Madeira Beach
Boca Ciega Drive Roadway and Drainage Improvement
The project is a cooperative funding project through SWFWMD and FDEP that
involves roadway, drainage, utilities, TMDL water quality improvements and
permitting for a 48 acre residential neighborhood. Stormwater BMPs include
Pervious Concrete and Nutrient Separating Baffle Boxes. Services include right of
way and topographic survey, civil engineering, permitting and construction

RESUME
WORK HISTORY
Frank A. Pfiffner is a retired judge of the State of Alaska, Superior Court for the Third
Judicial District at Anchorage. This position is similar to that of a Circuit Judge in the State
of Florida. He was appointed as a judge of the superior court by Governor Sean Parnell on
October 29, 2009. Judge Pfiffner retired on July 20, 2018. Judge Pfiffner continued to
serve as a judge pro tempore of the superior court until September 1, 2022, when he retired
a second time. As a superior court judge, he handled all types of serious civil and criminal
cases and certain appellate matters. After he retired a second time, Judge Pfiffner moved
to Clearwater, Florida, where, with his wife, he owns a condominium and resides at Sea
Island Condominium 1 Association, Inc., 400 Larboard Way, Apt 107. Judge Pfiffner is
the President of the Board of Directors of Sea Island Condominium 1 Association, Inc.
Prior to his appointment to the bench, Judge Pfiffner practiced with an Anchorage law fine
for 35 years and was admitted to practice in all state and federal courts. His law practice
focused on tort and commercial litigation with emphases on alternative dispute resolution,
construction, professional liability, negligence, products liability, and insurance issues. In
the realm of construction law covering a wide variety of disputes, he represented public
and private owners, general contractors, subcontractors and suppliers, and design
professionals such as architects and engineers. As a lawyer, Judge Pfiffner also served as
an arbitrator and as a mediator in commercial and construction disputes. While he
practiced law, Judge Pfiffner received an AV rating from the Martindale -Hubbell Rating
System. The AV rating is the highest attorney rating given by Martindale -Hubbell. Judge
Planer also continues to serve as an elected and active member of the American Law
Institute. The ALI is the premier independent U.S. legal organization that develops
treatises on what it believes the law should be in all American jurisdictions. The ALI
membership consists of judges, lawyers, and law professors who have been invited by ALI
to join the organization.
