PARKING AREA
In accordance with the terms of that certain development agreement dated August 4, 2022
and recorded on August 17, 2022 in O.R. Book 22172, Page 916 of the Public Records of Pinellas
County, Florida (the "Agreement"), the City of Clearwater, Florida (the "City") hereby establishes
its parking rules (these "Rules") for the City's fifty (50) spaces allocated within the Harborview
Project Parking Area (the "City Spaces"). These Rules are the culmination of discussion and
planning between the parties to the Agreement.
1. Use of City Spaces. Generally. The owner of the Harborview Project or its designee (the
"Owner") shall generally be permitted to charge market rate pricing for the use of the City
Spaces by the general public and patrons of the Harborview Project Hotel except as
otherwise provided in these Rules.
2. Use by City Staff Employee staff of the Clearwater Main Library ("Library Staff') shall
be entitled to use the City spaces free of charge during their employment hours subject to
availability. Library Staff shall be identified as such by use of a QR code or other
identification method acceptable to the City. The QR code or other identification shall say,
"Gratuity already included," or words to that effect. The Owner will be provided a list of
Library Staff who are eligible to park free of charge in the City Spaces, along with their
employment hours, which may be updated from time to time by the City at its sole
discretion.
3. Use by Library Patrons. Patrons of the Clearwater Main Library ("Library Patrons") shall
be permitted four (4) hours of free parking with validation subject to availability. Parking
exceeding the four (4) hour period may be charged in accordance with these Rules. For
purposes of these Rules, Library Patrons shall include any persons visiting the library to
make use of the services or attend events provided at the library or those persons attending
any official city meetings or business being conducted at the library including any City of
Clearwater employees.
4. Use by City Council. The City of Clearwater City Council shall be entitled to use the City
Spaces free of charge at any time subject to availability. The QR code or other
identification relating to City Council parking shall say, "Gratuity already included," or
words to that effect.
5. Term. These rules shall become effective upon the earlier of (i) the date a Certificate of
Occupancy is issued for the Harborview Project Hotel, or (ii) the date the Harborview
Project Hotel parking garage opens for use to guests and the general public, and shall
remain in effect until the expiration of the Agreement on August 18, 2052 unless the
Agreement is terminated earlier or further extended.
6. Record Request. Upon request from the City, the Owner shall provide to the City within
thirty (30) days of the request, reporting information and details on the usage of the QR or
other identification system used to track usage of the City Spaces by City Staff including

but not limited to time entering and exiting the garage. Any record subject to this
requirement shall be maintained by the Owner for a period of five (5) years from the
creation of such record. For example, a parking report for the date of April 5, 2028 shall
be maintained until at least April 5, 2033.
7. Rule Amendments. Amendments to these rules may be made by mutual consent of the
parties.
