ROLL CALL C.APPROVAL OF MINUTES FROM THE PRIOR MEETING MARCH 21, 2024 Board Member Haudricourt moved to approve the minutes for the March 21, 2024 meeting. E.REQUESTS FOR CONTINUANCES (ITEMS 1-2): 1.Case: FLD2015-11046A— 405-415 Island Way Level Two Application Owner(s): Azure Development Group LP Applicant: Terri Skapik; Woods Consulting, Inc.; 1714 Country Road 1, Ste. 22, Dunedin, FL, 34698; phone: (727) 919-0848; email: terriskapik@woodsconsulting.org Location: 1.345-acre property located on the east side of Island Way, approximately 100 feet south of the intersection of Island Way with Skiff Point Request: Amend a previously approved Flexible Development application (FLD2015- 11046) to construct a 2,729 square foot multi-use dock as accessory to a 46-unit attached dwelling project in the Medium High Density Residential (MHDR) District of the Island Estates Neighborhood Conservation Overlay (IENCOD) District for the property located at 405-415 Island Way. The amended project proposes an 87 square foot addition and is requesting a deviation for a side setback (north) of 2 feet to access a space with existing tie poles, and exceeds dock width. (Community Development Code Section 3-601.C.2-3). CDB 2024-04-16 Kyle Brotherton provided a PowerPoint presentation. In response to questions, Mr. Brotherton said blackwater is part of the domestic sewage carried off by toilets, urinals, and kitchen drains. Graywater is domestic sewage that is not blackwater. Regarding Accessory Dwelling Units (ADU), through lots and double frontage lots were not incorporated; staff is researching the matter and will include any appropriate provisions in another code update later this year. Assistant City Attorney Matthew Mytych said the intent to changing the term "living" to "dwelling" was to protect the City's short term rental prohibition. The proposed language clarifies that ADUs in the residential zoning district cannot be utilized for short term rentals. Ms. Clayton said the proposed ordinance includes a provision that notices for Level 11 cases will be provided four to six weeks prior to DRC. One individual spoke in support. Board Member Haudricourt moved to recommend approval of Case TA2024- 03001, Amendments to the Community Development Code, as amended by changing the term "living" to "dwelling," based on the evidence and testimony presented in the application, the Staff Report and at today's hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report. The motion was duly seconded and carried unanimously. H. DIRECTOR'S ITEMS — None. I. Clayton, Planning & Development Director April 15, 2023 DVA2022-06001A The Planning and Development Department staff requested the applicant consider revising the proposed amendment to Article IV, Section 4.12 regarding the allowance for 50% of the parking spaces to be above -ground at the City Hall site. Staff was concerned the proposed amendment might be interpreted to apply to both the City Hall and Harborview sites. The applicants reviewed this matter and submitted revised language for your consideration. Please see below the originally proposed revision and the amended proposed revision. Originally Proposed Revision: Section 4.12. Parking. The Project shall include a minimum of four hundred forty 440 parking spaces at the City Hall Site (or a ratio of 1.1:1 parking spaces, whichever is greater). The Harborview Site shall include the Code required parking which is anticipated to be one hundred nineteen (119) parking spaces at the former Harborview Site plus an additional fifty (50) spaces forthe benefit of the City at the Harborview Site fora total of one hundred sixty nine (169) spaces all as shown on the Concept Plan. The parking garage shall be constructed to include approximately 50% of the spaces above ground and 50% subterranean spaces. The aboveground spaces shall be designed so that they are not be visible from Osceola Avenue, but may be visible from Coachman Park. Amended Proposed Revision: Section 4.12. Parking.
