To provide continuity for research, items are in agenda order although not necessarily
discussed in that order.
The Chair outlined procedures and stated any aggrieved party may appeal a final administrative
order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County within thirty
days of the execution of the order. Florida Statute 286.0105 requires any party appealing a
decision of this Board to have a record of the proceedings.
1.Call To Order
The Chair called the meeting to order at 1:30 p.m. at the Main Library,
followed by the Pledge of Allegiance.
2. Approval of Minutes
2.1 Approve the minutes of the October 25, 2023 Municipal Code Enforcement Board
meeting as submitted in written summation.
Member Engel moved to approve the minutes of the October 25, 2023

Assistant Building Official Dana Root said there is an active permit on
the property.
Member Farrar moved to continue the status update for Case 32-22 to

Inspector Brown provided a PowerPoint presentation. She said the property
is large and there are several unmaintained pools and a fountain and piles of
debris on the property.
In response to questions, Ms. Brown said had contact with someone
affiliated with the Zillow listing, all mail was returned, and physical
postings were removed. She said she does not know how long the
property has been vacant.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before December 7, 2023. If the Respondent
does not comply within the time specified, the Board may order a fine
of $150.00 per day per violation for each day each violation continues
to exist. After 3 months from the recordation date of such lien, if the
fines and fees remain unpaid, the City Attorney's office is authorized to
foreclose, collect or settle such lien using any legal or equitable
remedies available under the law. The motion was duly seconded and
carried unanimously.
4.11 Case 126-23 - Find respondent(s) Henri & Emmanuelle Hebting at 1755 Fulton Ave. in
violation of Code for Vehicle Repair in Residential Zone, Parking on Unpaved
Surfaces, and Inoperative Vehicle; and issue an order with the compliance deadline
and fine if compliance is not met. (Dixon)
No one was present to represent the Respondent.
Inspector Dixon said the violation was corrected prior to the meeting and
requested a declaration of violation.
Member Farrar moved to find the Respondent was in violation of the
City of Clearwater Code as referred to in the affidavit in this case, the
violation was corrected prior to today's hearing, and to enter an order
that no fine be imposed against the Respondent. If the Respondent
repeats the violation, the Board may order a fine of up to $500 for each

day the violation continues to exist. The motion was duly seconded
and carried unanimously.
4.12Case 127-23 - Find respondent(s) Dorothy Fraley at 1754 Apache Trl in violation of
Code for Parking Restrictions, Exterior Surfaces, and Exterior Storage; and issue an
order with the compliance deadline and fine if compliance is not met. (Dixon)
No one was present to represent the Respondent.
Inspector Dixon provided a PowerPoint presentation. He said there is a lot of
items in the yard not intended for outdoor storage. There is peeling and
chipped paint on the house and the window frames are rotted. There is an
RV parked illegally on the property behind an unpermitted fence. He said a
six-foot fence would only be permitted at the back of the property because it
is fronted by a street on three sides.
In response to a question, Mr. Dixon said he has had contact the owner.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before December 27, 2023. If the
Respondent does not comply within the time specified, the Board may
order a fine of $150.00 per day per violation for each day each violation
continues to exist. After 3 months from the recordation date of such
lien, if the fines and fees remain unpaid, the City Attorney's office is
authorized to foreclose, collect or settle such lien using any legal or
equitable remedies available under the law. The motion was duly
seconded and carried unanimously.
4.13Case 128-23 - Find respondent(s) Veracity LLC at 1234 Eldridge St. in violation of
Code for Abandoned Building and Exterior Surfaces; and issue an order with the
compliance deadline and fine if compliance is not met. (Dixon)
Norman McNow was present to represent the Respondent. He admitted to
the violation. In response to a question, Mr. McNow said he works with the
owner of Veracity LLC.
Inspector Dixon provided a PowerPoint presentation. He said the water
has been shut off at the property since 2022. He said the exterior of the
house has stucco issues, peeling paint and the soffits need to be repaired.
Mr. McNow said he would get the utilities turned on today. He is
addressing the exterior surfaces issues. He requested 60 days to come
into compliance.

There was consensus to have a status update on the progress at the
December 20, 2023 meeting.
Member Farrar moved to find the Respondent in violation of the City
of Clearwater Code as referred to in the affidavit in this case. The
motion was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before January 24, 2024 with a status
update provided at the December 20, 2023 meeting. If the Respondent
does not comply within the time specified, the Board may order a fine
of $150.00 per day per violation for each day each violation continues
to exist. After 3 months from the recordation date of such lien, if the
fines and fees remain unpaid, the City Attorney's office is authorized to
foreclose, collect or settle such lien using any legal or equitable
remedies available under the law. The motion was duly seconded and
carried unanimously.
4.14Case 129-23 - Find respondent(s) 715 Laura LLC at 715 Laura St. in violation of Code
for Exterior Surfaces and Door and Window Openings; and issue an order with the
compliance deadline and fine if compliance is not met. (Kasman)

4.15Case 130-23 - Find respondent(s) Cleveland 639 Land Trust at 639 Cleveland St. in
violation of Code for Exterior Surfaces; and issue an order with the compliance

Inspector Kasman provided a PowerPoint presentation. He said there is a
small shed structure attached to the adjoining building but is owned by 639 Land Trust. The shed
structure needs to be cleaned and repainted. He said he spoke to the property manager who said
she would get the work done to bring the property into compliance.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.

4.16Case 131-23 - Find respondent(s) Northshore Partners LLC at 412 Pleasant St. in
violation of Code for Fences and Walls, Exterior Surfaces, and Roof Maintenance;
and issue an order with the compliance deadline and fine if compliance is not met.

No one was present to represent the Respondent.
Inspector Kasman provided a PowerPoint presentation. The bushes are
overgrown and overgrowth covers the sidewalk leading up to the house.
There is debris on the roof and the facia and soffits are not finished, there is
peeling paint, and mildew and mold are growing on the exterior surface. The
fence is in disrepair.
In response to a question, Mr. Kasman said he had contact with the
property owner.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before December 29, 2023. If the
Respondent does not comply within the time specified, the Board may
order a fine of $150.00 per day per violation for each day each

4.17Case 132-23 - Find respondent(s) Family Home Florida Enterprises Corp at 32 N. Ft.

Inspector Kasman provided a PowerPoint presentation. He said there
was a big chunk of missing awning and the flashing was peeling in
places at the entrance to the business. There is also an awning on the
2nd floor that is tattered and ripped. The awning at the entrance was
repaired prior to the meeting but the 2nd story awning is still in disrepair.
He has been in touch with the owner and said he feels compliance will
be met.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.

4.21 Case 136-23 - Find respondent(s) Codabudfit LLC at 1185 Court St. in violation of
Code for Prohibited Signage; and issue an order with the compliance deadline and

Inspector Burghardt provided a PowerPoint presentation. He said a pole
sign on the property is advertising for a business that is not there. There
is signage on the building as well. He said he spoke to the owner who
was selling the property. Inspector Burghardt said he waited until the

sale went through and spoke to the new owner who said they are
waiting on permits for major work to be done on the site and they will
take care of the violations when the permits are approved.
Member Farrar moved to find the Respondent in violation of the City
of Clearwater Code as referred to in the affidavit in this case. The
motion was duly seconded and carried unanimously.

correct the violations on or before January 29, 2024. If the Respondent

5.2 Case 66-23 - Accept the Affidavit(s) of Non-Compliance for respondent(s) Cleveland
Gulf to Bay LLC at 1417 Cleveland St. for Permits. (Espinosa)
Property representative Nick Anderson was present. He said the
property is not yet in compliance and he is working with a design
consultant and needs to get a contractor to pull the necessary permits.
He said the property owner is not ignoring the violations, but working
toward compliance.
Member Kenne moved to continue the acceptance of the Affidavit of
Non-Compliance for Case 66-23 to December 20, 2023. The motion was
duly seconded and carried unanimously.

order that specifies a fine that includes administration costs and establishes a date
payable or the lien will revert to its original amount. (Sudduth)
No one was present to represent the Petitioner.
Discussion ensued with concerns expressed regarding the absence of
the property owner or representative.
Member Kenne moved to continue the lien reduction request for Case
99-18 to December 20, 2023. The motion was duly seconded and
carried unanimously.
6.2 Case 76-21 - Consider request by petitioner(s) The Estate and Unknown Heirs of
Carole E. Martin at 209 S Jupiter Ave. to reduce the fine re Abandoned Building; and
if approved, issue an order that specifies a fine that includes administration costs and

Member Kenne moved to enter an order reducing the amount of the lien
for Case 76-21 to $2,000.00, payable within 30 days or the lien will
revert to its original amount. The motion was duly seconded and

6.3 Case 103-21 - Consider request by petitioner(s) 15 Hollingworth Street Realty Trust at
1831 N Highland Ave. to reduce the fine re Signage without Permits; and if approved,
issue an order that specifies a fine that includes administration costs and establishes

Code Enforcement Division Manager Rebecca Mulder said the property
was in compliance.
Member Kenne moved to enter an order reducing the amount of the
lien for Case 103-21 to $3,000.00, payable within 30 days or the lien will
revert to its original amount. The motion was duly seconded and
carried unanimously.
6.4 Case 91-22 - Approve the Stipulation and Agreement for petitioner(s) Mary M Jones at
924 Mandalay Ave. (Simpson)
Assistant City Attorney Jerrod Simpson reviewed the history of the
violation and the Stipulation Agreement.
Member Farrar moved to accept the Stipulation Agreement for Case
91-22. The motion was duly seconded and carried unanimously.

7. Nuisance Abatement Lien Filings
7.1 Case 145-23 (PNU2023-01071) - Accept the Nuisance Abatement Lien for
respondent(s) Flatrock Holdings Group, LLC at 706 S Ft. Harrison Ave. for Lot
Clearing; and issue an order with the compliance deadline and authorize the City to
mitigate the violation if compliance is not met. (Kasman)
No one was present to represent the Respondent.
Inspector Kasman provided a PowerPoint presentation. He said the little
lawn that there is on the property is overgrown and needs to be cut
back.
Member Farrar moved to enter an order finding the Respondent in
violation of the City of Clearwater Code and requiring the Respondent
to correct the violations within five days of the Board's written order. If
the Respondent does not comply within the time specified, the City
may take all reasonable actions, including entry onto the property, to
abate and maintain the nuisance, and charge the Respondent with the
reasonable costs which will become a lien on the property. After 3
months from the recordation date of such lien, if the costs remain
unpaid, the City Attorney's office is authorized to foreclose, collect or
settle such lien using any legal or equitable remedies available under
the law. The motion was duly seconded and carried unanimously.
7.2 Case 146-23 (PNU2023-01121) - Accept the Nuisance Abatement Lien for
respondent(s) DRB Investments, LLC at 1001 Engman St. for Lot Clearing; and issue
an order with the compliance deadline and authorize the City to mitigate the violation if
compliance is not met. (Dixon)

Inspector Dixon provided a PowerPoint presentation. He said it is a
vacant lot and the property owner has changed a few times and it is
currently not being maintained. The lot is overgrown and debris liters the
property.

violation of the City of Clearwater Code and requiring the Respondent
to correct the violations within five days of the Board's written order. If
the Respondent does not comply within the time specified, the City

passed away and he has been in contact with the attorney who is
handling the estate. He said the bushes are growing into the sidewalk
and the backyard is overgrown.

to correct the violations within five days of the Board's written order. If
the Respondent does not comply within the time specified, the City

7.4 Case 148-23 (PNU2023-00996) - Accept the Nuisance Abatement Lien for
respondent(s) Pavel Pristash at 1258 Franklin St. for Inoperative Vehicle; and issue
an order with the compliance deadline and authorize the City to mitigate the violation if
compliance is not met. (Stephens)
No one was present to represent the Respondent.
Inspector Stephens provided a PowerPoint presentation. He said an
SUV on the property does not have a license tag displayed. He has had
no contact with the property owner or the owner of the vehicle.
Member Farrar moved to enter an order finding the Respondent in
violation of the City of Clearwater Code and requiring the Respondent
to correct the violations within five days of the Board's written order. If
the Respondent does not comply within the time specified, the City
may take all reasonable actions, including entry onto the property, to
abate and maintain the nuisance, and charge the Respondent with the
reasonable costs which will become a lien on the property. After 3
months from the recordation date of such lien, if the costs remain
unpaid, the City Attorney's office is authorized to foreclose, collect or
settle such lien using any legal or equitable remedies available under
the law. The motion was duly seconded and carried unanimously.

vegetation is stuffed into the bushes and is falling into the sidewalk that
boarders Landmark Dr.
