AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A 15 FOOT DRAINAGE AND UTILITY EASEMENT
AS SHOWN ON THE ATTACHED EXHIBIT "A" AND AS
RECORDED IN O.R. BOOK 15904 PAGES 863-868, OF THE
PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, DC CLEARWATER BEACH 1 PROPERTY, LLC., are the owners in fee
simple title of real property located at 309 Coronado Drive, Clearwater, FL 33767, to which have
requested the City to vacate said easement located therein; and
WHEREAS, the City Council of the City of Clearwater, Florida finds this easement not
necessary for municipal use, and it is deemed to be in the best interest of the City and the general
public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER,
FLORIDA:
Section 1. The following:
An easement described as follows:
See Exhibit "A"
Is hereby vacated, closed, and released, and the City of Clearwater releases all rights, title, and
interest thereto, however, this vacation is in no way intended to impact the City's ownership of
Drainage and Public Utility facilities located on the property and other recorded Easements
therein, which are reserved and remain unaffected by this vacation.
Section 2. This vacation is conditioned upon the fee simple owners executing and
delivering to the City of Clearwater a Drainage and Public Utility Easement, as approved
by the City, to be simultaneously recorded following this ordinance adoption.
Section 3. The City Clerk shall record this Ordinance in the Public Records of Pinellas
County, Florida, following adoption, and this Ordinance shall take effect immediately
upon recording in the Public Records.
