The project will be 150 feet in height, proposes a minimum of 298 off-street parking spaces available for the hotel with 230 additional off-street parking spaces available to the general public and continues to include a proposed pedestrian overpass bridge extending between the subject site and 430 South Gulfview Boulevard (Opal Sands Resort) spanning Beach Walk and the South Gulfview Boulevard right-of-way as previously approved. The project requests allowable flexibility from height, setback requirements and the Design Guidelines of Beach by Design and a two- year Development Order (Community Development Code Sections 2-803.D and 4-407). Case: CPA2022-10002 — Amendments to the Comprehensive Plan related to the Parks and Recreation Impact Fee Level Three Application Applicant: City of Clearwater, Parks & Recreation Department. Request: The Community Development Board is reviewing a request to amend the City of Clearwater's Comprehensive Plan to address the creation of a new Parks and Recreation impact fee system and is making a recommendation to the City Council. Neighborhood Associations: Clearwater Neighborhoods Coalition, Board of County Commissioners, Pinellas County School Board Presenter: Art Kader, Parks and Recreation Assistant Director, Art.Kader@myclearwater.com Attorney Mytych requested that the Board accept Art Kader, Interim Parks & Recreation Director, as the City's expert witness in parks and recreation impact fees. Mr. Kader has been working with the consultant to prepare the ordinance and the associated impact fees. Board Member Rector moved to accept Art Kader as an expert witness in the subject matter. The motion was duly seconded and carried unanimously. Mr. Kader reviewed his professional experience and the request to amend the city of Clearwater's Comprehensive plan to address the creation of a new Parks and Recreation impact fee system. Community Development Board 2023-03-21 4 DocuSign Envelope ID: 1742511A-9193-4655-BE9B-9467C9134AFE In response to a question, Mr. Kader said the current ordinance requires fees collected at a facility must be spent within its vicinity. Board Member Rector moved to recommend to the Clearwater City Council approval of proposed Ordinance 9638-23, which would amend the City of Clearwater's Comprehensive Plan to address the creation of a new Parks and Recreation impact fee system, based on the Findings of Fact and Conclusions of Law, and the information provided to the Board, including the Staff Report. The motion was duly seconded and carried unanimously. 2. Case: TA2022-10002 — Amendments to the Community Development Code related to the Parks and Recreation Impact Fee Level Three Application Applicant: City of Clearwater, Parks & Recreation Department. Request: The Community Development Board is reviewing a request to amend the City of Clearwater's Community Development Code to replace Chapter 54 in its entirety with a revised Chapter 54, creating a new Parks and Recreation impact fee system, and is making a recommendation to the City Council. Neighborhood Associations: Clearwater Neighborhoods Coalition, Board of County Commissioners, Pinellas County School Board Presenter: Art Kader, Parks & Recreation Assistant Director, Art.Kader@myclearwater.com. Attorney Mytych requested the Board accept Art Kader as the City's expert witness in impact fees related to Parks and Recreation. Board Member Rector moved to accept Art Kader as an expert witness. The motion was duly seconded and carried unanimously. Mr. Kader reviewed the proposed impact fee system. In response to questions, Mr. Kader said the fees in the current ordinance have been in place for 40 years. The proposed ordinance will increase the fees by 40%. He said the current impact fee for single-family homes is $200. The proposed ordinance will impact new development. He said, for example, if an office building is torn down to construct housing, a new impact fee will be issued. The proposed ordinance will issue an impact fee for new residential development. Mr. Kader said staff researched 16 comparable cities with similar impact fees for single family homes and found the fees were over$4,000. Staff recommended an impact fee that was 70% below the suggested rate and in the middle of comparable cities. He said staff will review the impact fees every five years. The motion was duly seconded and carried unanimously. I. Director's Items Attorney Daigneault said the Board is required to elect a Chair and Vice Chair for the coming year at the March meeting. There is no established process. He said any member may nominate another member; a second is not required. Board Member Hutkin nominated Member Quattrocki as Chair. Board Member Park moved to appoint John Quattrocki as Chair. The motion was duly seconded and carried unanimously. Board Member Park nominated Bruce Rector as Vice Chair. Chair Quattrocki moved to appoint Bruce Rector as Vice Chair. The motion was duly seconded and carried unanimously. Planning and Development Director Gina Clayton thanked the Board for approving the special meeting in May. She said there will be a public engagement activity in April; information will be shared with the Board. J.
