Nuisance Abatement Board Meeting Minutes October 4, 2023

To provide continuity for research, items are listed in agenda order although not
necessarily discussed in that order.
1. Call to Order— Chair Baker
The meeting was called to order at 3:07 p.m.
2. Approval of Minutes
2.1 Approve the minutes of the June 7, 2023 Nuisance Abatement Board meeting as
submitted in written summation by the City Clerk.
Board Member Persechino moved to approve the minutes of the
June 7, 2023 Nuisance Abatement Board meeting as submitted in
written summation by the City Clerk. The motion was duly
seconded and carried unanimously.
3. Citizens to be Heard Regarding Items Not on the Agenda — None.
4. Old Business Items
4.1 Discuss status of Case No. 2022-01 - City of Clearwater v. Estate of Josephine Dixon.
Assistant City Attorney Melissa Isabel reviewed the case and said Lt.
Wannos, the case manager, has not heard from the Dixons or received
information that the terms of the order have been complied with. She said
the Board is being asked to impose the totality of the fine, which is
$2,250.
In response to a question, the City Clerk said her office did not provide notice
of today's hearing because Ms. Isabel's office handled the previous
meeting notice. Ms. Isabel said Mr. Lirot, the family's attorney, was

noticed of today's hearing.
Attorney Trask questioned if due process has been provided to the
estate. Staff stated that the meeting notice was provided. The Board can rely
on that information, or continue the meeting to another date so the estate
can receive written notice of the hearing.
The City Clerk said the Board typically meets on the first Wednesday of
the month; the next meeting can be held November 1, 2023.
Chelsea Gird, a concerned citizen, was swom in prior to her testimony.
Ms. Gird said she is familiar with the subject property and drives by it
everyday. She saw the notice for today's hearing posted on the front door.
She said she noticed a camera on the front door; it is not a Ring camera.
She did not notice any motion sensor lights on the property. She did not
see what the notice said.
Discussion ensued with a comment made that confirmation of the
meeting notice should be provided.
Board Member Persechino moved to continue Item 4.1 to
November 1, 2023. The motion was duly seconded and carried
unanimously.
The meeting adjourned at 3:20 p.m.
