To provide continuity for research, items are in agenda order although not necessarily
discussed in that order.
The Chair outlined procedures and stated any aggrieved party may appeal a final administrative
order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County within
thirty days of the execution of the order. Florida Statute 286.0105 requires any party appealing a
decision of this Board to have a record of the proceedings.
1. Call To Order
The Chair called the meeting to order at 1:30 p.m. followed by the Pledge
of Allegiance.
2. Approval of Minutes
Member Schultz moved to approve the minutes of the August 23, 2023
Municipal Code Enforcement Board meeting as submitted in written
summation. The motion was duly seconded and carried unanimously.
3. Citizens to be Heard Regarding Items Not on the Agenda
Bill Jonson expressed a concern regarding the non-compliance of violations
at 1510 Barry St. He said if the City and Board are not serious about board
orders and settlement agreements, then why would the property owner feel
they need to comply.
Assistant City Attorney Jerrod Simpson said there has been movement
toward compliance with this property even though it may not seem like it.
Nick Anderson requested additional time for compliance for the
violations at 1417 Cleveland St.
Attorney for the Board Andy Salzman said this case is not on today's
agenda and Mr. Anderson was instructed to work with the inspector.

4.2 Continued from August 23, 2023 - Case 69-23 - Find respondent(s) Dixon, Josephine
Est at 207 Pennsylvania Ave. in violation of Code for Exterior Surfaces; and issue an
order with the compliance deadline and fine if compliance is not met. (Dixon)
Property representative Kimberly Johnson was present. She said she is
having trouble obtaining a permit because the property is in an estate
and she is not the property owner.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Inspector Greg Dixon provided a PowerPoint presentation. He said there
is stucco damage and failing paint on the house. Pictures show the
house is in almost the same condition it was when the case was opened
in April of this year.
In response to a question, Assistant City Attorney Jerrod Simpson said
one must be owner of title to obtain a builder permit. Ms. Johnson could
hire a contractor to pull a permit and do work.
In response to a question, Ms. Johnson said she is unable to find a
contractor to perform work. She said she has been able to obtain permits
for this property in the past.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before November 25, 2023. If the
Respondent does not comply within the time specified, the Board may
order a fine of $150.00 per day per violation for each day each violation
continues to exist. After 3 months from the recordation date of such
lien, if the fines and fees remain unpaid, the City Attorney's office is
authorized to foreclose, collect or settle such lien using any legal or
equitable remedies available under the law. The motion was duly
seconded and carried unanimously.
4.3 Continued from July 26 and August 23, 2023, Continue to November 29, 2023 - Case
67-23 - Find respondent(s) Glozal Village LLC at 1510 Barry Rd. in violation of Code for

No one was present to represent the Respondent.
Inspector John Stephens provided a PowerPoint presentation. He said
the plywood covering on the windows have been vandalized with graffiti.
He has had no contact with the owner but the postings have been
removed and the grass has been cut.
Member Farrar moved to find the Respondent in violation of the City
of Clearwater Code as referred to in the affidavit in this case. The
motion was duly seconded and carried unanimously.
Member Rainey moved to enter an order requiring the Respondent to
correct the violations on or before October 27, 2023. If the Respondent
does not comply within the time specified, the Board may order a fine
of $150.00 per day per violation for each day each violation continues
to exist. After 3 months from the recordation date of such lien, if the

Inspector Kasman provided a PowerPoint presentation. He said he has
been in contact with the property owner who is considering demolishing
the structure. He said exterior surface issues still exist with peeling paint
and rust stains and some windows needs to be repaired or replaced.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.

correct the violations on or before October 27, 2023. If the Respondent

Property owner Steve Stellar was present and admitted to the violations.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Inspector Kasman provided a PowerPoint presentation. He said when he
first saw the property, there were inoperative vehicles stored at the

property which have since been taken care of. One person was living on a
bus at the property, there were several items being stored on the property
and a piece of metal siding was missing from the building. He said
exterior storage items would appear then be removed. As of today, there
are exterior storage items that need to be removed, the storage pod
remains, and the exterior surfaces need to be addressed.
Mr. Stellar said most of the issues have been corrected and nobody is
living on the bus anymore. He said the warehouse is for personal use but
items appear on the property and he throws them out. He said he needs
to find someplace to store the storage container. In response to a question,
Mr. Stellar said he had painted the exterior but then bad weather came in
and there are a couple spots that need attention.
Member Farrar moved to enter an order requiring the Respondent to
correct the violations on or before October 27, 2023. If the Respondent
does not comply within the time specified, the Board may order a fine
of $150.00 per day per violation for each day each violation continues
to exist. After 3 months from the recordation date of such lien, if the
fines and fees remain unpaid, the City Attorney's office is authorized to

4.11 Case 81-23 - Find respondent(s) Robert Schoeller, Shawn Schoeller, and Tim Schoeller
at 632 Drew St. in violation of Code for Exterior Surfaces; and issue an order with the
compliance deadline and fine if compliance is not met. (Kasman)
Property owner Shawn Schoeller was present and admitted to the
violation.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.
Inspector Daniel Kasman provided a PowerPoint presentation. He said
vines are growing on the building as well as cracked stucco is visible. The
courtyard area is filled with vines and a tree is growing into the building.
There is also missing brickwork.
Ms. Schoeller said she was abroad for nine months. She said she put a
new fence up and cleaned up the front of the building. She was unaware
that the vines needed to be removed as she considers them decorative.

In response to a question, Mr. Kasman said the vine cannot be on the
structure or growing on the building.
Member Rainey moved to enter an order requiring the Respondent to
correct the violations on or before November 25, 2023. If the
Respondent does not comply within the time specified, the Board may
order a fine of $150.00 per day per violation for each day each violation
continues to exist. After 3 months from the recordation date of such
lien, if the fines and fees remain unpaid, the City Attorney's office is
authorized to foreclose, collect or settle such lien using any legal or
equitable remedies available under the law. The motion was duly

4.12Case 82-23 - Find respondent(s) Emanuel Retails LLC, Nabil S Thomas at 706 Drew St.
in violation of Code for Portable Storage Units; and issue an order with the compliance
deadline and fine if compliance is not met. (Kasman)
Property owner Raouf Guirguis was present and denied the violation. He
said he needs storage space.
Inspector Daniel Kasman provided a PowerPoint presentation. He said
the initial complaint was for chickens being kept on the property. He
observed individuals raising chickens in the rear of the property which is
not allowed in the downtown district. He also observed inoperative
vehicles. The chickens have been removed and inoperative vehicles
have been taken care of and the only remaining issue is the storage unit.
The property owner considers the storage unit a shed.
In response to a questions, Mr. Kasman said a portable storage unit is
allowed on a property if there is an active construction permit. He said the
portable storage unit is not appropriate for outdoor storage.
In response to a question, Assistant Building Official Dana Root said it is
possible to have a storage unit as a shed but it must be permitted and
meet development code and setbacks. Assistant City Attorney Jerrod
Simpson said in order for a storage unit to be used as a shed, it must
meet building code for how it is constructed and meet the zoning code for
setbacks.
Member Farrar moved to find the Respondent in violation of the City of
Clearwater Code as referred to in the affidavit in this case. The motion
was duly seconded and carried unanimously.

framed in with a tarp wrapped around it to make it appear there was a wall.
In response to a question, Mr. Stephens said he has attempted to
communicate with the homeowner but he is difficult to understand.

correct the violations on or before October 27, 2023. If the Respondent
does not comply within the time specified, the Board may order a fine

meeting and requested a declaration of violation.

violation was corrected prior to today's hearing, and to enter an order
that no fine be imposed against the Respondent. If the Respondent
repeats the violation, the Board may order a fine of up to $500 for

Property owner Eddie Garrido said he has had several family emergencies
happen since he was last in front of the Code Enforcement Board. He said
his uncle is a general contractor who will pull the permit. He said he has
spoken to Assistant Building Official Dana Root who will allow the engineer
to submit plans directly to him via email with the proper certifications. He
requested more time before the Board accepts the Affidavit of
Non-Compliance to allow time for his uncle to apply for the required permit.
Member Farrar moved to continue the acceptance of the Affidavit of
Non-Compliance to the October 25, 2023 meeting. The motion was
duly seconded and carried unanimously.

property is vacant. The trees are overgrown and landscaping is growing
over the sidewalk. The property is littered with dead trees, lumber, large
piles of brush, cardboard, and branches. A homeless encampment was
discovered by the Police Department. He has attempted to contact the
owner but there is no tenant at their mailing address.
Member Farrar moved to enter an order finding the Respondent in
violation of the City of Clearwater Code and requiring the Respondent
to correct the violations within five days of the Board's written order. If
the Respondent does not comply within the time specified, the City
may take all reasonable actions, including entry onto the property, to
abate and maintain the nuisance, and charge the Respondent with the
reasonable costs which will become a lien on the property. After 3
months from the recordation date of such lien, if the costs remain
unpaid, the City Attorney's office is authorized to foreclose, collect or
settle such lien using any legal or equitable remedies available under
the law. The motion was duly seconded and carried unanimously.

and not currently living at the property. The vehicle is just a shell and
they tried finding a scarp yard to come take it away but have had no
response. They requested the City remove the vehicle.
