BY WAY OF ADOPTION TO SERGEANT ROBERT MAIN
This Agreement is made and entered into between the City of Clearwater, Florida,
hereinafter the "City," and Sergeant Robert Main.
WHEREAS, Canine Cash is 7 years and 7 months old and has exceeded the average
working life of a Clearwater Police Canine, which, based on our experience, has been
approximately 5 years. The canine veterinarian Dr. Greg Masters has determined, based
on his 30 -years of experience, Canine Cash should not be exposed to the physical
demands of a canine handler school due to his age.
WHEREAS, it would be impossible for anyone to gain the knowledge and compatibility
that was gained by the handler/canine team during approximately five years of canine
work. Dr. Masters identifies Canine Cash as "handler sensitive" and believes Canine
Cash is likely to respond poorly and potentially aggressive to a new hander.
WHEREAS, Canine Cash is a certified police canine trained to apprehend suspects and
will not make a good pet for anyone.
WHEREAS, Canine Cash is handler sensitive and will respond poorly to another
individual.
WHEREAS, Canine Cash has worked for the police department for approximately five
years.
WHEREAS, the Canine Cash has no commercial value and little market value
estimated to be less than $500.
WHEREAS, Code of Ordinances, Section 2.623(1), authorizes the surplus sales officer
to classify as surplus any tangible personal property owned by the city when that
property is determine to be obsolete, or the continued use of the property is
uneconomical or inefficient, or the property serves no useful function to the City.
WHEREAS, Code of Ordinances, City of Clearwater, Section 2.623(4), authorizes
property designated for disposal be donated when the market value is less than the
current fixed asset control level.
WHEREAS, Michael Walek, Interim Chief of Police, recommends Canine Cash be
retired from service and the city transfer ownership to Sergeant Robert Main.
NOW THEREFORE, in consideration of the promises contained in the Agreement, the
parties agree as follows:
1. The City agrees to transfer ownership of Canine Cash to Sergeant Robert Main by
way of adoption. In consideration for the adoption and transfer of ownership,
Sergeant Robert Main agrees to pay to Clearwater Police Department a payment in
the amount of $1.00 (one dollar).
2. Sergeant Robert Main agrees to assume ownership and all responsibility for the care
of Canine Cash.
3. Sergeant Robert Main agrees to indemnify and hold the City harmless from any and
all claims, suits, judgments, and liability for death, personal injury, or property
damage attributable to the dog's actions occurring after the Agreement is executed
by both parties, including legal fees, court costs, and other legal expenses.
4. The effective date of this agreement and transfer shall be July 15, 2023.
