9667-23DocuSign Envelope ID: CFAFF6EC-8A16-4007-8656-B6C0FAEE2644 ORDINANCE NO. 9667-23 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, VACATING A PORTION OF A PLATTED DRAINAGE AND UTILITY EASEMENT LOCATED ON LOT 1, BLOCK F, NORTHWOOD ESTATES — TRACT F, ACCORDING TO THE MAP OR PLAT THEREOF, AS RECORDED IN PLAT BOOK 77, PAGES 46-47, OF THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA, PROVIDING AN EFFECTIVE DATE. WHEREAS, Edgar and Vanessa Sherlock are the owners in fee simple title of real property located at 2584 Deer Run East, Clearwater, FL 33761-3933, and to clear a cloud on title due to an encroachment into a City easement, they have requested that the City partially vacate said easement located therein; and WHEREAS, the City Council of the City of Clearwater, Florida finds that the portion of said easement within the encroachment is not necessary for municipal use and it is deemed to be in the best interest of the City and the general public that the same be vacated; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following: The portion of the easement described as follows: See Exhibit "A" Is hereby vacated, closed, and released, and the City of Clearwater releases all rights, title, and interest thereto, however, this vacation is in no way intended to impact the City's ownership of the remainder of the easement on the property, which is reserved and remains unaffected by this vacation. Section 2. The City Clerk shall record this ordinance in the Public Records of Pinellas County, Florida, following adoption. Section 3. This ordinance shall take effect immediately upon adoption.
