1. Call To Order
The Vice Chair called the meeting to order at 1:30 p.m. at the Main
Library, followed by the Pledge of Allegiance.
The Vice Chair outlined procedures and stated any aggrieved party may appeal a final
administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas
County within thirty days of the execution of the order. Florida Statute 286.0105 requires any party
appealing a decision of this Board to have a record of the proceedings.
To provide continuity for research, items are in agenda order although not necessarily
discussed in that order.
2. Approval of Minutes
2.1 Approve the minutes of the August 24, 2022 Municipal Code Enforcement Board meeting
as submitted in written summation.
Member Farrar moved to approve minutes of the August 24, 2022
Municipal Code Enforcement Board meeting as submitted in written
summation. The motion was duly seconded and carried unanimously.
3. Citizens to be Heard Regarding Items Not on the Agenda
Bill Jonson thanked the Board for their efforts, showed photos of
improvements to properties previously cited for violations, and encouraged the
Board to monitor compliance.
4. New Business Items
4.1 Continued from April 27 and July 27, 2022, Continue to March 22, 2023 - Case 19-22 -
Find respondent(s) Sunshine Towers Apt Residences at 1243 Martin Luther King, Jr.
Ave., Bldg. C in violation of Code for Unsafe Building; and issue an order with the

Attorney Adam Gurley, representing the condo association, reviewed repair
efforts. He said materials for temporary stairs for the building's rear were
shipped to southwest Florida following the hurricane. He said the contractor
reordered the materials and estimated delivery within 10 weeks. He said
SCI Engineering submitted certification to the City that jacks installed by the
firm provided sufficient stability for temporary shoring. He requested
scheduling the next status report in 90 days.
Member Farrar moved to schedule a Status Update on January 25,
2023. The motion was duly seconded and carried unanimously.
4.3 WITHDRAWN - Case 73-22 - Find respondent(s) Lasalle Properties LLC at 1849
Rainbow Dr. in violation of Code for Exterior Surfaces; and issue an order with the
compliance deadline and fine if compliance is not met. (Kasman)

4.4 Case 74-22 - Find respondent(s) 1472 Pierce LLC at 1472 Pierce St. in violation of
Code for Exterior Storage; and issue an order with the compliance deadline and fine if

Inspector Daniel Kasman provided a PowerPoint presentation and showed
photos of the property and violations. Since the owner's initial cleanup,
construction materials have been left in the yard again.

of Clearwater Code as referred to in the affidavit in this case. The
motion was duly seconded and carried unanimously.
Inspector Kasman recommended compliance by November 26, 2022 or a
fine of$150 per day be imposed for the exterior storage violation.

Inspector Daniel Kasman provided a PowerPoint presentation and showed
photos of the property and violations. The boat, relocated from the front yard
to behind a partial fence, can still be seen from the street. A motorcycle has
been parked on the sidewalk recently.

of Clearwater Code as referred to in the affidavit in this case. The
motion was duly seconded and carried unanimously.
Inspector Kasman recommended compliance by November 26, 2022 or a
fine of$150 per day be imposed for the Residential Grass Parking violation.

photos of the property and violations. Rear exterior surfaces have mildew,

algae, and growing vines. Shopping carts from multiple businesses were
scattered across the rear of the property. Today's photo showed a shopping
cart belonging to another business in the back of the property.

of Clearwater Code as referred to in the affidavit in this case. The
motion was duly seconded and carried unanimously.
Inspector Kasman recommended compliance by November 26, 2022 or a
fine of$150 per day per violation be imposed for the exterior surfaces and
shopping carts violations.

of up to $500 for each day the violation continues to exist. The

4.14Case 84-22 - Find respondent(s) Gertrudis Garcia at 2082 Camellia Dr. in violation of
Code for Roof Maintenance; and issue an order with the compliance deadline and fine if

photos of the property and roof maintenance violation. A contractor had
voided the permit. Photos showed tarp hanging from the roof and roof

construction materials piled in the carport. He told the owner that the roof
needed to be repaired but no work has been done and a permit has not
been obtained.

motion was duly seconded and carried unanimously.
Inspector Kasman recommended compliance by November 26, 2022 or a
fine of$150 per day be imposed for the roof maintenance violation.

property and violations. On September 23, 2022 a neighbor mowed the
overgrown yard. Mildew and algae remain visible on the decorative wall.
Member Farrar moved to find the Respondent(s) in violation of the City
of Clearwater Code for exterior surfaces as referred to in the affidavit in
this case. The motion was duly seconded and carried unanimously.
Inspector Mulder said compliance had been met for the landscaping violation
and requested a declaration of violation.
Member Farrar moved to find the Respondent was in violation of the
City of Clearwater Code for landscaping maintenance as referred to in
the affidavit in this case, the landscaping violation was corrected prior
to today's hearing, and to enter an order that no fine be imposed
against the Respondent. If the Respondent repeats the violation, the
Board may order a fine of up to $500 for each day the violation continues
to exist. The motion was duly seconded and carried unanimously.

Inspector Jason Cantrell provided a PowerPoint presentation and presented
photos of the property and violation. A permit for the house's roof is active
No permits have been pulled to repair the damaged detached garage, only
scorched exterior studs remain following the fire which did not damage the

house. Power to the house is on but not to the garage. Permits are
necessary to repair/replace all parts of the substantially damaged garage
structure. An Engineer will need to sign off on the stability of the remaining
structure for permits if the owner intends to use the damaged studs.
Ms. Jones said the wood is salvageable. She said she had sanded down the
scorched parts of the exterior cedar studs. She said it is difficult to find help
as many trade workers are repairing storm damages in Southwest Florida
Inspector Cantrell recommended compliance by obtaining required permits
by November 28, 2022 and completing permitted repairs by February 28,
2023 or a fine of$150 per day be imposed.

Inspector Jason Cantrell provided a PowerPoint presentation of the property
and violation. After the electric meter was removed, residents stole power by
bypassing the missing meter. A police officer was shocked during a police
raid of the property. Following the incident, the electric company cut power
