To provide continuity for research, items are in agenda order although not necessarily discussed in that order. B. ROLL CALL: C. APPROVAL OF MINUTES OF PREVIOUS MEETING: August 16, 2022 Member Rector moved to approve the minutes of the August 16, 2022 Community Development Board meeting as submitted in written summation. The motion was duly seconded and carried unanimously. Alternate Member Hutkin did not vote. D. CITIZENS TO BE HEARD RE ITEMS NOT ON THE AGENDA: Bill Jonson said the Notice of Hearing for the September 20, 2022 CDB (Community Development Board) meeting stated the staff report and materials would be posted on the City's website 5 days prior to the meeting; that was not the case. Re Case FLD2022-05017, he said staff did not inform the board that Code did not support the applicant's request to continue a non-conforming use. E. CONSENT AGENDA: The following cases are not contested by the applicant, staff, neighboring property owners, etc. and will be approved by a single vote at the beginning of the meeting: (Items 1-2) Community Development 2022-10-18 1 1. Case: FLD2022-07020 — 1185 Court Street Level Two Application Owner(s): In Your Face Skin Care, LLC. Request: The Community Development Board is reviewing a proposed approximately 6,000 square foot (0.17 FAR) light assembly use in the Commercial (C) District for the property located at 1185 Court Street. The proposed project will be approximately 15 feet in height (from grade) and requests allowable flexibility regarding landscaping, use, setbacks, provision of a loading zone space and parking (Community Development Code Sections 2-704.H, 3- 1202.G and 3-1406.A.3). Request: The Community Development Board is reviewing a 23-lot preliminary plat to construct a 22-unit attached dwelling use in the Medium Density Residential (MDR) District for the property located at 1524/1532 South Highland Avenue and an abutting unaddressed parcel (PIN 23-29-15-79254-002-0010). The project will be 30 feet in height, provides two off-street parking spaces per unit and requests allowable flexibility from setback requirements (Community Development Code Section 2-304.G and Article 4, Division 7, Subdivisions/Plats). Neighborhood Association: Clearwater Neighborhoods Coalition, Board of County Commissioners, Pinellas County School Board. Community Development 2022-10-18 2 Member Rector moved to accept David Ojeda as an expert witness in the fields of civil engineering, land development, utilities, construction and building permits, stormwater, and FEMA (Federal Emergency Management Agency) floodplain regulations. The motion was duly seconded and carried unanimously. Alternate Member Hutkin did not vote. Senior Planner Melissa Hauck-Baker provided a PowerPoint presentation of the Staff Report. The use is permitted and abuts a similar development. Project sidewalks will provide pedestrian connections and visibility triangle requirements will be met. The applicant is requesting less flexibility than permitted. Senior Engineering Specialist David Ojeda said Duke Energy is responsible for power lines along Highland Avenue. There are no plans to install a traffic signal or widen Highland Avenue at the project site. Housh Ghovaee, representing the applicant, said the project was redesigned to dedicate a portion of the site to the City for a utility easement as required by Code. He said the project will build new sidewalks and eliminate the ditch. He said the request is necessary as the site's border along the right-of-way jogs 7 feet. He said mechanical equipment must meet City regulations. He said an advanced drainage system that meets City and SWFWMD (Southwest Florida Water Management District) stormwater requirements will be installed. A resident spoke in opposition to the request and application as presented. Member Rector moved to approve Case FLD2022-02009/PLT2022- 01001 based on evidence in the record, including the application and the Staff Report, and here by adopt the Findings of Fact and Conclusions of Law stated in the Staff Report, with conditions of approval as listed. The motion was duly seconded and carried unanimously. Alternate Member Hutkin did not vote. F. LEVEL TWO APPLICATION: (Item 1) 1. Level Two Application Case: FLD2022-05016/PLT2022-05006 — 1951 North Belcher Road Owner(s): AL-ADWAN LLC. Location: 2.369 acres consisting of one parcel on the west side of North Belcher Road and bound by North Belcher Road on the west and Old Coachman Road on the north and east (to be platted into two separate parcels with Parcel 1 to be 1.227 acres and Parcel 2 to be 1.143 acres). Request: The Community Development Board is reviewing a two-lot preliminary plat to construct an approximately 4,350 square-foot vehicle service, limited use (car wash) consisting of one building 25 feet in height and a minimum of 22 parking spaces (five spaces per 1,000 square-feet gross floor area) on proposed Parcel 1 and to construct an approximately 6,750 square-foot retail plaza consisting of one building up to 25 feet in height and a minimum of 27 parking spaces (four spaces per 1,000 square-feet of gross floor area) on proposed Parcel 2, Community Development 2022-10-18 3 both in the Commercial (C) District for the property located at 1951 North Belcher Road. The project requests allowable flexibility regarding use and building orientation related to the vehicle service, limited use as a comprehensive infill redevelopment project (Community Development Code Section 3-704.F., Article 4, Division 7, Subdivisions/Plats). The motion was duly seconded and carried unanimously. Alternate Member Hutkin did not vote. Senior Planner Mark Parry provided a PowerPoint presentation of the Staff Report. Staff supports the request except for the ten 11-foot-tall vacuum booms proposed to span 13 feet along Belcher Road, which is designated as a primary scenic road. The booms would be visually unappealing from the street. Parking spaces can remain in this area, the application proposes more parking spaces than required. Member Quattrocki moved to accept P. Ely Payne as an expert witness in the fields of Civil Engineering, Industrial Engineering and Transportation and to accept Stephen Sposato as an expert witness in the fields of Planning and Transportation. The motion was duly seconded and carried unanimously. Alternate Member Hutkin did not vote. Todd Pressman, representing the applicant, said removing the vacuums would be a deal breaker as they are critical to the business. He provided a PowerPoint presentation on the site and application. He showed photographs of the current site's boarded retail store and carwash and drawings of site plan changes that reoriented the development, reduced the retail store's size, added hedges and 6— 8 trees to increase buffering and screening along Belcher Road, and relocated the vacuums away from the road. Stephen Sposato, representing the applicant, said the vacuums were necessary for the 2"d phase of the car wash process. He said redeveloping the site was challenging. He said the project is integrated in the shopping center and does not intensify or expand the current use or add access points. He said proposed additional landscaping will diffuse site lines and mitigate views of the vacuums. Community Development 2022-10-18 4 In response to a question, Ely Payne, representing the applicant, said the retail building was pulled away from the right-of-way, saving trees. He said a 2nd row of hedges was added for screening. Jim Tredwell, representing the property owners, said the owners were willing to compromise, the size of the carwash tunnel was previously reduced. He said while it was preferable to retain the vacuum booms as presented, the number of vacuums could be reduced. He said the owners were anxious for a decision as the sales contract was expiring. He said a list of all newly proposed landscaping had been prepared for staff. Discussion ensued re the exact neutral color proposed for the booms and ways to reduce the vacuums along Belcher Road. Planning Manager Ellen Crandall said signage is permitted separately. Staff requested time to discuss changes to the site plan with the applicant. Member Haudricourt moved to suspend the hearing for Case FLD2022-05016/PLT2022-05006 to conclude after the staff presentation. The motion was duly seconded and carried unanimously. Alternate Member Hutkin did not vote. The Community Development Board recessed from 2:53 to 3:02 p.m. Ms. Crandall reported the applicant had agreed to install additional landscaping, remove 5 vacuum booms in the northwest portion of the property along Belcher Road, remove 4 parking spaces in that area, and paint the booms white to match the building. She reviewed the modified conditions of approval. Staff recommended approval of the project with these changes. Mr. Pressman said the applicant agreed to the conditions of approval as presented. Member Rector moved to approve Case FLD2022-05016/PLR2022- 05006 based on evidence in the record, including the application and the Staff Report, and here by adopt the Findings of Fact and Conclusions of Law stated in the Staff Report, with conditions of approval as listed with changes: 1) Amended Condition 5: "That, prior to the issuance of any building construction permit, excluding demolition and clearing and grubbing, accessory/mechanical equipment, including the A/C unit on the east side of the building along Old Coachman Road, are removed;" 2) Condition 11 "That, prior to the issuance of any building construction permits, excluding demolition and clearing and grubbing, revised plans are submitted that remove the four parking spaces and five booms at the northwest corner of the site and provide improved landscape plans with additional trees and plants including native understory, sensitive to the existing tree root systems, to the satisfaction of City staff;" and 3) Condition 12 "That, the vacuum booms shall be painted white to match the building to the satisfaction of City staff." Community Development 2022-10-18 5 The motion was duly seconded and carried unanimously. Alternate Member Hutkin did not vote. G. DIRECTOR'S ITEM: 1. Presentation on Clearwater 2045 Comprehensive Plan Vision Statement & Preliminary Framework Report by Jayme Lopko H. ADJOURN Attest: Long Range Planning Manager Jayme Lopko provided a PowerPoint presentation re progress on the Clearwater 2045 Comprehensive Plan Vision Statement and Preliminary Framework Report. She reviewed the aspirational vision statement, planning themes, preliminary plan framework, and chapters. Staff is scheduled to hold workshops and draft plan elements through Spring 2023. The approval process will start with the CDB next Fall. Discussion ensued with recommendations the report consider rapidly increasing sea level rise, electric vehicles, phasing out natural gas, and installing resilient electrical backup batteries to power the City after a devastating hurricane.
