Call to Order The meeting was called to order at 3:05 p.m. 2. Approval of Minutes 2.1 Approve the minutes of the March 4, 2020 Nuisance Abatement Board meeting as submitted in written summation by the City Clerk. Board Member Baker moved to approve the minutes of the March 4, 2020 Nuisance Abatement Board meeting as submitted in written summation by the City Clerk. The motion was duly seconded and carried unanimously. 3. Citizens to be Heard Regarding Items Not on the Agenda — None. 4. New Business Items 4.1 Elect Chair and Vice Chair. Per the Board's Rules of Procedure, the Board must elect a Chair and Vice Chair annually. The Chair may not serve more than two consecutive terms as Chair. The City Clerk said, per the Board's rules, Ms. Grayston is eligible to serve as Chair for another term. A motion will be needed for a new Vice Chair as the current Vice Chair is no longer serving. Page 2 City of Clearwater Nuisance Abatement Board Meeting Minutes June 2, 2021 Board Member Baker moved to elect Leanne Grayston as Chair. The motion was duly seconded and carried unanimously. Board Member Coley moved to elect Leslie Coley as Vice Chair. The motion was duly seconded and carried unanimously. 4.2 Review Nuisance Abatement Ordinance and Sunshine Law. Attorney Trask said, as the Board's attorney, he represents the Board's interests and ensures due process is given and that Board Rules and city code are followed. He reviewed the City's nuisance abatement ordinance and the Florida Sunshine Law. He provided members with a copy of the 2021 Florida Guide to the Sunshine Amendment and Code of Ethics for Public Officers and Employees and F.S. Chapter 119, Public Records. In response to a question, the City Clerk said members of the public may request the email addresses for Board Members in order to send correspondence regarding an agenda item or potential topic, unless a Board Member cites an applicable exemption, the email addresses are public record. Board members should not engage in a conversation over email regarding matters that may potentially come before the Board as it is a Sunshine violation. 4.3 Staff update on the Nuisance Abatement process. Assistant City Attorney Matt Smith provided an overview of the City's nuisance abatement process. Cases typically involve drugs, gang activity, or prostitution. If a case fits within the city ordinance and state statute, staff prepares a letter notifying the property owner of the issue ordering them to contact the local Lieutenant within ten days. He said it an interactive process where the police Lieutenant works with the property owner to mitigate the nuisance. Cases are brought before the Board when the mitigation process fails. In response to questions, Mr. Smith said the Board maintains jurisdiction for a year on the orders issued by the Board. The process has made a difference in addressing nuisance activity. The case involving the hotel functioning as an apartment has been resolved. He said the main issue was the type of clientele the property attracted.
