AGREEMENT TO TRANSFER OWNERSHIP OF CANINE GRIMM BY WAY OF ADOPTION TO OFFICER ROBERT PEASEAGREEMENT TO TRANSFER OWNERSHIP OF CANINE GRIMM BY WAY OF ADOPTION TO OFFICER ROBERT PEASE This Agreement is made and entered into between the City of Clearwater, Florida, hereinafter the "City," and Officer Robert Pease. WHEREAS, Canine Grimm is a four-year, eight-month old Belgian Malinois/German Shepherd mix and been in service as a police canine with the Clearwater Police Department since 2019. WHEREAS, Officer Robert Pease has been with the department for 30 -years and has been a canine handler for 20 -years with the Clearwater Police Department Canine Unit. Officer Robert Pease is currently assigned as the canine handler for Canine Grimm. Officer Robert Pease will be retiring from the Clearwater Police Department on September 30, 2022. Officer Pease does not have any small children and can care for Canine Grimm. WHEREAS, Canine Grimm has been evaluated by multiple certified Florida Department of Law Enforcement (FDLE) Canine Evaluators employed with local law enforcement agencies and their professional opinion is Canine Grimm is not likely to successfully transition to a new handler based on his age, disposition and temperament. WHEREAS, the canine unit veterinarian Dr. Greg Masters has determined, based on his 28 -years of experience, Canine Grimm, although currently healthy, should not be exposed to the physical demands of a canine handler school due to his age. Dr. Greg Masters concurs Canine Grimm is not likely to successfully transfer to another canine handler due to the dog's age, disposition, and temperament. Dr. Masters identifies Canine Grimm as "handler sensitive" and believes Canine Grimm is likely to respond poorly and potentially aggressive to a new handler. WHEREAS, Canine Grimm has been evaluated by Lieutenant Michael Spitaleri and Canine Sergeant Robert Main, both having experience in the evaluation and handling of police canines, and both are certified FDLE Canine Evaluators. Lieutenant Spitaleri and Sergeant Main concur with the Florida Department of Law Enforcement evaluators and department veterinarian that Canine Grimm is not likely to successfully transition to a new canine handler. Additionally, it would be difficult to successfully rehomed Canine Grimm and Canine Grimm should not live in a home with small children. WHEREAS, the Clearwater Police Department Canine Unit is currently fully staffed and there are no current working canines that are scheduled to retire in the near future. WHEREAS, Canine Grimm has no commercial value and little market value estimated to be less than $500. WHEREAS, Code of Ordinances, City of Clearwater, Section 2.623(1), authorizes the surplus sales officer to classify as surplus any tangible personal property owned by the city when that property is determined to be obsolete, or the continued use of the property is uneconomical or inefficient, or the property serves no useful function to the City. WHEREAS, Code of Ordinances, City of Clearwater, Section 2.623(4), authorizes property designated for disposal to be donated when the market value is Tess than the current fixed asset control level. WHEREAS, Daniel Slaughter, Chief of Police, recommends Canine Grimm be retired from service and the City transfer ownership to Officer Robert Pease. NOW THEREFORE, in consideration of the promises contained in the Agreement, the parties agree as follows: 1. The City agrees to transfer ownership of K-9 Grimm to Officer Robert Pease by way of adoption. In consideration for the adoption and transfer of ownership, Officer Robert Pease agrees to pay to Clearwater Police Department a payment in the amount of $1.00 (one dollar). 2. Officer Robert Pease agrees to assume ownership and all responsibility for the care of K-9 Grimm. 3. Officer Robert Pease agrees to indemnify and hold the City harmless from any and all claims, suits, judgments, and liability for death, personal injury, or property damage attributable to the dog's actions occurring after the Agreement is executed by both parties, including legal fees, court costs, and other legal expenses. 4. The transfer is effective upon the execution of this Agreement by both parties.
