The meeting was called to order at 1:00 p.m. in Council Chambers at the Main Library
To provide continuity for research, items are in agenda order although not necessarily
discussed in that order.

4. New Business
4.1 Case CW22-44997 — Violation of Code for Prohibited Mooring: Respondent James
McManus.
Officer Perz said on April 1, 2022 a derelict vessel was found south of 45 Causeway
Blvd. (Memorial Causeway) in dismantled condition; the steering and propulsion were damaged
and there were bamacles on the bottom of the boat. Officer Perz spoke with Mr. McManus, who
has lived on the vessel for a few years, and said Mr. McManus had health issues and was
planning on moving somewhere else. Mr. McManus stated he knew the vessel could not stay in
the water and did not have the means to remove it. In response to a question, Officer Perz said
he gave a copy of the citation to Mr. McManus when he saw him on the vessel on April 1, 2022.
Officer Perz mailed a Notice to Appear on April 6, 2022 to the last known address of Mr.
McManus, General Delivery, 1345 Park St. Clearwater, which is St. Vincent de Paul's
Community Kitchen and Resource Center. The Notice of Hearing for today's meeting was
mailed certified and 1St class on April 18, 2022. The signed certified green card was received by
the Clerk's office.
Based on the evidence and testimony given, the Magistrate declared the vessel is
derelict under City of Clearwater code Article VII Sec 33.055 and awarded the City fees and
costs of $6, 000.00 for the vessel removal, $116.56 for investigative costs, $150.00 for
administrative fees, and $93.00 for civil penalty totaling $6359.56.
4.2 Case CW22-40070 — Violation of Code for Prohibited Mooring: Respondent Terrance
Brownson.

Officer Perz said on March 24, 2022 a derelict vessel was found south of 45 Causeway
Blvd. (Memorial Causeway) in derelict condition; the vessel had no steering or propulsion. Mr.
Terrance Brownson is listed in DAVID as homeless and the last known phone number was no
longer valid. Officer Perz placed a removal sticker on the vessel with his contact information.
Officer Perz mailed a Notice to Appear to the last known address of Mr. Brownson,
General Delivery, St. Petersburg. Officer Perz placed a Be On the Look Out (BOLO) alert to
attempt to contact him with no response. The Notice of Hearing for today's meeting was mailed
certified and 1st class on April 13, 2022.
Based on the evidence and testimony given, the Magistrate declared the vessel is
derelict under City of Clearwater code Article VII Sec 33.055 and awarded the City fees and
costs of $5,600.00 for the vessel removal, $116.56 for investigative costs, $150.00 for
administrative fees, and $93.00 for civil penalty totaling $5959.56.
