Location: 0.85 acre located on the south side of Sunset Point Road approximately
600 feet west of North Belcher Road.
Request The Community Development Board is reviewing the proposed
redevelopment of an existing limited vehicle service use in the Commercial (C)
District for the property located at 2185 Sunset Point Road. The project includes a
height of 32 feet, provides a minimum of 16 off-street parking spaces and requests
allowable flexibility for use, height, and setbacks (CDC Section 2-7045).

Scott Gross, representing Raintree Village, requested Party Status.
Member Flanery moved to grant Party Status to Scott Gross as representative
for Raintree Village. The motion was duly seconded and carried unanimously.

Joan Bigler requested Party Status.
Member Flanery moved to grant Joan Bigler Party Status. The motion was
duly seconded and carried unanimously. Alternate Member Abdur-Rahim did
not vote.
Bill Jonson, representing Clearwater Neighborhood Association, requested Party
Status.
Member Haudricourt moved to grant Party Status to Bill Jonson as
representative for Clearwater Neighborhood Association. The motion was

duly seconded and carried unanimously. Alternate Member Abdur-Rahim did
not vote.
Member Flanery moved to accept Ellen Crandall as an expert witness in the
fields of general planning, zoning, annexations, land use/rezoning
amendments, comprehensive planning, site plan analysis, land development
code & land development code amendments, special area plans and overlay
districts, site plan review, tree rating/assessment/inventory, tree preservation
techniques, erosion and sediment control for construction, Florida grades and
standards for landscape material and trees, and International Society of
Arboriculture standards. The motion was duly seconded and carried
unanimously. Alternate Member Abdur-Rahim did not vote.
Development Review Manager Ellen Crandall provided a PowerPoint presentation on
the Staff Report. Staff recommended the fence between the site and abutting
residences be 6-feet high. In response to questions and concerns, Ms. Crandall said
buffering helps reduce noise and is required by Code. The carwash has no code
violations. In existence for 22 years, the site may have some functional problems. The
driveway will remain in place and a portion of the base will be razed. The vacuum will be
moved to the side of the new addition relocated to the rear of the site away from
residences. The west elevation will be a solid wall. Code does not require noise
buffering for carwashes. The City does not regulate business hours of operation.
Customer ability to exit onto Belcher Road will continue.
Member Rector moved to accept Michael Palmer as an expert witness in the
field of Civil Engineering. The motion was duly seconded and carried
unanimously. Alternate Member Abdur-Rahim did not vote.
Member Caudell moved to accept Aaron David Coy as an expert witness in the
field of architecture. The motion was duly seconded and carried unanimously.
Alternate Member Abdur-Rahim did not vote.
Attorney Brian Aungst, representing Sunset Car Wash, said the project will improve the
site's aesthetics, provide architectural buffering, reduce density and traffic counts,
provide efficient vacuums and feature automated equipment designed to keep all noise
inside the carwash structure. He said the closest bay is now 20 feet from the west
property line; the redesigned structure will be 100 feet from that property line. He said
operations will be reduced from 24/7 to sunlight hours. He said nothing can be built in
the 6-foot easement on the site's west side; the proposed fence on the carwash
property will not damage tree roots or impact drainage. He reviewed the significant
landscaping on the site's west side.
Michael Palmer, representing Sunset Car Wash, said the project meets or exceeds all
Flexible Development requirements. He said the design will reduce site impacts.

Aaron David Coy, representing Sunset Car Wash, said the building and roof feature
were designed to meet or exceed infill criteria. He light poles will remain in current
locations; illumination will comply with Code.
Carwash owner Chamoun Jallo said the roof's steel construction added significant cost
to the project; architectural lighting may be added. He said the site needs sufficient
lighting at night to monitor for vagrancy. He said curb cuts will not change.
Concern was expressed that the roof feature will serve the purpose of signage.
Party Status Holder Scott Gross, representing Raintree Village, said staff originally had
recommended a more substantial wall between the carwash and residences. He said
Raintree Village residents are concerned about noise and fumes from vehicles lined up
behind their homes. He said residents want a 6-foot substantial fence installed closer to
the carwash driveway.
Party Status Holder Joan Bigler said her home abuts the carwash property. She said
the trees provide an insufficient buffer; she preferred a 6-foot brick wall to buffer noise.
She said she has called the Police Department numerous times about vehicles at the
carwash playing loud music with vibrating bass. She said the project will lower her
property values. She said multiple vehicles will play loud, window rattling music while
waiting in the driveway behind her yard. She expressed concern re late night loud music
and carwash runoff in her yard.
Party Status Holder Bill Jonson, representing Clearwater Neighborhood Association,
reviewed Code, stating the applicant had not met the burden of proof or provided
substantial competent evidence required for approval. He said the project will not
minimize adverse effects on adjacent properties. He said Code does not permit the
redevelopment of a nonconforming use; the carwash is a nonconforming use. He
encouraged site redevelopment with a use compatible with adjoining residences.
Attorney Aungst said the application is for a comprehensive infill. He said the DRC
(Development Review Committee) had provided a letter of completeness. He said
Engineering indicated the buffering wall had to be outside the easement.
Ms. Crandall said staff had determined a PVC (polyvinyl chloride) fence would not harm
tree roots; maintaining the trees for buffering is important.
At Mr. Palmer's suggestion, Mr. Jallo said as long as Engineering approves it, he would
agree to install a six-foot high masonry pier and lentil fence which would reduce sound
and not impact site drainage.
Ms. Crandall agreed a pier and lentil fence would be appropriate; an amendment to
Condition of Approval #4 would be required. It was stated a pier and lentil fence would
be more amendable to resident needs.

Concern was expressed if Engineering opposes a pier and lentil fence, the condition
need to include another fence material.
In response to questions, Attorney for the Board Randy Mora said neighbors can
complain if a pier and lentil fence does not satisfy their expectations. The site's
permitting history was not at issue.
In response to questions, Mr. Palmer said the project had only considered redeveloping
the carwash. He said site upgrades would reduce impacts from the carwash which has
been a compatible use for 20 years. He said the retention pond will capture all runoff.
Mr. Coy said the building with roof detail will be 16 feet tall.
Party Status Holder Jonson, representing Clearwater Neighborhood Association,
expressed concern Michael Gates was not present to validate his traffic counts during
cross examination. Attorney Aungst said traffic count evidence was in the record.
A resident expressed concern carwash customers will use loud vacuums late at night
and play loud music. He said Police Department responses to loud music complaints
have been frustrating.
Party Status Holder Bigler expressed concern she had just noticed that 2 lanes of
vehicles will line the driveway behind her home, increasing noise levels and fumes.
Party Status Holder Jonson, representing Clearwater Neighborhood Association,
expressed concern the applicant had not considered other redevelopment options as
Code requires. He said the huge project will disturb adjacent residents with increased
noise and fumes. He did not think the traffic count information was dependable. He said
the project should not be approved as it does not meet Code.
Attorney Aungst said the proposal will be a substantial improvement with enhanced
buffering, a lower ISR (Impervious Surface Ratio), less traffic, and reduced hours. He
said no expert witness testimony had been presented in opposition.
Mr. Jallo said they had worked hard to address residents' concerns by reducing
impacts. He said the double lanes will allow vehicles to move more quickly. He said
reduced hours will limit vehicles congregating on site. He said the site will be staffed
and vacuums will be turned off when operations close.
Attorney Mora reported that staff was amendable to rewording Condition of Approval 4
to require a six-foot high masonry pier and lentil fence.
Discussion ensued regarding the fence, reduced traffic counts due to reduced hours of
operation, landscape improvements, and relocating structures away from residences.
Member Rector moved to approve Case FLD2022-02006 based on evidence in
the record, including the application and the Staff Report, and here by adopt

the Findings of Fact and Conclusions of Law stated in the Staff Report, with
conditions of approval as listed with Condition of Approval 4 to read "That,
prior to the issuance of any building construction permit, excluding demolition
and clearing and grubbing, a revised landscape plan and site plan are
submitted which provides substantial buffering on the west property line by
providing at minimum a six-foot high masonry pier and lentil fence outside the
easement and without impacting the existing trees to be retained. The fence
shall be of a neutral color and textured to be complementary to the building
design. The fence placement shall allow for access of the landscaping on the
west side of the fence. The fence shall be reviewed and finalized to the
satisfaction of city staff. Absent city approval alternative buffering in the form
of a six-foot high PVC fence shall be provided satisfying all remaining
conditions otherwise previously set forth." The motion was duly seconded
and carried unanimously. Alternate Member Abdur-Rahim did not vote.
F. DIRECTOR'S ITEMS

Planning & Development Director Gina Clayton said Isabel Winget will contact each
board member to help with accessing the department's online portal and digital
Community Development Board materials. Soon, hard copies of these materials will not
be printed.
Ms. Clayton reported the 2nd workshop for the North Greenwood Community
Redevelopment Area Plan was scheduled that night.
It was requested that Code be reviewed and updated to require notices to be mailed to
all residents within 400 feet of a project.
