Councilmembers thanked him for his dedication, love for the city, and
service during his term.
The City Attorney said he appreciated what he and his family have done
for Clearwater.
The City Manager said he has enjoyed the brief time working together.

Police Chief Daniel Slaughter thanked him for his years of service. He
said, from a department director's perspective, Vice Mayor Hamilton has
always been fair to staff and judged when needed. As a friend, the Vice
Mayor never put me in a compromising position, which is a testament of
his ethics.
Vice Mayor Hamilton thanked his family for their support. He said the
City has great staff, they are professionals and give everything they have
for this community. He sad he was fortunate to serve with Pam Akin and
Bill Horne during his first 13.5 years. He congratulated Lina Teixeira
and Councilmember Allbritton on their elections. He complimented
Maranda Douglas on her campaign and said many are impressed with
her and that he looked forward to what she will be able to do in the future. He
said serving on city advisory boards and local non-profits have given him the
opportunity to establish relationships and fundraise for organizations that
serve the community.
5. Approval of Minutes
5.1 Approve the minutes of the March 3, 2022 City Council Meeting as submitted in written
summation by the City Clerk.
Vice Mayor Hamilton moved to approve the minutes of the March 3,
2022 City Council Meeting as submitted in written summation by the
City Clerk. The motion was duly seconded and carried
unanimously.
6. Citizens to be heard re items not on the agenda
Angela Tisdale requested consideration to approve additional
applications for the City's co-sponsorships for the local community
organizations and urged the City approve the application from Seeds of
Promise.
Bill Sturtevant thanked Vice Mayor Hamilton for his years of service to
the community. He said he looked forward to working with
Councilmember Allbritton and that he was glad Councilmember Bunker
was present and doing well.
Michael Dalton, Mark Birenbaum, and Barbara Birenbaum opposed the
proposed charter school at 2465 Nursery Road and expressed concerns that
the traffic count study was conducted on one day with a low vehicle count

and that the impacted residents were not informed of the project.
David Powers expressed concerns with the impact the proposed charter
school at 2465 Nursery Road would have on vehicular traffic and
emergency responders. He said the road is narrow and the school will
be located near two mobile home parks with residents who tend to have
medical emergencies.
Theresa Veneziano expressed concerns that the proposed charter
school at 2465 Nursery Road would increase vehicular traffic, increasing
noise and air pollution. She requested that a new traffic study be
conducted and that speed tables and a traffic light during school hours be
installed.
Glenna Wentworth and Don Gleason expressed concerns regarding
vehicular and pedestrian safety and volume of traffic when the charter
school at 2465 Nursery Road opens. She said there are 110 homes on
Nursery Road for whom Nursery Road is the only entrance and exit. She
requested the City work with Pinellas County to improve Nursery Road, a
narrow 2-lane county road.
Edward Thiebe said the Lake Bellevue community submitted a petition
last year on Earth Day to help restore Lake Bellevue and suggested that
baffles or filters be installed in the storm drains to improve the condition of
the water. He provided Councilmembers with a copy of the 1st edition of the
5-year calendar series that includes a list of 62 birds residing at the lake.
Sheila Neisler said marketing is not a function; it is the whole business
seen from the customers point of view. She said 78% of small
businesses fail due to bad marketing. She invited all small business
owners to attend Clearwater Business Spark's workshop, Use Your Brains
Before Spending Your Bucks, workshop at The Ring on March 24.
Eleanore Lyda presented the Downtown Gateway Business and
Neighbors Association's new mascot, Bob the Barrel.
Daniel Holuba expressed concerns with Clearwater Police Department
hiring officers without a thorough background and questioned why an
officer with a history of bad behavior was hired after a background check.
In response to questions re the proposed charter school, the City
Manager said he would like to meet with the neighborhood to have a
better understanding of the concerns and the condition of the road.

Planning and Development Director Gina Clayton said there was a notice
issue with the plat, the program identified the adjacent properties within
a 200 foot-radius from the center of the property instead of the perimeter.
She said more people should have been notified. The Development
Review Committee (DRC) meeting will be re-noticed. She said the DRC
is not a public hearing but a public meeting. Ms. Clayton said DRC is not
a place where the public may provide comments. No permits will be
issued until the DRC meeting is held again. She said two stop work
orders have been issued for the construction fence and the construction
trailer. The contractor has installed tree barricades and silk fences,
which do not require permits but are required to be in place, inspected
and approved prior to issuing the building permit. She said there are four
permits: one site permit and 3 building permits. Nursery Road is a county
roadway, Pinellas County has jurisdiction and maintenance
responsibility. Mayor Hibbard said he would discuss the concerns raised
tonight on the neighborhood's behalf with the county commissioners.
7. Consent Agenda — Approved as submitted.
7.1 Approve settlement of general liability claim 1900009 for payment of$57,500 to claimant
Linda Damsky with a general release of all claims and authorize the appropriate officials
to execute same. (consent)
7.2 Approve the purchase of Excess property insurance, including Bridges, Boiler and
Machinery and Terrorism coverages, from April 1, 2022 through April 1, 2023, at the level
of insurance provided for in this agenda item, at an amount not to exceed $3,220,000 and
at the property rate of$0.366 per $100 of values through April 1, 2023, and authorize the
appropriate officials to execute same. (consent)
7.3 Ratify and confirm payment to Thornton Tomasetti, Inc., in the amount of$143,925 and
Sabal Engineering in the amount of$1,886.91 for engineering consulting services and
authorize the appropriate officials to execute same. (consent)
7.4 Approve First Amendment to Agreement for Metered Parking between Pinellas County
and the City of Clearwater to allow replacement of parking meters on county-owned lots
and authorize the appropriate officials to execute same. (consent)
7.5 Approve a construction contract to Restocon Corporation of Tampa, FI., for the Municipal
Parking Garage Rehabilitation and Upgrade in the amount of$1,879,766.40, pursuant to
Invitation to Bid 18-0032-EN, and authorize the appropriate officials to execute same.

7.6 Accept Federal Emergency Management Agency, Florida Division of Emergency
Management (FDEM), Hazard Mitigation Grant Program (HMGP) grant award in the

amount of$221,285.25, with the required local match of$73,761.75, for the purchase
and installation of two 200kW mobile generators or the adequate size determined by the
vendor and/or electrical engineer and authorize the appropriate officials to execute same.

Councilmember Allbritton moved to approve the Consent Agenda
as submitted and authorize the appropriate officials to execute
same. The motion was duly seconded and carried unanimously.

8. Administrative Public Hearings
8.1 Approve the annexation, initial Future Land Use Map designation of Residential Low (RL)
and initial Zoning Atlas designation of Low Medium Density Residential (LMDR) District
for 2306 and 2322 Anna Avenue, and pass Ordinances 9523-22, 9524-22, and 9525-22
on first reading. (ANX2021-08014, ANX2022-01002)
These voluntary annexation petitions involve 0.458 acres of property consisting
of two parcels of land both occupied by detached dwellings. The properties are
located generally north of Drew Street, east of N. Belcher Road, south of
Sharkey Road, and west of Old Coachman Road. The applicants are
requesting annexation in order to receive sanitary sewer and solid waste
service from the City. The properties are located in an enclave. The property at
2322 Anna Avenue is contiguous to existing city boundaries to the north and
east. The property at 2306 Anna Avenue is not contiguous to existing city
boundaries; however, it is eligible for annexation pursuant to the Interlocal
Service Boundary Agreement with Pinellas County as the enclave is a Type A
enclave (surrounded on all sides by city property). It is proposed that the
properties be assigned a Future Land Use Map designation of Residential Low
(RL) and a Zoning Atlas designation of Low Medium Density Residential
(LMDR). One of the cases in this item (ANX2021-08014, 2322 Anna Avenue)
was continued on first reading by City Council on October 21, 2021 due to a
change in property ownership (original ordinance numbers 9503-21, 9504-21,
and 9505-21). This agenda item includes the original property plus an additional
property and the ordinance numbers have been updated to 9523-22, 9524-22,
and 9525-22.
The Planning and Development Department determined that the proposed
annexations are consistent with the provisions of Community Development
Code Section 4-604.E as follows:
• The properties currently receive water service from Pinellas County. The
closest sanitary sewer line is located in the adjacent Sharkey Road
right-of-way to the north of the subject properties. The applicants are
aware that the City's sewer impact and assessment fees must be paid

in full prior to connection and of the additional costs to extend city sewer
service to this property. Collection of solid waste will be provided by the
City of Clearwater. The properties are located within Police District III
and service will be administered through the district headquarters
located at 2851 McMullen Booth Road. Fire and emergency medical
services will be provided to these properties by Station #48 located at
1700 North Belcher Road. The City has adequate capacity to serve
these properties with sanitary sewer, solid waste, police, fire and EMS
service. The properties will continue to receive water service from
Pinellas County. The proposed annexations will not have an adverse
effect on public facilities and their levels of service; and
• The proposed annexations are consistent with and promote the following
objectives and policies of the Clearwater Comprehensive Plan:
Objective A.6.4 Due to the built-out character of the City of
Clearwater, compact urban development within the urban
service area shall be promoted through application of the
Clearwater Community Development Code.
Objective A.7.2 Diversify and expand the City's tax base through
the annexation of a variety of land uses located within the
Clearwater Planning Area.
Policy A.7.2.3 Continue to process voluntary annexations for
single-family residential properties upon request.
Policy A.7.2.4 Allow voluntary annexations for noncontiguous
properties that are within an enclave as defined by Section
171.031(13)(x), Florida Statutes (Type " enclaves) and as
authorized by the 2014 Interlocal Service Boundary Agreement
(ISBA) between Pinellas County and municipalities, including the
City of Clearwater.
• The proposed Residential Low (RL) Future Land Use Map category is
consistent with the current Countywide Plan designation of the
properties. This designation primarily permits residential uses at a
density of 5 units per acre. The proposed zoning district to be assigned
to the properties is the Low Medium Density Residential (LMDR) District.
The use of the subject properties is consistent with the uses allowed in
the District and the properties exceed the District's minimum
dimensional requirements. The proposed annexations are therefore
consistent with the Countywide Plan and the City's Comprehensive Plan
and Community Development Code; and
• The property proposed for annexation at 2322 Anna Avenue is
contiguous to existing city boundaries to the north and east; therefore,
the annexation is consistent with Florida Statutes Chapter 171.044. The
property proposed for annexation at 2306 Anna Avenue is not contiguous
to City boundaries but is located in a Type A Enclave and is therefore
consistent with the Interlocal Service Boundary Agreement authorized by

Florida Statutes section 171.203.

Councilmember Beckman moved to approve the annexation, initial
Future Land Use Map designation of Residential Low (RL) and initial
Zoning Atlas designation of Low Medium Density Residential
(LMDR) District for 2306 and 2322 Anna Avenue, and pass
Ordinances 9523-22, 9524-22, and 9525-22 on first reading. The
motion was duly seconded and upon roll call, the vote was:

8.2 Approve the Historic Designation for 900 N. Fort Harrison Avenue and pass Ordinance
9528-22 on first reading. (HIS2021-12003)
This historic designation application involves the former North Ward Elementary
School bounded by Cedar Street to the north, N. Fort Harrison Avenue to the
east, Nicholson Street to the south, and N. Osceola Avenue to the west. The
property is 1.989 acres in area and includes a total of five structures on the site,
with two of them being historically contributing. These include the original 1915
school building and its 1926, 1945, and 1951 additions, as well as the small
dome structure near the rear of the property constructed circa 1965.
The former North Ward Elementary School is significant at the local level as
representative of the history and development of education in Clearwater and
Pinellas County. It was one of the first schools built by the Pinellas County
Board of Public Instruction following the county's creation and was one of the
first county schools to be racially integrated. The school embodies the
distinctive characteristics of an early-twentieth-century grammar school, with
Prairie-influenced design of the original school being evident in the rectangular
form topped by a low-pitched hipped roof with wide overhanging eaves, centrally
located entrance, symmetry, and brick bands separating the floors.
The former North Ward Elementary School is one of Clearwater's few historic
landmarks and is listed on the National Register of Historic Places. The historic
designation of this property will preserve the character of a highly visible
community asset that had previously served the City of Clearwater and
neighborhoods north of Downtown for nearly 100 years. Designating the North
Ward Elementary School locally will ensure that any future improvements will
maintain the historic integrity of the building. Requests to materially alter the
building, erect a new building on the property, or demolish or relocate the

building will require a certificate of appropriateness to be obtained from the
Community Development Board.
The Planning and Development Department determined that the proposed
historic designation of the North Ward Elementary School is consistent with two
of the four criteria for evaluating historic properties specified in the Community
Development Code (Section 4-607.F.2.a-d):
• The property is associated with events that made a significant
contribution to the broad pattern of the City.
• The property possesses distinctive characteristics of a type, period or
method of construction.
Pursuant to Community Development Code Section 4-607.F.3., historic
properties shall be classified as exceptional, excellent, notable or of value as
part of the scene, depending on the number of designation criteria met.
Properties that satisfy two of the four criteria are classified as notable. As
previously stated, the North Ward Elementary School meets two of these
criteria and therefore should be classified as "notable."
The Community Development Board reviewed this application at its public
hearing on February 15, 2021 and unanimously recommended approval.
Ordinance 9528-22 was presented and read by title only.
Councilmember Bunker moved to approve the Historic Designation
for 900 N. Fort Harrison Avenue and pass Ordinance 9528-22 on first
reading. The motion was duly seconded and upon roll call, the vote
was:

8.3 Approve the annexation, initial Future Land Use Map designation of Residential Low (RL)
and initial Zoning Atlas designation of Low Medium Density Residential (LMDR) District
for 1819 Diane Drive, and initial Future Land Use Map designation of Residential
Medium (RM) and initial Zoning Atlas designation of Medium Density Residential (MDR)
District for 2704 South Drive, and pass Ordinances 9531-22, 9532-22, and 9533-22 on
first reading. (ANX2021-11016)
These voluntary annexation petitions involve 1.483 acres of property consisting
of two parcels of land, one that is occupied by a detached dwelling and one that
is occupied by multiple attached dwellings (six duplexes, 12 units total). The
properties are located generally north of SR 590, east of US Highway 19 North,
south of Sunset Point Road, and west of EI Trinidad Drive East. The applicants

are requesting annexation in order to receive sanitary sewer and solid waste
service from the City. The properties are located in an enclave and are
contiguous to existing city boundaries in at least one direction. It is proposed
that the property located at 1819 Diane Drive be assigned a Future Land Use
Map designation of Residential Low (RL) and a Zoning Atlas designation of Low
Medium Density Residential (LMDR) and the property located at 2704 South
Drive be assigned a Future Land Use Map designation of Residential Medium
(RM) and a Zoning Atlas designation of Medium Density Residential (MDR).
The Planning and Development Department determined that the proposed
annexations are consistent with the provisions of Community Development
Code Section 4-604.E as follows:
• The properties currently receive water service from Pinellas County. The
closest sanitary sewer lines are located in the adjacent South and Diane
Drives rights-of-way. The applicants have paid the City's sewer impact
and assessment fees in full and have been connected to the City's
sewer system. Collection of solid waste will be provided by the City of
Clearwater. The properties are located within Police District III and
service will be administered through the district headquarters located at
2851 McMullen Booth Road. Fire and emergency medical services will
be provided to these properties by Station #48 located at 1700 North
Belcher Road. The City has adequate capacity to serve these properties
with sanitary sewer, solid waste, police, fire and EMS service. The
properties will continue to receive water service from Pinellas County.
The proposed annexations will not have an adverse effect on public
facilities and their levels of service; and
• The proposed annexations are consistent with and promote the following

o The proposed zoning district to be assigned to the property at
2704 South Drive is the Medium Density Residential (MDR)
District. The use of the subject property is consistent with the
uses allowed in the District and the property exceeds the
District's minimum dimensional requirements.
• The properties proposed for annexation are contiguous to existing city
boundaries in at least one direction; therefore, the annexations are
consistent with Florida Statutes Chapter 171.044.

8.4 Approve the annexation, initial Future Land Use Map designation of Industrial General
(IG) and initial Zoning Atlas designation of Industrial, Research and Technology (IRT)
District for 1944 Calumet Street, Suite B, together with certain Calumet Street
right-of-way, and pass Ordinances 9534-22, 9535-22, and 9536-22 on first reading.
(ANX2021-11017)
This voluntary annexation petition involves a 0.806-acre property consisting of
one parcel of land occupied by a warehouse and office. The property is located
on the north side of Calumet Street approximately 545 feet west of North
Hercules Avenue. The applicant is requesting annexation in order to receive
sanitary sewer and solid waste service from the City. The Development Review
Committee is proposing that 0.679 acres of certain Calumet Street right-of-way
not currently within the city limits also be annexed. The property is located in an

enclave and is contiguous to existing City boundaries to the south and west. It is
proposed that the property be assigned a Future Land Use Map designation of
Industrial General (IG) and a Zoning Atlas designation of Industrial, Research &
Technology (IRT).
The Planning and Development Department determined that the proposed
annexation is consistent with the provisions of Community Development Code
Section 4-604.E as follows:
• The property currently receives water service from the City. The closest

of the property. The applicant has paid the required sanitary sewer

of the subject property is consistent with the uses allowed in the District
and the property exceeds the District's minimum dimensional
requirements. The proposed annexation is therefore consistent with the
Countywide Plan and the City's Comprehensive Plan and Community
Development Code; and
• The property proposed for annexation is contiguous to existing city
boundaries to the south and west; therefore, the annexation is
consistent with Florida Statutes Chapter 171.044.

Councilmember Allbritton moved to approve the annexation, initial
Future Land Use Map designation of Industrial General (IG) and
initial Zoning Atlas designation of Industrial, Research and
Technology (IRT) District for 1944 Calumet Street, Suite B, together
with certain Calumet Street right-of-way, and pass Ordinances
9534-22, 9535-22, and 9536-22 on first reading. The motion was duly
seconded and upon roll call, the vote was:

This voluntary annexation petition involves a 0.201-acre property consisting of
one parcel of land occupied by a new single-family dwelling (currently under
construction). The property is located on the southeast corner of Carlton and
Woodring Drives. The applicant is requesting annexation in order to receive
sanitary sewer and solid waste service from the City. The property is in an
enclave and is contiguous to existing city boundaries to the west and south. It is
proposed that the property be assigned a Future Land Use Map designation of
Residential Low (RL) and a Zoning Atlas designation of Low Medium Density
Residential (LMDR).
The need for sanitary sewer and water service was prompted by the applicant's
proposal to construct a single-family dwelling on a previously vacant lot. Due to
timing issues, the applicant has started construction of the single-family
dwelling while located in the County. The site plan approved by the County
meets the minimum standard development provisions of the Low Medium
Density Residential (LMDR) District. Due to the nature of the construction,
Pinellas County will require the applicant to connect to the City's sanitary sewer
system prior to the issuance of a Certificate of Occupancy (CO). To ensure
consistency in the application of Building Code inspections and to prevent any
construction liability issues, the project will be built in its entirety under Pinellas
County jurisdiction. For that reason, second reading of the annexation cannot
occur until after the County issues a CO. The Planning and Development
Department will schedule second and final reading after the applicant obtains
the CO.

annexation is consistent with the provisions of Community Development Code

Lantana Avenue and are vacant, and the other is located on The Mall and is
occupied by a detached dwelling. The applicants have indicated future plans to

This voluntary annexation petition involves 6.16 acres of property consisting of
two parcels of undeveloped land that are occupied by two existing billboards
governed by the Settlement Agreement between Pinellas County and
OUTFRONT Media LLC f/k/a CBS Outdoor, Inc., National Advertising Company,
Infinity Outdoor Advertising of Florida, Inc., and Viacom Outdoor, Inc. The
properties are located on the east side of US Highway 19 North approximately
1,170 feet south of Sunset Point Road. One billboard is located towards the
northwest corner of the site, approximately 125 south of the northern property
line, and the other one is located at the southwest corner of the site parcel,
approximately 35 feet north of the southern property line. Based upon a review
of historic aerials, the northern billboard appears to have been constructed in
1967/1968 and the southern one sometime between 1975-1979. The applicant
is requesting annexation in order to receive sanitary sewer and solid waste
service from the City upon site development. The properties are located in an
enclave and are contiguous to existing City boundaries in at least one direction.
It is proposed that the properties be assigned a Future Land Use Map
designation of US 19-Neighborhood Center (US 19-NC) and a Zoning Atlas
designation of US 19.

floor area ratio (FAR) of 1.5. The proposed zoning district to be assigned

• As indicated above, the two billboards are governed by a Settlement
Agreement in Pinellas County. Upon annexation, that agreement will not
be binding on the city, however, the billboards will be treated as
nonconforming uses/structures and will be governed by Community
Development Code Article 6 Nonconformity Provisions. These
provisions will only permit the normal repair and maintenance of the
signs and will prohibit any changes being made to the signs that would
increase the nonconformity such as changes in materials, increases in
height or width, etc. Further, in the event the signs are damaged or
destroyed beyond 50% of their value, the signs cannot be repaired or
rebuilt and will need to be removed.
Applicable Objectives and Policies of the Comprehensive Plan are as
follows:
Objective A.3.1 All signage within the City of Clearwater shall be
consistent with the Clearwater sign code, as found within the
Community Development Code, and all proposed signs shall be
evaluated to determine their effectiveness in reducing visual clutter and
in enhancing the safety and attractiveness of the streetscape.
Policy A.3.1.2 Proliferation of billboards along major collector and arterial
streets shall be prevented as is currently provided.
The annexation will not result in the proliferation of billboards as the
billboards currently exist. Community Development Code Section

City Council had previously approved a partial GPR survey of the subject
Property to determine whether burial remains from the former St. Matthew's
Baptist Church Cemetery had been relocated. With recent rediscovery of lost
African American cemeteries throughout the region, the City agreed to work with
community leaders and stakeholders to confirm whether the burials were
properly relocated prior to development.
In February and March of 2020, a partial ground penetrating radar (GPR) survey
indicated that intact burials may be present on the Property. City Engineering
staff contracted with Cardno, Inc. to prepare a work plan and complete an
archaeological excavation and ground truthing of the former cemetery. The
archaeological excavation confirmed the presence of active burials on the
property. As part of the recommendations from the archeological excavation
and ground truthing report, Cardno proposed completing an expanded GPR
survey of the property to determine the cemetery boundaries. This temporary
easement will allow the City ingress-egress access to the property and allow,
Cardno Inc., as the City's consultant, to perform a GPR survey on the property.
Staff recommends approval of the temporary easement.
Mayor Hibbard said due to his relationship with CRUM, he was recusing
himself from the discussion and vote.
Councilmember Allbritton moved to Accept a temporary easement

The City Manager provided an update on the efforts staff is making on
fixing all of the identified sidewalk issues. Over 203 sidewalks issues were
identified and over the past few months, over 100 sidewalks that are not
impacted by a tree were corrected. He said 103 sidewalks are impacted
by a tree and need to be addressed. He thanked staff for their hard work
in such short time. He said Neighborhoods Day will be held March 26.
He thanked the neighborhood associations that have organized events
on that day.

12. Closing comments by Councilmembers (limited to 3 minutes)
Councilmember Allbritton said Tuesday was the culmination of a long
campaign period. He was happy to the amount of people who came out to
vote. He thanked the voters for his re-election, encouraged Maranda
Douglas to stay involved, and congratulated Lina Teixeira on her
election.
Councilmember Beckman wished all a happy St. Patrick's Day. She
congratulated Councilmember Allbritton and Lina Teixeira on their
elections.
Councilmember Bunker congratulated Councilmember Allbritton and
Lina Teixeira on their elections. He said Maranda Douglas did a great
job on her campaign.
13. Closing Comments by Mayor
Mayor Hibbard reviewed recent and upcoming events, congratulated
APG for their 40 years of service to the community and Deputy Chief
Eric Gandy for his retirement and 30 years of service, and said the TDC
receipts for February were up by 70% over 2021. He said Clearwater has

a potential new Sister Cities relationship; the City of lxmiquilpan, located
near Hidalgo, Mexico, will be submitting an application. He thanked all of
the candidates running for Clearwater City Council; it is a grueling
process that is tough on the candidate's family. He expressed condolences
to the Turner Family for the loss of Joe Turner. He wished Irene McKeever
and Gigi Janicek a happy 100th birthday.

Your responsibilities under the law when faced with voting on a measure in which you have a conflict of interest will vary greatly depending

INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES
A person holding elective or appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which
would inure to his or her special private gain or loss. Each elected or appointed local officer also MUST ABSTAIN from knowingly voting on
a measure which would inure to the special gain or loss of a principal (other than a government agency) by whom he or she is retained
(including the parent, subsidiary, or sibling organization of a principal by which he or she is retained); to the special private gain or loss of a
relative; or to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies (CRAs) under
Sec. 163.356 or 163.357, F.S., and officers of independent special tax districts elected on a one -acre, one -vote basis are not prohibited
from voting in that capacity.
For purposes of this law, a "relative" includes only the officer's father, mother, son, daughter, husband, wife, brother, sister, father-in-law,
mother-in-law, son-in-law, and daughter-in-law. A "business associate" means any person or entity engaged in or carrying on a business
enterprise with the officer as a partner, joint venturer, coowner of property, or corporate shareholder (where the shares of the corporation
are not listed on any national or regional stock exchange).
