MEMORANDUM OF UNDERSTANDINGMEMORANDUM OF UNDERSTANDING This Memorandum of Understanding (MOU) is entered into on this 7 day of April 2022, by and between the CITY OF CLEARWATER ("City"), and CLEARWATER FIRE FIGHTERS ASSOCIATION, IAFF LOCAL 1158 ("Union"). WHEREAS, the City and Union are parties to a collective bargaining agreement ("CBA") with a term covering October 1, 2021 through September 30, 2024; and WHEREAS, upon review of the CBA, the City and Union agree that a drafting mistake, or scrivener's error, is contained in Step 1 and Step 2 of Article 6, Section 2; and WHEREAS, the Parties agree that the term "Fire District Commander" should be "Fire Division Chief' in Step 1 and Step 2 of Article 6, Section 2; and NOW THEREFORE, the Parties agree that the above terms, recitals, and representations are true and accurate and are incorporated herein by reference, and the Parties have further agreed to correct the CBA as follows: 1. Article 6, Section 2 is amended as follows: *** STEP 1 The grievant shall present his/her grievance in writing to his/her Fire Division Chief District Commander or Fire Marshal within 30 work days after the grievant has knowledge or constructive knowledge of the occurrence of the action giving rise to the grievance. The Fire Division Chief District Commander or Fire Marshal shall arrange for a meeting with the grievant within 10 work days of receipt of the grievance. Discussions will be informal for the purpose of settling differences in the simplest and most direct manner. The Fire Division Chief District Gemmarider or Fire Marshal shall review the grievance and submit a decision in writing to the grievant within 30 work days from the date of the meeting. If the grievance is not resolved at Step 1, the grievance may be appealed to Step 2. STEP 2 If the grievance is not settled at the first step, the grievant shall, within 30 work days of the date of written notification from the Fire Division Chief District Commander or Fire Marshal, present the written grievance to the Fire Chief or his/her designee. The Fire Chief or his/her designee shall obtain the facts concerning the alleged grievance and shall, within 10 work days following receipt of the written grievance, meet with the grievant. The Fire Chief or his/her designee shall review the grievance and notify the grievant of his/her decision in writing not later than 30 work days following the meeting day. If the grievance is not resolved at Step 2, the grievance may be appealed to Step 3. *** 1 2. All other terms and conditions of the CBA will remain in full force and effect. 3. This MOU shall not create or establish a practice or precedent. 4. The Parties agree that this MOU constitutes their final understanding and agreement with respect to the subject matter hereof and supersedes all prior or contemporaneous negotiations, promises, covenants, agreements, or representations concerning all matters directly, indirectly, or collaterally related to the subject matter of this MOU.
