1. Call to Order— Mayor Hibbard
The meeting was called to order at 9:00 a.m.
2. Office of Management and Budget
2.1 Amend the City's fiscal year 2021/22 operating and capital improvement budgets at first
quarter and pass Ordinances 9558-22 and 9559-22 on first reading.
The fiscal year 2021/22 operating and capital improvement budgets were
adopted in September 2021 by ordinances 9498-21 and 9499-21. Section
2.521 of the City's Code of Ordinances requires the City Manager to prepare a
quarterly report detailing income, expenditure estimates, collections, the
explanation of significant variances, as well as the financial status of all capital
improvement projects.
In response to questions, Budget Manager Kayleen Kastel said the
$300,000 Greenprint implementation line item was for Cenergistic.
Assistant City Manager Micah Maxwell said the Sustainability
Coordinator has a $300,000 capital fund, which is being used for the
solar study. Ms. Kastel said the $300,000 line item was an increase.
The Hurricane Irma reimbursements will soon be closed out but there are
still funds the City has not received.
3. Finance
3.1 Approve settlement of general liability claim 1900009 for payment of$57,500 to claimant
Linda Damsky with a general release of all claims and authorize the appropriate officials
to execute same. (consent)

Ms. Linda Damsky is a resident who participated regularly in playing pickleball at
the North Greenwood Recreational Center. On January 28, 2019, while playing
at the center, she slipped and fell in a puddle of water on the court, injuring her
left knee. As a result of this injury, Ms. Damsky incurred almost $30,000 in
medical expenses, which included the cost of surgery for her left knee, which
she underwent in February 2019.
A mediation was held on January 24,2022, which resulted in a settlement of
$57,500, contingent on council approval.
The Risk Management Division, Claims Committee and the Assistant City
Attorney recommend approval of this settlement.
Funding for the payment of this settlement is available in the budget for claims
expense in the Central Insurance Fund.

In response to a question, Risk Manager Rick Osorio said the roof had a
history of leaks.
3.2 Approve the purchase of Excess property insurance, including Bridges, Boiler and
Machinery and Terrorism coverages, from April 1, 2022 through April 1, 2023, at the level
of insurance provided for in this agenda item, at an amount not to exceed $3,220,000 and
at the property rate of$0.366 per $100 of values through April 1, 2023, and authorize the
appropriate officials to execute same. (consent)
The Risk Management Division requested Arthur J. Gallagher and Co. to obtain
quotes for the property insurance program expiring April 1, 2022. After a review
of quotes received, staff requests the renewal of the current coverage with
Berkshire Hathaway Insurance Group with a layer of coverage limits provided by
various carriers.
The current coverage with Berkshire Hathaway and additional sub-carriers was
a three-year rate guarantee which ends in 2023 and is subject to a loss ratio
provision of 100% for Named Windstorm and 40% for all other perils. The City's
renewal premium for 2023 is $2,951,063.
This renewal maintains the Named Windstorm coverage at $75 million, and
flood insurance at $75 million on an aggregate basis. The self-insured retention
(SIR) will remain at $100,000 per occurrence, with a 5% SIR for named storms
with no maximum deductible. The Boiler and Machinery Coverage with
Travelers will also remain at $200 million with an increase of premium of 6.8%
for a total of$80,324.
The City insures three city bridges on a stand-alone policy through Zurich: Sand

Key Bridge, Mandalay Channel pedestrian bridge and the McMullen Booth
pedestrian overpass. This policy has a self-insured retention (SIR) of$100,000
per occurrence. This program was placed in 2019, and incorporated a
three-year rate guarantee, which expires April 2022. Unfortunately, staff was
unable to obtain another multi-year agreement this year; the renewal premium
for the 2022 -23 renewal term will be $95,679, which is an increase of 62.5%
due mostly to the rising values of the bridges. Aside from this increase, this
policy will now include a flood deductible of 5% of the total covered value of a
loss, subject to a $100,000 minimum, and a Named Storm deductible of 5% of
the total covered value of a loss with a minimum of$500,000. They are also
including an annual aggregate limit for the perils of Earthquake, Flood and
Named Storm of$50 million each.
This requested renewal maintains our current coverage for "Terrorism -
Property & Liability" coverage limits at $25 million for property damage and $10
million for liability for a premium of$23,100. The program also provides
Nuclear, Biological, Chemical & Radioactive Terrorism coverage with limits of
$3 million, for a premium of$25,270.
Total premiums for this renewal are estimated to be $3,175,436, which
represents an increase of 15% in premium and less than 1% increase in rate
from last year. Staff recommends adding a contingency to a not-to-exceed
amount of$3,220,000.
Risk Management believes these recommended coverages will continue to
cover the City's property risks at levels and rates which represent a reasonable
insurance program for the City.
APPROPRIATION CODE AND AMOUNT:
Funds of$3,220,000 are available in the Central Insurance Fund operating code
5907590-545100, insurance premiums.
3.3 Ratify and confirm payment to Thornton Tomasetti, Inc., in the amount of$143,925 and
Sabal Engineering in the amount of$1,886.91 for engineering consulting services and
authorize the appropriate officials to execute same. (consent)
On Monday, December 20, 2021, a stairwell in a parking garage owned by
Plymouth Plaza, LLC, collapsed, trapping a construction worker. Sabal
Engineering was initially called out by the technical rescue team to assess the
situation. City emergency responders then enlisted Thornton Tomassetti, Inc.,
an engineering consulting firm, to assist with the recovery of the deceased
worker from the rubble.
Staff is requesting approval of the payment of$143,925 to Thornton Tomassetti,
Inc. and $1,886.91 to Sabal Engineering. Staff recommends the use of Central
Insurance Fund reserves for these expenditures and is pursuing recovery of the
monies via a claim filed with property owner, Plymouth Plaza, LLC.

4. Engineering
4.1 Approve First Amendment to Agreement for Metered Parking between Pinellas County
and the City of Clearwater to allow replacement of parking meters on county-owned lots
and authorize the appropriate officials to execute same. (consent)
August 18, 2011, City Council approved an agreement between the City of
Clearwater and Pinellas County that allows the City to place parking meters on
specified county-owned parking lots. The Clearwater Parking System runs
these lots as paid parking and splits the revenue 60% (City) 40% (County). The
current meters in these lots are beyond their useful life and require
replacement. As part of this amendment, the City of Clearwater Parking System
will install Cale touch screen parking kiosks in four of the lots that the City runs
on behalf of the County.
The City has a few extra Cale machines that were acquired in 2019 at a cost of
$6,250 each that will be deployed in the county lots. The agreement allows the
City to collect 100% of the generated revenue until the cost of the pay stations is
collected. Once the pay station cost is covered, the agreement reverts to the
60/40 split. This arrangement is the same as previously used to fund the
traditional parking meters being replaced.
4.2 Approve a construction contract to Restocon Corporation of Tampa, FI., for the Municipal
Parking Garage Rehabilitation and Upgrade in the amount of$1,879,766.40, pursuant to
Invitation to Bid 18-0032-EN, and authorize the appropriate officials to execute same.
(consent).
The Municipal Services Parking Garage provides 474 parking spaces for
Clearwater's employees from both the police department and municipal
services building. After regular work hours, the garage is open for public
parking. A condition assessment of the garage indicated that the lifespan of the
structure would benefit from several maintenance repairs. Additionally, this
construction period will be utilized to make upgrades to improve energy
efficiency and prepare for coming "green" upgrades.
This project consists of concrete repairs, installation of waterproofing
membrane, Tee stem bearing pad replacement, removal and replacement of
sealants, concrete island removal, miscellaneous painting, and replacement of
all light fixtures with new energy efficient LED fixtures. Additionally, conduit will
be run from the utility room to locations on the 1 st, 3rd, and roof levels for the
future addition of EV charging stations and possible solar panels. This will make
the garage "EV ready" and "Solar ready".
Six contractors were interested in the project and attended the pre bid meeting.

Restocon Corporation was the only responsible bidder in accordance with plans
and specifications. The project engineer reviewed Restocon's bid and prepared
a letter recommending award of the project to Restocon.
The Parking Systems Division operates and maintains the Municipal Services
Garage.
Portions of the garage will be closed in phases during the expected 6-month
construction duration, allowing continued use of the garage. City-owned surface
lots will be utilized for overflow parking until construction is completed.
APPROPRIATION CODE AND AMOUNT:
ENPK180003-CONS-CNSTRC $1,879,766.40
Funds are available in capital improvement project ENPK180003, Parking
Facilities, in the amount of$379,766.40, to fund this contract.
A midyear budget amendment will transfer of$1,500,000 of excess parking
operating revenues to capital improvement project ENPK180003, Parking
Facilities, to fund this contract.
In response to questions, Parking Manager Jeremy Alleshouse said based
on cursory counts of the garage, there are 100 to 150 parking spaces
available daily. The expected number of parking spaces needed for city hall
employees is 60. He said there is sufficient parking available to meet the
increased demand with having city hall employees park in the garage with
the current number of spaces. Staff has not been able to confirm if additional
levels can be added to the garage. Mr. Alleshouse said the restoration
project will address routine maintenance. Two EV charging double units will
be located on levels 1 and 3, with plans to add additional units in the future.
Staff is working with the consultant to have all garages on a 4-
year maintenance schedule. He said it has been more than four years since
the garage underwent routine maintenance. The City Manager said an
enhanced inspection is being performed of all physical assets to have an
understanding of their current state and then assign a routine inspection and
repair cycle.
Staff was requested to provide the total reserve in the parking fund.
4.3 Accept a temporary easement from Crum Properties II, LLC (Crum) to the City of
Clearwater (City) for ingress-egress access to certain real property owned by Crum
located at 100 S. Missouri Avenue (Property), and for purposes of completing a ground
penetrating radar (GPR) survey thereon and authorize the appropriate officials to execute
same. (consent)
City Council had previously approved a partial GPR survey of the subject
Property to determine whether burial remains from the former St. Matthew's
Baptist Church Cemetery had been relocated. With recent rediscovery of lost

African American cemeteries throughout the region, the City agreed to work with
community leaders and stakeholders to confirm whether the burials were
properly relocated prior to development.
In February and March of 2020, a partial ground penetrating radar (GPR) survey
indicated that intact burials may be present on the Property. City Engineering
staff contracted with Cardno, Inc. to prepare a work plan and complete an
archaeological excavation and ground truthing of the former cemetery. The
archaeological excavation confirmed the presence of active burials on the
property. As part of the recommendations from the archeological excavation
and ground truthing report, Cardno proposed completing an expanded GPR
survey of the property to determine the cemetery boundaries. This temporary
easement will allow the City ingress-egress access to the property and allow,
Cardno Inc., as the City's consultant, to perform a GPR survey on the property.
Staff recommends approval of the temporary easement.
The Mayor recused himself from the discussion.
The City Attorney said easements will no longer be approved by resolutions
but by consent as there is no legal requirement to accept easements by
resolutions. He said that the Assistant City Attorney said years ago the
easements were accepted by consent but the practice shifted to resolution
approximately five years ago.
4.4 Accept a utility easement from Good Goat, LLC for the construction, installation, and
maintenance of city utility facilities on real property located on a portion of land, lying in
the SW 1/4 of the NE 1/4 of Section 17, Township 29 South, Range 16 East, Pinellas
County, Florida and adopt Resolution 22-08.
The Utility Easement will grant the City rights for construction, installation, and
maintenance of utility facilities on the commercial site.
The City Engineering Department recommends acceptance of the easement.
4.5 Accept a drainage easement from Good Goat, LLC for the construction, installation, and
maintenance of city drainage facilities on real property located on a portion of land, lying
in the SW 1/4 of the NE 1/4 of Section 17, Township 29 South, Range 16 East, Pinellas
County, Florida and adopt Resolution 22-09.
The Drainage Easement will grant the City rights for construction, installation,
and maintenance of drainage facilities on the commercial site.
The City Engineering Department recommends acceptance of the easement.

5. Planning
5.1 Approve the annexation, initial Future Land Use Map designation of Residential Low (RL)
and initial Zoning Atlas designation of Low Medium Density Residential (LMDR) District
for 2306 and 2322 Anna Avenue, and pass Ordinances 9523-22, 9524-22, and 9525-22
on first reading. (ANX2021-08014, ANX2022-01002)
These voluntary annexation petitions involve 0.458 acres of property consisting
of two parcels of land both occupied by detached dwellings. The properties are
located generally north of Drew Street, east of N. Belcher Road, south of
Sharkey Road, and west of Old Coachman Road. The applicants are
requesting annexation in order to receive sanitary sewer and solid waste
service from the City. The properties are located in an enclave. The property at
2322 Anna Avenue is contiguous to existing city boundaries to the north and
east. The property at 2306 Anna Avenue is not contiguous to existing city
boundaries; however, it is eligible for annexation pursuant to the Interlocal
Service Boundary Agreement with Pinellas County as the enclave is a Type A
enclave (surrounded on all sides by city property). It is proposed that the
properties be assigned a Future Land Use Map designation of Residential Low
(RL) and a Zoning Atlas designation of Low Medium Density Residential
(LMDR). One of the cases in this item (ANX2021-08014, 2322 Anna Avenue)
was continued on first reading by City Council on October 21, 2021 due to a
change in property ownership (original ordinance numbers 9503-21, 9504-21,
and 9505-21). This agenda item includes the original property plus an additional
property and the ordinance numbers have been updated to 9523-22, 9524-22,
and 9525-22.
The Planning and Development Department determined that the proposed
annexations are consistent with the provisions of Community Development
Code Section 4-604.E as follows:
• The properties currently receive water service from Pinellas County. The
closest sanitary sewer line is located in the adjacent Sharkey Road
right-of-way to the north of the subject properties. The applicants are
aware that the City's sewer impact and assessment fees must be paid
in full prior to connection and of the additional costs to extend city sewer
service to this property. Collection of solid waste will be provided by the
City of Clearwater. The properties are located within Police District III
and service will be administered through the district headquarters
located at 2851 McMullen Booth Road. Fire and emergency medical
services will be provided to these properties by Station #48 located at
1700 North Belcher Road. The City has adequate capacity to serve
these properties with sanitary sewer, solid waste, police, fire and EMS
service. The properties will continue to receive water service from
Pinellas County. The proposed annexations will not have an adverse
effect on public facilities and their levels of service; and
• The proposed annexations are consistent with and promote the following
objectives and policies of the Clearwater Comprehensive Plan:

Objective A.6.4 Due to the built-out character of the City of
Clearwater, compact urban development within the urban
service area shall be promoted through application of the
Clearwater Community Development Code.
Objective A.7.2 Diversify and expand the City's tax base through
the annexation of a variety of land uses located within the
Clearwater Planning Area.
Policy A.7.2.3 Continue to process voluntary annexations for
single-family residential properties upon request.
Policy A.7.2.4 Allow voluntary annexations for noncontiguous
properties that are within an enclave as defined by Section
171.031(13)(a), Florida Statutes (Type " enclaves) and as
authorized by the 2014 Interlocal Service Boundary Agreement
(ISBA) between Pinellas County and municipalities, including the
City of Clearwater.
• The proposed Residential Low (RL) Future Land Use Map category is
consistent with the current Countywide Plan designation of the
properties. This designation primarily permits residential uses at a
density of 5 units per acre. The proposed zoning district to be assigned
to the properties is the Low Medium Density Residential (LMDR) District.
The use of the subject properties is consistent with the uses allowed in
the District and the properties exceed the District's minimum
dimensional requirements. The proposed annexations are therefore
consistent with the Countywide Plan and the City's Comprehensive Plan
and Community Development Code; and
• The property proposed for annexation at 2322 Anna Avenue is
contiguous to existing city boundaries to the north and east; therefore,
the annexation is consistent with Florida Statutes Chapter 171.044. The
property proposed for annexation at 2306 Anna Avenue is not contiguous
to City boundaries but is located in a Type A Enclave and is therefore
consistent with the Interlocal Service Boundary Agreement authorized by
Florida Statutes section 171.203.
5.2 Approve the Historic Designation for 900 N. Fort Harrison Avenue and pass Ordinance
9528-22 on first reading. (HIS2021-12003)
This historic designation application involves the former North Ward Elementary
School bounded by Cedar Street to the north, N. Fort Harrison Avenue to the
east, Nicholson Street to the south, and N. Osceola Avenue to the west. The
property is 1.989 acres in area and includes a total of five structures on the site,
with two of them being historically contributing. These include the original 1915

school building and its 1926, 1945, and 1951 additions, as well as the small
dome structure near the rear of the property constructed circa 1965.
The former North Ward Elementary School is significant at the local level as
representative of the history and development of education in Clearwater and
Pinellas County. It was one of the first schools built by the Pinellas County
Board of Public Instruction following the county's creation and was one of the
first county schools to be racially integrated. The school embodies the
distinctive characteristics of an early-twentieth-century grammar school, with
Prairie-influenced design of the original school being evident in the rectangular
form topped by a low-pitched hipped roof with wide overhanging eaves, centrally
located entrance, symmetry, and brick bands separating the floors.
The former North Ward Elementary School is one of Clearwater's few historic
landmarks and is listed on the National Register of Historic Places. The historic
designation of this property will preserve the character of a highly visible
community asset that had previously served the City of Clearwater and
neighborhoods north of Downtown for nearly 100 years. Designating the North
Ward Elementary School locally will ensure that any future improvements will
maintain the historic integrity of the building. Requests to materially alter the
building, erect a new building on the property, or demolish or relocate the
building will require a certificate of appropriateness to be obtained from the
Community Development Board.
The Planning and Development Department determined that the proposed
historic designation of the North Ward Elementary School is consistent with two
of the four criteria for evaluating historic properties specified in the Community
Development Code (Section 4-607.F.2.a-d):
• The property is associated with events that made a significant
contribution to the broad pattern of the City.
• The property possesses distinctive characteristics of a type, period or
method of construction.
Pursuant to Community Development Code Section 4-607.F.3., historic
properties shall be classified as exceptional, excellent, notable or of value as
part of the scene, depending on the number of designation criteria met.
Properties that satisfy two of the four criteria are classified as notable. As
previously stated, the North Ward Elementary School meets two of these
criteria and therefore should be classified as "notable."
The Community Development Board reviewed this application at its public
hearing on February 15, 2021 and unanimously recommended approval.
In response to questions, Planning and Development Director Gina Clayton

said staff is working on the RFP for the activation and renovation of the
building. Staff will discuss with the city manager about the possibility of
resident engagement sessions. The school is located within the proposed N.
Greenwood CRA. The City Manager said he has met with various
businesses interested in relocating to this site. He said the project is a great
opportunity for a public-private partnership.
5.3 Approve the annexation, initial Future Land Use Map designation of Residential Low (RL)
and initial Zoning Atlas designation of Low Medium Density Residential (LMDR) District
for 1819 Diane Drive, and initial Future Land Use Map designation of Residential
Medium (RM) and initial Zoning Atlas designation of Medium Density Residential (MDR)
District for 2704 South Drive, and pass Ordinances 9531-22, 9532-22, and 9533-22 on
first reading. (ANX2021-11016)
These voluntary annexation petitions involve 1.483 acres of property consisting
of two parcels of land, one that is occupied by a detached dwelling and one that
is occupied by multiple attached dwellings (six duplexes, 12 units total). The
properties are located generally north of SR 590, east of US Highway 19 North,
south of Sunset Point Road, and west of EI Trinidad Drive East. The applicants
are requesting annexation in order to receive sanitary sewer and solid waste
service from the City. The properties are located in an enclave and are
contiguous to existing city boundaries in at least one direction. It is proposed
that the property located at 1819 Diane Drive be assigned a Future Land Use
Map designation of Residential Low (RL) and a Zoning Atlas designation of Low
Medium Density Residential (LMDR) and the property located at 2704 South
Drive be assigned a Future Land Use Map designation of Residential Medium
(RM) and a Zoning Atlas designation of Medium Density Residential (MDR).
The Planning and Development Department determined that the proposed
annexations are consistent with the provisions of Community Development
Code Section 4-604.E as follows:
• The properties currently receive water service from Pinellas County. The
closest sanitary sewer lines are located in the adjacent South and Diane
Drives rights-of-way. The applicants have paid the City's sewer impact
and assessment fees in full and have been connected to the City's
sewer system. Collection of solid waste will be provided by the City of
Clearwater. The properties are located within Police District III and
service will be administered through the district headquarters located at
2851 McMullen Booth Road. Fire and emergency medical services will
be provided to these properties by Station #48 located at 1700 North
Belcher Road. The City has adequate capacity to serve these properties
with sanitary sewer, solid waste, police, fire and EMS service. The
properties will continue to receive water service from Pinellas County.
The proposed annexations will not have an adverse effect on public
facilities and their levels of service; and

single-family residential properties upon request.
• The proposed annexations are consistent with the Countywide Plan and
the City's Comprehensive Plan and Community Development Code
based on the following:
o The proposed Residential Urban (RU) and Residential Medium
(RM) Future Land Use Map categories are consistent with the
current Countywide Plan designations of the properties. These
designations primarily permit residential uses at a density of 7.5
units per acre, and 15 units per acre, respectively;
o The proposed zoning district to be assigned to the property at
1819 Diane Drive is the Low Medium Density Residential
(LMDR) District. The use of the subject property is consistent
with the uses allowed in the District and the property exceeds the
District's minimum dimensional requirements; and
o The proposed zoning district to be assigned to the property at
2704 South Drive is the Medium Density Residential (MDR)
District. The use of the subject property is consistent with the
uses allowed in the District and the property exceeds the
District's minimum dimensional requirements.
• The properties proposed for annexation are contiguous to existing city
boundaries in at least one direction; therefore, the annexations are
consistent with Florida Statutes Chapter 171.044.
In response to questions, Senior Planner Kyle Brotherton said the code
enforcement team visit the properties and notifies staff of any potential code
violations. The City Attorney said the current annexation ordinance provides
Council some guidance regarding what factors must considered for
annexations. Factors include consistency with the City's community

development code, if the annexation does not comply, Council could deny
the request. A vast majority of the annexations have transient violations. He
said if the violations found on the property serious, long-term, or permanent,
that would be a basis to deny the annexation request.
5.4 Approve the annexation, initial Future Land Use Map designation of Industrial General
(IG) and initial Zoning Atlas designation of Industrial, Research and Technology (IRT)
District for 1944 Calumet Street, Suite B, together with certain Calumet Street
right-of-way, and pass Ordinances 9534-22, 9535-22, and 9536-22 on first reading.
(ANX2021-11017)
This voluntary annexation petition involves a 0.806-acre property consisting of
one parcel of land occupied by a warehouse and office. The property is located
on the north side of Calumet Street approximately 545 feet west of North
Hercules Avenue. The applicant is requesting annexation in order to receive
sanitary sewer and solid waste service from the City. The Development Review

of the subject property is consistent with the uses allowed in the District
and the property exceeds the District's minimum dimensional
requirements. The proposed annexation is therefore consistent with the
Countywide Plan and the City's Comprehensive Plan and Community
Development Code; and
• The property proposed for annexation is contiguous to existing city
boundaries to the south and west; therefore, the annexation is
consistent with Florida Statutes Chapter 171.044.
In response to a question, Planning and Development Director Gina Clayton
said as the City annexes unincorporated areas, the right-of-way is also in an
unincorporated area. The right-of-way falls within the City's planning
jurisdiction and takes responsibility for the maintenance of those streets and
utilities.

for 2635 Woodring Drive, and pass Ordinances 9537-22, 9538-22, and 9539-22 on first

This voluntary annexation petition involves a 0.201-acre property consisting of
one parcel of land occupied by a new single-family dwelling (currently under
construction). The property is located on the southeast corner of Carlton and
Woodring Drives. The applicant is requesting annexation in order to receive
sanitary sewer and solid waste service from the City. The property is in an
enclave and is contiguous to existing city boundaries to the west and south. It is
proposed that the property be assigned a Future Land Use Map designation of
Residential Low (RL) and a Zoning Atlas designation of Low Medium Density
Residential (LMDR).
The need for sanitary sewer and water service was prompted by the applicant's
proposal to construct a single-family dwelling on a previously vacant lot. Due to
timing issues, the applicant has started construction of the single-family
dwelling while located in the County. The site plan approved by the County
meets the minimum standard development provisions of the Low Medium
Density Residential (LMDR) District. Due to the nature of the construction,

Pinellas County will require the applicant to connect to the City's sanitary sewer
system prior to the issuance of a Certificate of Occupancy (CO). To ensure

County jurisdiction. For that reason, second reading of the annexation cannot
occur until after the County issues a CO. The Planning and Development
Department will schedule second and final reading after the applicant obtains
the CO.

known as The Mall approximately 620 feet south of Union Street. The applicants
own three other parcels already incorporated into the City that surround the

Lantana Avenue and are vacant, and the other is located on The Mall and is
occupied by a detached dwelling. The applicants have indicated future plans to
construct a second detached dwelling (guest house) on their property, although
no plans have been submitted at this time. Annexation is being requested so, at

overall campus of Calvary Church. The property is located in an enclave and is
contiguous to existing City on all sides. It is proposed that the property be
assigned a Future Land Use Map designation of Residential Urban (RU) and a
Zoning Atlas designation of Low Medium Density Residential (LMDR).
The Planning and Development Department determined that the proposed

designation of US 19 for two unaddressed parcels along US Highway 19 North, and pass
Ordinances 9561-22, 9562-22, and 9563-22 on first reading. (ANX2021-12020)
This voluntary annexation petition involves 6.16 acres of property consisting of
two parcels of undeveloped land that are occupied by two existing billboards
governed by the Settlement Agreement between Pinellas County and
OUTFRONT Media LLC f/k/a CBS Outdoor, Inc., National Advertising Company,
Infinity Outdoor Advertising of Florida, Inc., and Viacom Outdoor, Inc. The
properties are located on the east side of US Highway 19 North approximately
1,170 feet south of Sunset Point Road. One billboard is located towards the
northwest corner of the site, approximately 125 south of the northern property
line, and the other one is located at the southwest corner of the site parcel,
approximately 35 feet north of the southern property line. Based upon a review
of historic aerials, the northern billboard appears to have been constructed in
1967/1968 and the southern one sometime between 1975-1979. The applicant
is requesting annexation in order to receive sanitary sewer and solid waste
service from the City upon site development. The properties are located in an
enclave and are contiguous to existing City boundaries in at least one direction.
It is proposed that the properties be assigned a Future Land Use Map
designation of US 19-Neighborhood Center (US 19-NC) and a Zoning Atlas
designation of US 19.

Neighborhood Center and US 19 Corridor future boundaries
depicted on Map A-17.
• The proposed US 19-Corridor (US 19-C) Future Land Use Map category
is consistent with the future boundaries depicted on Map A-17, US 19
Corridor Redevelopment Area, and primarily permits a mix of uses at a
floor area ratio (FAR) of 1.5. The proposed zoning district to be assigned
to the properties is the US 19 District. The proposed annexation is
therefore consistent with the City's Comprehensive Plan and
Community Development Code;
• As indicated above, the two billboards are governed by a Settlement
Agreement in Pinellas County. Upon annexation, that agreement will not
be binding on the city, however, the billboards will be treated as

nonconforming uses/structures and will be governed by Community
Development Code Article 6 Nonconformity Provisions. These
provisions will only permit the normal repair and maintenance of the
signs and will prohibit any changes being made to the signs that would
increase the nonconformity such as changes in materials, increases in
height or width, etc. Further, in the event the signs are damaged or
destroyed beyond 50% of their value, the signs cannot be repaired or
rebuilt and will need to be removed.
Applicable Objectives and Policies of the Comprehensive Plan are as
follows:
Objective A.3.1 All signage within the City of Clearwater shall be
consistent with the Clearwater sign code, as found within the
Community Development Code, and all proposed signs shall be
evaluated to determine their effectiveness in reducing visual clutter and
in enhancing the safety and attractiveness of the streetscape.
Policy A.3.1.2 Proliferation of billboards along major collector and arterial
streets shall be prevented as is currently provided.
The annexation will not result in the proliferation of billboards as the
billboards currently exist. Community Development Code Section
3-1804.0 prohibits billboards and no new billboards can be erected on
the property. The proposed annexation is consistent with city
regulations;
• The proposed US 19-Neighborhood Center (US 19-NC) Future Land
Use Map category assigned to the two unaddressed properties will
require an amendment to the Countywide Plan Map from Retail &
Services (R&S) to Activity Center (AC);
• The properties proposed for annexation are contiguous to existing City
boundaries in at least one direction; therefore, the annexation is
consistent with Florida Statutes Chapter 171.044.
6. Public Utilities
6.1 Accept Federal Emergency Management Agency, Florida Division of Emergency
Management (FDEM), Hazard Mitigation Grant Program (HMGP) grant award in the
amount of$221,285.25, with the required local match of$73,761.75, for the purchase
and installation of two 200kW mobile generators or the adequate size determined by the
vendor and/or electrical engineer and authorize the appropriate officials to execute same.

The Clearwater Public Utilities Department submitted a grant application and
has been officially awarded a Hazard Mitigation Grant from Florida Division of

Emergency Management which can be used only for the acquisition and
installation of generators which will provide backup power at the City's three
wastewater reclamation facilities. The project is for the purchase and setup of
an emergency generator system to reduce and/or mitigate the damage that
might otherwise occur from severe weather or other hazards. This flexibility will
reduce water quality concerns, mitigate public health and safety hazards, and
reduce potential impacts to coastal zones, wetlands, fisheries, and historic
resources.
The project period will commence upon approval by Council and will end on or
before January 31, 2024. Public utilities will return to Council for approval of the
purchase for the generators.
APPROPRIATION CODE AND AMOUNT:
Funds will be included in the department's budget request.
7. Legal
7.1 Adopt Ordinance 9552-22 on second reading, vacating a portion of the 10 feet wide
platted Drainage and Utility Easement and a portion of the 5 feet wide platted Utility
Easement located on Lot 156, Woodgate of Countryside - Unit One, according to the
map or plat thereof in Plat Book 70, Pages 13-14, of the Public Records of Pinellas
County, Florida.
8. City Manager Verbal Reports
8.1 Resort Attached Dwellings - Gina Clayton, Planning & Development Director
The City Manager expressed concerns with projects that include an
excessive number of bedrooms and private pool per unit and how the
proposed units would impact the neighborhood.
Planning and Development Director Gina Clayton provided a PowerPoint
presentation regarding two proposed houses with minimal connections to
meet Resort Attached Dwelling (RAD) criteria.
In response to questions, Ms. Clayton said the units have a garage but they
are oriented with a driveway that does not have sufficient space to stack
cars. It is likely some cars will not be able to get out if there are cars in the
driveway. The projects currently meet city criteria and will obtain approval.
The City Attorney said the City's Resort Attached Dwelling code did not
contemplate the projects being proposed. He suggested Council consider
potential code changes. Ms. Clayton said 1.5 parking spaces per unit is
insufficient for units with 6-8 bedrooms. The City's Resort Attached Dwelling
code contemplated one pool shared by all units.

Discussion ensued with comments made that individual pools for RAD
products was not an issue.
In response to a suggestion, Ms. Clayton said some apartment codes base
parking requirements on the number of bedrooms, which gets larger as more
bedrooms are added. She said staff can look at language that better
accommodates parking for these types of projects.
The City Manager said he will work with staff to present Council with
appropriate code changes at a future meeting.

10.1Tampa Bay Estuary Program Update - Councilmember Beckman
Councilmember Beckman provided a PowerPoint presentation.
Discussion ensued with a suggestion made to trim the mangroves and
remove the Brazilian peppers and sea grapes from the causeway. The City
Manager said he has approached staff regarding the removal of the invasive
plants.
