BACKGROUND The applicant is requesting four variances to the city's sign regulations: 1) A variance of 42.3 sq.ft. property identification signage to permit a 66.3 sq.ft. pole sign; 2) A variance of 14 ft. to permit a 20 ft. high pole sign; 3) A variance of 40.5 sq.ft. business I.D. signage to permit 55.5 sq.ft. of such signage; and 4) A variance of one (1) business T.D. sign to permit two (2) such signs. The variances are sought to: (a) permit the applicant to use the existing pole (property identification) sign structure facing Sunset Point Road which is larger and taller than allowed by code; and (b) allow a second business identification (wall) sign facing Old Coachman Road that is larger in area than allowed by code. The applicant's property is located at the southeast corner'•of Sunset Point Rd. and Old Coachman Rd., and is zoned Limited Office (OL) ; it fronts on old Coachman Rd. and also fronts on Sunset Point Rd., a major thoroughfare. The maximum allowable height of a pole sign is 6 ft. The property does not front on two major thoroughfares as designated on the thoroughfare plan, and is therefore entitled to only one property identification and one business identification sign. Regarding the applicant's proposed pole sign, the existing pole sign structure is proposed to be retained. The applicant states that meeting code requirements creates a disadvantage with competitors who are permitted 20 ft. high signs with surface areas of 56 sq. ft. or larger depending on the zoning district in which they are located. The proposed county-wide Sign Regulations permit a maximum height of 12 ft. and surface area of 50 sq. ft. for freestanding signs in office Districts. The applicant's property appears to have been zoned OL due to its proximity to residential districts on the south and west of the property. While this is a case of different sign restrictions for different zoning districts which will frequently be considered by the Commission, staff would recommend that some consideration be given to the sign height variance request. The 20 ft. height proposed by the applicant is too high, but a 12 ft. sign height, given the proximity of other zoning districts which allow a 20 ft. tall sign appears reasonable. If the Commission is agreeable, the staff would propose a 12 ft. maximum height for freestanding signs in the OL district, bringing that district into conformity with the sign regulations of other nonresidential zones. The staff would recommend no increase in the area allowed for such pole signs, so the sign would be a maximum of 24 sq. ft. in area. Regarding the applicant's proposed additional business identification (wall) sign, although Old Coachman is not designated as a major thoroughfare, it does serve as, an arterial route to and from the shopping districts and the junior college campus to the south. With recent and proposed changes in these shopping areas, this traffic can be anticipated to increase the ADT to the lower limits of minor arterial roads. It is reasonable for the applicant to desire adequate business signage facing old Coachman Rd. in order to advertise his establishment to the traffic traversing this road. If an additional Property identification sign was allowed, this sign could be a wall sign of 48 sq. ft. in area. If a variance is granted to allow an additional business identification sign, the maximum size should be 48,sq. ft. BACKGROUND: This item was continued from the January 2, 1992 Commission meeting. The Coda of Ordinances currently adopts the 1979 Standard Housing Code, which is not the most recent edition. The attached ordinance proposes to amend the Code to adopt the most recent edition, the 1991 Standard Housing Code. In addition, the ordinance proposes to apply the provisions of Section 308 of the Standard Housing Code to hotels, motels, dormitories and lodging houses. City staff intends to bring forward amendments to the Housing Code under a separate ordinance in the near future to change the administrative process for the housing Inspection program. The City Commission, in continuing this item, desired additional information concerning the types and extent of the changes in moving from the 1979 Standard Housing Code to the 1991 version. A complete listing is provided on the attachment:, and the following paragraphs list the major changes. it should be noted 'ghat several of the changes will result in reduced costs for property owners from the 1979 code, particularly the changes to sections 302.4 and 302.5. Sec. 101.4 This change removes the "automatic" determination that a structure judged to.,need repairs in excess of 50% of its value is beyond repair. Sec. 103.2.2 This change shortens the required period to bring structures into conformance with the code and differentiates between major and minor violations with regard to the performance period. Sec. 302.5 This change recognizes the technology changes in unvented heating fixtures that make them safe, cost--effective substitutes for more traditional heating systems. After an insoecti.on determines that housing code violations exist, the City makes available several forms of assistance to repair the home. The City of Clearwater provides interest free deferred payment loans for qualified low income owner:/occupants of deteriorated housing. These loans do not need to be repaid until the owner dies or vacates the residence. For higher income owners, the Challenge 2000 program provides bank loans at" fav-Drabl.e interest rates. Under certain conditions, owner occupants whose housing is bc!?yond repair can have a new home built on their lot with low interest financing. Renters of substandard housing who must vacate due to government action are given preference for housing authority assistance. Ivir. Brennan has also asserted a discrimination claim on these same issues under the Florida Human Rights Act, Chapter 760, Fla.Stat. Constitutional Claims: Mr. Brennan also alleges a constitutional claim under 42 U.S.C. §19$3 for alleged constitutional deprivations under the First and Fourteenth Amendment of the U.S. Constitution and Article 1 of the Florida Constitution. 't' he basis of these claims appears at this point to be that Jti1r. Brennan alleges his First Amendment rights were infringed upon by virtue of his being disciplined for an insubordinate memorandum written by him in 1959. He also alleges that the City's violation of its own equal employment/affirmative action policies has deprived him of his constitutional rights. 3. Whistlehlower Act: ,4vfr. Drennan slates a claim under r- lorida's whistleblower law for alleged adverse action and retaliation for having reported allegations of malfeasance and violation of city policies. The City recently received a settlement offer from ,dr. Brennan regarding this litigation which is the subject of this motion. In summary, Mr. Brennan's settlement offer is that for a total amount of $100,939.05 ($75,000.00 in compensatory damages and $25,939.05 in attorneys' fees) plus compensation for all unused vacation, one half Of aJl unused sick leave and a refund of pension contributions. This denial begins the time period in which t,o begin the appeal process, if you decide to take an appeal. We should discuss this and decide on an appeal during your regular meeting on Thursday, January 15. Let me recap what I. told you back in November: To take an appeal, or not is seldom an easy decision, because there are pros and cons to be considered. The negative side of the question includes' the following: We will be liable for the plaintiffs' attorneys' fees for the appeal, as well as for the trial, if the appeal, is not successful. At this point, I still do not know how much they will ask for attorneys' fees. The odds are against appellants, statistically speaking. This does not mean that an appeal should not be taken. Some of our most important appellate court decisions have resulted from reversals of lower court decisions, a notable example being our own portable sign case, Dan's_Porta Signs v. City of Clearwater. This is one of those cases that could have gone either way. The positive side of the question includes. the following: I have identified several potentially reversible points in the court's order, although it is premature for me to give you a listing of these points. Although this case could have gone either way, it seemed more likely to go our way. 14y optimism, of course, is not an assurance that we will succeed in an appeal., but it is an indication that an appeal would be justifiable and not frivolous. If an appeal is successful., you will not be obligated to paytheplaintiffs, attorneys' fees. If you are wondering how long it may take to obtain a decision from the Eleventh Circuit Court of Appeals, the answer is, "It depends." Based"on our experience in Don's Por.ta Signs and the Spence case, oral argument could be set for eight to ten months after filing the notice of appeal, and the decision could come back in six months to a year after oral argument--more or less. The court could decide to dispense with oral argument altogether, in which case it will be up to the court to decide how long it will take to reach a decision. BACKGROUND: Six 1001 metal light poles currently,, light the infield portion of Jack Russell Stadium. As a result of the wind storm that occurred in April of 1991, one of the four anchor bolts at the base of one of the poles was found to be broken off at the bottom of the leveling nut under the base plate. Temporarily, so as not to interfere with the summer Florida State League, this pole was structurally supported until such time as it could be properly inspected and permanently repaired. While investigating the condition of this pole, the city's consultant engineers found similar damage to the other five metal poles. Because of the apparent potential conditions of failure in the majority of anchor bolts of the six light poles, the consultant recommends that all pole, be removed and foundations replaced. This contract will provide for said work. This was an unforeseen situation and is being treated as an emergency by staff. According to the contract, work must be completed in 45 days so as not to interfere with the opening game of the Philadelphia Phillies Spring Training Season scheduled for March 6, 1992. Also, one night game is scheduled for March 25. Regarding funding, staff recommends that existing CIP Code 315-1-3228 (Jack Russell Stadium) be used for this project. This particular project was originally used for the painting of the stadium roof which has since been completed. It has an available balance of $24,758. To help cover the cost of this light pole contract, staff recommends that $75,400 be transferred into this code (3228) from General Fund Surplus, The existing balance with the transfer will provide a total of $100,158 to accomplish the light pole refurbishment as well as to cover the cost of the replacement and installation of additional lamps while the poles are on the ground. BACKGROUND: The work proposed under this contract is the rehabilitation of approximately 4,430 L.F. of 1211 and 1511 sanitary interceptor pipe by the use of Insituform Liner. In the comparison oC bid prices with Insituform projects of similar scope, pipe size and liner thickness the unit prices were found to be reasonable and consistent with the reliner projects for Pinellas, Hillsborough and Manatee Counties and the City of Tampa. The south sanitary interceptor to the Marshall Street Advanced Pollution Control Facility is 40 to GO years old and has been scheduled for replacement and restoration due to its history of hydraulic overloading and mechanical failure. CDM has determined that the southernmost portion of the interceptor (known as Marshall St. PCF, South Interceptor, Phase 3) from just south of the intersection of Lakeview Road and Greenwood Avenue to the intersection of Missouri Avenue and Turner Street has sufficient size and grade to meet the expected future flow requirements. However, the existing clay pipe material is badly deteriorated and recently has had several breaks and collapses. Restoration of the structural ability of the line must be made while preserving its hydraulic capacity. The restoration alternatives of conventional replacement and sliplining were rejected in this particular, pipe section due to extensive disruption and additional costs for the first alternative and unacceptable hydraulic capacity reduction for the second. The method of choice for restoration in this particular line segment is the Insituform process which will restore the existing structural ability and maintain or even improve the flow characteristics. Both Phase 1 and 2 will require conventional pipe replacement due to needed additional capacity. Phase 1 is scheduled for advertisement in January, 92. Phase 3 construction in this contract is being planned ahead of Phase 1 and 2 due to the advanced deterioration of the existing clay pipe. Second, the Downtown Development Plan has been moved up in schedule due to recent, unforeseen property acquisitions; this necessitates adjusting several project schedules within the Plan, as well as making some amendments associated with the Downtown Development District Comprehensive Plan classification. Third, clarification of the intent behind Policy 19.1.1 (relating to the Coastal Construction Control Line) has been received by staff. Fourth, adjustments to the Capital Improvements Element are necessary to reflect the current city Capital Improvement Program. AMENDMENTS TO POLICY 3.2.1. CONCERNING INTERPRETATION OF THE LAND USE MAP. 1. The amendment to the discussion/description of the Downtown Development District plan classification is to reflect the changes to Downtown zoning associated with the Downtown Development Plan. 2. The amendment to the discussion/ description of the Conservation plan classification is intended to clarify current zoning districts/regulations included in the Conservation classification. AMENDMENT TO POLICY 19.1.1. CONCERNING DEVELOPMENT SEAWARD OF THE COASTAL CONSTRUCTION CONTROL LINE (CCCL). This amendment is intended to clarify the intent of this policy - to insure that development does not occur seaward of the Coastal construction control Line (CCCL), except for public purposes or in the case of unique circumstances which warrant variances. Reference to development densities is deleted since the CCCL is a structure placement guideline, not a determinant of intensity of development., AMENDMENT TO OBJECTIVE 19.7. CONCERNING REDEVELOPMENT STRATEGIES ON CLEARWATER BEACH. This amendment is intended to: (1) adjust the objective to reflect concerns raised by the Beach Task Force about the condemnation aspects of redevelopment" plans; and (2) bring the timing of the actions associated with this objective into conformance with the changes proposed for Objective 2.1 above. The scheduling of the Downtown Development Plan has necessitated this latter change. AMENDMENTS TO THE CAPITAL IMPROVEMENT ELEMENT CONCERNING PROJECTS TIMING AND FUNDING. These amendments are intended to bring the Comprehensive Plan into conformity with the City's adopted Capital Improvement Program. 1 3 - codes and local land development regulations. ATTACHMENT PROPOSED TEXT AMENDMENTS TO THE COMPREHENSIVE PLAN The following amendments to the Comprehensive Plan indicate the,precise wording being proposed. The recycled water would be used to irrigate neighborhood areas, including public properties, private and commercial. The project will be used as a pilot program to establish the feasibility of the project in terms of demand, costs and technical considerations for this kind of "retail distribution" of recycled water. Marshall Street Into ee for/Water Reuse Line Replace the 40 to 60 year old Marshall Street Advanced Pollution Control Facility south interceptor due to pipe deterioration and hydraulic insufficiency and provide the first leg of the Water Reuse system from the Marshall Street tvastewater facility. DRAINAGE ELEMENT I Allen's Creek Innvrovements Project improves slnrmwater quality in Allen's Creek basin. Initially, a sediment basin is planned in the vicinity of Druid Road of the Allen's Creek bridge. Actions to reduce storm hank erosion will also be a part of this project. Stevenson's Creek Improvements Funding is in response to major storm events of July 1987, September 1988 and November 1988. A Stevenson's Creek Master Drainage Plan has been prepared for phased improvements to Stevenson's Creek in two stages. The contract with Recycling and Recovery Systems expires January 1 with an agreed extension to February 1. It is the intent of the Solid Waste Division to take over the Recycling and Recovery Systems routes with existing personnel and vehicles on February 1, 1992. The approximately $50,000. annual subsidy to Recycling and Recovery Systems, along with some additional overtime, will be used to help 'fund this take over project. A reallocation of personnel and vehicles will also be implemented. The vehicles to be used, side loaders, rear loaders and Eager Beaver Trailers, are not ideal for this project and are temporary measures only. The Solid Waste Division will not implement public education at this time but will only take over existing routes, providing only the limited service previously provided by Recycling and Recovery Systems. At the same time, the Solid Waste Division will move forward to begin a full scale recycling pilot project of approximately eight hundred homes in Morningside, Grovewood, The Meadows and Skycrest Subdivisions. These residents will receive a yellow eighteen gallon curbside container in which to place their recyclables (three colors of glass, HDPE and PET [#1 and #2] plastics, newspapers, aluminum and tin cans). These containers will be picked up once a week on a regular garbage collection day by a specialized recycling truck to be purchased from grant funds. A full scale education program will be implemented for this project. A monthly report will be provided to the Commission detailing the progress of the pilot study.
