AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, VACATING 12 FEET OF A PLATTED DRAINAGE
AND UTILITY EASEMENT, LOCATED ON LOT 52,
CYPRESS BEND OF COUNTRYSIDE UNIT ONE,
ACCORDING TO THE PLAT THEREOF AS RECORDED IN
PLAT BOOK 76, PAGE 10, OF THE PUBLIC RECORDS OF
PINELLAS COUNTY, FLORIDA; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the owner in fee title of real property described and depicted in Exhibit
"A" (attached hereto and incorporated herein), has requested that the City vacate said
drainage and utility easement; and
WHEREAS, the City Council of the City of Clearwater, Florida finds that said
drainage and utility easement is not necessary for municipal use and it is deemed to be in
the best interest of the City and the general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
A drainage and utility easement described as follows:
See Exhibit "A"
is hereby vacated, closed and released, and the City of Clearwater releases all of its right,
title and interest thereto, contingent upon, and subject to, the following conditions
precedent:
1. Frontier Communications has facilities in the area, which may be in conflict with
the proposed construction plans. The Property Owner must contact Sunshine 811
by dialing 811, 2 full business days prior to the start of any work to have these
facilities located. All necessary precautions must be taken to protect and avoid
damage of these facilities during construction.
2. WOW! Maintains facilities within this area that conflict with the vacation request.
WOW! Has no objections provided easements for their facilities are granted and/or
applicant bears the entire expense for relocation of associated WOW! Services.

3. Charter/ Spectrum has no objections provided applicant bears the expense for
relocation of any Spectrum facilities to maintain service to customers affected by
the proposed Vacate.
4. Easements granted and/or actions taken as required above by each entity, shall
be in the location and in accordance with the terms of which are acceptable to the
respective utility providers.
Section 2. The City Clerk shall record this ordinance in the Public Records of Pinellas
County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
