AGREEMENT TO TRANSFER OWNERSHIP OF K-9 AXE BY WAY OF ADOPTION TO OFFICER JESSE MYERSAGREEMENT TO TRANSFER OWNERSHIP OF K-9 AXE BY WAY OF ADOPTION TO OFFICER JESSE MYERS This Agreement is made and entered into between the City of Clearwater, Florida, hereinafter the "City," and Officer Jesse Myers. WHEREAS, K-9 Axe is 7 years and 9 months old and has exceeded the average working life of a Clearwater Police Canine, which, based on our experience, has been approximately 5 years. WHEREAS, the Canine Unit veterinarian has determined, based on his 28 years of experience, K-9 Axe would not be a candidate for transfer to another Clearwater Canine Handler due to his age-related deterioration and inability to adjust to another handler. WHEREAS, K-9 Axe is at an age where it is not economically feasible to transfer him to another Clearwater Canine Handler. Assuming Axe could adjust to another handler, the length (640 hours) and rigors of canine school would result in further age-related deterioration and accelerated retirement resulting in the new handler repeating canine school, thus incurring significant personnel costs for the 640 hours of training required to certify. WHEREAS, it would be impossible for anyone to gain the knowledge and compatibility that was gained by the handler/canine team during approximately 6 years of canine work; coupled with his age, he would be of no use to the city, any other police department, or security agency. WHEREAS, Section 2.624(1), Code of Clearwater, authorizes the City Manager to dispense with the bidding requirements for the disposal of surplus property and to dispose of the property as the City Manager deems necessary when the value of the property does not exceed $500. Moreover, Section 2.624(3), Code of Clearwater, authorizes the City to dispense with the bidding requirements and to dispose of the property as deemed necessary when the item can be sold or otherwise disposed of through only one source. NOW THEREFORE, in consideration of the promises contained in the Agreement, the parties agree as follows: 1. The City agrees to transfer ownership of K-9 Axe to Officer Jesse Myers by way of adoption. 2. Officer Jesse Myers agrees to assume ownership and all responsibility for the care of K-9 Axe. 3. Officer Myers agrees to indemnify and hold the City harmless from any and all claims, suits, judgments, and liability for death, personal injury, or property damage attributable to the dog's actions occurring after the Agreement is executed by both parties, including legal fees, court costs, and other legal expenses. 4.
