09/27/2007 CHARTER REVIEW COMMITTEE MEETING MINUTES CITY OF CLEARWATER September 27, 2007 Present: Jay E. Polglaze Chair Frank L. Akin City Attorney Cynthia E. Goudeau City Clerk Rosemarie Call Management Analyst Patricia O. Sullivan Board Reporter The Chair called the meeting to order at 2:30 p.m. at City Hall. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. 2 – Approval of September 13, 2007 minutes Member Drayer moved to amend the minutes of the Charter Review Committee of September 13, 2007, by inserting at the beginning of page 4: Section 3.03(g) “ – Powers and duties of the city manager. Member Drayer moved to insert in Section 3.03(g) of the Charter: Historic Preservation: 1) The City Manager shall have (insert appropriate government division) prepare an annual report on the status of the preservation of historic structures and districts within the City. This report shall be submitted to the City Manager on or before (insert date) of each year and 2) The City Manager shall make a report to the Council on the status of historic preservation within the City on or before (two months after above date report is submitted to the City Manager) of each year. This report shall include a summary of legislation and actions taken to promote historic preservation in the preceding year, recommendations and goals for the coming year, and a 5- year plan to promote historic preservation. The motion was duly seconded. Members Dame, Drayer, Harra, Milam, Wallace, and Warshauer and Chair Polglaze voted “Aye”; Member motioncarried Blackwood voted “Nay.” Motion carried.” The was duly seconded and unanimously. Charter Review 2007-09-27 1 Member Wallace moved to approve the minutes of the Charter Review Committee motioncarried meeting of September 13, 2007, as amended. The was duly seconded and unanimously. 3 – Section 2.01(d)(6) – Consider rescinding previous motion deleting entire section Member Dame moved to rescind the previous motion to delete Section 2.01(d)(6) and add to paragraph 2, line 5, “/recreation” after “open space.” There was no second. The City Attorney reviewed permitted recreation uses that would be allowed if this charter change is approved. Member Dame withdrew his motion. motion Member Dame moved to leave Section 2.01(d)(6) as it currently exists. The was carried duly seconded and unanimously. 4 - Section 3.03(g) – Consider language regarding historic preservation: Approved 9/13/2007 5 - Section 8.05(d) – Discuss makeup of canvassing board and change meeting requirement to meet state law. The City Attorney recommended that the City Attorney and City Clerk not be appointed to the Canvassing Board. Member Gardner moved to amend Section 8.05(d) so that the Canvassing Board shall be comprised by councilmembers whose names do not appear on the ballot, and in the event there are less than three councilmembers, council will appoint a citizen as the third member. motioncarried The was duly seconded and unanimously. 6 – Discuss citizen recommendation regarding Safe Water Amendment Discussion ensued. It was felt the issue should be addressed via ordinance. Member Dame moved to exclude safe water language from the Charter. The motion was duly seconded. Consensus was to allow public comment. Two people spoke against adding fluoride to City water and one person requested streamlining the citizen initiative process. It was stated that council has reviewed the Safe Water Amendment initiative in the past and has declined to support it. No vote was taken. 7 – Discuss letter by Member Harra Charter Review 2007-09-27 2 Member Harra submitted a letter recommending future Charter Review Committees assign sections of the Charter to individual members for in-depth review. Discussion ensued. Consensus was to attach Member Harra's letter to the committee's final report. 8 - Discuss impact if City election is moved to January 2008 City Clerk Cyndie Goudeau said if the Council moves the City election to January 2008, the Charter Review Committee will present the final report on October 17, 2007. Consensus was that the Committee could complete its work in time and members will forward final recommendations to staff prior to October 11,2007. 9 - Set aqenda for October 11 , 2007 meetinq: Approve final committee report.
