1. Call to Order— Mayor Hibbard
The meeting was called to order at 6:00 p.m.
2. Invocation — Rev. Alethea Winston from St. James A.M.E. Church
3. Pledge of Allegiance
4. Special recognitions and Presentations (Proclamations, service awards, or other
special recognitions. Presentations by governmental agencies or groups providing
formal updates to Council will be limited to ten minutes.) — Given.
4.1 Teacher Appreciation Week, May 3-7, 2021 Proclamation — Sarah Painter, Eisenhower
Elementary School Teacher of the Year and Pinellas County Schools Districtwide Teacher of the
Year
Farewell to Public Utilities Director
Public Utilities Director Dave Porter thanked City Council, staff and citizens for their support for the
last 10 years and for allowing him to do his job. He said his retirement from the City tomorrow will
be bittersweet.
The City Council thanked him for this dedicated service and wished him
well in his retirement.
5. Approval of Minutes
5.1 Approve the minutes of the April 15, 2021 City Council Meeting as submitted in written
summation by the City Clerk.

Vice Mayor Hamilton moved to approve the minutes of the April
15, 2021 City Council Meeting as submitted in written summation
by the City Clerk. The motion was duly seconded and carried
unanimously.
6. Citizens to be heard re items not on the agenda
Talma Pilato provided information about Mental Health First Aid, a free
one-day training available to city employees to help improve mental
health awareness.
Joe Hernandez expressed concerns with his recent utility billing. He
said he connected to the city sewer because he was told the cost would
not be much higher than being on septic. He said he never received the
reclaimed water meter he was promised.
Erika Escamilla expressed concerns with adding fluoride to the City's
water and allowing 5G infrastructure. She recommended Council read
The Invisible Rainbow (Firstenberg, 2016).
Peter Goulding requested consideration to allow recreational vehicles,
that are the same size as boats or trailers, be parked in driveways. He
said he receive a letter notifying him of a code violation for his camper
that was parked in his driveway, others in his neighborhood have not
been cited for their parked recreational vehicles.
Assistant City Manager Michael Delk said city code allows recreational
vehicles"up to 20 ft. to be parked in the driveway but campers need to
be parked behind the building line in the side yard.
Jamie Lewis expressed concerns with the suspended particulate
matter associated with fireworks and requested the City consider ways
to mitigate those impacted in the neighborhood who are not watching the
July 4 fireworks.
Bill Jonson thanked the Council for the newly renovated Crest Lake Park.
He said documentation for the amenity experience at Coachman Park are
still missing and that the video fly-over for Imagine Clearwater provided at a
recent work session was inadequate.
7. Consent Agenda — Approved as submitted.
7.1 Authorize the piggyback of State of Florida Term Contract No. 84121500-15-01,

Purchasing Card Services, with Bank of America, for the term April 6, 2021 through
January 4, 2026, including administrative extensions, pursuant to Clearwater Code of
Ordinances Section 2.564(1)(d) Other Government Entities Bids, and authorize the
appropriate officials to execute same. (consent)
7.2 Authorize a purchase order to O'Neils LLC dba O'Neils Tree Service (O'Neils) of Ozona,
FL in an annual not to exceed amount of$350,000.00 for term May 10, 2021 through May
9, 2022 with four one-year renewal options pursuant to Invitation to Bid 20-21, Tree and
Stump Removal Services and authorize the appropriate officials to execute same.

7.3 Approve agreements with Prison Rehabilitation Industries and Diversified Enterprises
(PRIDE) dba PRIDE Enterprises, of Brandon, FL, in the amount of$112,950 for the
refurbishment of two command vehicles, in accordance with Clearwater Code of
Ordinances Section 2.564(2) and authorize the appropriate officials to execute same.

7.4 Approve an agreement between Divecom Services, LLC, located at 1323 20th Avenue
East, Palmetto, FL 34221, and the City of Clearwater to provide vessel removal, towing,
storage, and/or disposal services to accommodate all needs of the Clearwater Police
Department and the Marine and Aviation Department and authorize the appropriate
officials to execute same. (consent)
7.5 Authorize the Clearwater Police Department (CPD) to accept a Florida Department of
Health, Helping Emergency Responders Obtain Support (HERDS) Program grant, to
update the Department's Naloxone (Narcan) supply in the valued amount of$11,800 and
authorize the appropriate officials to execute same. (consent)
7.6 Approve the final plat for Elevate SafePoint, whose physical address is 1551/1555/1559
Union Street, located on the south side of Union Street approximately 900 feet east of
Highland Avenue. (consent)
7.7 Approve the final plat for Leeks Thomas Estates, whose physical address is 511-517
Virginia Lane, located on the east side of Virginia Lane approximately 300 feet south of
Gulf to Bay Boulevard. (consent)
7.8 Approve the final plat for Aventon Clearwater, whose physical address is 24323 / 24479
US Highway 19 North, located on the east side of US Highway 19 North approximately
800 feet north of Sunset Point Road. (consent)
7.9 Approve an Engineer of Record (EOR) Work Order to Metzger and Willard, Inc., of
Tampa, Florida, in the amount of$256,542.00 for Local Limits and WRF Permit
Renewals (21-0007-UT) and authorize the appropriate officials to execute same.

One Work Order to Metzger and Willard, Inc. in the amount of$78,139.19, increasing the
work order from $262,020.00 to $340,159.19, and authorize the appropriate officials to
execute same. (consent)
7.11Approve Amendment One to Southwest Florida Water Management District (SWFWMD)
Cooperative Funding Agreement (N915) for Lower Spring Branch Conveyance
Improvements (14-0048-EN), extending the expiration date through June 30, 2024, and

7.12Appoint Lori Y. Carter to the Brownfields Advisory Board as a business owner or

Councilmember Allbritton moved to approve the Consent Agenda
as submitted and authorize the appropriate officials to execute
same. The motion was duly seconded and carried unanimously.

8. Administrative Public Hearings
8.1 Approve the request from the owner of property addressed as 2055 Buford Avenue,
Clearwater to vacate a platted 10-foot Utility Easement, described as the north 10 feet of
lot 18, Cedar Heights, according to the plat thereof as recorded in Plat Book 81, Page
85, of the Public Records of Pinellas County, Florida, and pass Ordinance 9461-21 on
first reading.
The property owner at 2055 Buford Ave., Clearwater, has requested that the

City vacate a 10-foot platted Utility Easement along the rear of their property.
The purpose of this vacation will be to allow construction of a pool and pool
deck.
There are no utilities present within this easement. City staff have reviewed this
vacation and have no objection.
One individual requested that the public notice include the physical
address.
Councilmember Beckman moved to approve the request from the
owner of property addressed as 2055 Buford Avenue, Clearwater

8.3 Continue to June 3, 2021: Approve the contraction of the Clearwater Cay Community
Development District and pass Ordinance 9437-21 on first reading.
CL Clearwater LP, a Delaware limited partnership; CL Clearwater LLC, a
Delaware limited liability company, doing business in Florida as CL
Tampa Clearwater LLC; CL Clearwater Owner 3 LLC, a Delaware limited
liability company; CL Clearwater Owner 4 LLC, a Delaware limited liability
company; CL Clearwater Owner 5 LLC, a Delaware limited liability
company; and CL Clearwater Owner 6 LLC, a Delaware limited liability
company, owners in Clearwater Cay Community Development District
(Petitioners), a community development district established by Ordinance
No. 7515-05, adopted on September 15, 2005 as amended by Ordinance
7564-05, adopted on January 19, 2006 of the City Council of Clearwater,
Florida, and effective on that date (City Ordinance), have petitioned the
City Council of the City of Clearwater, Florida (Council), through its Petition
to Amend Clearwater Cay Community Development District (Petition), to
contract by non- emergency ordinance, the boundaries of the Clearwater
Cay Community Development District (District).
The Petition is complete in that it meets the requirements of Section
190.046(1), Florida Statutes (2020). Appropriate city staff reviewed the
application and determined it to be complete and sufficient.
The costs to the City of Clearwater and government agencies from
contraction of the District are nominal. There is no adverse impact on
competition or employment from District contraction. The persons affected
by contraction are the future landowners, present landowners, the City of
Clearwater and its taxpayers, and the State of Florida. Methodology is as
set forth in the Statement of Estimated Regulatory Costs (SERC) on file
with the City. The SERC of the Petitioner pertaining to District contraction
is complete and adequate, in that it meets the requirements of Section
120.541, Florida Statutes.

Contraction of the District by this Ordinance, whose uniform general law
charter is Sections 190.006 - 190.049, Florida Statutes, is subject to and
not inconsistent with the local Comprehensive Plan of the City of
Clearwater and with the State Comprehensive Plan.
The area of land within the District as contracted is sufficient size, is
sufficiently compact, and is sufficiently contiguous and has been
developed as one functional, interrelated community.
The area that is proposed to be served by the District after the contraction
is amenable to separate special district government.
Upon the effective date of this Ordinance. the Clearwater Cay Community
Development District will cease to be duly and legally authorized to exist
on the proposed Contraction Property and, as to the Contraction Property
shall cease to exercise any of its general and special powers in
accordance with, and as granted by, its uniform community development
district charter as provided in Sections 190.006- 190.049, Florida
Statutes.
All notice requirements of law were met and complete notice was timely
given.
The City Attorney said the Applicant has requested to continue the
item to June 17, 2021.
Councilmember Beckman moved to continue Item 8.3 to June 17,
2021. The motion was duly seconded and carried unanimously.
9. Second Readings - Public Hearing
9.1 Adopt Ordinance 9440-21 on second reading, annexing certain real property whose post
office address is 1313 Parkwood Street, Clearwater, Florida 33755, together with the
right-of-way of Parkwood Street abutting Lots 4 and 5, into the corporate limits of the city
and redefining the boundary lines of the city to include said addition.
Ordinance 9440-21 was presented and read by title only.
Councilmember Beckman moved to adopt Ordinance 9440-21 on
second and final reading. The motion was duly seconded and
upon roll call, the vote was:

10. City Manager Reports
10.1Confirm COVID-19 Emergency Proclamation and adopt Resolution 21-21.
Division Chief of Emergency Management Jevon Graham said due to the
Governor's Executive Order, the City will no longer extend its state of
emergency. COVID-19 is not over and the City encourages the public to
continue following CDC guidelines.

Assistant City Manager Micah Maxwell said the City intends to switch the
"Mask UP"signs at the old city hall with "Go Bolts."
Councilmember Allbritton moved to confirm COVID-19 Emergency
Proclamation. The motion was duly seconded and carried
unanimously.
Resolution 21-21 was presented and read by title only.
Councilmember Beckman moved to adopt Resolution 21-21. The
motion was duly seconded and upon roll call, the vote was:

11. City Attorney Reports — None.
12. Other Council Action
12.1 Chickens - Mayor Hibbard
Mayor Hibbard said Council promised to discuss backyard chickens and
staff has looked at other cities. Tonight, Council will discuss the issue,
allow citizens to provide feedback, and decide if staff should draft an
ordinance. An ordinance would require two hearings, providing citizens in
support and in opposition additional opportunities to speak.
The City Attorney said Clearwater is not the only municipality in Pinellas
County that does not allow backyard chickens. She said Pinellas County
allows four chickens and includes a fair amount of guidelines. She
provided copies of a table that summarized the current status of backyard
chicken ordinances in Pinellas County. Ordinances are typically
enforced by code enforcement staff but in some municipalities the
enforcement falls under the police department. Clearwater Police Chief
Daniel Slaughter said the larger municipalities allow residents to have four
to 12 chickens. The smaller beach communities, approximately 9, do not
permit backyard chickens.
In response to questions, Chief Slaughter said it was not clear per city
code that backyard chickens were not permitted in Redington Beach
and Indian Shores. He said he spoke with St. Petersburg Police Chief
Anthony Hollaway, Pinellas Park Police Chief Michael Haworth,
Belleair Police Chief Richard Doyle and Tarpon Springs Police Chief
Jeff Young and regarding the call impact of backyard chickens and they
all reported it was relatively low. The City Attorney said she would

anticipate staff drafting an ordinance similar to the zoning and use
restrictions included in the Pinellas County ordinance. She said the city
ordinance would likely fall under code enforcement. Chief Slaughter said
many of the regulations allow backyard chickens in single-family homes
and restrict them in multi-family locations.
Four individuals spoke in support with one suggesting that consideration
be given to require permits, limit one hen per 2,000 sq. ft., and setbacks
of 10 feet from the property line where the coop is located.
Three individuals submitted eComments supporting backyard chickens
that were read by the City Clerk (see page 15).
Discussion ensued with comments made that the backyard chickens be
limited to single family homes and include a setback from the fence.
There was council consensus for staff to draft an ordinance for council
consideration.
13. Closing comments by Councilmembers (limited to 3 minutes)
Councilmember Bunker congratulated Vice Mayor Hamilton on his
lottery win. He said he was happy we are getting back to normal life. He
was sad to read about the murder of a transgender woman in Clearwater
as well as crimes against transgenders and Asians across the country.
He said as we get the chance to be with other people and be more
friendly, maybe we can put a stop to some of this.
Councilmember Beckman thanked the citizens who showed up to the
meeting to share their concerns and ideas. She said she loves civic
engagement.
Councilmember Allbritton said it is an exciting time in Clearwater. He
said there was a ribbon cutting for Crest Lake Park and it is a must see
and a precognition of what we will have on the water in Imagine
Clearwater. There is a lot of underground work being done and a
groundbreaking ceremony coming up for that. He said to be nice to your
neighbor.
Vice Mayor Hamilton said to respect business owners who still require a
mask, there is no need to be ugly against business owners,just have a
little consideration. He thanked the city clerk's office for their work
in recognition of City Clerks Week.

Hi , My name is Tara Penix ,
My Husband Roger and I are here in support of Chickens being part of a wonderful life in Clearwater Fl. There
are many ways chickens help people. My chickens are ESA Chickens. I have Disablilities that they help me with .
Chickens actually have personalities and show cuddles and love . They are a great distraction for PTSD and
Anxiety. THey have been a GODSend thru the Pandemic. I use to volunteer at an Urban farm before covid and
she called me her chicken wrangler because i was so happy there and good with them . It was a happy place a
calm place to be with these feathered friends. . The pandemic hit and Shut downs and such . Boy was i grateful to
still have my Three girls to keep me distracted and give me peace . Now yes the eggs are a bonus. my Mother
inlaw is allergic to store eggs so She now gets to have fresh eggs to eat where she could not afford the expensive
eggs at market from farmers fresh eggs. Also we grow a Food yard. The chicken droppings go in a compost and
we build soil to use in our garden that we grow food to feed us and share with others . Chickens have so many
places in our community to help everyone of any age . They are so helpful Mentally Spiritually and Physically. My
neighbors say they are no bother. In two years i have never had a complaint. They are kept in a very well built
run and coop with Hardware cloth that keeps out racoons and critters that could harm them. .. They are not
smelly as we keep them clean. and with 3 girls its not hard work. . They are quieter than all the neighborhood
dogs that bark at sirens , cats , squirrels , People walkning by. Heck they bark at the air for half . Stray cats are
roaming the neighborhood all hours of the day and night peeing and pooing in peoples yards. Chickens are in
Chicken Runs kept safe and no bother to neighbors in that aspect. Sure they sing the occassional egg song when
happy about laying an egg. . for the most part they are pretty quiet. No roosters oh my they never hush up. ha....
So in ending. I really do hope you see how many ways chickens are a great part of life !... I do have ESA letters if
you would like to see them tonight during this session. . Thankyou for taking the time to hear us and i hope you
too agree a few Good Hens are a great ingredient to sustainability and Mental health. ,

Please support allowing : limited number of chickens at single family homes with reasonable guidelines regarding
care, space, and cleanliness. When deciding on spacing, please keep in mind that many of us in older Clearwater
have narrow lots but can still be responsible chicken owners.
In limited numbers, hens are as quiet and clean as wild birds, and are a great lesson in care and sustainable
living for our kids!

I'm a resident of Clearwafer since 1998. I'm a strong believer of having a permaculture garden in the city for fresh
foods, landscaping, and outdoor activities. Anybody that have a garden for many years know the importance of
having chicken. There are many good qualities that chicken can provide, such as fresh egg, waste reduction,
fertilizer, natural pest control, entertainment and education to our children. We now live in society that go to
supermarket to buy everything we need and sometime resource to fast food drive-thru for a quick meal. We stop
teaching our children the important life skills like growing our own foods. I have two young kids and I want to avoid
seeing them playing with their iPad and game console all day indoor. They enjoy playing in the backyard, picking
tomatoes, berries, and flowers from the garden. I remember a few times my kids asked me, why can we have
chicken in our backyard?
