A. CALL TO ORDER, INVOCATION, PLEDGE OF ALLEGIANCE
The Chair called the meeting to order at 1:00 p.m. at the Main Library followed by the
Pledge of Allegiance.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.

Member Quattrocki moved to approve the minutes of the December 15, 2020

Request: The Community Development Board is reviewing a proposed boatlift in
association with an existing multi-use dock greater than 500 square-feet in area with
a side (east) setback of 0.5 feet in the Tourist (T) District and the Clearwater Pass
District of Beach by Design for the property located at 724 Bayway Boulevard Unit 3-
A, Slip 6. No changes are proposed to the existing building or site. The project
requests allowable flexibility from setbacks (Community Development Code Section
3-601.C.3).

Location: 7.002-acre property located on the south side of Union Street
approximately 117 feet west of the Powderhorn Drive and Union Street intersection.
Request: The Community Development Board (CDB) is reviewing a proposed 96-
bed assisted living facility, 16 attached dwellings units (independent living facility)
and a preliminary plat in the Medium Density Residential (MDR) District for the
properties located at 1551 Union Street, 1555 Union Street, and 1559 Union Street.
The project will create two lots, be 32 feet in height, includes 80 off-street parking
spaces and requests allowable flexibility from height requirements (Community
Development Code Sections 2-304.A, 2-304.13, and Article 4 Division 7:
Subdivisions/Plats).

Member Lau moved to accept Ellen Crandall as an expert witness in the fields of
zoning, annexations, land use/rezoning applications, comprehensive planning, site plan
analysis, and land development code. The motion was duly seconded and carried
unanimously.
Planning Manager Ellen Crandall provided a PowerPoint presentation of the Staff
Report.
Party Status Holder Diane Moronio expressed concerns the project's 30-foot tall
buildings behind her 6-foot fence will encroach on her privacy, the development will
increase neighborhood flooding from the onsite stream, an onsite retention pond would
require maintenance and attract snakes and bugs, and the development will devalue
her property value.
Party Status Holder Janis Przywara said 2006 paperwork indicated the subject property
was home to owls and wildlife and its swamp overflowed every time it rained, forming a
river between nearby homes, and flooding front yards; rainwater took 2 days to drain.
She said her neighborhood was now a designated flood zone and questioned how the
project's drainage issues would be resolved.
Concern was expressed the project's tree inventory indicated the removal and
replanting of 101 trees would result in a 1 496-inch deficit. Ms. Crandall reviewed tree
mitigation requirements and the $48 per-inch charge for the removal of trees worthy of
preservation that were not replaced inch for inch. A final number will be computed when
the building permit is finalized.
Jay Doucette, representing the property owners, said the project would reduce
stormwater problems. He said the property did not have wetlands; it sloped to the south
where a pond will control runoff for a 100-year storm. He said the project was looking for
an opportunity to pipe outfall underground. He said FEMA (Federal Emergency
Management Agency) rated the property "X." He said Pinellas County had implied the
property was in a flood plain but the City's designation reflected FEMA's rating.
Concern was expressed a significant amount of tree canopy will be lost to the project
and the City's tree mitigation charge of$48/inch was insufficient. It was stated
replanting a 2-inch tree cost 5 times more than the City's mitigation charge. It was
commented while the Code encouraged payments into the tree fund, the City would
benefit more from requiring inch for inch tree loss replacement. It was agreed the Code
needed to be addressed re mitigating tree loss.
It was recommended the City take into account Pinellas County's flood designation for
the property; it was noted SWFWMD (Southwest Florida Water Management District)
may respond to this issue if it is brought to their attention.
