01/05/1993 MINUTES PLANNING & ZONING BOARD MEETING TUESDAY, JANUARY 5, 1993 - 1:30 PM PLEDGE OF ALLEGIANCE INVOCATION Members Present: Chairman Mazur, Messrs. Bickerstaffe, Carassas, Hamilton, Merriam, Savage, Ms. Martin Also present: Scott Shuford, Planning Manager Etim Udoh, Planner I Vickie Davenport, Recording Secretary A. APPROVAL OF MINUTES A motion was made by Mr. Hamilton, and seconded by Mr. Bickerstaffe to approve the minutes of December 15, 1992. Motion carried unanimously (7 to 0). B. REQUESTS FOR EXTENSION, DEFERRED AND CONTINUED ITEMS: 1. (Continued from 12/1/92) Lots 1 thru 6, Blk 5, Milton Park, and north l/2 of vacated alley (607 Jeffords St), GTE Florida Inc, (Morton Plant Day Care Center), CU 92-78 Request - To permit child day care Zoned - IL (Limited Industrial) A motion was made by Mr. Bickerstaffe, and seconded by Mr. Carassas to continue this request to February 2, 1993. Motion carried unanimously (7 to 0). C. CONDITIONAL USES: 1. M&B 43.03, Sec. 30-28-16 (26508 US 19 N), Hinely Associates, Ltd, (Arigato Japanese Steak House), CU 93-01 Request - To permit on-premise consumption of beer, wine, and liquor Zoned - CR 28 (Resort Commercial) Mr. Shuford gave the background of the case and presented, in writing, the staff recommendation. In response to questions by the Board, Mr. Shuford stated that there are no police concerns regarding this license. He assumed that the 4-COP-SRX license will take the place of the existing 4-COP-S license at the hotel. Applicant, Dale DelBello, 3600 66th St. N, St. Petersburg, stated that they are not currently serving alcohol. Mr. DelBello stated that it seems every restaurant seems to have this problem of not being able to serve liquor when opening the business. He felt this is very hard on small businesses. He suggested to the Board, that when applicants apply for permits, there should be a red ink stamp on the permit indicating that a conditional use permit is required, similar to the back flow preventor stamp. Mr. DelBello added that this not only be used for restaurants, that if you have a liquor license application, that you need to come before Planning and Zoning, because no one tells you that the process takes 2 l/2 months. Pro: None Con: None A motion was made by Mr. Hamilton, and seconded by Mr. Savage to approve the request subject to the following conditions: 1) The requisite occupational license shall be obtained within six months from the date of this public hearing; 2) There shall be no outdoor speakers associated with the use; and 3) To the extent possible given site conditions, the parking lot shall be landscaped to meet the perimeter landscaping requirements of Section 136.023(c)1.b of the Land Development Code within 18 months of the date of this public hearing. A landscaping plan generally meeting these requirements shall be submitted to the Director of Planning and Development and the Environmental Division within six months of the date of this public hearing. Motion carried unanimously (7 to 0). 2. M&B 23.04, Sec. 18-29-16 (125 S Belcher Rd), Scott M Trefz (Gulf Bay Animal Hospital), CU 93-02 Request - To permit expansion of veterinary offices; and animal grooming and/or boarding facilities Zoned - CG (General Commercial) Mr. Shuford gave the background of the case and presented, in writing, the staff recommendation. Applicant's representative, John Townley, 321 Central Ave., St. Petersburg, stated that the applicant is not requesting any variances. Mr. Townley stated that the certificate of occupancy within one year could possibly be a problem, and requested it be extended to 15 months. He noted that the permits, which were ready the middle of last year, have expired due to a problem with financing. Mr. Shuford stated he felt there would be no problem with this request and also suggested a nine month time period for obtaining the building permit. Pro: None Con: None A motion was made by Mr. Hamilton, and seconded by Mr. Carassas to approve the request subject to the following conditions: 1) A building permit shall be obtained within nine months from the date of this public hearing; 2) All animals boarding shall be indoors; 3) The applicant shall obtain the requisite variance approval from the Development Code Adjustment Board or modify his plans to meet City code; 4) The applicant shall comply with all ordinances and regulations of the City concerning tree removal and landscaping including buffering along the east property boundary; 5) The requisite occupational license shall be obtained within 15 months of the date of this public hearing; and 6) The applicant shall comply with the City's ordinances and regulations concerning disposal of animal excrement. Motion carried unanimously (7 to 0). D. ANNEXATION, ZONING, LAND USE PLAN AMENDMENT, LAND DEVELOPMENT CODE TEXT AMENDMENT, AND LOCAL PLANNING AGENCY REVIEW: None E. CHAIRMAN'S ITEMS Mr. Mazur stated the procedures for the Election of Board Officers. Mr. Merriam nominated Mr. Hamilton for Chairman. Motion was carried unanimously (7 to 0). Mr. Carassas was nominated for Vice Chairman. Motion carried unanimously (7 to 0). F. DIRECTOR'S ITEMS 1. Review of Planning & Zoning Board By-Laws - Mr. Hamilton took over the meeting, as Chairman, from this point. He questioned the Board if the By-Laws have to be adjusted. Mr. Merriam stated his ideas for changes. He will meet with Mr. Shuford to discuss the appropriate changes and will give out copies at the next meeting for approval. Discussion ensued as to changing the starting time for the meeting. A motion was made by Mr. Carassas to start at 2:00 p.m., and seconded by Mr. Bickerstaffe. Motion carried unanimously (7 to 0). The next meeting will be at 1:30 p.m., and the meeting February 16, 1993 will be at 2:00 p.m. G. BOARD AND STAFF COMMENTS Mr. Shuford introduced Etim Udoh to the Board members. He advised members there is a video for them to see on planning in the Training Room downstairs. Mr. Shuford thanked Mr. Mazur for a good year of service as Chairman.
