critical root zones (drip lines)of trees to be preserved and how you propose
to address these impacts i.e.; crown elevating, root pruning and/or root
aeration systems. Other data required on this plan must show the trees
canopy line, actual tree barricade limits (2/3 of the drip line and/or in the root
prune lines if required), and the tree barricade detail. And any other pertinent
information relating to tree preservation.

1. Prior to CDB: This application has insufficiencies and conflicting plans and
is not sufficient to move forward to the Community Development Board
meeting. Specifically, the parking analysis is lacking in data, details, and
conclusion. The civil and architectural plans have multiple inconsistencies
with each other. Which plan and which configuration is correct?There are
requirements of Beach by Design that do not appear to be satisfied including
screening off-street parking, confirming landscape buffer dimensions, and

The next submittal for CDB is 2/12/2021 by 12 noon, with 10 complete and
collated hardcopies and one digital. These issues to not appear to be able to
be resolved by this date. The following date is 3/12/2021 by 12 noon. I would
suggest submitting a revised set electronically a week or two prior to allow
staff to review and confirm prior to submitting. Subject to change depending
on other division comments at PreDRC.
2. Prior to CDB: Submit a complete affidavit to authorize from the property
owner.
3. Prior to CDB: In the Site Data Table the south setback is treated as front
setback with 25 feet. In the Site Data Table, please consider the north and
east side as front AND west and south as sides for setback purposes. Please
be aware that Old Florida District design guidelines of Beach by Design
supersede any CDC setback requirements. Please update the Site Data
Table to reflect the existing setbacks according to Beach by Design.
4. Prior to CDB: On the proposed Site Plan (Sheet C2), please give the
setback dimensions callouts from the property line.
5. Prior to CDB: Setbacks shown on the sheet A-001 do not match the site
plan C2. The design proposal needs to be consistent throughout.
6. Prior to CDB: In the Site Data Table on Sheet C2 and Sheet A?001 need
to have all the numbers regarding site area, building areas and setbacks
need to match consistently throughout the design proposal. Some building
areas need to be consistent and further classified for greater clarity. E.g.
Area of the Fire Station on Sheet A?001 and in the application (pg2) is
11,462 sq ft is used for parking but is not visible on the site plan sheet C2.
7. Prior to CDB: The applicant is asking for parking reduction from 54 off-
street parking spaces to 9 spaces which is a significant parking reduction.
Again, the parking numbers throughout the design proposal meaning
documents, site plans and drawings need to be consistent throughout. The
parking study and application mentions required spaces as 55 and in the
Sheet A-001 and application (pg 4)the parking required is 46; the site plan
sheet C2 required parking spaces as 54. Also, some plans show 11
proposed parking stalls where others show nine.
8. Prior to CDB: The submitted parking study is insufficient. Not enough data
or details were provided to draw any meaningful conclusions from the list of
fire stations and parking counts. It should include the GFA, the number of
staff, the number of living quarters, how many parking spaces were required
as a Government Use and how many were approved so that some kind of
conclusion as to how much of a parking reduction is appropriate for a Fire
Station can be concluded. This must be reviewed by Traffic Engineering and
Planning and agreed to prior to moving forward.
9. On the site plan sheet C2— please clearly state the VUA. This area might
require clarification in the form of a separate sheet showing which areas are
considered for interior green space.
10. This project will be reviewed as a Level Two— Flexible Development
Application and needs to satisfy the flexibility criteria of Comprehensive Infill
Redevelopment Project. It's clear that the applicant is asking for flexibility
from parking. Please clarify if the applicant is requesting flexibility from
Landscape Buffer requirements as required by Beach by Design.

landscape buffers are required and there is no flexibility for buffers required
by Beach by Design.' Please show the landscape buffer on the site plan and

with a maximum reduction down to five. Clearly show that a five-foot
minimum, landscape buffer is provided in the fronts. It appears the
landscaping extends into the ROW. If approvable by Engineering this is a
nice extension of the required buffer. Show that the palms are within the
private property to count towards the landscape buffers.
12. Prior to CDB: As per Beach by Design, Chapter VII.C.1, Design, Scale
and Mass of Buildings, please provide the building footprint area AND total
length and width of the building on the site plan.
13. Prior to CDB: As per Beach by Design, Chapter VII.C.3, at least sixty
percent (60%)of any elevation will be covered with windows or architectural
decoration. Please show how does the building elevations meet this criterion
and how much of the elevation is covered with windows or architectural
decoration. (The north meets the 60% glazing, the east was stated has 40%
glazing and therefore needs 20% detailing, the south and west are
unknown).
14. Prior to CDB: As per Beach by Design, Chapter VII.D.1, please provide
the dimensions from the building to the edge of the right-of-way.
15. Prior to CDB: As per Beach by Design, Chapter VILE.1, at least sixty
percent (60%)of the street level facades of buildings used for nonresidential
purposes which abut a public street or pedestrian access way, will be
transparent. OR landscaped or hardscaped courtyard or plazas, where street
level facades are set back at least fifteen feet (15')from the edge of the
sidewalk and the area between the sidewalk and the facade is a landscaped
or hardscaped courtyard or plaza. The area along Mandalay Avenue below
the Dorm rooms, where currently in the rendering's benches are shown, this
covered seating is an improvement over the past design proposals. Please
provide more details as to how it will be illuminated, maintained, and
landscaped. To make it a more inviting courtyard additional benches,
benches facing each other or at 45-degree angles, art in the courtyard rather
than in the landscape bed and show cases or items to look at on the wall
would be helpful plaza amenities.

17. Prior to CDB: Revise the plans to provide landscaping to screen the off-
street parking from the north public right of way. As per Beach by Design,
Chapter VII.F, all parking areas will be separated from public rights of way by
a landscaped decorative wall, fence, or other opaque landscape treatment of
not less than three feet (3') and not more than three and one-half feet (3'h')
in height. Please show how the parking and the dumpster areas will be
screened.
18. Prior to BCP: Please be aware that as per CDC Section 3-904. - Sight
visibility triangles do apply to landscaping for driveways from parking lots.
Please show SVT's on all the driveways.
19. Prior to BCP: As per Beach by Design, Chapter VII.H, all sidewalks along
arterials and retail streets will be landscaped with palm trees, spaced to a
maximum of thirty-five feet (35')on centers. Please show palm trees on
landscape plan along Mandalay and Bay Esplanade.

show the location of street furniture along Mandalay and Bay Esplanade.

21. Prior to BCP: As per Beach by Design, Chapter VII.I, please show street
lighting locations at equal distance to be coordinated with the City's
Engineering dept.
22. Prior to CDB: As per Beach by Design, Chapter VILL.1, in the Beach by
Design narrative please explain how the finish materials and building colors
reflect Florida or coastal vernacular themes.
23. Prior to CDB: As per CDC Section 3-1202.G, please submit a
comprehensive landscaping plan for reduction to vehicular use area green
space required under CDC section 3-1202.E.2.A. Site data table lists that
1,155 square feet is required where 346 square feet is provided.
24. Prior to CDB: Please clarify the underground dumpster. It is currently
shown as located outside the property line in right of way in architectural site
plan (Sheet A-001). Moreover, it is shown in two different locations on
architectural site plan (Sheet A-001)and the Site Plan (Sheet C2). It needs
to be consistently shown in one location.
25. Prior to CDB: Solid waste, Planning and Engineering need to finalize
dumpster location and all related aspects of it. Maintenance, flood water,
size, etc. are some of the issues need to be addressed.
26. Architectural site plan does not show the actual geometry of the property
lines and proposed development with respect to the site plan. All plans and
drawings must be consistent throughout the design proposal.
27. Prior to CDB: Please give a 24 feet driveway dimension in Site Plan Site
Plan (Sheet C2)for the rear parking area (from parking stall to the closest
edge of the building)
28. Prior to BCP: Please show the location of mechanical equipment and
how you are going to screen it. As per CDC Section 3-204.(D):
a. Equipment shall be placed on roofs or to the rear or side of buildings and
shall not be placed between any right-of-way and the principal structure(s).
b. Equipment shall be exempt from side and rear setback requirements.
However, no mechanical equipment shall be permitted within a side setback
which has been reduced as part of a Level One or Level Two application.
c. Equipment shall be screened from public view by landscaping, fencing, or
architecturally finished walls and/or enclosures designed to be compatible
with the exterior fagade of the building. Rooftop mechanical and elevator
penthouses shall complement the design of street-facing building fagades
and shall be clad on all sides in the same or a material complementary to
that used on street-facing fagades.

Stormwater Review Please acknowledge of the following prior to Building Permit issuance:
1) Please show on the design and support with geotechnical data that the
proposed ponds have a minimum of 6" vertical clearance above SHWT and
draws down its volume within 72 hours with a safety factor of 2.
2) Proposed building's finished floor elevation shall be at least 1 foot above
the adjacent crown of pavement.
3)The following structures gr-1, gr-2, ss-3, gr-4, gr-6 might be too
shallow/small to receive the new pipes and should be replaced.
4) Damaged curb and low spot observed at the existing driveway/brick area
on Bay Esplanade should be replaced/addressed as part of the
reconstruction of the new driveway. Another low spot is located at the
existing gr-2. Since sidewalk/storm pipe between gr-2 to gr-4 are being
replaced, consider relocate gr-4 to stay outside of the pedestrian ramp and
reestablish the flow line to address all issues/preference all at once, if field
condition allows.
5)Specify stronger concrete for new driveway and curbing that are often
subject to heavy fire trucks.
6)Add special instructions for demolition/restoration of the brick road on Bay
Esplanade disturbed by the reconstruction.
General notes:
1. A detail review of the submitted application at DRC level was not
performed at this time. A comprehensive review will be performed at Building
Permit Application; additional comments will be forth coming.
2. All re-submittals shall be accompanied with a response letter addressing
how each departmental condition has been met.
Traffic Eng Review Prior to Community Development Board:
1. Show 20' x 20' sight visibility triangles at driveway connection to Mandalay
Avenue. There shall be no objects in the sight triangle which do not meet the
City's acceptable vertical height criteria at a level between 30 inches above
grade and eight feet above grade.
(City's Community Development Code, Section 3-904). Also provide sight
triangles for adjacent Mandalay Avenue& Bay Esplanade intersection.
Motorists' exiting the existing public driveway shall not have their sight
visibility blocked by proposed project.
2. Is the driveway on Mandalay Avenue a one-way egress only? If so,
please provide do not enter and wrong way signs where applicable per
current MUTCD standards.
3. Provide a turning template of a scaled fire truck(AASHTO standard)
entering and exiting the site in a forward direction without hitting objects.
4. Show typical back-out width dimension (minimum width 24') for parking
space(s).
5. Parallel parking spaces (on street)shall be 23' in length per Community
Development Code Section 3-1402.

4)A standard right-of-way permit will be needed for work on City right-of-way
(e.g. driveways, sidewalks, utility connections, closures of lanes/sidewalks,
etc.). The city must approve a Maintenance of Traffic Diagram (M.O.T.)
plans to issue a right-of-way permit. A link to the ROW application

5)Construction plan shall show the exact location of all proposed facilities to
be installed pursuant to this permit, said construction plan to be sufficiently
detailed to allow location of said installation by reference thereto.
6)Application for Right of Way Use Permit, Provide city staff three completed
right of way use application packages including relevant construction plan
sheets, City construction details; if pedestrian and/or vehicular traffic will be
impacted a Mobilization of Traffic (MOT) plan is required to the engineering
department or email to ivan.dimitrov@MyClearwater.com
7)Once the packet is approved, the applicant shall receive the right of way
use permit after payment of the appropriate fee.
8)Any parking meter affected by the proposed work or MOT plans will
require parking fees to be paid. Contact City Parking department
9)The Contractor shall provide a minimum of forty-eight (48) hours of
notification by phone at 727-562-4750 prior to the commencement of work in
the right of way.
10) During construction in the Right of Way or when the City will have an
easement to maintain the system please schedule the following inspections
prior to completing work:
a. Driveway Rough
b. Sidewalk Rough
c. Sanitary Sewer Rough
d. Storm Sewer Rough
e. Water Main Rough
11) Prior to the receipt of the Certification of Occupancy (C.O.)the ROW
permit shall be closed out and the final C.O. shall be contingent on passing

Utilities Departments. Prior to Final Inspections, the applicant must submit to
Engineering Department five sets of site as-built signed and sealed by the
Engineer of Record certifying the project was constructed per project plans

Traffic Eng Review Prior to CDB:
1. Show 20' x 20' sight visibility triangles at all driveway connections to S.
Missouri Avenue. There shall be no objects in the sight triangle which do not
meet the City's acceptable vertical height criteria at a level between 30

inches. Note: palm trees with 10 feet of clear trunk receive a 1 inch deficit if

GENERAL:
1. Application - FLU
Please correct page one of the application as well as the site data table in
that the Future Land Use is NOT MDR but is RM (Residential Medium).
Please also correct the same item on the Preliminary Plat application (page
2)
2. Application— ISR
The ISR is listed as 0.40 on page two of the application and as 0.47 on the
site data table. Please provide the corrected impervious surface area as well
as the proposed ISR. Make sure the ISR on the Preliminary Plat application
is also correct (page 3). On that same page, the existing ISR is probably 0
since the site is undeveloped. An ISR of 1 means that the entire site is
paved.
3. Fencing/Walls
Clarify if any fencing or walls are proposed around the perimeter of the site.
4. Parking Space Dimension
Please provide parking space dimensions for the garage spaces. The
dimensions should be exclusive of any interference (i.e. water heater,
washer, dryer).
5. Overhead Utilities
Please be aware that all proposed utilities that will lead onto and serve the
site will need to be placed underground to the extent allowed by Duke
Energy.
6. Mechanical Equipment
Please show where mechanical equipment will be located and include a note
that provides that mechanical equipment will be screened from view with
fencing and/or landscaping not only from adjacent rights-of-way but also from
adjacent properties. Feel free to use this exact note if you like: "Mechanical

way with fencing and or landscaping."
7. Interior Landscape Area
The vehicular use area is listed as 10,201.9 SF and the interior landscaping
is listed as 18,830.1 SF. That would be 184.57 percent of the vehicular use
area. Please submit a separate plan which clearly delineates what you
consider to be the VUA and what areas are being considered as interior
landscaping. Interior landscaping would consist of landscape islands
surrounded on at least two sides by VUA and would NOT include required
perimeter landscaping. Make sure that corrections to this effect are provided
on page two of the Preliminary Plat application.

Clarify how site lighting will be addressed. Please provide a clarification and
evidence that Article 3 Division 13 will be strictly adhered to.

The building footprint is listed as 6,483.28 SF. For a two-story building that
should equal a total floor area of 12,966.56 SF where the GFA is listed as
20,432.13 SF. Please clarify the discrepancy. Make sure that corrections to
this effect are provided on page two of the Preliminary Plat application.

12. Application
The application needs to be signed and notarized.
13. CLP Criterion 1
The response most notes that adjacent properties aren't landscaped. The
criterion actually requires that it is clarified how the proposal itself is better
than what would otherwise be required by the CDC. Given existing site
constraints including flood zoning, site contours and existing trees it appears
impossible (or nearly so)to even begin to meet the landscape requirements
along the street. It's unclear how a three-foot landscape buffer is inherently
better than the otherwise required 15-foot buffer. It is staff's opinion that it
would be more in keeping with the CDC to plat the lot into four detached
dwelling lots of approximately 10,700 SF each (60 feet by 177 feet). Not
every site can be developed to its full otherwise permitted intensity of use
and this site may be one of those. The Planning Director will not approve the
requested flexibility for landscaping however, it is recognized that the CDC
requirements that prohibit backout parking into a r-o-w and tandem parking
for all but detached dwellings have driven the submitted design solution. The
Department intends to bring a series of CDC amendments to City Council for
approval which will permit backout and tandem parking for duplexes
however, the time frame for this is expected to be upwards of nine months.
14. CLP Criterion 2
The response notes "...the space available..." The space available is
created solely by the designer and is not an existing condition. It is unclear
how the proposal meets the requirements of a CLP.
15. CLP Criterion 5
Technically, this criterion doesn't apply since there is not a special area of
scenic corridor plan in place for this site.

16. Gen. App. Criterion 1
You will want to clarify how the proposal is in harmony with the scale, bulk,
coverage, density and character of adjacent properties.

The Community Development Coordinator will not approve the proposal as

Stormwater Review Prior to DO:
1) Proposed building's FIFE shall be at least 1 foot above the adjacent crown
of pavement.
2)When using rational method, Pre and Post flow rates shall be based on Tc
of 60 minutes and rainfall intensity of 3.6 in/hr for 25-year storm event. 3)
Pond's drawdown analysis shall include a safety factor of 2.

Planning Review Planning Review
1. The subject property is an irregular shaped lot located at the northeast
intersection of Mandalay Avenue and Bohenia Circle South, resulting in
approximately 304 linear feet of property frontage along the west, south and
east property lines which is considered a front yard for purposes of setbacks;
the remaining north property line is approximately 110 linear feet and is
considered a side yard.
2. The property is in the Low Medium Density Residential District (LMDR)
and features a future land use designation of Residential Urban (RU), where
the required front yard setback is 25 feet and the side yard setback is five
feet consistent with CDC Section 2-202, Minimum standard development.
3. As a Level One, Flexible standard development, a Residential Infill Project
may request flexibility for a front yard setback in the range of 10 feet to 25
feet consistent with CDC Section 2-203, Flexible standard development.
4. The proposed project requests a reduced front setback of 10 feet along
the Bohenia Circle South (east)frontage for the installation of a pool and
deck.
5. CDC Section 3-203.A, provides that: Accessory uses and/or structures
shall not be located between the right-of-way and the principal structure
except as may otherwise be permitted in Section 3-204.
6. CDC Section 3-204.1-1, provides that: Swimming pools and their associated
decks that are 12 inches or less above grade shall be classified as an
accessory structure. Swimming pools and their associated decks that are
greater than 12 inches above grade shall be classified as a principal
structure.
7. The proposed swimming pool is currently proposed at an elevation at 12
inches above grade which classifies the use as an accessory structure and is
not permitted in the front yard area of the property.
8. The design of the proposed swimming pool and deck needs to be modified
to elevate the structure at a height of above 12 inches from grade.
Additionally, the design must be an integral part of the architectural design of
the principal structure, including the same materials, colors, and other
architectural details shall be incorporated into the design of the pool and
deck.
9. Details regarding the proposed pool and deck design being incorporated
into the detached dwelling have not been provided, please provide detailed
information regarding the proposed method of finishes and architecture for
the pool and deck.
10. The existing garage structure along the east side of the detached
dwelling was constructed in 2017 and would not have been permitted except
that the design included the breezeway connecting the garage to the dwelling
with similar roof line and building materials.
11. A response to the General Applicability Criteria includes text that a fence
and landscaping will be included, however, the site plan does not provide any
of these details.
12. The proposed mechanical equipment for the pool has also not be
identified on the site plan, please provide revised plans.
13. The proposed Impervious Surface Ratio has been provided at 0.45 where
0.65 is the maximum permitted and the applicant shall confirm that the
percentage includes all proposed paver areas of the pool deck.
14. The applicant has provided responses to the Flexibility Criteria and the
General Applicability Criteria for the submitted application.
15. The application must include a full and complete property survey of the
entire parcel showing all existing conditions, please include a property survey
in the resubmittal.

the city or regional, state or federal agencies.
2. Clarify if the yellow portion of the deck on the south side attached to the
existing tile patio is new. If so provide a side setback dimension from
property line to the nearest point of the pool deck. If less than the minimum
required five foot side setback it will need to be added to the request. If it is
new it need to be a part of the approval if not you would have to go through
another Level One review for a side setback reduction.
Findings of Fact
1. That the 0.303 acre property is located on the west side of Mandalay
Avenue at the Mandalay Avenue and Bay Esplanade intersection;
2. That the property currently features a detached dwelling;
3. That the subject property is located within the Low Medium Density
Residential (LMDR) District and the Residential Urban (RU) Future Land Use
Plan category;
4. That the rear(west)setback will be five feet to pool deck where a
minimum of 10 feet is required;
5. The requested reduction to a rear setback is consistent with Level One
approvals for rear setback reductions to pools from the east side of Eldorado
Avenue into the immediate area at 961 Mandalay Avenue (FLS2018-02004)
from 10 feet to five feet, rear setback reduction to 967 Eldorado Avenue
(FLS2018-05023)from 10 feet to five, and rear setback reduction to 932
Bruce Avenue (FLS2015-11037)from 10 feet to five. On the west side of
Eldorado Avenue at 1010 Eldorado Avenue (FLS2006-12072)from 10 feet to
five feet;
6. That the subject property is not located in a special area plan; and,
7. That there are no active Code Compliance cases for the subject property.
Conclusions of Law

The DRC reviewed this application with the following comments:
Engineering Review Easement dedication. easements will be required over side lot line swales
and Stormwater retention/detention areas. A lot grading plan and drainage
narrative will be required to verify the project can be meet City of Clearwater
Stormwater criteria prior to final plant approval.
Easement dedication to a private entity who will be responsible for the
operation and maintenance of the common Stormwater areas.

four detached dwellings. The proposed development is consistent with all of
the requirements of the Low Medium Density Residential District and the
Residential Urban future land use designation of Article 2, Division 2. Low

2. The project shall comply with all requirements of Article 4, Division 7.
Subdivision/Plats related to the Final Plat requirements.

area as required per the the approved master Grading/Paving plan of the
