consumpnon of alcoholic beverages (beer and wme) shall take place, the Plannmg and ZOning Board shall consider
the followmg analysts and make the followmg determmanon
1. [s the proposed condmonal use in conflict With any section of the City of Clearwater Land
Development Code (Section 41.033 - 2);
The proposed use compiles With all other applicable Secnons of the Land Development Code
2. Is the proposed use in compliance with applicable conditional use general and supplementary
standards of approval (Sectton 41.033 - 3);
The proposed use compLtes With all other applicable condlbonal use general and supplemental standards of
approval In particular, thiS proposed use comphes With Secnon 41 052 (2) ~ acceptable mgress/egress from
the SIte, (3) - nOise generated from the use shall not unreasonably diminish the use, enjoyment or value of

ftxtures on the Site shall not adversely affect surroundmg properties, (6) - suffiCIent parlang IS proVided and

Zonmg District In addition, there are currently two other estabhshments 10 thIS complex which serve beer
and/ or wme and one other establishment on the property (but not phYSiCally attached to the complex)
which also serves alcohol Furthermore, grantlOg of thiS condltlOnal use IS not anticipated to result 10 an
mcreased demand on pubbc faCilities
6. Is the proposed use consistent with the land use plan (Section 41 033.1);
The proposed use IS compaoble WIth the other commercIal uses In the area, subject to the suggested
condloons of approval
C. FINDINGS OF FACT

. Whereas, the proposed use IS located WIthin an eXlsong retad complex and IS surrounded by office,
restaurant and other types of commercial uses, and
. Whereas, the proposed use will not have an adverse Impact on any surrounding properties
D. STAFF RECOMMENDATION
Staff has revIewed thiS applicatlOn for a Condloonal Use Permit to allow a Nightclub, Tavern or Bar at
2551 Drew Street Based on the Findings of Fact, staff has determined that the proposed use meets the standards
of review set forth In Section 41033 of the Land Development Code Staff recommends APPROVAL of thiS
request subject to the follOWing condloons
CONDITIONS OF APPROVAL
1. TIllS Conruoonal Use Penrut IS based on the apphcatJ.on, testlmony, and doa.unents sub nutted by the
apphcant, Indudmg maps, plans, surveys, and other documents In support of the request DeVlaoon from
any of the documents beyond the scope expressly authonzed by the Board In approval of thIS vanance, will

2 The apphcant shall obtam an occupaoonal hcense withm SlX (6) months from the date of thIS public
heanng;
3. The sale of alcoholic beverages shall be !tmlted to consumpnon on premIses WIth no package sales,
