applicant wants to change the boat slip from a wet slip to a dry slip. He
stated four pilings will be driven into the water at the existing slip to
install a hoist to lift a boat out of the water.
No persons appeared in support of or in opposition to the above request.
Motion was made by Mr. Hogan, seconded by Ms. Nash. to approve the above
reques t subject to the construct ion permit being issued within 6 months of
approval of the conditional use. Motion carried unanimously (5 to 0).

Ms. Harvey advised this request for conditional use is for a marina in the
Business (B) zoning district located on Sand Key. specifically for approval of
a 78-slip marina including refueling and pump out facilities. She also advised
the governing sections of the Land Development Code are Sections 136.025(b)
and (c)(18). She further advised the Traffic Engineer, Building Department,
Harbormaster. and Environmental Coordinator all reviewed the conditional use
request and had no objection.

Ms. Harvey stated. though the request appears simple on face value, other
mat ters need to be considered In reviewing the reques t and she provided
background information. Ms. Harvey stated this property is part of a
settlement stipulation with the City of Clearwater which provided for specific
development for the upland property adjacent to the marina that would
accommodate up to 220 motels rOOms and 85,000 square feet of commercial area.
She also stated a site plan, which has not been formally reviewed by the City,
has been provided with the application which appears to be close to what will
be required for the site. She further stated that during settlement
negotiations there was conversation regarding a proposed marina but City staff
felt it ~ould not be appropriate to include a marina in the settlement since
several other approving authorities would be required. She stated the former
property owner was advised that the City would not object to a marina unless
there was particular violation of any local ordinance. Ms. Harvey advised
that. in terms of the concept of the marina. the City is in support and
willing to help applicant through the process.
Ms. Harvey provided information to the Board concerning Developments of
Regional Impact (DR!). She stated a DRI is governed by the State with review
process at the local, county and regional levels with ultimate review by the
Department of Community Affairs. She stated certain requirements need to be
met to qualify as a DR!. such as number of rooms. parking spaces, boat slips.
square footage, etc. She also stated that the subject project, as far as the
upland property and the commercial site are concerned, is not a DRI in the
City's opinion because the project is covered by Court Order which was amended

through Settlement Stipulation. She advised since the marina and the proposed
development are considered a mixed use, which exceeds the threshold of a DR1,
the project would appear to be a DRr. She also advised the applicant has
several options as follows for having a determination made as to whether or
not the project is a DR1 and if development approval is required: 1) Request a
binding letter from the Department of Community Affairs who makes the
determination as to whether the project has the status of a DRI; 2) Request a
letter of vested rights which we would assume to exist on the upland property
and whether or not those vested rights would be sufficient to allow applicant
to proceed with the marina on its own not being considered a DRI; or 3) Make
full application for development approval with the subsequent issuance of the
development order by the City of Clearwater for the applicant to proceed.
Ms. Harvey stated staff had no objection to a marina at the subject site but
since it is the marina itself that raises the quest ion of a DRI it is
important for the applicant to have some indication from the City whether it
should proceed with the marina. She advised it would then be applicant 's
respons ibi IHy to obtain all necessary permits from the State. Ms. Harvey
advised that staff recommended approval of the above request subject to the
following: 1) That determination of the DRI status of this proJect and
subsequent compliance with DR1 regulations be completed prior to issuance of
permit; 2) That the pump out facility and fueling station be specifically
authorized by the Planning and Zoning Board as required by code; 3) That the
parking for the marina be in compliance with the Settlement St ipulat ion as
recorded for Parcel III, which is one space per slip; and 4) That all required
permits from the county and the state be obtained before issuance of building
permi t.
Ms. Harvey advised one letter of support for the above request was received.
Ms. Claire Carraway, attorney for applicant, appeared requesting approval of
this conditional use. She advised the marina will be located at the northern
end of Sand Key in Clearwater Harbor. She also advised applicant proposes to
build a hotel, retail and restaurant development on Sand Key. She further
advised the marina will be for customers and the general public. She stated
the ma rina has been de signed, af ter me et ing with the D. E. R., to prot ec t sea
grasses. She also stated applicant proposes to build a boardwalk over the sea
grasses, approximately 100 feet in length, and the marina will stretch north
to south parallel to the seawall to act as a barrier to the sea grasses. She
further stated the applicant proposes to give added protection to the sea
grasses by placing warning signs along the edges of sea grass bed not
protected by the martna. Ms. Carraway advised a breakwater is intended to
lessen wave action in the marina. She also advised fueling, pump out
facilities, and parking on the upland property will be provided. She further
advised that applicant has met with the Departments of Natural Resources and
Environmental Regulat ion and the U. S. Army Corps of Engineers and applicant
received a favorable reaction from the agencies. She stated formal
applications are being prepared for submission to the proper government
agencies and the plan for the marina is subject to change but will not have
more than 78 slips.

The following persons appeared in support of the above request to give their
comments:
Hr. S. J. Vaccaro, advised he is in the marine business and owns Clearwater
Discount Marine. He stated more slips are needed In the area, the plan has
been accepted by government agencies, and it appears there will be no damage
to the environment.
Hr. David Martens, stated he felt there is a need for additional marinas to
serve the public as well as an attractive multiple use waterfront project such
as the project proposed by applicant.
The following person appeared in opposition to the above request to give her
comments:
Hs. Eleanor Andrews. stated this marina appeared to be very large for such a
small area of the bay. She also stated fueling and pump out facilities may be
harmful to the environment through accidents. She expressed concern about the
impact on Sand Key residents and felt increased traffic may cause problems.
After questioning by Ms. Nixon, Hr. Todd Turrell, Coastal Engineer
representing applicant, appeared and advised the marina will extend
approximately 300 feet into the water and the overall length will be
approximately 1,000 feet. He also advised applicant has worked with the
Departments of Natural Resources and Environmental Regulation to make the best
use of water and still protect sea grasses.

After questioning by Mr. Ferrell. Ms. Harvey stated a previous request for a
marina located on Clearwater Beach ~as approved but fueling station was denied
because of the close proximity of residences and the concern for the lack of
water flow where the marina was to be located. Ms. Harvey felt the request for
fueling and pump out facilities was appropriate due to dis tance from other
such authorized facilities.
After questioning by Mr. Hogan, Ms. Carraway advised all boat slips will be
rented on a first come, first serve basis and persons visiting the restaurant
will dock along the boardwalk.
After questioning by Mr. Ferrell, Ms. Harvey stated the Harbormaster reviews
the plans for all aspects of navigation and the Harbormaster qualifies that
the project will cause no harm to navigation.
Motion was made by Mr. Hogan, seconded by Mr. Ferrell, to approve the above
request subject to the following: 1) That determination of the DR! status of
this project and subsequent compliance with DRI regulations he completed prior
to issuance of permitj 2) That the pump out facility and fueling station is
authorized; 3) That the parking for the marina be in compliance with the
Set tlement Stipulat ion as recorded for Parcel III, which is one space per

The Development Review Committee at its meeting of June 23, 1988 approved the
above described final site plan subject to the following conditionsl
1. SWFWMD permit must be approved prior to issuance of building permit.
2. The required open space and recreation fees for each Phase of the project
must be paid prior to issuance of the building permit for each Phase.
3. The entrance area of the south driveway must be redesigned in
consideration of location of traffic islands and ramp design to the
parking deck and approved by the Traffic Engineer prior to certIfication
of the final site plan. (The Traffic Engineer requires an entry gate to
be installed at the lower level for the south park~ng area.)
4. The water dIstribution sIstem must be shown on the final site plan for
certification. (The Ut lities Department finds the revised plan to be
acceptable.)
5. The fire protection system must be redesigned as required by the
Utilities Department ana the Fire Marshal. (The Fire Marshal finds the
revised plan to be acceptable.)
6. Ingress/egress easement and 10' utility easement must be provided over
the water mains up to and including meters and hydrants prior to issuance
of a building permit.
7. The dumpster locations must be shown on the final site plan or provisions
for trash pickup. Locations or provisions are subject to the approval of
the Sanitation Division. Any dumpsters must be visually screened with a
12' wide clear opening. (The Utilities Department finds the revised plan
to be acceptable.)
8. The site plan must denote those areas where landscaping is required and
where it is to be provided. (The Urban Forester finds the revised plan to
be acceptable.)
9. In accordance with the terms of the Settlement Stipulation, completion of
this project shall occur no later than October 16, 2006.

Dear Ms. Hanna:
The Department has reviewed your request for a determ~nation
of the Development of Reglonal Impact (DRI) status of the Radisson
Bayside Hotel and Conference Center in Pinellas County at Sect~ons
17 and 20, Township 29S, and Range 15E. Based on the material you
have submitted to the Department, we understand that the followlng
facts descrlbe the development.
The rev~sed s~te plan for the project lS proposed for a 220-
room hotel and conference center, a 46,675 gross square foot re-
ta~l center with 307 parking spaces on 2.92 acres, and a 60
watercraft wet Slip marina on a total of 7.9 acres. It lS our
understanding that this amount of development is the total extent
of development that your client has an interest within the Imme-
diate surrounding area of the site. Finally, it is our under-
standing that site plan approval by the City of Clearwater is re-
quired before the project will have local government authoriza-
tion to commence development.

Therefore, based upon the above representations as we
understand them, the applicable DRI gU1delines and standards for
the project would be those in effect on and after July 1, 1988,
due to the recent legislat1ve changes to Chapter 380, Flor1da
statutes (F.S.). Pursuant to Paragraphs 380.0651(3) (e), (f) and
(i), F.S., and the above representat10ns, the Radisson Bayside
Hotel and Conference Center development is 40.0 percent of the
wet storage marina threshold; 12.28 percent of the retail parking
space threshold; 62.86 percent of the hotel threshold; and 79.41
percent of the applicable multi-use development threshold.
Therefore, the proposed Radissan Bays1de Hotel and Conference
development is below 80 percent of all applicable DRI thresholds
and is not requ1red to undergo DRI review.
However, you should be aware that a binding letter
determination of DRI status is the only way to legally ascertaIn
the status of the applicabllIty of the review requIrements of
Sect10n 380.06, F.S., to the proposed development. In the
absence of a bInding letter, this agency reserves the right to
determ1ne that Chapter 380, F.S., 1S applicable to your proJect.
If we obtain Informat1on indicatlng that your plans have
materially changed, 1f the appllcable guidelines and standards
change, or if your proJect is part of a larger un1fied plan of
development than disclosed, we will request additlonal
information from you and we may request that all development
activity cease until the applIcability of Chapter 380, F.S., may
be determined or agreed upon.
This letter is not a bInding determination, and your project
may still be found to be a DRI until you recelve such a bindlng
determinat1on. ThlS letter 1S not a recognltlon of vested rights
for the proposed development, nor IS it a determlnation of vested
rlghts cased upon ~he proJec~'s contractual relatlonsh1p w1th the
City of Clearwater. The sole purpose of this letter is to inform
you that the current proposed Radisson Bayside Hotel project is
not currently required to undergo DRI review, based on the factual
information we presently have, as recited above.

The applicant has since amended the plan to delete a utilit~es easement wh~ch
has been found to be an unnecessary easement by Publ~c Works Department and
Utilities and place a ~sports court" ~n th~s area of the site (between the hotel
and retail center developments).

the Radlsson Sand Key Marlna. We recently receIved a copy of your
letter to Mr. Fred Marguls dated September 19, 1990, wh~ch
dlscussed the reqUIrements of the condltlonal use approval for the
mar lna gIven by the Cl ty of Clearwater. We would lIke to take
thlS opportunlty to brlng you up to date wlth our progress on the
marlna.
1. DRI. Wlth regard to our DRI determlnatlon, we recelved
a clearance letter, a copy of WhlCh IS attached, from the
Department of Communlty Affalrs dated August 1, 1988, whIch states
that the "Radlsson Bayslde Hotel and Conference development IS
below 80 percent of all appllcable DRI thresholds and IS not
requlred to undergo DRI reVlew. 01 ThlS letter was based upon a
slte plan for the development WhlCh provIded for a 220-room hotel,
a 46,675 gross square foot retall center, and a 60 wet Sllp
marlna. The retall portlon of the development was scaled back.

Mr. Petrarca orlglnally contemplated a larger proJect and
requested a B~nd~ng Letter of Vested Rlghts from the Department of
CommunIty Affa~rs based upon the Settlement Stlpulatlon between
U. S. Steel Corporat~on and the Cl ty of Clearwater. However r he
w~thdrew that request when he deCIded to scale down the
development to the SIze reflected ln the enclosed clearance
letter.
II. Parklng. The Settlement Stlpulat~on requIred that one
parklng space per Sllp be provlded for the marlna. Enclosed lS a
copy of the flnal, approved slte plan for the uplands portIon of
the development, WhlCh lndlcates 466 parklng spaces and Wh1Ch
provldes for one parklng space per marlna Sllp. The contractor,
The Cedarwood Companles, further explalned the park1ng
requlrements In a letter to Sandy Glatthorn at the Clty of
Clearwater dated July 20, 1989, a copy of WhICh IS enclosed. ThIS
letter states that although 434 spaces are requlred to meet the
reqUIrements of the Settlement St1pulatlon, 466 spaces wlll be
prov1ded. ThlS number 1ncludes 60 spaces for the mar1na.
As for today, the uplands port1on of the development has been
constructed and lS 1n operat1on. Along wlth the hotel and retall
center, 466 parklng spaces are on SIte. The Settlement
Stlpulatlon requ~red 220 spaces to serve the hotel, 154 spaces to
serve the retall, and 60 spaces to serve the proposed mar1na,
totalllng 434 spaces. The number of park1ng spaces presently
constructed exceed the number of spaces requlred by the Settlement
Stlpulatlon by 32 spaces.
II. Ot he r S ta t e and Count y Perml ts . At thI s t1me, ln
add1t1on to the Clty of Clearwater condltlonal use approval, we
have recelved perm~ts for the marlna from the Department of
Envlronmental RegulatIon, the U.S. Army Corps of Eng1neers, and
the U.S. Coast Guard. Coples of these permIts are enclosed. The
remaIDlng permlts we need to obtaIn are from the Plnellas County
Water and Navlgatlon Control Authorlty and from the Department of
Natural Resources, lDcludlng the submerged land lease.
In connectlon wlth our applIcatIon to the Water and
NavIgatlon Control AuthorIty, we submltted a SIte plan of the
marlna WhlCh the Harbormaster approved and WhlCh the PlannIng
Department approved, subJect to the marlna obtaInIng the necessary
state and county permlts.

Dear Ms. Glatthorn:
We met, in early October, 1n your off1ce to discuss a pro-
posed Snack Shack that the owner des1res to have at the
referenced location. During our meet1ng, you retrieved the
approved site plan from your files to determine if th1s
addition would constitute a substant1a1 change and 1f a new
slte plan approval process would have to be 1n1tiated.
As a result of our discussions, 1t was your op1n1on that
this proposed Snack Shack would be a minor deviat10n and you
requested that I forward a "marked-up" Slte plan when the
owner gave conceptual approval to the project.
The attached drawing represents a partial slte plan as
extracted from the approved/recorded plan. The cross-
hatched area represents the Fltness Center as was orlglnally
approved, and the high-llghted area represents the proposed
Snack Shack. The footprlut of the F1tness Center that is
shown on the approved drawlng represents an area of approxi-
mately 2,924 square feet. However, the bU1ld1ng that was
actually bUllt has a footpr1nt area of approximately 2,744
square feet. The d1fference between what was approved and
what was actually bUl1t lS approx1mately 180 square feet --
what was bU1lt lS less than what was approved
The proposed Snack Shack has a footprint area of approxl-
mately 285 square feet and the total eX1st1ng structure plus
the proposed structure would be approx1mately 100 square
feet greater than what was approved.
As we have discussed, it would appear that thlS change 18
minor in nature and would require no further slte plan
approvals

Th~s condItional use application meets the criterIa
for mar~nas in AquatIc Lands/Coastal conta~ned in the Clearwater
Z on~ng Code. The marIna wIll abut prope rt y w~ th a comme rci a 1
zonIng des~gnat~on. It will not obstruct navigatIon ~n thIS
area of Clearwater Harbor. The owner has been adv~sed by
the Coast Guard stat~on on Sand Key that the mar~na wIll not
restr~ct theIr use of the harbor.
The marIna w~ll contaIn 78 slips. At this
length w~ll be suffic~ent to protect most of the
beds and its width w~ll not obstruct the waterway.

In add~tlon to not adVersely affecting the environment,
the mar~na wIll actually protect an important env~ronmental
resource in the area, the sea grass beds. The mar~na w~ll
act as a barr~er preventIng boaters from dr~ving their boats
through the beds to the seawall as they do now. Th~ proposed
buoys or s~gns, If permItted, w~ll further protect the grasses.
The marIna w~ll be compat~ble with surroundIng land
uses. The mar~na ~s des~gned so that all the sl~ps are enclosed
by boardwalks. The mar~na w~ll be placed out from and along
the m~ddle of the owner's property. The northern end of the
marIna w~ll be 150 feet or more from the property owner to
the north, and the southern end of the marina will be several
hundred feet from the property owners to the south. The access
to the mar.1.na w~ll be located m~dway along ~ts length, mak.lng
It even more unlIkely that boaters w.lll dIsturb ne~ghboring
property owners.
The marina's des~gn includes a perv~ous breakwater
to lessen wave act~on ~n the mar~na. Fuel~ng fac~lI tIes W~ th
appropr~ate envIronmental safeguards, sewage pump-out
facIl~t~es, water and electric serv~ce w~ll also be available.
The park~ng structures on the owner's property WIll prov~de
parkIng for the marIna. As shown on the attached prellm~nary
s~te plan, the parking prov~ded w~ll far exceed the requirements
of the St~pulat~on Agreement appl.lcable to thIS parcel of
land.
Th~s marIna w~ll satisfy the publ~c demand for boat
sl~ps while protecting the sea grass beds. The marina WIll
be compatible with neighboring land uses and w~ll not restr~ct
nav~gat~on in the harbor.
