Section 46.06(2) of the Clearwater Land Development Code allows Clty
Manager approval of m1nor subd1v1sion plat adJustments wlthout the need
to replat prov1ding that all prov1slons of the clted code, sectlOns
46.06(2)(a) and 46.06(b) are met.
In the case presented herein, the appl1cant wlshes to comb1ne the west
201 of Lot 1, Block F, HIGHLAND ESTATES OF CLEARWATER 1ST ADDITION w1th
the presently vacated 60' wi de CAROLYN LANE right-of-way of HIGHLAND
ESTATES OF CLEARWATER 1ST ADDITION to create an 80lw1de slngle famlly
resldential lot.
All conditions of the Land Development Code have been met, the correct
appllcation form and fees have been rece1ved together with the quit c1alm
deed, survey and un ity of tit 1 e (at tached) and appropr i ate s taft have
rev iewed and approved the request for th 15 ml nor subd, v 1 s 1 on plat
adJustment.

Sec. 46.02. Purpose of chapter.
(1) It IS the J)urpose of this chapter to estabhsh
a procedure and standards for the dIVISIon of un~
platted property and the rewV18ion or recombina.

erty for indiVlduallots owned in fee simple and to
the diVISIon of property for the purpose of convey.

recreatIon/open space, environmental protection,
ublity extension, energy conservatIon and related
policies and design guidelines of such plan ele.

Sec. 46.03. Applicability and scope of chap-
ter.
(1) These plattIng regulatIons shall apply to all
subdIVISIons and condomIniums Wlthin the corpo.
rate bnuts of the Clty
(2) A subdiVIsion shall be any diVISIon or redi~
VISion ofland into two or more lots, tracts, SItes or
parcels for the purpose of transfer of ownership or
bUIlding development. Furthermore, a subdIVI-
sion shall be any change of a property line of a lot,
tract, site or parcel

(3) A condominium shall be the partitioning of
single umts In a multiple-unit structure for the
purpose of mdividual ownerslnp where there are
mcluded commonly owned areas or facilitIes.
(4) Whenever any subdivision of land 18 pro-
posed, and before any site plan approval or bwld-
ing permit for the development of or construction
of any improvement on land proposed for subdi-
vision IS granted, the owner of the property shall
apply for and secure approval from the city of a
prelunmary plat in accordance Wlth the proce-
dures and standards delineated in 'this chapter,
and the approved prehminary plat shall be certI-
fied by the Clty as constituting a record of approv-
al. FollOWIng certIfication of the prelimmary plat,
and following certIfication of the site plan when
required pursuant to chapter 43, a bwIding per.
mlt for one bwlding may be issued for the prop-
erty, except that no bwldmg permit shall be IS-
slled for a townhou~~ development prior to the
recording of the final plat However, no certrlicate
of occupancyluse shall be issued for property pro-
posed to be platted until the plat is recorded m
accordance with the provisIOns contamed In this
chapter.
(5) Whenever any condominIum is proposed, be-
fore any bwlding permit or certificate of occupancyl
use 18 Issued and before any condominIum plat is
filed of record at the office of the clerk of the coun~
ty court, a condomuuum plat shall be presented to
the CIty engmeer for review m accordance WIth
the terms contained m section 4606.
(6) The subdivider shall bear th~ expense of the
improvements reqwred by this chapter In accor-
dance with city standards, specmcatIons and pol-
icies on file in the office of the Clty engmeer.

Sec. 46.04. Exemptions.
The follOWIng transactions shall be exempt from
subdiVISIon and condominIum plat review proce-
dures:
(1) The public acqUlsltion of stnps ofland for
the Wldemng of eXlStmg streets;
(2) The reversion, combination or recombma.
tion of portIons of previously platted lots

are created which arE' smaller than any of
the ongmallots or less than the minimum
lot area requirements as set forth 10 chap~
ter 40 which pertams to zoning;
(3) The transference of part of one lot or tract

transference neither reduces any lot or tract
to an area or a Wldth less than that speci-
fied in chapter 40 nor contravenes any oth-
er development regulation contamed in this
development code

Sec. 46.05. Administration, interpretation,
etc., of chapter.
The adnunistration, interpretation and applica~
bon of the proVlslons oftlus chapter not othelWlse
specifically set out in this chapter shall be as set
forth 10 chapters 35, 36,39,42,43 and 45.

Sec. 46.06. Administrative plat approval;
condominium plats and lot divi-
sions.
(1) Condomimum plats. Before any condom1O.
ium plat is filed of record 10 the office of the clerk
of the county court, a copy of the ground level
survey drawmg shall first be subnutted to the City
engineer for determination that all requisite ease-
ments are properly delineated on the plat, all
streets are properly named Wlthout duplication,
and the plat comports WIth other engineering prac-
bces of the city.
(2) Lot dtvt8wns Minor subwvision plat adjust-
ments may be approved by the CIty manager with.
out the reqUIrement to replat. It 18 the objective of
thts proVISion to enable a simpWied admimstra-
bve process whereby owners ofprevtously platted
property may further wvtde such property accord-
ing to the followmg process without filing an
amended plat
(a) The City manager is hereby autbonzed to
review and approve or disapprove the fur.

(b) Action by the city manager to approve or
disapprove such diVlslon of platted proper-
ty shall be llimted to the following-
1. Not more than two new or previously
platted tracts or lots are aiJ'ected.
2. No new street or alley is proposed or

alleys, setback lines, access control or
easements IS required or proposed.
4. Such actlon will not result in signifi-
cant increases in service reqUIrements
or 10terfere WIth mamtaining existing
service levels.

lot without direct access to a street
7. A nonconforming situation mil not be
created.
(c) In grantmg approval, the city manager may
impose such conditions and restnctions upon
the property as determined necessary to car-
ry out the intent and purpose oftlus chap-
ter and the development code. The CIty man-
ager may, at his discretion, require any
diVIsion or combination of previously plat~
ted property to comply with the full plat~
ting process where the conwb.ons of the in~
stant case warrant.

Sec. 46.07. Variances.

made in wntmg and be submitted to the develop.

ARTICLE I. IN GENERAL
Sec. 46.01. Title.
Tlus chapter shall be known and may be CIted
as the subd.1VIslon and condomrmum plattmg reg-
ulatIons and may be referred to in tlus chapter as
"tlus chapter" or "these plattIng regulations ..

Sec. 46.02. Purpose of chapter.
(1) It IS the 'Jl.1rpose oftlus chapter to estabhsh
a procedure and standards for the diVIsIOn of un-
platted property and the red.1VlSlon or recombina-
tIon of preVIously platted property so as to further
the orderly layout of property proposed to be di-
VIded, rediVIded or recombmed and to ensure prop-
er legal descnpbons and monumentmg of platted
property.
(2) It 18 fun.her the purpose of thLs chapter to
ensure that the plattmg process IS apphed m a
unllorm manner to conventIonal diVIsions of prop-
erty for mdiVIduallots owned in fee srmple and to
the diYlSlOn of property for the purpose of convey-
mg ownershIp in a condomrmum form.
(3) It IS the specmc obJecbve of this chapter to
establish a procedure and standards that are con-
slStent With the CIty'S comprehensive plan, and in
partIcular Wlth the thoroughfare, parks and rec.
reahon, enVll"onmental conservatton, utility and
energy elements of the plan, mcludmg the street,
recreation/open space, enVIronmental protectIon,
utIhty extenslOn, energy conservation and related
pohcles and deSIgn guIdelines of such plan ele-
ments.

Sec. 46.03. Applicability and scope of chap~
ter.
(1) These plattmg regulations shall apply to all
subdIVIsIons and condomllliums WItlun the corpo-
rate Irmlts of the Clty
(2) A subdiVlslOn shall be any diVISIon or red1-
viSIOn ofland mto two or more lots, tracts, sItes or
parcels for the purpose of transfer of ownership or
bulldmg development. Furthermore, a subdiVI-
SIOn shall be any change of a property line of a lot,
tract, site or parcel

(3) A condommlUm shall be the partItIoning of
slllgle units in a multIple-urnt structure for the
purpose of indiVIdual ownersmp where there are
Included commonly owned areas or facilitIes.
(4) Whenever any subd.1Vlslon of land IS pro-
posed, and before any site plan approval or bwld-
mg permit for the development of or constructIOn
of' any llDprovement on land proposed for subd.1-
VlSlon IS granted, the owner of the property shall
apply for and secure approval from the city of a
prelimmary plat in accordance WIth the proce-
dures and standards delineated in .tlus chapter,
and the approved prelimmary plat shall be certI-
fied by the Clty as constItutmg a record of approv-
al. Followmg certificatIOn of the prelim10ary plat,
and following certification of the site plan when
reqUIred pursuant to chapter 43, a bwldmg per-
mIt for one bOOding may be issued for the prOlJ.
erty, except that no bwldmg permlt shall be IS-
slled for a townhoU&!d development prlOr to the
recordmg of the final plat. However, no cerb.ficate
of occupancyluae shall be lssued for property pro-
posed to be platted untIl the plat is recorded m
accordance WIth the provisIons contamed 10 tms
chapter
(5) Whenever any condomimum 16 proposed, be-
fore any bwldmg permit or cert1ficate of occupancyl
use IS ISSUed and before any condominIum plat IS
filed of record at the office of the clerk of the coun-
ty court, a condommlUm plat shall be presented to
the CIty engmeer for reVIew In accordance WIth
the terms contamed in sectIon 46 06
(6) The subdIvider shall bear th:. expense of the
Improvements reqwred by this chapter In accor-
dance WIth Clty standards, specificatIons and pol-
ICies on file m the office of the cityen{;1neer.

Sec. 46.04. Exemptions.
The follOWing transactIons shall be exempt from
subdiVlslon and condomrmum plat reVlew proce-
dures
(1) The pubhc acquiSItIon of stnps of land for
the WIdening of existing streets;
(2) The reverSIOn, combmatIOn or recombina-
tIon of portIons of preVIously platted lots
